Council members Pacheco and Marlen Garcia thanked her for her dedication and service to the community Administration of Oath of Office and Certificate of Appointment to Planning Commissioner Hugo Tzec Mayor Lozano administered the Oath of Office to Commissioner Tzec Proclamation proclaiming May 3 9th as City Clerk's Week in the City of Baldwin Park Mayor Lozano, joined by Council and Treasurer presented the proclamation to City Clerk Rubio & Deputy City Clerk Nieto. City Clerk Rubio also acknowledged the support of Rosa Caballero in the Administration Department PUBLIC COMMUNICATIONS Augustine Galaviz, representing the American Legion read a statement regarding Ordinance No. 1324 related to the sale of fireworks. He requested that the Council reconsider allowing the Veterans to sell fireworks Mayor Pro Tern Monica Garcia advised that they could apply through the Little League if they so desired, as they were an organization dedicated specifically for the youth Mariana Lake, Valley County Water District President announced Water Awareness week Courtney Gonzales, resident and St. John the Baptist student requested sponsorship to attend the Young Leaders Conference in Washington D.C. Council member Pacheco requested that $300 from the Wal-Mart donation be put towards her trip Joseph representing the Veteran's group inquired about plaques that had been previously given to the Mayor and about the Eternal Flame monument at Morgan Park Al Pouliot, American Legion echoed the sentiments of the previous speakers regarding the sale of fireworks for the Veterans Thomas Cary, resident spoke about the recently adopted fireworks ordinance and the exclusion of the veterans as well as the proposed ordinance regarding abandoned properties Pilar Arellano, resident representing 25 children who take the school bus on Big Dalton requested that the City designate a curb and paint it red so that it could be specifically used by the school bus Page 2 of 6 BIB] 40073-U01 2009-U02 04-U02 15-U02 CC-U02 MIN-U02 LI1-U03 FO8420-U03 FO122580-U03 DO125155-U03 C4-U03 MINUTES1-U03 9/9/2009-U04 ROBIN-U04 2009 04 15 CC MINHÄ—@¸— 4Xþfor loading and unloading of children. Irma Escobedo, resident represented the families of Baldwin Creeck Apartments on Francisquito explained that children taking the bus have to walk to Puente Avenue or Vineland Avenue to be able to cross the street. She is very concerned that children cross in the middle of the street to catch the school bus because there is no crosswalk or traffic light and expressed concerned a child might get hit by a car and requested that the City add a warning light and crosswalk. Ruby Casas, resident submitted a petition with signatures Simon Guillen, owner and businessman thanked the city for cleaning up an area behind his property. He also announced that there were more vacancies in the former Albertson's shopping center and inquired about the Chamber of Commerce. Mayor Lozano stated for the benefit of the audience that the money received by the city from the Chamber of Commerce was repayment of a loan Greg Tuttle, business owner handed out a copy of a newspaper and a newsletter; inquired about the offices on Maine previously used by Bisno Development and about the Mutual Settlement and Release Agreement and issues related to Council member Bejarano Cecilia Lee, business owner commented about the audio system in the Council chamber Public Communications were closed at 7:58 p.m. Mayor Lozano announced that Ordinance No. 1324 would be brought back for consideration of adding the Veteran's. Council member Pacheco commented about his motion to consider a 2nd tier for permits if all 14 booths did not go to the youth Council member Bejarano announced that his position on the issue was based on the comments made by youth groups in attendance at previous meetings and stated that the public needs to come and speak in favor or opposition. He stated his support of another public meeting and suggested that any group awarded a stand be required to submit an accounting of what they raised and how they spend it. He also suggested that when youth groups come to solicit funding, that they be given the names of the fireworks sellers so that they could approach them for sponsorships Council member Pacheco commented about the committee that he and Council member Marlen Garcia worked on to establish the process. He suggested that it be looked into and reviewed to see how it could be improved. Council member Pacheco reported on the chamber lunch he attended as well as upcoming events for the benefit of the residents and community Council member Marlen Garcia also announced a program offered through AQMD that would allow old lawn mowers to be traded for new ones at a reduced cost Council member Pacheco announced that the Council was approving many items that were beneficial to the community CONSENT CALENDAR Motion: Approve CONSENT CALENDAR Moved by Council member Pacheco, seconded by Mayor Lozano. 1. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR THE PERIOD OF APRIL 15, 2009 MAY 5, 2009 City Council approved the preparation and presentation of the plaques, proclamations and certificates as outlined in the staff report. 2. MINUTES City Council approved the minutes of the special meeting of February 25, 2009. 3. 2nd READING OF ORDINANCE NO. 1325 City Council waived further reading, read by title only and adopted on second reading Ordinance No. 1325 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, ADDING CHAPTER 150.029 TO THE BALDWIN PARK MUNICIPAL CODE REQUIRING OWNERS AND OTHER PERSONS RESPONSIBLE FOR VACANT AND ABANDONED PROPERTY TO REGISTER WITH THE CITY AND TO MAINTAIN SUCH PROPERTY." 4. 2nd READING OF ORDINANCE NO. 1326 City Council waived further reading, read by title only and adopted on second reading Ordinance No. 1326 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING SECTION 121.04 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO SUSPENSION OF SOLICITATION PERMITS." 5. AUTHORIZATION TO PROCEED WITH REQUEST FOR PROPOSALS FOR THE HOMELESSNESS PREVENTION PROGRAM AND RAPID RE-HOUSING PROGRAM City Council authorized staff to proceed with the RFP for the Homelessness Prevention Rapid Re-Housing Program. CONSULTANT SERVICES CONTRACT FOR DEVELOPMENT OF THE CITY'S SEWER SYSTEM MANAGEMENT PLAN SSMP) City Council awarded a Consultant Services Contract to Advanced Infrastructure Management, Inc. in the amount not to exceed $77,540 and authorize the Mayor to execute the Agreement. 7. MONTHLY FINANCIAL REPORT 8. AWARD A CONTRACT FOR THE CONSTRUCTION OF THE FRANCISQUITO AVENUE REHABILITATION PROJECT FEDERAL NO. STPL 5323(017) City Council awarded a Construction Contract to Hardy & Harper, Inc. in the amount of $868,000; authorized the Mayor to execute the Agreement and authorized the Director of Public Works to execute any necessary change orders in an amount not to exceed ten percent 10%) of the original contract. 9. AWARD A CONTRACT FOR CONSTRUCTION MANAGEMENT OF THE FRANCISQUITO AVENUE REHABILITATION PROJECT FEDERAL NO. STPL 5323 017) City Council awarded a Construction Management Contract to Vali Cooper and Associates, Inc. in the amount of $94,985 and authorized the Mayor to execute the Agreement. 10. MEMORANDUM OF UNDERSTANDING BETWEEN THE BALDWIN PARK POLICE DEPARTMENT AND BALDWIN PARK UNIFIED SCHOOL DISTRICT POLICE DEPARTMENT Continued from April 1, 2009) City Council reviewed the Memorandum of Understanding and authorized the Chief of Police to sign the Memorandum of Understanding and enter into an agreement with the Baldwin Park Unified School District Police Department regarding law enforcement protocol. 11. UPDATE ON STIMULUS FUNDED PROJECTS AND DESIGN SERVICES CONTRACT AMENDMENT City Council received and filed. 12. REVIEW AND ANALYSIS OF SINGLE-USE PLASTIC BAG LEGISLATION City Council supported AB 68 and AB 87 if amended, consistent with the League's support, as both bills will have the same impact upon the consumer and authorized staff to send the letters of support included with the staff report. CITY COUNCIL/ CITY CLERK / CITY TREASURER / STAFF REQUESTS & COMMUNICATIONS Request by Moor Pro_Tem Monica Garcia for discussion on the following: Discussion and direction to staff for establishing an environmental commission Page 5 of 6 BIB] 40073-U01 2009-U02 04-U02 15-U02 CC-U02 MIN-U02 LI1-U03 FO8420-U03 FO122580-U03 DO125155-U03 C4-U03 MINUTES1-U03 9/9/2009-U04 ROBIN-U04 2009 04 15 CC MINHÄ—@¸— 4Xþa body of 3 or 5 community members that meets quarterly or as needed to make recommendations to City Council on environmental issues, such as single use plastic bags / retailers, provides input on walk-able or cycle-able communities, proposals such as the MRF, superfund site updates, etc. This body would focus specifically on environmental issues and could have joint meetings with the Planning Commission for projects that require MND or EIR. Mayor Pro Tern Monica Garcia introduced the idea of a possible Environmental Commission that would discuss and provide recommendations on environmental issues. Requested that staff move forward with this item and report back to the Council Request by Council member Marten Garcia for discussion on the following: Discussion on the Steppin' Out Challenge taking place April 20 26, 2009 Council member Marlen Garcia thanked City Attorney Pannone for bringing this event to her attention and challenged her Council colleagues and staff to participate in the Steppin' Out challenge Council member Pacheco requested a report of expenditures made from the Wal Mart donation.
