The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the
above time and place.

ANNOUNCEMENTS
Mayor Lozano adjourned in memory of Steve Megyes; William Harrold Nixon,
son of Clint & Betty Nixon Baldwin Park residents; and Benjamin de la Cruz.
Council member Bejarano adjourned in memory of Maria Luisa Troncoso,
Baldwin Park senior
Council member Pacheco acknowledged the St. John's staff members and
students in attendance at the meeting as well as Woman's Club members; Mayor
Pro Tern Monica Garcia also acknowledged the Woman's Club members and
announced the wedding anniversary of one of its members
Mayor Lozano also closed in memory of Rudy Berumen, father of Housing

PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
Presentation to 57th Assembly District Woman of the Year Reyna Del Haro
Mayor Lozano, joined by the Council, Clerk & Treasurer presented Ms. Del
Haro with a plaque in honor of her recognition. Ms. Del Haro expressed her
gratitude to the Council and Assembly member

Presentation to St. John the Baptist EcoFriends Forever contest winners
Council member Pacheco provided background on the program that the
students participated in. Mayor Lozano, joined by the Council, Clerk &
Treasurer presented certificates to the student winners and Vice Prinicpal
Nguyen
Matthew Nakano spoke about his experiences and thanked the Council on
behalf of the group. Mayor Lozano announced that their story would be placed
in the NOW and their names on the marquee at Morgan Park
Presentation to incoming Baldwin Park Women's Club President Mary Dosa
and outgoing President Gloria Fierro
Mayor Pro Tern Monica Garcia announced the new board for the Woman's
Club and read the certificates to be presented. Mayor Lozano, joined by the
Council, Clerk & Treasurer presented certificates to outgoing President Fierro &
incoming President Dosa. They each shared the accomplishments of the club
Presentation of Proclamation proclaiming May 10th 16th as Poppy Week in
the City of Baldwin Park to Jasmine Benavides, 2009 Miss Poppy
Mayor Lozano read the proclamation and, joined by the Council, Clerk &
Treasurer presented it to Miss Poppy Jasmine Benavides
PUBLIC COMMUNICATIONS
Joe Saey, business owner, spoke about the Notice of Public Workshop
Comprehensive Zoning and General Plan Amendments and expressed concerns
about various issues in it He expressed his opposition to the proposed changes
and requested additional information and notifications to affected property owners
Ken Woods, resident/business owner spoke about the proposed changes to the
zoning in the area of his business and the negative effect it would have on his
property
Peter Hertz representing the property owners of 3928 Downing Avenue asked for
the Council's consideration to assist landlord by permitted uses in the zone the

Mary Saey thanked the Council for considering their comments and the
comments of other members of the public regarding the zoning and General Plan
Amendments
Patty Rascon, business owner commended staff for the transparency of the
recently-held zoning and General Plan Amendment meeting. She further spoke
about the timing of the proposed changes
Thomas Cary, resident spoke about various issues including the upcoming
election, fireworks and matters of the Council
Greg Tuttle, business owner spoke about a settlement agreement between the
city and Bisno Development; provided information regarding the recall attempt;
day laborer and other issues
Augie Galaviz, resident/American Legion member thanked the Council for
supporting the Veteran's and the children; reminded the community about the
upcoming Memorial Day holiday and encouraged all to attend
Mark Flores, resident thanked the Mayor & City Council for the support shown
during the time when he lost his son. He and his wife want to give back to the city
by starting a music scholarship fund.
Simon Guillen, resident/business owner invited Mayor and Council to Cinco de
Mayo celebration at the former Albertson's shopping center
Public Communications were closed at 8:03 p.m.
Council member Bejarano requested staff to update the Council on the zoning
update and encouraged those affected to meet with staff to discuss
Community Development Manager Castagnola gave background on the
process, including the public outreach and recent meeting. He spoke about the
further steps in the process and that some questions have not yet been
answered. It was assured that outreach and meetings will continue.
In response to an inquiry from Council member Bejarano staff responded that
the last update to the zoning code was in 1989.

Motion: Approve CONSENT CALENDAR with the exception of Item #7
Moved by Mayor Lozano, seconded by Council member Bejarano.

City Council approved the preparation and presentation of the plaques,
proclamations and certificates as outlined in the staff report.
3. MINUTES
City Council approved the minutes of the regular meetings of April 1, 2009 &
April 15, 2009.
4. CLAIM REJECTIONS
City Council rejected the claims of Patricia Murray; Claudette Albin; David Albin;
Luis Martinez and LeeAnn Chapman and directed staff to send the appropriate
notices of rejection to the claimants.
5. CITY TREASURER'S REPORT MARCH 2009
City Council received and filed the City Treasurer's Report for March 2009.
6. SUPPORT FOR SB 696
City Council supported SB 696, consistent with the Independent Cities
Association and authorized staff to send the letters of support included in the
staff report.

7. ADOPTION OF RESOLUTION NO. 2009-007 AMENDING THE FEE
SCHEDULE AND ESTABLISHING A NEW FEE FOR THE REGISTRATION
OF VACANT AND ABANDONED PROPERTY
City Council waived further reading, read by title only and adopted Resolution
No. 2009-007 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK AMENDING THE FEE SCHEDULE, ADOPTED
BY RESOLUTION NO. 2009-007, TO ESTABLISH FEE FOR THE
REGISTRATION OF VACANT AND ABANDONED PROPERTY PURSUANT
TO CHAPTER 15.029 OF THE BALDWIN PARK MUNICIPAL CODE."
Council member Pacheco commented about the work done towards
eliminating blight in the community and acknowledged staff for their efforts in
bringing this item forward
Motion: Waive further reading, read by title only and adopt Resolution No.
2009-007 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK AMENDING THE FEE SCHEDULE, ADOPTED BY

FOURTH OF JULY FIREWORKS CELEBRATION
City Council awarded a contract to Pyro Spectaculars, Inc. for professional
pyrotechnic services related to the 4th of July Fireworks Celebration in the
amount of $16,500 and authorized the Director of Recreation & Community
Services to execute the agreement.
9. APPROVAL TO PARTICIPATE IN THE 2009 SUMMER LUNCH PROGRAM
City Council authorized staff to submit an application to the State of California,
Department of Education to participate in the 2009 Summer Lunch Program and
authorized the Director of Recreation & Community Services to execute all
Summer Lunch Program documents, including the agreement with El Monte
Union High School District.
10. 2nd READING OF ORDINANCE NO. 1328
City Council waived further reading, read by title only adopted on second
reading amended Ordinance No. 1328 entitled, AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION
93.12 OF THE BALDWIN PARK MUNICIPAL CODE REGARDING REPORTS
OF REVENUES AND EXPENSES QUALIFYING ORGANIZATIONS MUST
FILE RELATING TO FIREWORKS."
SET MATTERS PUBLIC HEARINGS
11. SECOND PUBLIC HEARING FOR FISCAL YEAR 2009-2010 COMMUNITY
DEVELOPMENT BLOCK GRANT CDBG) AND HOME INVESTMENT
PARTNERSHIP FUNDS HOME) ANNUAL ACTION PLAN
Housing Manager Ruelas presented the report. Council member Pacheco
requested that staff summarize major points of this project. Manager Ruelas
stated funding is the same and more would be added for street improvements.
It was stated that the bulk of HOME funds would go to the CHDO agreement
and that public services are the same. The City's CHDO was with Emanuel
House of Hope
Mayor Lozano opened the public hearing for those wishing to speak in favor or
opposition. Seeing no interest the public hearing was closed
Motion: Approve the FY 2009-2010 CDBG and HOME Annual Action Plan.
Moved by Mayor Lozano, seconded by Mayor Pro Tern Monica Garcia.
12. PUBLIC HEARING TO CONSIDER APPROVAL OF AN AMENDMENT TO
FY 2008-2009 ANNUAL ACTION PLAN TO INCLUDE THE AMERICAN
RECOVERY AND REINVESTMENT ACT OF 2009 ARRA) HOMELESSNESS
PREVENTION AND RAPID RE-HOUSING PROGRAM
Housing Manager Ruelas presented the report; Mayor Lozano opened the
public hearing for those wishing to speak in favor or opposition. Seeing no

Motion: Approve the proposed Amendment to the FY 2008-2009 Annual Action
Plan to include the Homelessness Prevention and Rapid Re-housing Program
HPRP.)

REPORTS OF OFFICERS
13. AWARD OF CONTRACT TO CONSTRUCT MODIFICATIONS TO THE CITY
YARD DUE TO THE CALTRANS HOV PROJECT
Director Galvez presented the report
Mayor Lozano inquired about the proposed work; Director Galvez responded
that the entire front entry needed to be cleared and that the street would still run
through the property. In response to an inquiry from Council member
Pacheco staff responded that the work had not yet been completed. Work was
halted at approximately 50% completion and parts have been ordered. Council
member Pacheco requested that steps be taken for this to not happen again.
CEO Singhal stated that there were transitions in staffing at the City Yard
Motion: Waive further reading, read by title only and adopt Resolution No.
2009-014 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK DECLARING AN EMERGENCY AND AUTHORIZING
ENTERING INTO A CONSTRUCTION AGREEMENT," award a construction
contract to Mark Drop Corporation in the amount of $58,900 and authorize the
Mayor to execute the Agreement.
Moved by Mayor Lozano, seconded by Council member Pacheco.
CITY COUNCIL / CITY CLERK / CITY TREASURER / STAFF REQUESTS &
COMMUNICATIONS
Mayor Pro Tern Monica Garcia also reported on the recent job fair and that it was
well attended by the community and thanked staff for their efforts
Mayor Lozano suggested that a tree-planting effort be made in the community
Council member Bejarano requested that staff include the intersection of
Channing & Puente Avenue between Pacific & Merced for consideration of a stop
sign. Council member Pacheco stated that in the past, a study was completed
and a traffic calming device was warranted. It was further requested that staff look
into it. Mayor Lozano also mentioned the intersection of Baldwin Park Boulevard
and Ohio Street

There being no other matters for dicussion the meeting was adjourned in memory
of Steve Megyes, William Harrold Nixon, Benjamin De La Cruz, Maria Luisa
Troncoso and Rudy Berumen at 8:20 p.m.
