Recognition of Margarita Vargas for her 21 years of service with the Baldwin
Park Unified School District
Mayor Lozano, joined by the City Council, Clerk & Treasurer presented Mrs.

PUBLIC COMMUNICATIONS
Mayor Lozano acknowledged the dignitaries who were present at the meeting
Mayor Lozano acknowledged Margaret Salonisen's birthday and the Council and
audience wished her a happy birthday
Principal Hamilton of Central Elementary introduced the student particpants of
the History Day Club and they expressed their appreciation to the Council for their
support. Destiny Garcia, Daniel Barbosa and student Velasquez each spoke
about their experiences about their trip to Sacramento
Elisa Clifford, Southern California Edison provided an overview of the state of the
system for SCE and complimented staff on the recent Police Open House event.
She reported a decrease in the number of new customers and spoke about the
innovations and upgrades that will be coming in the next five years
Ken Woods, resident/business owner spoke about a resolution previously
adopted by the City Council and the need for a supermarket in the former
Albertson's shopping center
Thomas Cary, resident spoke about various issues related to the City Council
including
Leslie Brito, resident/mediator for the day laborers provided information on the
organization
Miguel Valencia, representative, Day Laborers of Baldwin Park addressed the
differences between the groups in the city
Jesus Barragan, resident representative of day laborers
Juan Osorio, resident and secretary of board of directors for the Jornaleros spoke

Roberto Zapata, resident spoke provided a history on day laborers in the state of
California with the assistance of City Interpreter Salceda)
Margaret Salonisen, Baldwin Park Chamber of Commerce President commented
on the successful installation event and announced a grand opening event that
would be taking place in the near future
Greg Tuttle, business owner commented about dates on reports he previously
presented to the Council and recent violence in the city. Inquired to the Mayor on
several issues and to Council member Bejarano regarding his father and a prior
investigation
Cecelia Lee, business owner expressed that her roots are in Baldwin Park, Police
Activity Reports, speaker Tuttle and decorum in the Council Chamber
Seeing no further interest, the public communications were closed at 8:05

City Council received and filed.
2. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR
THE PERIOD OF JUNE 3, 2009 JUNE 16, 2009
City Council approved the preparation and presentation of the plaques,
proclamations and certificates as outlined in the staff report.
3. MINUTES
City Council approved the minutes of the special meeting of May 6, 2009 and
the minutes of the special and regular meetings of May 20, 2009.
4. CITY TREASURER'S REPORT APRIL 2009
City Council received and filed.
5. AUTHORIZATION TO PROCEED WITH ADVERTISEMENT OF A REQUEST
FOR PROPOSALS FOR JANITORIAL SERVICES FOR ALL CITY FACILITIES
City Council authorized staff to advertise the RFP for the janitorial services for
the City.
6. RESOLUTION NO. 2009-023 FINDING A SEVERE FISCAL HARDSHIP WILL

7. AUTHORIZE REQUEST FOR PROPOSALS FOR PROGRAM MANAGER
AND ENGINEERING & ARCHITECTURAL SERVICES FOR TRANSIT
CENTER PARKING FACILITY
Council member Pacheco commented about the securing of funding for this
project and the years that it took for the project to move foward. Director
Galvez stated that it would take approximately 18 months to construct this
project. Council member Marlen Garcia clarified that this project was
spearheaded by the City Council in prior years and that through the support of
Congresswoman Hilda Solis, funding wsa secured
Motion: authorize staff to advertise an RFP for Program Management
Services and an RFP for Architectural / Engineering Services.
Moved by Council member Pacheco, seconded by Mayor Lozano.
8. AUTHORIZE REQUEST FOR PROPOSALS FOR DESIGN SERVICES FOR
MAINE AVENUE STREET IMPROVEMENTS
City Council authorized staff to advertise an RFP for Design Services.

9. PUBLIC HEARING TO CONSIDER APPROVAL OF AN AMENDMENT TO FY
2008-2009 ANNUAL ACTION PLAN TO INCLUDE THE AMERICAN
RECOVERY AND REINVESTMENT ACT OF 2009 AARA) COMMUNITY
DEVELOPMENT BLOCK GRANT RECOVERY CDBG-R)
Housing Manager Ruelas presented the report. Mayor Lozano opened the
public hearing for those wishing to speak in favor or opposition. Seeing no
interest, the public hearing was closed.
Motion: 1) approve the proposed amendment to the FY 2008-2009 Annual
Action Plan to include the $395,726 in Community Development Block Grant
Recovery CDBG-R) funds and 2) allocate the CDBG-R funds to Street
Improvement Project.
Moved by Council member Bejarano, seconded by Mayor Lozano.
10. PUBLIC HEARING FOR REGARDING THE APPLICATION FOR THE
NEIGHBORHOOD STABILIZATION PROGRAM NSP) FUNDS FROM THE

DEVELOPMENT
Housing Manager Ruelas presented the report. Mayor Lozano opened the
public hearing for those wishing to speak in favor or opposition.

OPPOSITION:
Cruz Sembello inquired about the stability of the funding agreement
considering the uncertain economy in El Monte
Thomas Cary inquired about the housing being available for legal residents of
the city, county, state and country only; also addressed the possible bankruptcy
of the city of El Monte
Seeing no further interest, the public hearing was closed. Community
Development Manager Castagnola and Housing Manager Ruelas clarified
that the MOU was only for administration of the funds
Mayor Pro Tem Monica Garcia expressed the opinion that the intent of this
matter was to beautify blighted areas in the city; Council member Pacheco
stated his support of this item and the benefits it would provide
Motion: 1) conduct the public hearing to receive public comment on the
application that will allow the City to receive $970,226 in Neighborhood
Stabilization Program NSP) funds from the State of California Department of
Housing and Community Development to primarily help stabilize and revitalize
communities hard hit by the mortgage crisis; 2) approve the NSP Sub recipient
Agreement with the City of El Monte; 3) approve the City's Anti-Displacement
and Relocation Plan; 4) waive further reading, read by title only and adopt
Resolution No. 2009-020 entitled, A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK APPROVING THE APPLICATION FOR
FUNDING AND THE EXECUTION OF A GRANT AGREEMENT AND ANY
AMENDMENTS THERETO FROM THE STATE OF CALIFORNIA
NEIGHBORHOOD STABILIZATION PROGRAM NSP;)" and 5) authorize the
Chief Executive Officer to execute and submit all required documents on behalf
of the City in conjunction with the NSP.

Chief Hadsell and Lt. Reynoso presented an overview of part one crimes in
the City of Baldwin Park
Mayor Lozano expressed his gratitude to the Police Department and spoke
about the stereotypes in the community
Council member Bejarano commented about the past history and that he feels
safe in the City of Baldwin Park; thanked the Chief and her department for the
work that they do
Council member Marlen Garcia echoed the sentiments of her Council
colleagues, speaking about neighboring cities and the challenges they are
having. She further commented that the actions of the public reflect negatively
on the community
Mayor Pro Tern Monica Garcia echoed the comments of Council member
Bejarano and spoke about the increased, acknowledged Chief of Police and the
Police Department for their commitment to the community, recognizing
challenges
Council member Pacheco acknowledged the hard work and dedication of the
police department staff, stating the crime is a community issue and that the
residents and staff must work together
Report by Mayor Lozano and Council member Marlen Garcia on the Home
Depot and Day Labor issue
Mayor Lozano spoke about a meeting and agreement that was reached
between the City and the day laborers; he spoke about identification for the
members and the issues that were ongoing at the Home Depot Center. Thanked
them and expressed extreme optimism for a favorable outcome
Council member Marlen Garcia thanked Leslie Brito, liaison between the city
and day laborers; at issue was the identification of the group and the challenges
that have been encountered
Council member Bejarano congratulated the Council and day laborer
participants and expressed sympathy for the situation and circumstances that
they are in. He reiterated the sentiment that the Home Depot site was not an
appropriate venue. He further requested that if they are going to be recognized
as an organization significant controls such as business license & membership
should be on file.
Council member Pacheco expressed his continued support of the day laborers
and the formation of a center for them. He was glad to see progress and stated
the significance of the poor economy.
Council member Marlen Garcia stated that she was bringing forward concerns
of the people in the community, not criminalizing the individuals who were

Mayor Pro Tern Monica Garcia recognized the participants for moving forward
on this matter because it is of significant importance. The group should be self-
sufficient and organized to protect the participants. She encouraged them to
keep moving forward
Mayor Lozano stated his optimism that the members would come through and
thanked them for their participation
Request by Council member Bejarano and supported by Mayor Lozano,
Mayor Pro Tern Monica Garcia and Council member Marlen Garcia for
discussion on the following:
Discussion and direction regarding an investigation to determine if Council
member Pacheco engaged in berating an Executive Team Member
Council member Bejarano stated a provision of the Fair Employment &
Housing Act that mandates somebody who is a supervisor or manager to report
or address allegations of harrassment. His request for an investigation is what
would be required by law.
Noted that the closed session that took place that evening to address the matter
was not attended by Council member Pacheco.
Council member Pacheco expressed his belief that this was a
politicallymotived request and emphasized that he had never disrespected
anyone. He further alleged that the process being followed was not in
accordance with law and that he would not be participating in this matter
Motion: undertake an investigation of the alleged berating of an Executive staff
member by Council member Pacheco
Moved by Council member Bejarano, seconded by Council member Marlen
Garcia.
ADJOURNMENT
There being no other matters for discussion the meeting was adjourned in
memory of Patricia Thomas Allen and Gregory Anguiano at 9:00 p.m.

in car accident that took place in the city. He congratulated all of the graduates of
the local high schools.
City Treasurer Maria Contreras congratulated Alfonso Contreras on his 21st
Wedding Anniversary. Mayor Pro Tern Monica Garcia adjourned in memory of
Christian Torres Rodriguez, resident & student at Tracy Elementary.
Mayor Lozano thanked the Chief of Police for the increased patrolling of the
graduation parties in the city

Smokefree Apartment Registry spoke about the detriments of smoking in
apartment complexes
Jesse Rudy Escalera,resident spoke about issues on his street including
overcrowding, vehicles, graffiti. He requested that the Police Department come
out and observe the situation
Ray Alber, business owner spoke about the closed session agenda item and
wanted to know what was going on with the process. He requested that the
Council share their vision with the public
John, resident thanked the Council and staff for attending his graduation and
spoke about his involvement with the Keep Youth Tobacco Free program; thanked
the Council for approving the ordinance that would increase enforcement of youth
tobacco sales; Zodin Delrosario also thanked the Council for approving the
ordinance and spoke about the importance of enforcement. Congratulated the city
for producing good students
Thomas Cary, resident commented about the new design of the NOW; Morgan
Park; closed session items; redevelopment
Chris Agrella, candidate for the 32nd Congressional seat spoke about budget
cuts in local agencies, including reducing travel budgets.
John Rios, resident commented about some overgrown vegetation in his
neighborhood and provided photos of possible code violations in his neighborhood
Greg Tuttle, business owner spoke about various issues including Superior
market, photographs of Council members, and the minutes of the May 20th
meeting

litigation challenging the constitutionality of any seizure by state government of
the city's street maintenance funds and Commission's tax increment.

7. FEDERAL ECONOMIC STIMULUS FUNDING OPPORTUNITY ENERGY
EFFICIENCY AND CONSERVATION BLOCK GRANT
Mayor Pro Tern Monica Garcia commented about the item and commended
staff for identifying funds. She spoke about the possibility of hiring a
consultant to prioritize on Baldwin Park so that the community would receive
the full benefit of these programs
CEO Singhal commented that staff had had meetings with Edison and
Siemens to discuss opportunities for the city and upcoming assessments that
would be beneficial to the city
Council member Pacheco expressed his support of green and energy
efficiency programs; requested that a consultant be hired through the RFP
process
Motion: approve Resolution No. 2009-026 and Community Development
Commission Board approve Resolution No. 452 authorizing the city attorney
and general counsel to cooperate with the League of California Cities, the
Community Redevelopment Association, other cities and counties in litigation
challenging the constitutionality of any seizure by state government of the
city's street maintenance funds and Commission's tax increment.

In response to an inquiry from Council member Pacheco, CEO
Singhal stated that ten percent 10%) of the grant would go to funding

that the intent of the consultant would be to guide staff through the process.

Director of Public Works Galvez presented the report. Mayor Lozano
opened the public hearing for those wishing to speak in favor or opposition.
FAVOR:
Thomas Cary inquired about the speed measurement in certain areas in town
OPPOSITION:
Cruz Sembello inquired if the study could be broadened to include other areas
Seeing no further interest, the public hearing was closed
Council member Pacheco inquired about the recommended speed on Puente
Avenue and asked if it could be moved down to 35 or if the proposed ordinance
had to reflect the findings of the study. Director Galvez commented that they
could possibly install the speed study signs or increased enforcement if
speeding continues
Council member Marlen Garcia expressed concern about increasing the
speed on Big Dalton. She inquired about Merced & Big Dalton as the
pedestrian crosswalk. Director Galvez responded that it was not considered an
interior residential cross walk and that classifying the street differently would be
difficult.
Council member Marlen Garcia commented that if the increase was approved,
the residents would express concern about the speeding. Director Galvez
suggested that the ordinance be introduced for first reading, excluding the Big
Dalton segment
Mayor Pro Tern Monica Garcia expressed concerns because speeding does
take place and they hope to get people to slow down on the streets. She further
commented about the study and rationale used to determine speed
Council member Pacheco spoke about the traffic conditions on Big Dalton and
that speed in residential areas needed to be closely monitored
CEO Singhal commented about the challenges at the staff level regarding the
study suggested that this item be deferred to a proposed study session to take
place on July 13.
Director Galvez suggested that Council consider approving the speed survey
with the exception of Big Dalton to avoid any enforcement issues
Council member Marlen Garcia inquired about the installation of a crosswalk
at Merced & Big Dalton or possible traffic calming measures that may be
considered. Director Galvez responded that Big Dalton was similar to Vineland
and that traffic calming devices may be warranted.

Mayor Pro Tern Monica Garcia addressed the comments regarding the Sheriff's
department and the Council was not considering bringing in the sheriffs
Mayor Pro Tern Monica Garcia inquired about the issuance of speaker cards for
public communications and requested Council consensus to bring forward
speaking cards so that everyone was included. Council member Pacheco
inquired about the format of the card and if it would have to be brought back for
Council approval. Council member Pacheco expressed his opinion that the
current format used for public communications was fine
It was recommended that this be brought forward for further discussion
Mayor Pro Tem Monica Garcia commented about the intersection of Merced &
Lubican and requested that staff conduct a study there to try and address it and
bring forward findings to the Council
Council member Marlen Garcia announced the Baldwin Park Police
Department's participation in carrying the torch through the City for the Special
Olympics; she also spoke about the Sierra Vista High School Swim Team and
their successful competition in the CIF finals. It was requested that they be invited
to a future Council meeting for recognition. Lastly she spoke about the premiere
of the movie Food, Inc. which featured a Baldwin Park family and highlighted their
eating and fitness habits. She thanked her Council colleagues and staff for all of
their support.
