ORAL COMMUNICATIONS
Mayor King declared Oral Communications open and ORAL
invited those wishing to speak on any subject to come COMMUNI
forward. CATIONS
OPEN
Bob Brizius, Westar Associates, spoke regarding the BOB
implementation of the DDA agreement for the Westar BRIZIUS
Center, and about several problems that may delay the
completion of the center such as bid dates that do not
comply with Westar's commitment dates with tenants.
He asked if the City can find a way to speed up the
process.
Peter Koetting, Westar Associates, spoke regarding the PETE
delays on the downtown project such as: being KOETTING
required to go out to bid, ma Street not cut through,
and the approved signal not being completed. He
requested public discussion on the project at a future
Council meeting.
Eileen Pinhero, Amar Road, spoke regarding the EILEEN
heritage book, the accomplishments of the City, and PINHERO
the Taylor Funeral Home being saved to be used as a
Hall of Fame, an art gallery, or a little theatre.
Z Frank Ramirez, 4924 Wimmer, spoke about the Utility FRANK
Users Tax and what a 4% percent tax would cost users. RAMIREZ
Dorothy Soffe, 13013 Amar Road, told about illegal DOROTHY
fireworks being set off on 4th of July and the SOFFE
problems she had encountered with these illegal
fireworks and also about shots that were fired.
Mrs. Garrison, 3945 N. Puente, complained about MRS.
illegal fireworks and requested that something be GARRISON
done.
Justina Ramirez, 4924 Wimmer, spoke about fireworks' JUSTINA
and the problems involved. She felt that fireworks RAMIREZ
should not be prohibited and suggested that the

fireworks, the restrictions on smoking, and asked for
an update on All Star Automotive's building plans.

City Clerk Gair stated that this was a supplemental
report to the report presented at the last Council
meeting and explained that the partners of Yellow Top
Cab Company's experience in the taxi cab business
ranges from four years to ten years in every phase of
the taxicab business. City Clerk Gair recommended
that the City Council approve the Certificate of
Public Convenience and Necessity.
Mayor King declared the Public Hearing open and PUBLIC
invited those wishing to speak on this subject to come HEARING

There were none. NONE
Mayor King declared the Public Hearing closed. CLOSED
It was moved and seconded to approve the certificate CERTIFI-
of Public Convenience and Necessity" for Yellow Top CATE

REPORTS OF OFFICERS, COMMISSIONERS AND COMMITTEE
City Clerk Gair explained that two of the five offices STAFF
of the Human Services Commission expired on June 30, REPORTS
1989, both terms are for two years; five of the seven CITY
offices of the Housing Commission expired on June 30, COMMISSION
1989, the different requirements of each office and APPOINT-
terms of each office; and two of the seven offices MENTS
of the Planning Commission expired on June 30, 1989,
both terms are for two years.
City Clerk Gair further explained that all
commissioners but one stated that they desire to be
reappointed, if council so desires. Housing
Commissioner June Glass was unable to accept
reappointment. Council has received a list of all
persons seeking commission appointments and she
recommended that Council appoint or reappoint
commissioners to the Human Services, Housing and
Planning Commissions and adopt the appropriate
resolutions relating to those commissions.
Mayor King stated that Nicholas Barone would not be
able to accept reappointment to the Housing Commission.
It was moved and seconded to reappoint Newton Seay and RESOLUTION
Nellie Martinez and appoint Jesus Leyson, Awilda NO. 89-51
Sanders and Albert Reale to the Housing Commission and ADOPTED
adopt Resolution No. 89-51, A RESOLUTION OF THE CITY
p COUNCIL OF THE CITY OF BALDWIN PARK APPOINTING MEMBERS
TO THE HOUSING COMMISSION OF THE CITY OF BALDWIN
PARK". M/S/C: IZELL/LOWES. There were no
objections.
It was moved and seconded to reappoint Betty Wallace RESOLUTION
and Dorothy Harper to the Human Services Commission NO. 89-52
and adopt Resolution No. 89-52, A RESOLUTION OF THE ADOPTED
CITY COUNCIL OF THE CITY OF BALDWIN PARK APPOINTING
MEMBERS TO THE HUMAN SERVICES COMMISSION OF THE CITY

It was moved and seconded to reappoint Merrill Whitley RESOLUTION
and Frank Fitzgerald to the Planning Commission and NO. 89-53
adopt Resolution No. 89-53, A RESOLUTION OF THE CITY ADOPTED
COUNCIL OF THE CITY OF BALDWIN PARK APPOINTING MEMBERS
TO THE PLANNING COMMISSION OF THE CITY OF BALDWIN
PARK". M/S/C: IZELL/MCNEILL. There were no
objections.
Assistant to the City Manager Volmert explained that STAFF
several ordinances and policies on no smoking and on REPORT
use of the Council Chambers by outside groups were NO
gathered. The City Attorney's Office also provided SMOKING
Z copies of the state regulations relating to no
smoking. She further explained that chamber use
policies can be adopted as administrative policy;
smoking restrictions in city-owned buildings require
the adoption of an ordinance; and smoking regulations
affecting employees in the workplace would require
notification to employee associations and a meet and
confer process if requested by any of the
associations. She outlined a City Council Chambers
Use Policy and recommended that Council adopt the
proposed policy for Use of City Council Chambers by
Non-City Groups or Officials".
It was moved and seconded to adopt the policy Use of COUNCIL
City Council Chamber Chambers by Non-City Groups and CHAMBER
officials". M/S/C: IZELL/LOWES. There were no POLICY
objections. ADOPTED
Assistant to the City Manager Volmert outlined smoking
restrictions in the Chambers and other Public Areas of
City-Owned Buildings and recommended that Council
adopt an ordinance prohibiting smoking in public
access areas of City-owned facilities.
It was moved and seconded to adopt Ordinance No. ORDINANCE
1023, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NO. 1023
BALDWIN PARK PROHIBITING SMOKING IN PUBLIC ACCESS APPROVED
AREAS OF CITY-OWNED BUILDINGS". M/S/C: LOWES/IZELL. SECOND
There were no objections. READING)
Assistant to the City Manager Volmert outlined smoking
restrictions in the City workplace and recommended
that Council propose a change to the City's Personnel
Rules restricting smoking in areas of city-owned
buildings open only to employees.
It was moved and seconded to propose a change to the PERSONNEL
City's Personnel Rules restricting smoking in RULE
employee work areas and to forward a copy of the PROPOSAL
proposed policy to the employee groups. M/S/C: APPROVED
IZELL/LOWES. There were no objections.
Acting Director of Community Services Rangel gave an SIDEWALK
updated report of the Neighborhood Improvement Program IMPROVE-
regarding sidewalk improvements. He explained that MENTS
the School District responded with a priority list and
map of those sidewalks to be constructed, which listed
Walnut and Charles Bursch Elementary schools as the
first schools where the monies should be spent.
Acting Director of Community Services Rangel DISCUSSION
recommended that Council review the maps and proposed
priority list and direct staff accordingly.
Council discussed the monies to be used for sidewalks
for safe routes to schools and the School Districts
recommendation to start with either Walnut or Charles
Bursh Elementary schools and that the School District
would cooperate and pay for sections that belong to
them.

Council also discussed doing all sidewalks at one time
since sixty percent of the City already has sidewalks
Council asked the City Attorney if such consideration
could be initiated under the 1911 act.
City Attorney Flandrick responded that this can be
done by City Council or by petition to initiate doing
the whole city at one time.
It was moved and seconded to direct staff to install SIDEWALKS
the sidewalks recommended by the School District and AT BURSCH
to start with Charles Bursh Elementary School. M/S/C: APPROVED
Z LOWES/IZELL. There were no objections.

COUNCIL INITIATIVES
Acting City Manager Yelton explained that Council COUNCIL
members receive a salary which is based on City COMPEN-
population and the current maximum salary the City of SATION
Baldwin Park Council members may receive is $500.00
per month. Council may only increase their salary
when one or more members begins a new" term of
office. Council presently receives $250.00 per month.
Acting City Manager Yelton further explained that
Council members are also authorized to receive
benefits paid for by the City. Council currently
receives $275.00 per month for benefits at the level
comparable to the amount that the majority of city
employees receive CLOCEA unit). He outlined what
7- each bargaining unit would receive for fiscal year
1989/1990 and that Council will automatically receive
the amount that the CLOCEA unit will receive, or they
may consider another benefit level. He recommended
that Council adopt the ordinance setting Council
compensation at an amount of $500.00 per month, to be
effective April, 1990. No recommendation was made on
the designation of benefit level for Council members.
Council discussed the increase in salary and felt that DISCUSSION
it was not the right time to accept an increase. They
also discussed benefits and agreed to accept the group
benefit level of Executive employees.
It was moved and seconded that the City Council COUNCIL
receive the group benefit levels of the Executive BENEFITS
employees. M/S/C: MCNEILL/LOWES. There were no APPROVED
objections.
Mayor King reported that Acting Director of Community AQMD
Services Rangel was looking into the draft of the AQMD CITY
plan with respect to clean air guidelines regarding COMPLIANCE
City compliance with the plan.
Mayor pro Tem Lowes stated her concern regarding the UTILITY
lack of revenue being generated in certain projects, TAX
City income being over projected, the need for ten
percent in reserve funds and other budgetary concerns.
She suggested that a 3% utility tax limited to five
years be placed on the November ballot.
Council discussed the pros and cons of a utility tax DISCUSSION
and directed the City Clerk to draft the necessary
resolution to place an advisory measure on the
November ballot, for the next Council meeting.

It was moved and seconded that the necessary UTILITY
resolution be drafted for placing an advisory measure TAX
on the November ballot relating to a 3% utility tax, DIRECTION
limited to five years. M/S/C: LOWES/MCNEILL. There APPROVED
were no objections.

The City Council adjourned to a Closed Session at 8:30 CLOSED
p.m. SESSION
City Attorney Flandrick stated that the Closed Session
related to the matter of Meet and Confer and is
authorized under Section 54957.6(a) of the Government
Code.
The City Council reconvened at 8:49 p.m. Roll Call
remained the same.
City Attorney Flandrick stated that no further action
was requested.
