The City Council of the City of Baldwin Park met in regular session in Council Chambers, at 10:00 a.m. ROLL CALL: PRESENT: COUNCILMEMBERS IZELL, LOWES, ROLL CALL MCNEILL AND MAYOR KING fl; ALSO PRESENT: Acting City Manager Yelton, City Attorney Flandrick, and City Clerk Gair 00- Mayor King called the meeting to order and adjourned to CLOSED a Closed Session at 10:00 a.m., for consideration of a SESSION personnel matter pursuant to Government Code Section 54957. The special meeting of the City Council was reconvened MEETING at 11:41 a.m. Roll Call remained the same. RECONVENED In response to Mayor King's request, City Attorney CITY Flandrick stated that the Closed Session was held for ATTORNEY personnel matters pursuant to the section of the Brown Act noted in the agenda. He explained that Item No. 2 Consideration of a Settlement of Disputed Claim Richard A. Hoskin) of the agenda is to be deleted and removed from the agenda. Mayor King stated that, if the Council agrees, that the MOTION following motion is necessary, That through FOR consultation with the City Manager as required by law, TERMINA- Richard A. Hoskin be and hereby is terminated from his TION position of Chief of Police, City of Baldwin Park, STATED effective immediately; the Mayor shall give written notice to Mr. Hoskin of this action." It was moved and seconded that the motion stated by MOTION the Mayor be approved. fl/S: LOWES/MCNEILL. Mayor King asked if there were any objections. Councilman Izell stated that he has been a long time DISCUSSION friend of Mr. Hoskin as family friends, Kiwanis friends and have worked together for a long time. Under these conditions, as a personnel problem, he would abstain from voting, but at this time he believed that Council has not exhausted the negotiation process and that will be reflected in his vote. In response to Mayor King's question, Councilman Izell clarified that he said that he did not think that the negotiation process had been exhausted. Councilman Izell requested a roll call vote on the ROLL CALL motion to terminate the employment of the Chief of VOTE Police. He stated that what he Izell) says one time and says another is not fact. Councilman Izell requested that Mayor King state what he wanted to say. Mayor King stated that the following motion is MOTION FOR necessary, That Carmine Lanza be and hereby is ACTING appointed Acting Police Chief effective immediately and CHIEF shall continue in such appointment until further order STATED of this Council." It was moved and seconded to approve the motion as stated MOTION by Mayor King. M/S/C: MCNEILL/LOWES. There were no APPROVED objections.
