Park met in regular session in the
Council Chambers at 7:00 p.m.

PRESENTATIONS
Mayor King presented Michael Yelton, Director of PRESENTA-
Administrative Services, with a plaque for his TIONS
services as an employee of the City. He explained
that Michael Yelton has accepted a job with the City
of Simi Valley. Councilmembers complimented him on
his years of service and contribution to the City.
Mayor King announced his resignation and explained
that he is going to pursue other endeavors with his
family. Councilmembers complimented Mayor King on his
years of dedicated service to Baldwin Park and the San
Gabriel Valley and wished him well on his retirement.

Mayor King declared Oral Communications open and ORAL COMMU
invited those wishing to speak on any subject to come NICATIONS
forward. OPEN
Eli Roca, 14637 California, requested to be on the ELI ROCA
next agenda to present Parents for Youth, Progress
and Proficiency" program. He inquired about clean-up
of the empty lot at the end of California Street.
Filex Padilla, 14335 E. Ramona Boulevard, asked if FILEX
the situation that exists with transients hanging out PADILLA
around the park can be looked into and hopefully
something can be done about the problems being
created.
Frank Fitzgerald, 14302 Clydewood, wished both Michael FRANK
Yelton and Mayor King well. FITZGERALD
Ana Montenegro, 4519 Park Avenue, commented on the ANA
Mayor and wished him the best of luck. She requested MONTENEGRO
that the City choose a city manager that would be
aware of the needs of the people and since a larger
percentage of the City is hispanic, hopefully, a
person of hispanic descent can be chosen.
Anthony Bejarano, 3508 Big Dalton, inquired about a ANTHONY
speed sign on Big Dalton, a stop sign on Channing, and BEJARANO
brighter street lights near the schools that were

the request of Mayor pro Tern Lowes.
It was moved and seconded to approve Consent Calendar CONSENT
Item No. 5 1-7 as presented. M/S/C: LOWES/IZELL. CALENDAR
There were no objections. APPROVED
Mayor pro Tern Lowes explained that the City needs to ITEM NO. 8
hire a person in order to receive the money from the
State for state disaster assistance. She suggested
the money the City would receive from the State be set
aside to hire a part-time civilian.
Acting City Manager Yelton stated that the police
department staff should be directed to do research on
this, approve the resolution and come back with a
further recommendation.
It was moved and seconded to approve Item No. 8 of ITEM NO. 8
the Consent Calendar with directions as indicated. APPROVED

PUBLIC HEARING
Acting Director of Community Services Rangel PUBLIC
introduced the Public Hearing on 89-V-4, Approving HEARING
the Order to Vacate a Street Easement Located INTRO-
Immediately North of Nubia Street, 100' Extension of DUCED
Borel Street Adjacent to 14925 E. Nubia Street". 89-V-4
Acting Director of Community Services Rangel explained
that this item was originally continued at the October
18, 1989 council meeting because staff had not and
still has not received the necessary easement
information from the utility companies. He
recommended that the City Council continue the public
hearing indefinitely.
It was moved and seconded to table the public hearing 89-V-4
on 89-V-4. M/S/C: MCNEILL/IZELL. There were no TABLED
objections.
Acting Director of Community Services Rangel PUBLIC
introduced the Public Hearing on Z-491 & TM-47278, A HEARING
Request for Approval for a Zone Change from R-G, INTRO-
Residential Garden, to R-G PD), Residential Garden DUCED
Planned Development Overlay Zone, a Development Plan Z-491 &
in order to allow the Construction of 15 Single-Family TM-47278
Detached Dwelling Units, and a Tentative Tract Map in
Order to Allow a 16 lot Residential Subdivision
Pursuant to Sections 17.30.030 and 16.01.070 of the
City Code. Applicant: Gilbert Roybal; Location:
4305, 4315, 4325 Merced)."
Acting Director of Community Services Rangel explained
that the subject property consists of three 3)
parcels totaling 1.84 gross acres. A total of 15
units are proposed yielding[ a net density of 10.4
units per acre for the project. Staff feels that this
project meets the purpose and intent of the Planned
Development Overlay Ordinance. Approval of this
project will result in substantial improvement to the
neighborhood.

He recommended that the city Council approve the
Negative Declaration of Environmental Impact, approve
a zone change from R-G to R-G(PD), and approve the
Development Plan and Tentative Tract Map with the
conditions listed in the Staff report.
Mayor King declared the Public Hearing open on Z-492 & PUBLIC
TM-47278 and invited those wishing to speak on this HEARING
subject to come forward. OPEN
There were none.
Mayor King declared the Public Hearing closed. CLOSED

REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES
Acting Director of Community Services Rangel explained STAFF
that Section 15.04.140 of the Baldwin Park Municipal REPORT-
Code requires that public improvements be constructed ISSUANCE
as a condition of issuance of building permits for the OF
construction or reconstruction of any building or BUILDING
structure, the estimated cost of which is in excess of PERMITS
$5,000.00. He also explained that these improvements
are not required under certain circumstances. The
Director of Community Services, upon written
application, may waive the improvements, if it is
found that any one or more conditions exists as listed
in the staff report. He recommended that the City
Council approve an ordinance which provides for the
Director of Community Services to approve a two year
deferment to section 15.04.140.
It was moved and seconded to approve Ordinance No. ORDINANCE
1031, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NO. 1031
BALDWIN PARK AMENDING CERTAIN PROVISIONS OF THE FIRST
BALDWIN PARK MUNICIPAL CODE RELATING TO CONDITIONS OF READING)
ISSUANCE OF BUILDING PERMITS." M/S/C: IZELL/ LOWES.
Acting Director of Community Services Rangel explained STAFF
that the City will be entering into a new refuse REPORT
collection agreement with Webster's Refuse Disposal REFUSE
and portions of the new agreement are inconsistent COLLECTION
with the existing municipal code. He recommended that
Council approve the amendments to the municipal code
as they relate to refuse collection.

It was moved and seconded to approve Ordinance No. ORDINANCE
1032, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NO. 1032
BALDWIN PARK AMENDING CHAPTER 8.24 OF THE BALDWIN PARK FIRST
MUNICIPAL CODE RELATING TO REFUSE COLLECTION." N/S/C: READING)
IZELL/LOWES. There were no objections. APPROVED
Acting Director of Community Services Rangel explained REFUSE
that the City Council selected Webster's Refuse AGREEMENT
Disposal as it's sole franchisee for refuse collection
within the City. As condition to the approval of the
agreement, the City Council is required to approve
Collection Routes Schedules and Disposal Sites and
Locations. He recommended that the City Council
authorize the refuse collection agreement between the
City and Webster's Refuse Disposal for signature,
approve the collection routes schedules and approve
Puente Hills Landfill, BKK, Spadra, and Valley
Reclamation as the authorized refuse disposal
locations.
City Attorney Flandrick stated that changes had been CITY
made in the language of the ordinance and there may ATTORNEY
still be some technical changes required. The
agreement that is recommended for approval by the City
Council is the latest draft dated November 15, 1989.
It was moved and seconded to approve the refuse REFUSE
collection agreement between the City and Webster's AGREEMENT
Refuse Disposal. N/S/C: IZELL/MCNEILL. There were APPROVED
no objections.

COUNCIL INITIATIVES
Mayor King tabled Item No. 1, Request to Refrain from ITEMS
Using Animals for Medical Research Los Angeles TABLED
County" and rtem No. 2, Authority for Appointment and
Dismissal of Unclassified Services Employees."
Council discussed the monthly Dial-A-Ride ridership
service and boarding statistics. No action was taken.
Mayor King tabled Item No. 4, Approve Appointment of
Acting Director of Administrative Services."

It was moved and seconded to adjourn the regular MEETING
meeting of the City Council at 8:00 p.m. in memory of ADJOURNED
Lisa Keyser. N/S/C: IZELL/MCNEILL. There were no 8:00 P.M.
objections.
It was announced that a Special Meeting to recite the SPECIAL
results of the November 7, 1989 election be held on MEETING
November 11, 1989 at 7:00 p.m. in the Council ANNOUNCED
Chambers. Council concurred.
