The City Council of the City of Baldwin
Park met in regular session in the
Council Chambers at 7:00 p.m.
ROLL CALL: PRESENT: COUNCILMEMBERS IZELL, KEYSER, ROLL CALL
MCNEILL AND MAYOR LOWES
An ALSO PRESENT: City Manager Penman, and
City Clerk Gair

REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES
City Clerk Gair reported on the canvass of the April 10, DECLARING
1990 General Municipal Election and verified that all RESULTS
ballots had been correctly counted and accounted for. APRIL 10,
She stated that a majority of the voters voting voted 1990
for Bette L. Lowes for Mayor and for Bobbie W. Izell ELECTION
and Julia S. McNeill for Members of the City Council
and that a majority of the voters voting did not vote in
favor of either Measure A or Measure B and therefore the
measures are not adopted or ratified.
It
was moved and seconded to adopt Resolution No. 89-22, RESOLUTION
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 90-22
CALIFORNIA, RECITING THE FACT OF THE GENERAL ADOPTED
MUNICIPAL ELECTION HELD ON APRIL 10, 1990, DECLARING THE
RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW."
M/S/C: MCNEILL/IZELL. There were no objections.
City Clerk Gair administered the Oath of Office to Bette OATHS OF
L. Lowes for Mayor and to Bobbie W. Izell and Julia S. OFFICE
McNeill for Members of the City Council. A Certificate
of Election was presented to each elected official.
City Clerk Gair explained that the election of Bette L. FILLING
Lowes as Mayor has created a vacancy on the City COUNCIL
Council. The options before Council to fill the VACANCY
unexpired term are to either appoint someone to the
vacancy or to call a special election. Law would
require that a special election be held in consolidation
with the November election held by Los Angeles County.
Cost of such an election, as quoted by the county, could
be as much as $31,000. Resolutions were prepared for
approval for either choice that Council might make.
Mayor Lowes stated that although this was a special
meeting of the City Council and Oral Communications is
not a requirement that public input would be taken on
this item. She requested that discussion of any other
subjects be held until the regular meeting of the City
Council.
Mayor Lowes declared Oral Communications open on the ORAL COMMU
consideration of filling the Council vacancy and invited NICATION
those wishing to speak on that subject to come forward. OPEN

Speaking in favor of the appointment because of the 33 IN FAVOR
vote difference between the second and third candidate, OF
the voters already making that choice, and because a APPOINT-

Raul Reyes, 3160 Athol Street, spoke concerning the REYES
mixed feelings that he had about Council appointing
and/or calling a special election.
George Archibeque, 3262 Francisquito, spoke against the ARCHIBEQUE
appoinment of Dr. Martin Gallegos.
There being no other speakers, Mayor Lowes declared Oral CLOSED
Communications closed.
Councilwoman McNeill explained that although she COUNCIL
appreciated people remembering what she said about DISCUSSION
wanting the people to vote for her when she was elected,
she stated that this was a different situation, because
the City has just had an election and with a difference
of 33 votes between the second and the third candidate
she felt that the people have spoken.
Councilwoman McNeill made a motion to adopt Resolution MOTION TO
No. 90-23, appointing Martin Gallegos to the vacancy APPOINT
on the City Council. GALLEGOS
Councilman Keyser commented on all the procedures that DISCUSSION
he went through three years ago to get the utility tax
brought to an election and it was turned down. He felt
that the citizens have a right to vote, no matter the
cost, and he was in favor of an election.
Councilman Izell stated that he was not comfortable
making an appointment to the Council unless he can
choose who is to be appointed.
Mayor Lowes commented on the utility tax issue and that
it did come to a vote in November. She felt that the
people have made their choice in the April election and
that she respects the voters by their mandate at that
election.
Mayor Lowes seconded the motion of Councilwoman McNeill MOTION
to approve Resolution No. 90-23 and appoint Martin SECONDED
Gallegos to the vacancy on the City Council.

Councilman Izell made a motion to approve Resolution No. MOTION TO
90-23 and appoint George Archibegue to the vacancy on APPOINT
the City Council. Councilman Keyser seconded the ARCHEBEQUE
motion.

City Manager Penman explained that the Council has until DEADLINE
May 16th to make a decision on appointment or a special
election. The 30 day period would end at that time.
Council discussed the options before them and the fact DISCUSSION
that Councilman Izell would be leaving town for an
extended period of time. Councilman Izell stated that
he did not have a problem with this being considered
while he was gone.
* Mayor Lowes requested that this item be placed on the CONSIDER
May 2nd agenda for further discussion and possible MAY 2ND
consideration.
It was moved and seconded to adjourn the special meeting MEETING
of the City Council at 8:05 p.m. M/S/C: IZELL/MCNEILL. ADJOURNED
