The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, IZELL, ROLL CALL KEYSER, MCNEILL AND MAYOR LOWES ALSO PRESENT: City Manager Penman, City Attorney Flandrick, Acting Dir. of Administrative Serv. Neelans, Dir. of Housing & Economic DeY. Pearce, Chief of Police Lanza Dir. of Human Serv. Lucas, Deputy City Clerk Branek and City Clerk Gair 00- City Treasurer Montenegro's absence was excused. ABSENCE EXCUSED 00- Chief of Police Lanza introduced Officers Melissa Stehly OATHS OF and Mark Kincaid and told of their backgrounds and OFFICE education. City Clerk Gair administered the Oath of Office to the officers. Chief of Police Lanza introduced Cora Taylor, Police PROCLAAA- Records Manager, and told of her background and TIONS achievements. Mayor Lowes read a proclamation for Law Enforcement Records and Support Personnel" and presented it to Ms. Taylor. Mayor Lowes read a proclamation declaring the month of July as Recreation Month." She presented the proclamation to Lee Lucas, Director of Human Services. 00- Mayor Lowes declared Oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come NICATIONS forward. OPEN Eli Roca, 14637 California Street, spoke regarding gang ROCA violence, crime school drop-out rates and the need for vocational education for these cast-away students. Raul Reyes, 3160 Athol Street, complimented the City on REYES the opening of the Community Center and suggested that there be fund raising events held to assist the police department. Mildred Knorr, 3437 Feather Avenue, and June Puho, 3465 KNORR & Feather Avenue, requested help regarding the grafitti PULIO and trash along the railroad tracks between Merced Avenue and MacDevitt Street. They presented photos showing the grafitti and the trash and told of the health hazards that this is causing. Waive Further Reading and Adopt RESOLUTION NO. 90-49 APPROVING 5TH YEAR OCJP GANG GRANT It was moved and seconded to approve the Consent CONSENT Calendar as presented. M/S/C: MCNEILL/IZELL. There CALENDAR were no objections. APPROVED 00- CLOSED SESSION The regular meeting of the City Council was adjourned to CLOSED a Closed Session at 7:29 p.m. to consider personnel SESSION matters as authorized under section 54957 of the Government Code. The regular meeting of the City Council was reconvened at 7:46 p.m. Roll Call remained the same. 00- PUBLIC HEARING City Manager Penman presented the proposed budget for FY PROPOSED 1990-91 and explained the processes and study sessions BUDGET that have occurred in preparation of this budget and the FY 1990-91 necessary staff cuts and the anticipated revenues. He also explained the impact of the staffing reductions and that the three police vacancies will not effect response time in patrols, but will slow down investigations. He reminded Council that the sale of Proposition A funds will balance the budget this one time and that it is assumed that the Redevelopment Agency will be able to pay $200,000 to the City next fiscal year. Mayor Lowes declared the Public Hearing open on the PUBLIC Proposed Budget for FY 1990-91 and invited those wishing HEARING to speak on this subject to come forward. OPEN Eli Roca, 14637 California Street, requested that the ROCA Council not cut any police positions, because more patrols are needed for the citizens' protection. He also felt that the City was not big enough to need 171 employees Justina Ramirez, 4924 Wimmer Avenue, stated that she was RAMIREZ against police officers being cut. She was against a utility tax, but she would support a special tax for police. There being no other speakers, Mayor Lowes declared the CLOSED Public Hearing closed. City Manager Penman explained that the Police Department and the Human Services Department are 89% of the budget and that no one likes to cut police. The City does have 171 employees and 85 of those are in the Police Department. Also, many positions are not funded by the General Fund. Councilman Gallegos expressed concern about the DISCUSSION possibility of new taxes not being legal, the tenuous nature of the revenue sources and felt that the necessary personnel cuts should be made at this time. Mayor Lowes and Councilwoman McNeill expressed their regret at the cuts that are having to be made, but felt that this approach was necessary for a balanced budget and that the City will go forward from here. Councilman Izell commented on this being his eleventh budget and that in 1978 the City was down 14 police officers. Our police were on the bottom of the pay scale in the valley and the first thing that the Council did was to raise all the employees pay up to the median pay and Council has attempted to keep them at the median. He expressed his regret for the fees for ambulance service, animal control and the construction taxes that are ultimately passed on to the consumer. It was moved and seconded to adopt Resolution No. 90-50, RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 90-50 PARK ADOPTING THE BUDGET FOR THE CITY OF BALDWIN PARK ADOPTED FOR THE FISCAL YEAR COMMENCING JULY 1, 1990 AND ENDING JUNE 30, 1991." M/S/C: MCNEILL/IZELL. There were no objections. City Planner Onaga introduced the Public hearing on AGP- PUBLIC 92 and Z-499, A request for approval of the following: HEARING ON 1) An Amendment to the General Plan Land Use Element Map AGP-92 & from Open Space to Single Family Residential; and 2) A Z-499 zone change from Os, Open Space, to Ri, Single Family INTRODUCED Residential Zone pursuant to Section 17.54.040 of the City Code 3430 & 3446 Vineland Avenue). City Planner Onanga explained that this property was previously zoned as open space and was owned by the Los Angeles County Flood Control District, who deeded it back to the City. He described the proposed development of single family residences on these underutilized lots and stated that this land would not be suitable for park usage under the current Open Space zoning. The Planning Commission has recommended approval of this project. Mayor Lowes declared the Public Hearing open on AGP-92 PUBLIC and Z-499 and invited those wishing to speak on this HEARING subject to come forward. There were none. OPEN Mayor Lowes declared the Public Hearing closed. CLOSED It was moved and seconded to approve the Negative NEG DEC Declaration of Environmental Impact relating to AGP-92 APPROVED and Z-499, 3430 and 3446 Vineland Avenue. MIS/C: GALLEGOS/MCNEILL. It was moved and seconded to adopt Resolution No. 90- RESOLUTION 51, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 90-51 BALDWIN PARK APPROVING AN AMENDMENT TO THE LAND USE ADOPTED ELEMENT OF THE GENERAL PLAN FROM OPEN SPACE TO SINGLE FAMILY RESIDENTIAL FOR THE REAR APPROXIMATE 91 FEET OF THE PROPERTIES LOCATED AT 3430 AND 3446 VINELAND AVENUE CASE NO. He outlined the services that SERVICES have been provided, the complaints relating to some of AGREEMENT the services, the cost breakdown of the service, and the amendments as outlined in the June 20th staff report. Council inquired about the number of vehicles that are DISCUSSION used by Baldwin Park and by west Covina, the advantages of having the extended service, the number of rides generated from Baldwin Park that go outside the city limits, and the possibility of routing one or two vehicles. Council expressed concern at approving a contract for three years. They commented on the complaints that are received regarding the service that is provided and also commented on their dissatisfaction with the costs of the program. It was also suggested that the senior citizens should be able to ride free. In response to Council's inquiry, Mr. Hazen stated that the City does own their own buses and that there is a provision for cancelling the contract if the Council is not satisfied with the services. It was moved and seconded to approve a three year TRANSIT contract with Community Transit Services, Inc., with AGREEMENT written reports to be presented in five 5) months and APPROVED for senior citizens to ride free. RIDE FREE Assistant to the City Manager Volmert stated that the HEAT Council had previously approved application for an RECOVERY Energy Partnership Loan with CEC for a heat recovery SYSTEM system for the Morgan Park pool. The loan application MORGAN is to be considered at a later date by the CEC, but it PARK POOL is necessary to approve purchase of this equipment at AGREEMENT this time so that it can be installed as close as possible to the date the pool facility is to be completed. City Attorney Flandrick stated that the City Council is acting as the agent for the Baldwin Park Financing Authority in this action. It was moved and seconded to approve a purchase AGREEMENT agreement with Kaiser Sales Corporation/Dectron APPROVED Corporation for a heat recovery unit for the Morgan Park Aquatics Facility. M/S/C: GALLEGOS/MCNEILL. There were no objections. City Manager Penman explained the recommendation for an CONSTRUC- increase in the construction tax that is collected by TION the City. This is one of the revenue increases that was TAX recommended to Council to balance the FY 1990-91 budget. INCREASE The existing tax is $125 for each bedroom, not to exceed $500. The increase will be $250 per bedroom, not to exceed $1,000. City Attorney Flandrick stated that tax measures become effective immediately and this increase will take effect on July 5th.
