The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, IZELL, ROLL CALL MCNEILL AND MAYOR LOWES ALSO PRESENT: City Manager Penman, n City Attorney Flandrick, Acting Dir. of Admin. Serv. Schuld, Dir. of Housing & Economic Dev. Pearce, Dir. of Human Serv. Lucas, Acting Chief of Police Kies, Deputy City Clerk Branek and City Clerk Gair 00- The absences of Councilman Keyser and City Treasurer ABSENCE Montenegro were excused. EXCUSED 00- Mayor Lowes and City Manager Penman displayed the award AWARD TO from the Los Angeles County Transportation Commission CITY LACTC) naming a transportation vehicle after the City of Baldwin Park. A replica of the plate that will be displayed in the Baldwin Park car was presented to Council and Staff at a special presentation earlier. 00- ORAL COMMUNICATIONS Mayor Lowes declared Oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come NICATIONS forward. OPEN Roland Westermeyer, M.D., Maine Avenue, requested that WESTER- the decision denying his application for a loan from the MEYER City be appealed. Joanne Watkins, 14542 Hallwood Drive, inquired about WATKINS funding for school crossing guards for summer school. Ed Huetinck, 13059 Amar Road, spoke regarding the HUETINCK problem with ice cream push carts in the City and the lack of police enforcement to stop them. C William Watkins, 14542 Hallwood Drive, asked about the WATKINS island on Maupin Street and who is responsible for the upkeep. He also suggested that volunteers be organized to act as summer school crossing guards. There being no other speakers, Mayor Lowes declared CLOSED Oral Communications closed. 00- City Manager Penman explained that there is a need to SUBSE- place an additional item on the agenda under Reports of QUENT Officers. Need for this action arose after the posting NEED ITEM of the agenda and relates to United Concrete Pipe, Irwindale Sewer Project. It was moved and seconded to place the United Concrete SUBSE- Pipe, Irwindale Sewer Project on the agenda as a QUENT Subsequent Need Item under Reports of Officers. N/s/C: NEED ITEM IZELL/MCNEILL. Also, change orders can be made up to 25%, sections can be added that Council desires without having to come back to the Council if that is their direction. They also stated that $33,000 worth of change orders can done and gave a breakdown of square footage, curbs and gutter and other costs. It was moved and seconded that Item No. 7 be approved ITEM NO. 7 with the understanding that the Council can make APPROVED necessary changes. M/S/C: IZELL/GALLEGOS. There were WITH no objections. CONDITION In regard to the School Impact Fees Contract, Mayor ITEM NO. 9 Lowes stated that it might be appropriate to charge the school district for collecting these fees. In response, City Manager Penman stated that the City had taken a survey and found that out of twenty two cities only two collect the school impact fees and do not charge for collecting. The other twenty cities do not collect for the school district. He suggested that this item be brought back to the Council at a later date. It was moved and seconded that Item No. 9 of the ITEM NO. 9 Consent Calendar be removed for consideration at a later REMOVED date. H/S/C: MCNEILL/GALLEGOS. There were no APPROVED objections. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Transportation Manager Hazen explained that a fixed FIXED route services for summer, July 9 August 30, is being ROUTE proposed to transport people, in one hour cycles, from SHUTTLE the new Community Center to Sierra Vista Pool with SUMMER designated stops. The service operates from 12:00 p.m. SERVICE to 5:00 p.m., Monday through Friday and coincides with the swim time at the pool. The charge is 25 cents per day. Council discussed the proposed route and recommended DISCUSSION that the shuttle loop on Anderson Street and make stops at Holland Jr. High and Heath Elementary School. It was moved and seconded to approve the Fixed Route FIXED Shuttle with the changes as recommended by the City ROUTE Council. M/S/C: IZELL/GALLEGOS. There were no SHUTTLE objections. APPROVED City Manager Penman stated that the next agenda item is SUBSE- the Subsequent Need Item" that was approved by Council QUENT earlier in the meeting. He explained that this item NEED relates to the request from the Koll Company and the ITEM City of Irwindale for Council approval to construct a IRWINDALE sewer main to serve the proposed United Concrete Pipe SEWER development on Live Oak between Arrow Highway and PROJECT Commerce Drive. The proposed sewer effects Commerce Drive and Center Street. Conditions related to this project are contained in a June 12, 1990 letter to the Koll Company. The City is requested to bear 2/3 of the cost of reconstructing the pavement on this sewer project. A pending escrow closing on Friday makes it necessary for this item to before Council tonight. In reponse to Council concern about funding 2/3 of KOLL the pavement, Jeff Drightley, 350 S. Glenroy, Los COMPANY Angeles, and Vice-President of Development with the Koll RESPONSE Company, stated that due to his company's need to meet the escrow closing deadline on Friday and the need for Council approval of this project, he would commit Koll company to pay the full amount for the construction of the street work. Council and the City Manager discussed the Koll Company COUNCIL proposal and concluded that it would be necessary for DISCUSSION the soil compaction to meet acceptable standards under AND the City Engineer's inspection. Also, it was understood CONDITIONS that: 1) Commerce Drive is to be trenched and patched, 2) Center Street will have three elements, one case that is a crack seal and slurry, another will be an overlay with a fabric, and another will be complete removal and reconstruction, and 3) the reconstruction will be paid by the Koll Company. It was moved and seconded that an agreement be prepared MOTION TO to accomodate all the terms and conditions that have PREPARE been indicated to be acceptable by the City Council and AGREEMENT that the contract be between the City of Irwindale, the WITH City of Baldwin Park and the Koll Company, and include CONDITION all of the items except Number 11 of the June 12, 1990 APPROVED letter to the Koll Company, and will require 100% payment by Koll Company for reconstruction of the street work described. There were no objections. 00- COUNCIL INITIATIVES Councilman Izell requested that an ordinance be brought FIREWORKS before the Council before next Fourth of July to take ORDINANCE care of the problem of a discount distributor competing with our local non profit organizations for fireworks sales. councilwoman McNeill requested that Captain Kies work CROSSING with Manpower Consortium to get summer school crossing GUARDS guards. Mayor Lowes requested that the policy of limiting the PAY number of public phones in certain sites and limiting PHONES the calls to out-going only was previously adopted by LIMITS & $ the City Council. She requested a report on this at the FEES August 1st Council meeting, because of the problems that have arisen at Bess and Garvey Avenues. She also requested that there be specific charges for placement of the phones and not just a general license fee of $87.50. Mayor Lowes also requested that a committee of citizens BUDGET be established to work with Staff and Council to study ADVISORY the budget and be an advisory to the Council on budget CONflITTEE matters. A report was requested regarding this at the August 1st Council meeting to advise how this committee could be structured Council concurred.
