Lucas, Chief of Police Lanza, City Planner Onaga, City Treasurer Montenegro, Deputy City Clerk Branek, and City Clerk Gair 00- Mayor Lowes declared oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come NICATIONS forward. There were none. OPENED Mayor Lowes declared Oral Communications closed. CLOSED 00- City Clerk Gair presented the Consent Calendar: CONSENT CALENDAR 1. Approval of Certificate of Posting for September 19, 1990 2. Approve Minutes of September 5, 1990 3. Waive Further Reading and Adopt RESOLUTION NO. 90-73 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 4. Receive and Pile Treasurer's Report August 31, 1990 5. Waive Further Reading and Adopt RESOLUTION NO. 90-75 SUPPORTING RTD AND ITS EFFORTS TO REDUCE TRAFFIC CONGESTION At the request of Mayor Lowes Item No. 5 of the Consent ITEM NO. 5 Calendar was removed for separate consideration. It was moved and seconded to approve Item No. 5 with ITEM NO. 5 the requested changes. MIS/C: IZELL/MCNEILL. There APPROVED were no objections. WITH CHANGES PUBLIC HEARING Director of Housing & Economic Development Pearce PUBLIC introduced the Public Hearing and approval of Grantee HEARING Performance Report GPR) 15th Year Community Development 15TH YR Block Grant CDBG) Program. CDBG GPR) INTRODUCED Director Pearce explained that the City receives an annual grant from the U.S. Department of Housing and Urban Development HUD), that is to benefit low and moderate income persons and to eliminate blighted conditions in the City. On February 3, 1984, HUD mandated a change in the GPR process, the completed GPR is to be available for public comments. Also, proper posting and publication was made on September 1, 1990. The GPR was reviewed and approved by the CDBG Advisory Committee in a public forum with a recommendation that unappropriated program income would come back to the Advisory Committee for consideration for disposition/reallocation. This public hearing is to incorporate any and all public comments into the final adopted GPR. Mayor Lowes declared the Public Hearing open on Grantee PUBLIC Performance Report GPR) and invited those wishing to HEARING speak on this subject to come forward. There were none. OPEN Mayor Lowes declared the Public Hearing closed. CLOSED It was moved and seconded to Approve the Grantee CDBG Performance Report GPR) 15th Year Community Development GPR) Block Grant CDBG) Program and submit it to HUD. City Planner Onaga introduced the Public Hearing, A PUBLIC request for a Change of Zone, Z-501 approval of a HEARING Development Plan, and Tentative Tract Map No. 48419 for Z-501 & property located at 3920 3926 Stewart Avenue." TM-48419 INTRODUCED City Planner Onaga explained the request for a zone change from RG, Residential Garden to RG(PD), Residential Garden Planned Development Overlay Zone, and a development plan to construct eight 8) single family residences each with private and common open space. A Tentative Tract Map is processed in conjunction with this development. The property consists of two parcels which is surrounded, except to the west, with single family and multiple family residences. The west side of property is zoned C-2, and is developed with a retail commercial shopping center. He described the proposed lot sizes, variety of building designs, and the parking areas. This project is recommended for approval by the Planning Commission by a vote of 5-1. Mayor Lowes declared the Public Hearing open on Z-501 & PUBLIC TM-48419 and invited those wishing to speak on this HEARING subject to come forward. Jin-Jie Yu, 2457 Country Club Drive, Glendora, YU representing the Ampert Development Inc., stated that the company agrees to all the qualifications required for this project. There being no other speakers, Mayor Lowes declared the CLOSED Public Hearing closed. It was moved and seconded to approve the Negative NEG DEC Declaration of Environmental Impact relating to Z-501 & APPROVED TM-48419. MIS/C: IZELL/MCNEILL. There were no objections. City Planner Onaga gave the corrections needed for the ordinance and resolution relating to Z-501 & TM48419 as: Ordinance) Section 1, parts a) and b), the words require" and required" changed to warrant" and warranted"; Section 2 was changed from 12.54" to 17.54". Resolution) The word granted" in Section 3 was changed to approved"; additions to Section 3, s) That the subject property be rezoned to RG(PD)". to section 6, x) That the subject property be rezoned to RG(PD)". It was moved and seconded to introduce Ordinance No. ORDINANCE 1045, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NO. 1045 BALDWIN PARK APPROVING A CHANGE OF ZONE FROM RG, TO APPROVED RG(PD) ON APPROXIMATELY 83 ACRES; APPLICANT: AMPERT FIRST DEVELOPMENT INC.; CASE NO. Z-501; LOCATION: 3920-3926 READING) STEWART AVENUE) and to waive further reading of the ordinance. M/S/C: IZELL/GALLEGOS. There were no objections. It was moved and seconded to adopt Resolution No. 90- RESOLUTION 76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 90-76 BALDWIN PARK APPROVING A DEVELOPMENT PLAN AND A ADOPTED TENTATIVE TRACT MAP APPLICANT: AMPERT DEVELOPMENT INC.; CASE NO. Z-501 & TM-48419; LOCATION: 3920-3926 STEWART AVENUE). M/S/C: MCNEILL/GALLEGOS. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS, AND COMMITTEES City Clerk Gair reported that the National League of NLC Cities requested the names of the voting delegate and VOTING two alternate voting delegates for the 1990 Congress of DELEGATES Cities. It was moved and seconded that Mayor Pro Ten be the VOTING voting delegate. Mayor Lowes and Councilman Gallegos DELGATES will serve as alternate voting delegates. MIS/C: APPROVED IZELL/GALLEGOS.
