The City Council of the City of
Baldwin Park met in regular session in
the Council Chambers at 7:00 p.m.

PRESENTATION
Mayor Lowes presented a City Plaque to City Employee EMPLOYEE
Glenn Fritchie for his 32 years of service to the City SERVICE
and told of some of his activities through out those AWARD
years.
Councilman Izell stated that he had worked with Glenn
Fritchie in the community and that he was a good friend.
Chief Lanza presented the City Council with a picture of POLICE
the police force. He introduced several of the officers PRESENTA
in the audience and stated that the picture was TION
coordinated by Sgt. Bazzell.

Mayor Lowes declared Oral Communications open and ORAL COMMU
invited those wishing to speak on any subject to come NICATIONS
forward. OPEN
Roni Galuna, 14817 Olive Street, complained about a GALUNA
vacant house at 14813 Olive. She stated that there is
vandalism, people coming to the house late at night, a
shooting that occurred a few weeks ago and how this
disturbs all the neighbors.
Leoria Richard, 3336 Millbury, spoke in opposition to RICHARD
allowing alcoholic beverages to be served in the
Community Center. She stated that children are taught
to Just Say No" to drugs and alcohol and the Community
Center is a place for the family.
Roy Test, 15115 Kenoak, agreed with the statement that TEST
alcohol should not be allowed in the Community Center.
He also stated that graffiti seems to be on the increase
and asked if any persons are ever caught.
Josh Wilkins, 40 Glenellen, Covina, thanked the Council WILKINS
and Staff for the opportunity afforded the Scout Troop
#469 to present the Invocation and the Flag Salute.

At the request of Mayor Lowes Item No. 8 of the Consent ITEM NO. 8
Calendar was removed for separate consideration.
It was moved and seconded to approve Items No. 1-7 of CONSENT
the Consent Calendar as presented. N/S/C: CALENDAR
MCNEILL/GALLEGOS. There were no objections. APPROVED
Mayor Lowes requested that Administrative Assistant ITEM NO. 8
Nunez explain the agreement with the City of West
Hollywood to trade Proposition A funds.
Administrative Assistant Nunez explained that the city
of West Hollywood was the only city interested in
exchanging funds. The offer presented was at an
exchange rate of sixty cents $.60) of general funds for
one dollar $1.00) of Proposition A funds.
The report requests $500,000 to be exchanged but that
has been increased to $850,000. The money would be used
to settle with Wells Fargo and the remainder used to
balance the budget. Staff recommends that the City of
Baldwin Park exchange $850,000 Proposition A funds and
authorize the Mayor to execute the agreement.
It was moved and seconded to approve Item No. 8 of the ITEM NO. 8
Consent Calendar with the changes requested. N/S/C: APPROVED
IZELL/MCNEILL. There were no objections.
REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES
City Manager Penman stated that the Collection of SCHOOL
Developer Fees for School District" had been placed on IMPACT
the agenda once more because there were only four FEES
councilmembers present at the last meeting and that
there was a tie vote. He listed the options, first to
continue collecting the fees as the City is currently
doing; to continue collecting the fees with a 3% charge
for handling, or let the school district collect the
fees. He has met several times with the school district
and they recommend that the fees be collected by the
City without charge to the district.

City Manager Penman also explained that a continuing
good relationship with the district is important to the
City. The previous agreement expired June 30th and that
there is a clause in that agreement that if terminated
all fees are due and payable within thirty days. Four
projects payments were deferred, three of those are due
in 1991 and the other one is due in 1992. However,
staff felt that the previous agreement had expired, and
was not terminated as stipulated in the agreement.
Councilman Gallegos inquired if the City Attorney agreed
with Staff and what debate could be used in connection
with the expiration of the agreement.
City Attorney Bower stated that the wording is ambiguous
relating to termination, stating that the agreement is
terminated if the district submits a demand in writing
making the deferred monies due in ten days.
It was moved and seconded to approve the City Manager's MOTION
recommendation to continue collecting the fees with no
charge to the School District. N/S: GALLEGOS/IZELL.

Director of Human Services Lucas requested that the City ALCOHOLIC
Attorney review the Alcoholic Beverage Ordinance for the BEVERAGE
Community Center. He stated that the Community Center ORDINANCE
was not allowed to have alcohol served at any function. REVIEW
The Center receives many request to have beer and wine COMMUnITY
at different social functions. A study shows many other CENTER
cities allow alcohol to be served with dinners. He
explained that after the City Attorney reviews the
ordinance, and it is brought back to Council, the
commission would like to review and set a policy that
only allows six permits a year.
Councilman Gallegos questioned the possibility of fees DISCUSSION
being charged and the procedure used to issue the six
permits. He also stated that he did not see a problem
with alcohol served at dinners. He pointed out that if
the service clubs go to a restaurant, beer and wine are
usually served.
Councilwoman McNeill stated that at a country club
alcohol is expected, but that the Boy's and Girl's Club
or the park is for the youth and these areas need to be
drug and alcohol free.

Mayor Lowes commented that the Community Center was
built for family entertainment, the city Police
Department support Just Say No", and the City needs to
set an example to the youth of Baldwin Park.
Councilman Gallegos moved to approve the Human Services MOTION
recommendation to have the City Attorney review the FAILS
alcoholic beverage ordinance relating to the Community
Center. Motion died for lack of a second.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilman Keyser requested that citations be changed REQUEST
from a misdemeanor to an infraction for a yard sale or CITATION
an auto for sale on the street. And a policy be made CHANGE
that if the paperwork is not in the court by the time
the citation is due and payable the citation be
dismissed.
Council concurred to have staff bring a report to the REPORT
January 16, 1991 meeting concerning the requests made REQUESTED
by Councilman Keyser.
Mayor Lowes commented on the success of Operation Big OPERATION
Switch and would like to see it expanded next year. BIG SWITCH
Director of Human Services Lucas explained that next
year both high schools would be involved in Operation
Big Switch.
Councilman Gallegos requested that Operation Big Switch
include at least two Councilmember's position to be
filled.
City Manager Penman announced the upcoming PAC meeting, ANNOUNCE-
and the February 1st implementation of recycling in the MENTS
City by Webster's Disposal. He also spoke about the
military calling individuals into active service and
that the City will attempt to help these employees in
line with the Military Code.
City Clerk Gair reported that the Deputy City Clerk SCHOLAR-
Branek had been awarded a scholarship to begin the SHIP
Certification Program for City Clerks by the Southern
Division of the City Clerks Association.

of the City Council at 8:05 p.m. MIS/C: IZELL/ ADJOURNED
