Mayor Lowes read a proclamation declaring the week of PROCLAMA-
March 17-22, 1991, as National Adult and Continuing TION

RESOLUTION NO. 91-9 SUPPORTING THE TROOPS
OF THE UNITED STATES
OF AMERICA IN THE
PERSIAN GULF WAR
At the request of Mayor Lowes Items No. 4, 6, and 11 of ITEMS NO.
the Consent Calendar was removed for separate 4,6 & 11
consideration. REMOVED
It was moved and seconded to approve Items No. 1-3, CONSENT
5, and 7-10 of the Consent Calendar. MIS/C: MCNEILL/ CALENDAR
GALLEGOS. There were no objections. APPROVED
In regard to Item No. 4 Mayor Lowes requested that, if ITEM NO. 4
the applications for the residential loan program
increase, the funds up to $50,000, be transferred from
the commercial loan program to meet that need.
It was moved and seconded to approve Item No. 4, ITEM NO. 4
Approve CDBG Transfer of Funds to the Morgan Park APPROVED
Expansion Project with consent to transfer up to $50,000
of commercial loan program monies to the residential
loan program if needed." MIS/C: IZELL/GALLEGOS. There
were no objections.
City Manager Penman explained that Item No. 6, ITEM NO. 6
Ordinance No. 1046, is a reorganization of Department
Head positions and he explained the new Department Head
positions and the deletions.
It was moved and seconded to approve Item No. 6, ITEM NO. 6
Ordinance No. 1046, Amending the BPMC Relating to APPROVED
Department Heads". MIS/C: GALLEGOS/MCNEILL. There
were no objections.
Mayor Lowes referred to Item No. 11, Supporting the ITEM NO.
Troops of the United States of America in the Persian 11
Gulf War", she read the commendation to the troops and
the list of government agencies that will receive the
resolution.
In response to the speech of President Bush, Councilman
Izell stated that he would like to see the City have a
special celebration this 4th of July.
It was moved and seconded to approve Item No. 11, ITEM NO.
Supporting the Troops of the United States of America 11
in the Persian Gulf War." H/S/C: IZELL/GALLEGOS. APPROVED

Mayor Lowes commented on Item No. 8 regarding Robert ITEM NO.8
Bower, of Rutan and Tucker is now the permanent City DISCUSSED
Attorney, and complimented him for his work.

PUBLIC HEARING
Acting Building Superintendent Cosgrove stated that the APPEAL
appeal of Unreinforced Masonry Building Andrew UNREIN-
Steiner, 14362 Ramona Boulevard," was continued from the FORCED
February 20, 1991 Council meeting. He pointed out the MASONRY
URM law mandating cities in the State of California BUILDING"
to inventory all unreinforced masonry buildings and
create a program to mitigate the earthquake hazards in
these buildings. He outlined the type of buildings that
have a history of poor performance in past earthquakes.
He stated that the initial request to Mr. Steiner in
September 1989 requested supporting documents to support
Mr. Steiner's opinion. The appeal to Council on
January 16, 1991 was verbal and without any
documentation. On February 8, 1991 a certified letter
was mailed to Mr. Steiner advising him that the appeal
had been continued and that he needed to submit any
documents to the City Clerk's Office by February 14,
1991. As of this Council meeting no documents have been
received. Mr. Cosgrove referred to a map issued by
Thomas Guide dated May, 1928, that shows the property in
question. Staff recommended denial of the appeal.
Mayor Lowes declared the Public Hearing open and invited HEARING
those wishing to speak on this subject to come forward. OPEN
Andrew Steiner, 14362 Ramona Blvd., stated that he has STEINER
hired an architect and an engineer but has not received
any data from them. He questioned how it was determined
that the building is unsafe.
After responding to City Attorney Bower's question Mr.
Steiner requested that the appeal be continued to April
3, 1991 and confirmed that he should have a report from
the architect and engineer by that time.
There being no other speakers, Mayor Lowes declared the CLOSED
Public Hearing closed.
It was moved and seconded to continue the Public UNREIN-
Hearing, Unreinforced Masonry Building," Andrew FORCED
Steiner, 14362 Ramona Blvd. to April 3, 1991. MIS/C: MASONRY
GALLEGOS/MCNEILL. There were no objections. CON'T

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
City Planner Onaga provided some background regarding SECURITY
the City's Municipal Code regulations that apply to WINDOW
security window and door bars. He stated that at the BARS
February 20, 1991 Council meeting that staff was EXTERNAL)
directed to report on the history, purpose and intent of
the Municipal Code requirement which precludes exterior
mounted security window bars. He pointed out that
Ordinance No. 964 was adopted in August of 1987, that
allowed bars to be mounted only on the inside of
industrial or commercial buildings, and gave up to two
years to comply with the regulations that all bars be
removed.

City Planner Onaga stated that since the expiration of
the two year amortization period the City has attempted
to achieve full compliance, but because of no code
enforcement the City requires compliance when a property
owner/tenant applies for a business license, a building
permit for remodeling, or a conditional use permit or
zone variance. This approach has been the most
efficient way to enforce the ordinance without a code
enforcement staff. He stated that the enforcement may
be an inconvenience to the business owner, but the
regulations that were adopted are consistent with the
goals and polices stated in the City's General Plan. He
pointed out that adherence to these policies will result
in more attractive buildings, increased property values
and potentially more successful business.
Council discussed the fact that industrial areas need DISCUSSION
protection, and that window bars on the inside of a
building does not prevent the window from breaking.
Council also discussed business owners installing silent
and audible alarms as a deterrent and questioned the
response time by the police department for a burglar
alarm call.
It was moved and seconded to send the ordinance back to INDUSTRIAL
the Planning Commission to consider allowing outside AREA WIN-
window bars on windows in the industrial areas. H/S/C: DOW BARS
IZELL/MCNEILL. There were no objections. APPROVED
City Manager Penman suggested that Council appoint a WATER
committee to meet with the Water Company to discuss RATIONING
rationing. Councilmen Gallegos and Izell volunteered. COMMITTEE
City Manager Penman announced that the Citizens Finance CITIZENS
report has been completed and is available to the FINANCE
public. He stated that the Council needs to decide on REPORT
the presentation and discussion of the report by:
1). setting a special meeting with the Finance
Committee.
2). A study session at the beginning or the end of
the Council meeting on March 20th.
3). Place on the March 20th agenda.
Council agreed on a 6:00 p.m. Study Session on March STUDY
20th and also placing the item on the regular meeting SESSION
agenda for March 20th.

It was moved and seconded to adjourn the regular meeting MEETING
of the City Council at 7:55 p.m. to an adjourned regular ADJOURNED
meeting on March 20, 1991, at 6:00 p.m. with the AT 7:55 PM
Citizens Committee on City Finance. H/S/c:
