and told of his background and education. City Clerk OFFICE
Gair administered the Oath of Office to the officer.

Mayor Lowes read a proclamation declaring September 1991 PROCLAMA-
as Literacy Month." She presented the proclamation to TION
Librarian, Dolores Pedro.
Proclamations recognizing the American Red Cross" and
Rideshare Week" were acknowledged.

City Manager Penman introduced the new Building Official INTRODUC-
Andy Rodriguez formerly with the City of Moreno Valley. TION

Mayor Lowes declared Oral Communications open and ORAL COMMU
invited those wishing to speak on any subject to come NICATIONS

Martha Cruz, 4323 Downing, stated that Downing Street CRUZ
and 4950 Bogart is in need of repair. She questioned
the reasons the property owners would need to pay for
the street repairs and why the tax bills increase.
Ana Montenegro, 4519 N. Park, invited everyone to MONTENEGRO
participate in the Latin Cultural Festival at the
Baldwin Park Library on September 19th, 21st and 26th.
There will be different entertainers at each event.

Joe Bally, 2621-1 whitley, Pomona, requested a flag be BALLY
flown for the American MIA/POW's in southeast Asia until
some, if not all, the men come home. Recognition of the
MIA/POW's is September 20th.
Bill Van Cleave, 13232 Emery, commented on the need for VAN CLEAVE
curb-side code enforcement, on the decrease in street
vendors since the police department has been enforcing
the law, and the tons of trash hauled away rom five
pieces of property by the Baldwin Park Beautiful
Committee.
Jeanne Martens, 14847 Sierra Way, suggested that rental MARTENS
property be inspected when vacant, a certificate issued
before occupancy and the cost be passed on to the
absentee landlord. A Disclosure Statement would be
helpful in assisting the City with code enforcement.
Claudia Rivas, 13837 Foster, Student at Sierra Vista RIVAS
High School, Speaker of the House for the Associated
Student Body, stated that their goal is to get more
students involved in activities. She invited everyone
to this season's first home game with El Monte High
School this Friday night.
Claude Ellington, 4517 Harlan, commented on the length ELLINGTON
of time he has lived in the City, and how most of his
neighbors are tenants. He requested that the Ordinances
be enforced and to have code enforcement again.
Pam Schnabel, 14217 Los Angeles Street, requested the SCHNABEL
streets in her area be swept on Friday after the trash
has been picked up.
Sue Ellington, 4517 Harlan, commented about the ELLINOTON
businesses being run out of the homes, cars parked on
yards and the need for an inspector to go around and
stop these types of activities.
Raul Martinez, 14465 Cavette Fl., stated that the MARTINEZ
property at the corner of Ramona/Syracuse has several
vehicles for sale every week and it looks like a car
auction. He volunteered to speak Spanish and assist the
police officers as a ride-along.
Lorin Lovejoy, 12749 Torch, spoke about water running LOVEJOY
into the gutter from apartment buildings that have
automatic sprinklers and being wasted.
Roth Dryden, 3745 Harlan, stated concern about the DRYDEN
condition of the City, junk cars on lawns, other cities
not allowing cars on lawns and that something needs to
be done.
There being no other speakers, Mayor Lowes declared Oral CLOSED
Communication closed.

It was moved and seconded to approve the Consent CONSENT

SPECIAL PRESENTATION
Mayor Lowes read a brief background of Steven Hastings, SPECIAL
who is listed as missing in Vietnam and presented a PRESENTA-
commemorative Resolution No. 91-72 to his parents Mr. TION
and Mrs. Gene Hastings of Baldwin Park.

PUBLIC HEARING
Administrative Assistant Mimura, requested the Council GRANTEE
to approve the Grantee Performance Report GPR) for the PERFORM-
16th Year CDBG Program of the City City Fiscal 1990- ANCE
91). The GPR was reviewed and approved by the CDBG REPORT
Advisory Committee. The positive accomplishments are: GPR)
1) completed the renovation of the Senior Citizens 16TH YEAR
Center; 2) acquired two properties for the expansion of CDBG
Morgan Park. The CDBG Sidewalk Program was not PROGRAM
completed and the project was carried over to FY 1991-
92. Staff recommended that, following the Public
Hearing, Council approve the GPR and instruct staff to
incorporate any and all public comments into the final
adopted GPR.
Mayor Lowes declared the Public Hearing open and invited OPEN
those wishing to speak to come forward.
Pam Schnabel, 14217 Los Angeles Street, requested SCHNABEL
sidewalks for her street, because people can not get out
of their driveways. One piece of property has a hedge
that blocks the view of the street.
There being no other speakers, Mayor Lowes declared the CLOSED
Public Hearing closed.
Mayor Lowes stated that the Commercial Loan Program was STAFF
not included in the report. She requested that staff DIRECTION
bring back a report on the LDC which would include what
they are doing, determine the need to continue, consider
placing the funds in the residential loan program and
the EDA funds go to other projects. Council Concurred.

In response to Councilman Gallegos, Administrative
Assistant Mimura stated that the funding was pay as you
go and Mid-Valley Mental Health did receive the total
amount allocated.
It was moved and seconded to approve the GPR and to GPR
incorporate any and all public comments into the final APPROVED
adopted GPR. MIS/C: MCNEILL/GALLEGOS. There were no
objections.

REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES
City Manager Penman requested Council to review and CODE
consider the information and options regarding a code ENFORCE-
enforcement program. The code enforcement duties have MENT
been transferred to other divisions with a projected
backlog of one-hundred eleven 111) calls. Staff feels
the existing codes and the provisions in the City Code
are sufficient to eliminate most violations.
A more comprehensive, proactive program could be
developed with a mandatory inspection program and fees
set to recover the cost. This could be an annual
inspection of all rental units or a mandatory inspection
of all residential units upon sale. If the Real Estate
Transfer Disclosure Statement is instituted by the City
and violations noted, the property owner would be
responsible for repairs before a certificate of
occupancy would be issued. Council has authorized one
person to initiate the Code Enforcement Program and over
a period of time additional staff could be added as
Council desires and funding is available. Staff
recommends that the City initiate a Code Enforcement
Program with the one position currently authorized and
with no ordinance changes at this time.
In response to Council questions, City Manager Penman DISCUSSION
stated that Mid-Valley Manpower will be issuing warnings
to the people that have illegal yard sales and fines of
$50.00 will be charged after that. If a more
comprehensive program of code enforcement is implemented
an ordinance would need to be adopted, inspections
required, fees for the recovery of costs and that it
would take several weeks to get the program in place.
Responding to Councilman Gallegos, city Manager Penman
stated that the property owner that does not comply may
have their property liened, but this is a lengthy
process.
council discussed that a more aggressive approach to
code enforcement would increase property values, the
possibility of violators responding to a letter, renters
moving into a place that is not presentable having no
incentive to improve the property, the time lapse of
renting the property and the issuance of a certificate
of occupancy, and using the utility companies to
identify changes in renters. They also discussed that
the fines for violations would pay for the program.
Councilman Izell made a motion to have Real Estate MOTION
Disclosure Statements filed with the City. Motion died DIED
for lack of a second.

Councilman Gallegos stated that there is community
support for a comprehensive proactive program. The City
needs to take a stand and staff will find the time and
money to do the paperwork to implement the program.
Once the program is implemented it will pay for itself.
It was moved and seconded that staff initiate a CODE
comprehensive proactive program with no ordinance ENFORCE-
changes at this time. M/S: GALLEGOS/MCNEILL. MENT
Mayor Lowes spoke in support of the City Manager's DISCUSSION
recommendation. She felt the City needs to get
volunteers involved and not spend money before the City
has it.
City Manager Penman clarified the need for ordinance
changes.
Council concurred to amend the motion to read the City CODE
initiate a comprehensive proactive code enforcement ENFORCE-
program with any necessary and reasonable ordinance MENT

Administrative Assistant Nunez provided the Council with DIAL-A-
an overview of the City's Proposition A funded Dial-A- RIDE
Ride Program. The City of West Covina and the City of PROGRAM
Baldwin Park created a Joint Powers Authority to
consolidate Dial-A-Ride services. The report covered
the period of January 1, 1991 thru July 31, 1991 and
contains a comparison of the level of ridership in and
outside the city, a breakdown of monthly cost for
providing the service, a cost per ridership and
information on peak ridership times. Staff recommended
that Council receive and file the report.
Mayor Lowes stated that the problem with service is with STAFF
the 99 latchkey children that ride during the peak DIRECTION
hours, which causes others to have to call five to six
days in advance to make a reservation. Dial-A-Ride is
to service the general public. Council directed Staff
to see if the Boys & Girls Club can pick up more
children, speak to the school district to see if they
can help with the school children by using the school
buses, and try to reduce the time the general public has
to wait for a ride.
Administrative Assistant Nunez stated that there is DISCUSSION
$50,000 in the budget to replace the old vehicle which
could be used as a standby. CTS would provide a
part time driver for the peak hours.
In response to Council inquiries, Human Services
Director Lucas recalled that in the negotiations on
whether to charge or not to charge, and in order to keep
the ridership up, the latchkey program was used to
provide the numbers needed. Administrative Assistant
Nunez also commented that as an incentive, all fares
that are collected go back to CTS, the service provider.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Mayor Lowes shared that she was installed as a new INDEPEND-
officer for the Independent Cities Association. ENT CITIES
Councilman Izell spoke in favor of outside window bars, WINDOW
because he had window bars removed from two offices that BARS
he rents out and the windows have been damaged by glass
cutters.
Mayor Lowes requested a Council and School Board joint JOINT
meeting to discuss problems that they have in common. MEETING
Mayor Lowes announced the Hazardous Waste pickup this HAZARDOUS
Saturday at 9:00 a.m. until 2:00 p.m. at Morgan Park. WASTE

The City Council was adjourned to a joint closed session CLOSED
with the Redevelopment Agency at 9:24 p.m. to consider SESSION
actual litigation as authorized by Government Code
Section 54956.9(a) Garcia vs City of Baldwin Park,
Baldwin Park and Associates vs City and the
Redevelopment Agency. Closed session for the Agency as
authorized by Section 54956.9(a) to discuss Kallins vs
Redevelopment Agency and potential property acquisition
of property in the Baldwin Park triangle between Baldwin
Park Blvd. and Francisquito.
