Mayor Lowes read a proclamation declaring the week of PROCLAMA
March 22-28, 1992 as National Adult and Continuing TION
Education Awareness Week" and presented it to Chamber
President Pat Chapman and Sally Wieck, Adult Education.
Mayor Lowes presented Eddie Rodriguez, the Montview AWARD OF
League and CIF 1A Champion, and 5th place State Wrestling MERIT
Champion an Award of Merit. Sierra Vista High School
Wrestling Coach Cisneros told of the athletic
accomplishments of Eddie Rodriguez.

Mayor Lowes declared Oral Communications open and ORAL COMMU

William Van Cleave, 13232 Emery, complimented the high VAN CLEAVE
visibility of the police department on the streets, the
detainment of gang members and the number of times the
patrol units have driven through the motel in his area.
Benjamin Benitos, 3841 Maine, stated that Vineland BENITOS
School sent home a flier regarding the closure of
MacDevitt Street and several parents were at the Council
Meeting to speak against the closure.
Lydia Lopez, 3350 Athol, stated that she appreciated the LOPEZ
meeting at the Senior Citizens Hall regarding the police
department and since that time, the police patrol every
hour and her neighborhood is quiet.
Helen Montenegro, 3366 Athol, stated that she MONTENEGRO
appreciated the work now being done by the Chief of
Police.

Hearing scheduled for April 1st be continued and that
this item be considered as a Subsequent Need Item and a

Albert Sanders, 4421 Stewart, stated that Officer SANDERS
Carlos' letter in the newspaper attacked Councilman
Keyser and it revealed confidential information that
could only have been received through police records.
He requested the City Attorney investigate to see if
Officer Carlos could be prosecuted for this invasion of
privacy and demanded that Officer Carlos stop those
tactics.
Dominic Tu, Sierra Vista High School ASB President, TU
stated that one hundred ten students will help the West
Covina Optimist Club on Saturday, March 21st. with the
games for the handicapped. He announced that tickets
were available for the basketball game with the Los
Angeles Breakers.
There being no other speakers, Mayor Lowes declared Oral CLOSED

Mayor Lowes requested Staff to develop a policy that DIRECTION
Council could review regarding the items declared
surplus and to whom equipment is sold. Council
concurred.

PUBLIC HEARING
City Planner Onaga requested Council consideration of an PUBLIC
appeal of the Planning Commission's denial of a request HEARING
for approval of a zone variance from Section ZV-596
17.10.020.A.3 of City Code to permit the construction of
a second dwelling unit on a lot which contains less than
the minimum required 10,000 square feet in area. The
property measured 9,900 square feet and to approve this
variance would set a precedence for approving the
requests for each of the fourteen other properties
located on this block. To approve the requested
variance and to permit construction of a second dwelling
unit on an undersized lot, diminishes the standard set
by the Zoning Code and it is contrary to the objectives
of the General Plan. Staff and Planning Commission
recommended that the Council adopt the Findings of Fact
as listed in the staff report and deny ZV-596.
Mayor Lowes declared the Public Hearing open on ZV-596 OPEN
and invited those wishing to speak on this subject to
come forward.
Irene Ramirez, 3434 Mangum, stated that the 100 square RAMIREZ
feet amounted to 6" all the way down the property line.
Neighbors have offered to sell and to give enough
property to meet the need of the 100 square feet. She
questioned the Commission's knowledge concerning the
property since no one had seen the property.
Rosemary Monteleon, 3412 Mangum, spoke in support of MONTELEON
her neighbor adding another home on the lot and that the
home will benefit the community.
Rick Godoy, 3418 Mangum, stated that there are two homes GODOY
on lot on Emery, the lot is smaller than the Ramirez's
and it would be unfair to deny their request.
Margaret Trenkamp, 3440 Mangum, stated that a large lot TRENKAMP
requires a lot of work and that a second home would be
an improvement to the community.
There being no other speakers, Mayor Lowes declared the CLOSED
Public Hearing closed.
Councilman Gallegos stated that according to the DISCUSSION
blueprint, the zone variance should be granted and that
he was perturbed that the item was brought before
Council. He directed staff to be more flexible, which
would save the appellant time and money, and for the
Planning Commission to review minimum lot sizes.
It was moved and seconded to approve the zone variance APPROVE
and direct the City Attorney to prepare the resolution ZONE

City Planner Onaga requested Council consideration of a PUBLIC
request to amend Chapter 17.22 of the City Zoning Code HEARING
to include mini-malls also referred to as indoor swap AZC-128
meets or multi-tenant retail stores) as uses permitted PLAZA 88
in the C-2, General Commercial, Zone with a conditional
use permit. The request was initiated by Michael
Montgomery, a representative for the owners of an
existing commercial building known as Discount Mart 88
Plaza" located at 14151 Ramona Boulevard which is a
large unit currently being operated as a department
store. The unique characteristics of a mini-mall were
described and the results of a survey from several
cities that addressed mini-malls. Staff and the
Planning Commission recommended that Council deny the
request to amend the Zoning Code to include mini-malls
also referred to as indoor swap meets or multiple-
tenant retail stores) as uses permitted in the C-2,
General Commercial, zone with a conditional use permit.
Mayor Lowes declared the Public Hearing open and invited OPEN
those wishing to speak regarding AZC-128, the amendment
to the Zoning Code to include mini-malls as uses
permitted in the C-2, General Commercial Zone with a
conditional use permit to come forward. There were none.
Mayor Lowes declared the Public Hearing closed. CLOSED
It was moved and seconded to adopt Resolution No. 92- RESOLUTION
22, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 92-22
BALDWIN PARK DENYING AN AMENDMENT TO THE BALDWIN PARK ADOPTED
ZONING CODE CHAPTER 17.22 TO INCLUDE MINI-MALLS AS USES
PERMITTED IN THE C-2, GENERAL COMMERCIAL, ZONE WITH A
CONDITIONAL USE PERMIT APPLICANT: MICHAEL MONTGOMERY;
CASE NO: AZC-128)." H/S/C: GALLEGOS/MCNEILL. There
were no objections.
City Planner Onaga requested Council approval of the MITIGATED
Mitigated Negative Declaration of Environmental Impact NEGATIVE
for the Baldwin Park Commuter Rail Station. A brief DECLARA-
description of the boarding platform, parking area, TION OF
landscape and lighting was given. The project also ENVIRON-
includes construction of two traffic signals at the MENTAL
intersections of Ramona and Downing and Pacific and IMPACT
Downing. A Negative Declaration and Initial Study that COMMUTER
included a noise study was referred to in the staff RAIL
report. The noise study concluded that the project will
not have a significant effect on the adjacent
residential uses. The only additional noise created by
the project will be from the additional vehicle traffic
generated by the station. Based upon the environmental
analysis, staff has concluded that the construction and
operation of the commuter rail station will not result
in adverse environmental impacts if the mitigated
measures referred to in the staff report are
incorporated into the project. It was recommended that
Council approve the Mitigated Negative Declaration of
Environmental Impact for the Baldwin Park Commuter Rail
Station.
Mayor Lowes declared the Public Hearing open and invited OPEN
those wishing to speak regarding the Mitigated Negative
Declaration of Environmental Impact for the commuter
rail to come forward. There were none.
Mayor Lowes declared the Public Hearing closed. CLOSED

REPORTS OF OFFICERS, COMMISSIOnS AND COMMITTEES
Maintenance Superintendent Dart requested Council JANITORIAL
approval for the award of contract to Lee's Maintenance SERVICES
Company for janitorial services for City buildings. The CITY
contract is for a two year period with the option to BUILDINGS
extend for one additional year. It was recommended that
Council award the referenced contract to Lee's
Maintenance Company for $6,399 per month.
Mayor Pro Tem McNeill expressed concern regarding the DISCUSSION
spread between the bids in the dollar amounts.
It was moved and seconded to reject all bids for BIDS
janitorial services for City buildings and request new REJECTED
bids. MIS/C: MCNEILL/GALLEGOS. There were no
objections.
Interim City Engineer Brock requested Council direction CLOSURE
for the permanent closure of Downing Avenue northerly of OF
Ramona Boulevard. An overhead presentation identified DOWNING
that the crossing from Downing Avenue north of Ramona AVENUE
Boulevard presented a potential hazard due to the skew
of tracks as they cross the street and the inability to
fully project the north Downing Avenue approach with
crossing arms, which led the Southern California
Regional Rail Authority SCRRA) to recommend that this
location be permanently closed to through traffic. The
closure would be accomplished in conjunction with
modifying the existing entrance only to the adjacent
parking area to accomodate both directions of traffic.
It was requested that Council direct staff on the
permanent closure of Downing Avenue north of Ramona
Boulevard.
Edward Ladd, 4123 Downing Avenue, disagreed that the LADD
crossing at Downing was a safety hazard and could recall
only three accidents at the crossing in the forty years
that he has lived in the City.
Ray Alber, commercial property owner, spoke in ALBER
opposition to the closure of Downing Avenue north of
Ramona Boulevard, that all the traffic would be diverted
on to a narrow street, two cars cannot pass at the 90
degree parking angle and there needs to be more study
done on the project.
Tom Morehart, 4137 Alderson, opposed the closing of MOREHART
Downing and pointed out that traffic would be diverted
to a narrow street, which would be used by semi-trucks
and the vehicles from the VFW, and also some of the
problems with the parking area.
Kenneth Woods, 15261 Badillo, business located at 4125 WOODS
Alderson, speaking on behalf of Wood's & Sons, stated
that he was on Alderson due to redevelopment, his
business would be further isolated with the street
closure and he suggested that Downing be made a right
Z turn only.
Kenneth Matthew, Manager of Public Programs for SCRRA MATTHEW
explained the concern for safety at the grade crossing
with the skewed tracks, the four entrances at the
intersection of Downing/Ramona, poor visibility to see
an oncoming train and access of Alderson off of Bogart.

In response to Council questions, Mr. Matthew stated DISCUSSION
that a traffic study was completed and that with the
street closure a few parking spaces could be added. The
entrance south of Downing is the entrance to the station
site and a raised median will be installed with gates, a
right turn only on Ramona and the median will preclude
motorist from going around the gates. A right turn only
could be placed to preclude the left turn pocket from
east bound Ramona going north. He explained that a
raised median was in the specifications and plans and
was authorized in a letter signed by the City Manager.
Carol Woods, 15261 Badillo, spoke in opposition to the WOODS
closing of Downing, because Bogart is to narrow for the
traffic.
It was moved and seconded to direct staff to meet with MEETING
SCRRA to get additional ideas that do not affect the WITH SCRRA
citizens and businesses in the area. N/S/C: APPROVED
MCNEILL/GALLEGOS. There were no objections.
Chief Lanza requested Council approval for the Police NEW RADIO
Department to solicit bids for a new radio system. The SYSTEM
deteriorated system from the radios in the cars to the POLICE
antennas on the roof are in need of replacement. One DEPART-
major recommendation from the consultant was to change MENT
from a VHF frequency to a UHF which would improve
transmission/reception range. The consultant prepared a
bid package for the new radio equipment and two firms
have expressed interest in bidding on the radio
equipment and the installation. The Asset Seizure fund
has sufficient funds to support the expenditure. Staff
recommended Council approval to solicit formal bids for
a new police radio system.
It was moved and seconded to approve solicitation of SOLICIT
formal bids for a new police radio system. N/S/C: BIDS
GALLEGOS/MCNEILL. There were no objections. APPROVED
Facilities and Activities Manager Rose requested Council URBAN PARK
approval to submit an application to the United States &
Department of the Interior National Park Service for the RECREATION
Urban Park and Recreation Recovery Program UPARR RECOVERY
Program). A brief description of the requirements for PROGRAM
the funding of projects was given and staff proposed the UPARR)
City apply for a grant to initiate a community outreach
program for troubled youth and utilize the Baldwin Park
Community Center. Staff recommended that Council
approval be granted to submit an application to the
United States Department of the Interior National Park
Service for UPARR funding for the community outreach
program.
It was moved and seconded to adopt Resolution No. 92- RESOLUTION
21, A RESOLUTION OF THE CITY OF BALDWIN PARK, NO. 92-21
CALIFORNIA AUTHORIZING FILING OF GRANT APPLICATION UNDER ADOPTED
THE URBAN PARK AND RECREATION RECOVERY ACT OF 1978."

City Manager Penman stated that a traffic study for MERCED/
Merced and Frazier will be prepared and a report brought FRAZIER
to Council. PETITION
Mayor Lowes requested staff contact the City Council of LOWES
Irwindale to see about repairing Olive Street from
Bleecker to Azusa Canyon Road. Also, the wall along
Olive is filled with graffiti and the City of Irwindale
needs to keep it painted or remove it. Council
concurred.
