Mayor Vargas read Resolution No. 92-44, a Resolution of PRESENTA-
Commendation for Public Service, and presented it to TIONS
Maywood Reserve Officer Kenneth Welsh.
Mayor Vargas introduced Officer Joseph Cowan and Police
Dog Ex" and told of their background and presented an
Award of Merit to the officers.
Mayor Vargas introduced Sara Luna Corral and presented
her with a City plaque in honor of her being one hundred
twenty three years old.

Mayor Vargas declared Oral Communication open and ORAL COMMU
invited those wishing to speak on any subject to come NICATIONS

Richard Moran, 13824 Kenmore, Street Minister, Faith MORAN
Fellowship Church, invited Council and the Community to
Morgan Park on June 27th for Program Gang Reachout.
Robert Van Cleave, 13128 Waco, stated that a friend was VAN CLEAVE
killed on Maine Street and that he wanted to collect
money for a reward for the apprehension of the killer.
Jeanne Martens, 14847 Sierra Way, stated that Baldwin MARTENS
Park Beautiful was presented the Hall of Fame Award at
the Citizen of the Year Banquet and at mid-night, KCET-
TV will show the June 6th Supervisorial grafitti
cleanup
Martha Laidlaw, 13736 Foster, requested a four-way LAIDLAW
STOP" at the corner of Baldwin Park Boulevard and
Foster Avenue due to the accidents at that intersection.
Dick Nichols, Executive Director of the Chamber of NICHOLS
Commerce, stated that the illegal street vendors are
selling their goods at the schools and in the community
and it is effecting the businessman.
William Van Cleave, 13232 Emery, stated that 7-11 has VAN CLEAVE
stopped selling several items because of the street
vendors and the police do not stop the vendors. Also,
on August 1st a county-wide grafitti cleanup with 200 to
300 people expected to participate will be held.

Adrienne Gaffers, 4645 Bogart, stated that her neighbor GAFFERS
was burglarized, it was attributed to a street vendor
and she requested something be done about the vending.
Aileen Pinheiro, 13009 Amar Rd., spoke regarding the PINHERO
alternative uses for the civic auditorium.
Rosie Rodriguez, 4234 Hornbrook, stated that the big RODRIGUEZ
trucks that travel down Hornbrook are ruining the
street. She criticized the police officers handing out
baseball cards to children.
Nancy Beach, 4639 Bogart, felt that the City budget BEACH
could be cut by replacing the Police Department with the
Sheriff's Office. She also referred to the reason the
vendor law was instituted.
Alma Agabashian, 12853 Ledford, requested information AGABASHIAN
about the bus passes for RTD #428 and for Foothill
Transit. which one will service the downtown route?
There being no other speakers, Mayor Vargas declared CLOSED

City Attorney Bower explained that there was no
conflict of interest.

Mayor Vargas introduced the public hearing on the FY PUBLIC
1992-93 Proposed Annual Budget. HEARING
City Manager Penman presented additional information PROPOSED
regarding possible cuts in the City budget and requested ANNUAL
public input regarding the City's Preliminary 1992-93 BUDGET
Budget. Council had directed staff to prepare options FY 92-93
for balancing the budget with a new projected surplus of
$117,500. Several positions were identified for
elimination and the impact has not been addressed. The
State is faced with a $10 to $11 billion shortfall and
the cities have been targeted to possibly lose the motor
vehicle in lieu fees and property taxes. A comparison
of last year's figures and the possible impact by
the State budget was shown. Staff did not recommend
adoption of the budget at this meeting. Rather, staff
recommended continued monitoring and a more active role
in the State budget process. An adoption date at the
end of June may provide Council with time to obtain a
clearer picture of the State plans.

William Van Cleave, 13232 Emery, stated that cuts in the VAN CLEAVE
budget should start at the top, the City Manager does
not need a new car, and the City should raise the
utility tax 2% more.
Eli Roca, 14637 California, stated one solution to the ROCA
budget problem is to bankrupt CRA and there is currently
no reason to keep the CRA program.
Jeanne Martens, 14847 Sierra Way, suggested using MARTENS
volunteers for some of the positions that will be
eliminated and raising the utility tax another 2%.

Adrienne Gaffers, 4645 Bogart, stated that she was GAFFERS
nervous about the State budget and asked what she and
other citizens could do to help.
Maria Van Muysen, 14207 Badillo, stated that she is one VAN MUYSEN
of the employees to be terminated, but it is unfair for
management to bump another employee out of a job.
Denise Beach, 4639 Bogart, requested that the police BEACH
department stop handing out baseball cards to the
children.
Robert Hussey, 3564 Maine, spoke in favor of the City HUSSEY
Yard mechanics. He felt the City id losing the good
people.
There being no other speakers, Mayor Vargas declared the CLOSED
Public Hearing closed.
Councilwoman McNeill moved that Gary Rose's name be MOTION
eliminated from the list of employees to be cut.
The motion died due to the lack of a second. NOTION
DIES
Council stated that personnel items needed to be DISCUSSION
discussed in closed session, that they want to do what
is best for the City, the cuts did not involve
personalities but positions and that no final decisions
would be made tonight.
Mayor Vargas stated that the situation that Council has
is not an enviable one, the City had a $500 thousand
p-- dollar deficit, staff was able not only to balance the
budget, but create a surplus. when he looked at
positions that were to be cut, there were no names
attached.
In reference to the campaign promises that were made, he
explained that the City does not have the sales tax
revenue that other cities have, or the businesses, and
people do not feel safe coming into the City to shop or
live. That is the reason Council has made the police
department a priority.
He also explained the salaries and benefits received by
the Human Services Director position that's open, and
the two directors under the Human Services Director. A
decision had to made, keep the directors or make the
funds available to the children for their programs. If
the State does make cuts to the City, the police force
may also have to be cut. He explained that the State
cuts would be equal to one-fourth of the City's budget.
He gave assurances that the people will be safe in the
community and the young people of the community will
have the resources they need to stay off the streets.
Councilman Izell requested that Mayor Vargas be given a
chance, because the citizens elected the best man in
April.

Mayor Vargas introduced the Public Hearing on, The PUBLIC
Citywide Lighting and Landscape Maintenance District for HEARING
FY 1992-93."
Director of Public Works Mousavi stated that Council had CITYWIDE
authorized the City Engineer to prepare the Engineer's LIGHTING &
Report, on June 3, 1992, and approved the report for FY LANDSCAPE
1992-93 with no rate increases at this time. The MAINTE-
resolutions before Council represent a final step in the NANCE
process for reauthorizing the existing Landscaping and DISTRICT
Lighting District for Fiscal Year 1992-93 and conforming
the corresponding assessments for existing Landscaping
and Lighting Maintenance District.
Mayor Vargas declared the Public Hearing on, The PUBLIC
Citywide Landscaping and Lighting Maintenance District HEARING
for FY 1992-93," and invited those wishing to speak on OPEN
this subject to come forward. There were none.
Mayor Vargas declared the Public Hearing closed. CLOSED
It was moved and seconded to adopt Resolution No. 92- RESOLUTION
55, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 92-55
BALDWIN PARK, CALIFORNIA, AUTHORIZING THE ADDITION OF ADOPTED
SPECIAL ASSESSMENTS TO THE TAX BILL." M/S/C:
GALLEGOS/IZELL. There were no objections.
It was moved and seconded to adopt Resolution No. 92- RESOLUTION
56, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 92-56
BALDWIN PARK, CALIFORNIA, ORDERING THE CONTINUED ADOPTED
MAINTENANCE OF CERTAIN PUBLIC FACILITIES AND CONFIRMING
A DIAGRAM AND ASSESSMENT." M/S/C: GALLEGOS/IZELL.
There were no objections.

REPORTS OF OFFICER, COMMISSIONS AND COMMITTEES
Assistant to the City Manager Volmert recommended that LEGISLA-
Council support SB 1642 relating to the authority to TIVE
regulate the sale and display of spray paint and felt REPORT
tip markers, support HR 2806 relating to the
availability to affordable earthquake insurance and
oppose current attempts by the State of California to
redistribute city revenues to counties and schools as
part of the State's budget balancing efforts. The City
has an aggresive anti-graffiti ordinance but a state
appellate court determined that local regulation of
retail sales of aerosol paint containers is preempted by
state law. SB 1642 would clarify that Baldwin Park has
the authority to enforce the existing city ordinance.
HR 2806 is legislation that pertains to risk
minimization and insurance for earthquake damage. It
was recommended that Council support SB 1642 and HR 2806
and oppose State budget balancing efforts which only
redistribute city funds to other agencies.
It was moved and seconded to approve support for SB 1642 MOTION
and HR 2806 and to oppose State budget balancing TO
efforts. M/S/C: MARTINEZ/GALLEGOS. There were no APPROVE
objections.
Captain Kies explained the street vendor situation in
Baldwin Park, and the Police Department's enforcement
efforts to police and the vendor's activities. A Task
Force was put together in 1991 that operated three days
a week for four hour periods, and vendors were issued
citations and had their wares taken. The District
Attorney's Office rejected the majority of cases. Staff
requested Council direction on the level of enforcement
it desires for street vendors.

Council discussed their concern with the down time for a DISCUSSION
police officer that must wait for a tow truck when a
street vendor's goods are confiscated, the problem
cannot be a priority and the public is at risk when they
make purchases from street vendors.
Mayor Vargas directed staff to provide the public with DIRECTION
information that they are at risk making purchases from TO STAFF
street vendors. Council concurred.
Director of Public Works Mousavi responded to Council CROSSWALK
inquiries regarding the crosswalk removal on Baldwin REMOVAL
Boulevard in conjunction with the recent Slurry Seal
Project. He explained the visual effect on a driver
when he sees a crosswalk and the number of feet required
in order to be able to stop. Pedestrians can still
utilize the unmarked crosswalk on Baldwin Park Boulevard
at Morgan Street and at the controlled intersection of
Ramona Boulevard and Baldwin Park Boulevard. It was
recommended that Council concur with the Traffic
Committee's findings and that certain
information/educational letter be sent to the residents
within the neighborhood explaining the City Code/policy
and the reasons for the City's action.
It was moved and seconded to concur with the Traffic TRAFFIC
Committee's findings and a program to inform the public. FINDINGS
M/S/C: GALLEGOS/ MARTINEZ. There were no objections. APPROVED
City Planner Onaga requested Council approval of a PARTICIPA-
Participation Agreement with the East San Gabriel Valley TION
F Integrated Waste Management Joint Powers Authority to AGREEMENT
prepare a General Plan Air Quality Element. The JPA
received a $150 thousand AB 2766 grant to be used for
the preparation of the Air Quality Elements for each
participating city which would pay only a portion of the
consultant's costs for the preparation of the cities
elements. The balance of the fees would be paid by the
participating cities and Baldwin Park's share is
approximately $20 thousand. The City's share of the
costs can be funded from the City's Air Quality
Improvement fund. The Participation Agreement
represents a formal commitment to further consider the
development of an Air Quality Element. The City will
have the opportunity to review the final costs.
It was moved and seconded to approve the Participation PARTICIPA-
Agreement with the East San Gabriel Valley Integrated TION
Waste Management JPA to prepare a General Plan Air AGREEMENT
Quality Element. M/S/C: MARTINEZ/IZELL. There were no APPROVED
objections.

Mayor Vargas requested the following:
1. A report regarding a STOP sign at Belgate/Stewart.
2. A status report on the olive Street repairs from
the City of Irwindale.
3. The status of the sidewalks and handicap ramps at
Merced/Maine Avenues.
4. Status report regarding the Community Policing.
5. The status of the discussions with Waste Management
regarding options instead of doing two hazardous
waste roundups.

Council at 12:56 a.m. to an adjourned regular meeting ADJOURNED
