The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, IZELL, ROLL CALL KEYSER AND MAYOR LOWES ALSO PRESENT: City Manager Penman, City Attorney Bower, Dir. of Administrative Services Schuld, Police Chief Lanza, Dir. of Human Services Lucas, City Treasurer Montenegro, Deputy City Clerk Branek and City Clerk Gair 00- The absence of Mayor Pro Tern McNeill was excused. ABSENCE EXCUSED Chief of Police Lanza introduced Officers Rudolph OATH OF Hernandez and Herbert Cranton and told of their OFFICE backgrounds and education. City Clerk Gair administered the Oath of Office to the officers. 00- It was moved and seconded to place the Inter-Agency SUBSEQUENT D.U.I. Task Force on the agenda as a Subsequent Need NEED ITEM Item. M/S/C: IZELL/ GALLEGOS. There were no APPROVED objections. FOR AGENDA 00 ORAL COMMUNICATION Mayor Lowes declared Oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come NICATIONS forward. OPEN Hillel Arkin, 4347 Stewart, stated that Marsha Arkin was ARKIN recently appointed as the I.R.S. Publicity Chairman of Los Angeles County, and is available to help the taxpayers. He requested a second hand bookstore in the City and referred to a piece of property that he thought would be appropriate. Marcia Arkin, 4347 Stewart, stated that the library is ARKIN an important learning institution and the Friends of the Library are looking for a site for the second hand bookstore. Gerard Avila, 12769 Torch, stated that the Code AVILA Enforcement Officer had issued a warning to him regarding the cars parked on the yard at his home. He felt the complaint came from Eggleston's, that nothing is done with his complaints about them and that he will contact a lawyer. Pam Schnabel, 14217 Los Angeles, stated that one SCHNABEL homeowner would not sign for the sidewalk program on Los Angeles Street, but with City Staff assistance, the right of way was obtained. REVOCATION Mayor Lowes declared the Public Hearing open on CP-273 PUBLIC and continued to January 15, 1992. HEARING OPENI CONTINUED It was moved and seconded to continue the Public Hearing MOTION TO for the revocation of CP-273 to January 15, 1992. CONTINUE MIS/C: GALLEGOSI IZELL. There were no objections. APPROVED Assistant to the City Manager Volmert presented an PRELIMI- overview of the City's preliminary draft waste NARY DRAFT management plans to allow for additional input and SOURCE comments to be incorporated into the final draft plans REDUCTION prior to their adoption. The Preliminary Drafts have & RECYCL- been available for public review, staff has not received ING any written comments from the public and the Final ELEMENT Drafts will be ready for public review by the end of this year. The draft elements reflect the overall goals that have been previously established. The three documents submitted for review are the initial environmental assessment, the Preliminary Draft Source Reduction and Recycling Element and the Preliminary Draft Household Hazardous Waste Element which also contains various requirements. It was recommended that Council conduct the public hearing and provide direction relating to the preparation of the Final Draft Source Reduction and Recycling Element and the Final Draft Household Hazardous Waste Element. Mayor Lowes declared the Public Hearing open for the PUBLIC Preliminary Draft Source Reduction and Recycling Element HEARING and the Preliminary Draft Household Hazardous Waste OPEN Element and invited those wishing to speak on this subject to come forward. Roth Dryden, 4537 Holly, asked for clarification of the DRYDEN report. There being no other speakers, Mayor Lowes declared the CLOSED Public Hearing closed. Mayor Lowes stated that Council had previously discussed DISCUSSION the goals and priorities of the Preliminary Draft Source Reduction and Recycling Element and the Preliminary Draft Household Hazardous Waste Element and did not see a need to go through them again. The reduction of trash in the landfills is required by the state, which gives no help financially or a way to control growth. It was moved and seconded to direct staff to prepare the PREPARE Final Draft and advertise for the Public Hearing. FINAL M/S/C: IZELL/GALLEGOS. There were no objections. DRAFT APPROVED Administrative Assistant Mimura requested council to COMPREHEN- conduct a public hearing on the approval of the SIVE Comprehensive Housing Affordability strategy CHAS). As HOUSING a condition to receive a Federal grant for the program, AFFORDABI- cities are required to develop and implement the CHAS LITY which replaced the Housing Assistance Plan. The STRATEGY Strategy is to determine the housing needs of the low CHAS) and moderate income persons/families and develop and implement a plan to meet those housing needs. In response to Council questions, Administrative DISCUSSION Assistant Mimura stated that when the city receives the 1990 Census data the plan will be reviewed and amended, all cities were given a deadline of October 31, 1991, and there are no fines if the deadline is not met. It was moved and seconded to approve the Comprehensive CHAS Housing Affordability Strategy CHAS) plan. MIS/C: APPROVED GALLEGOS/IZELL. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES City Manager Penman provided information to the Council BALLOT regarding two possible ballot measures, a special police MEASURES tax and a card club ordinance, for the April, 1992 CARD CLUB municipal general election. The Citizens Finance & SPECIAL Committee recommended placing both of the measures on POLICE the ballot for the April, 1992 election. The cost of ASSESSMENT the election, the time limit for placing a measure on the ballot, the cost to verifying signatures to qualify a measure were outlined. Staff suggested that $850,000 was needed to fund twelve position in the police department and a formula was presented for Council to consider. The City of Inglewood uses a sliding scale on the commercial/industrial front footage formula. Council direction needed regarding the following matters: 1) Placing a card club ordinance on the April, 1992 ballot; 2) Placing a special police tax on the April, 1992 ballot; and 3) Number two will require some direction regarding the method of assessment. If one or both ordinances are placed on the April, 1992 ballot, the City Attorney will need to prepare the necessary ordinances and the City Clerk will prepare the resolutions for the next meeting. Councilman Gallegos stated that he had not and does not DISCUSSION agree with the Card Club, but he will support placing the Card Club Measure on the ballot. The reasons that he will support the measure are because, Councilman Keyser has almost enough signatures to place the Card club Measure on the ballot, it is obvious by the signatures that the people want a voice the decision, and out of respect for his constituent. Councilman Keyser stated the number of signatures collected, the cost to the City for a Special Election and that the citizens have a right to vote on the Card Club. Councilman Izell stated that he will stay with his original vote and not vote for the Card Club. Council discussed the number of multi-family rentals and single family residence, using a simple method for figuring the Police Assessment and the maximum amount needed for the police department. Councilman Izell stated that he felt all of this was circumventing Proposition 13, and the utility tax could be raised or lowered as needed. Council concurred. Mayor Lowes also stated that Council has never had a LOWES tour of the Telacu project.
