PUBLIC HEARING
Mayor Vargas introduced the Public Hearing on SP 93-1, PUBLIC
Approval of a Specific Plan to encompass approximately HEARING
16.5 acres of land to ensure the coordinated development SP 93-1,
of the plan area for commercial purposes. Property DR-S &
Involved: An area bounded by N. Baldwin Park Boulevard CP-515
on the northwest, E. Francisquito Avenue on the
northeast, and the San Bernardino Freeway on the south."
and the Public Hearing on DR-6 & CP-515, Approval of a
Development Plan for a fast food restaurant within the
Sierra Vista Overlay Zone and approval of a Conditional
Use Permit to allow a vehicular drive-thrir in
conjunction with a fast food restaurant pursuant to
Sections 17.29.030 and 17.21.030.H respectively of the
City's Code 3188 Baldwin Park Boulevard).
Associate Planner Nagle explained the request for STAFF
approval of a Specific Plan for a Jack in the Box and REPORT
the necessity for the Specific Plan due to the Freeway
Commercial Zoning. He stated that the master plan of
the triangle allows for a free standing restaurant in a
large development. He outlined the stipulation of the
Specific Plan regarding access easements, parking, the
design of the drive-thru and the landscape buffer. The
Development Plan must also be approved, the plan has
been reviewed and the development meets the requirements
of the Sierra Vista Project Area and the Planning
Commission has recommended it for Council approval.

19, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 93-19
BALDWIN PARK APPROVING THE NEGATIVE DECLARATION OF ADOPTED
ENVIRONMENTAL IMPACT AND A SPECIFIC PLAN ENCOMPASSING
APPROXIMATELY 16.5 ACRES OF LAND TO ENSURE THE COORDINATED DEVELOPMENT OF THE PROPERTY FOR COMMERCIAL
PURPOSES APPLICANT: JACK IN THE BOX; CASE NO. SP 93-1;
LOCATION: 3060-3188 BALDWIN PARK BLVD. EVEN
ADDRESSES), 13616-13766 FRANCISQUITO AVENUE EVEN

There were no objections.
Mayor Vargas introduced the Public Hearing on AZC-129 & PUBLIC
DRO 93-1, Amending Chapter 17.44 of the Municipal Code, HEARING
Landscaping Regulations, including amendments to require AZC-129 &
the review of landscaping and irrigation plans for DRG 93-1
specified development projects, and a Landscape Design
Manual establishing criteria for the review of said
plans. These items have been prepared in response to
the State of California's Water Conservation in
Landscaping Act."
Associate Planner Nagle explained the adoption of the STAFF
State Model Water Efficient Landscaping Ordinance as REPORT
adopted in July of 1992 by the State Department of Water
Resources. The City has not adopted a local water
efficient landscape ordinance and is therefore legally
obligated to use the State's model ordinance. The City
ordinance will have a lower level of expectancy in
promoting water conservation and is designed to more
specifically address the needs of the city. The design
manual has been written to exclude review of homeowner
provided landscaping in single family and multiple
family residential projects.

REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES
Chief of Police Lanza explained the need for protective SOLICIT
glass for the front lobby in the police department. BIDS
This project now satisfies the requirements of the FRONT
Americans with Disabilities Act and has been reviewed LOBBY
and approved by the City's Building Official. Council GLASS
was requested to approve solicitation of formal bids for POLICE
this project which will be funded through Asset Seizure
Funds.
Councilman Martinez expressed his concern regarding the DISCUSSION
time between approval of this project 1991) and the
actual implementation of the project. He felt that when
the safety of the employees is at risk a project should
be pursued, especially when the liability to the City is
so great. He requested that contracts be enforced and
followed through on.
In response to Councilman Martinez, Chief Lanza stated
that the actual cost was not known at this time. The
department is hoping for a good figure.
It was moved and seconded to approve the solicitation of SOLICIT
formal bids for the Police Department lobby glass BIDS
partition. M/S/C: MARTINEZ/MCNEILL. There were no APPROVED
objections.
Acting Building Official Cosgrove requested that Council UNIFORM
adopt by reference the 1991 editions of the Uniform BUILDING
Housing Code and Uniform Solar Energy Code. The City CODE
utilizes these codes to maintain regulations.
It was moved and seconded that Ordinance No. 1063, AN ORDINANCE
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 1063
PARK, CALIFORNIA, ADOPTING BY REFERENCE THE 1991 INTRODUCED
EDITIONS OF THE UNIFORM HOUSING CODE AND UNIFORM SOLAR FIRST
CODE, AND DELETING CERTAIN PROVISIONS OF THE CITY;S READING)
MUNICIPAL CODE WHICH PREVIOUSLY ADOPTED A UNIFORM SIGN
CODE," be introduced for first reading, be read in title
only and that all further reading be waived. MIS/C:

City Clerk Gair, as Parade Chairman for the Annual ANNUAL
Parade requested that Council approve a change of date PARADE
for the parade from January to November. She outlined DATE
the request included in the packet from Danny Wagner, CHANGE
Visual and Performing Arts Director for Baldwin Park
School District, and stated that all parties involved
are in agreement with the change of date. This will
incorporate the Annual Parade, BEBOP and the Sierra
Vista High School Field Tournament as one event.
It was moved and seconded to change the date of Annual DATE
Parade from January to the first weekend in November to CHANGE
coincide with the Sierra Vista High School Field APPROVED
Tournament and BEBOP. M/S/C: MCNEILL/MARTINEZ. There
were no objections.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilwoman McNeill expressed her concern that the POLICY FOR
policy is not being followed in the way items are placed COUNCIL
on the agenda from the Council/Staff Requests and REQUESTS
Communications" portion of the agenda. She asked the DISCUSSION
City Clerk to read the policy that was established in
the past from the minutes of February 21, 1990. She
requested that items brought up in Council Requests" be
voted on for placement on a later agenda. She felt that
things were piling up on staff by the many requests or
directions that were being given by Councilmembers. She
stated that her main concern was that the Council should

follow the policy regarding the items brought up and the
requests made of staff by Councilmembers.
Councilman Martinez and Mayor Vargas disagreed that
directions were being given to the staff and that a vote
needs to be taken regarding Council requests of staff.
They felt that this has been done for ten months and if
there is an objection to any Council request it should
be made at the time the request is made and the request
can be withdrawn. They stated that the requests by
Council are made openly so that the public is aware and
matters may be taken care of promptly and there is an
exchange of information between Council and Staff.
Mayor Vargas commented on the meeting the City had with VARGAS
Senator Feinstein and how this allowed the City to
present the needs of the community to her. In regard to
President Clinton's speech on the budget, he requested
that the City Manager get the specifics of his program
and prepare a report on the effect the President's
program will have on the City.
Councilman Martinez thanked Public Works Director MARTINEZ
Mousavi for the report on the Commuter Rail Station. He
expressed concern regarding the budget on this project
and asked that the Council be warned regarding costs.
City Manager Penman stated that a Team Building Retreat PENMAN
for Council and Department Heads will be held on Friday
and Saturday, February 26 & 27, 1993, at 8:30 a.m. at
the Holiday Inn in Monrovia. The adjourned meeting of
Tuesday, February 23, 1993, will be adjourned to the
Team Building meetings.
