The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, IZELL, ROLL CALL MARTINEZ, MCNEILL AND MAYOR VARGAS ALSO PRESENT: Acting City Manager Lanza, City Attorney Bower, Dir. of Administrative Services Yeats, Dir. of Human Services Nunez, and City Clerk Gair The absence of City Treasurer Montenegro was excused. ABSENCE EXCUSED 00- Police Chief Lanza gave a brief biography of the career TWENTY- of Sergeant Ralph Orantes and Mayor Vargas presented FIVE YEAR Sergeant Orantes with a twenty-five year pin for his PIN service to the City. Mayor Vargas presented Awards of Merit to Outgoing Human AWARDS OF Services Commissioners Betty Wallace and Dorothy Harper. MERIT An Award of Merit was also prepared for outgoing Planning Commissioner Raul Reyes who could not be present. Mayor Vargas also presented Awards of Merit to Ching Lim, Ginette flondeau and Papo de Asis for their work in the Uniting Youth Through the Arts" project. 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come UNICATION forward. Approve Purchase of Vehicles Police Department At the request of Mayor Vargas Item No. 8 was removed ITEMS NO. from the Consent Calendar and at the request of 8 & 11 Councilwoman McNeill Item No. 11 was also removed from REMOVED the Consent Calendar. It was moved and seconded to approve Items No. 1-7 and CONSENT 9-10 of Consent Calendar A. M/S/C: GALLEGOS/MARTINEZ. CALENDAR A There were no objections. APPROVED Mayor Vargas expressed his concern that only one bid had ITEM NO. 8 been received for Item No. 8. He requested a staff report, in the status report, on the steps that were taken in seeking bids for janitorial supplies. In response to Councilwoman McNeill's inquiry regarding ITEM NO. Item No. 11, Maintenance Superintendent Dart explained 11 that the lowest available bid is received through the process that the City is using. He stated that the cost savings is approximately $45,000 on these 11 vehicles at the 1990 prices that were received. It was moved and seconded to approve Items No. 6 & 11 of ITEMS NO. Consent Calendar A. M/S/C: VARGAS/MCNEILL. There were 8 & 11 no objections. APPROVED City Clerk Gair presented Consent Calendar B: CONSENT CALENDAR B 1. CONSENT M/S/C: GALLEGOS/IZELL. Councilman Martinez abstained. City Planner Onaga stated that major changes are being proposed for development standards and guidelines. There had been no design review guidelines prior to 1989 in the City and developers built what was attractive to developers. Design review guidelines allow the City to increase the best and prevent the worst. He outlined the amendments to the zoning code, the design review guidelines and the procedure to be established for administrative adjustment with staff approving minor deviations rather than City Council. He also stated that the Design Review Guidelines are meant to be flexible and a creative solution to design problems. They will help create quality developments citywide. These regulations are compatible with long range plans and the need for higher quality developments. The Planning Commission voted to recommend approval by the City Council. Mayor Vargas declared the Public Hearing open on AZC-132 PUBLIC and DRG-93-2 and invited those wishing to speak on this HEARING subject to come forward. OPEN Larry Speight, developer, spoke regarding the letter he SPEIGHT had presented to the Planning Commission and no response being made to it. He felt this ordinance was over- regulating and in the present economy the market is not right for some of the requirements. Also, he stated that some of the neighborhoods do not support better development. There being no other speakers, Mayor Vargas declared the CLOSED Public Hearing closed. Council commented regarding developers building a good DISCUSSION product so that it is marketable, not generalizing on what is acceptable to be built in the City, the increasing of density placing demands on services, and the increased cost of housing through regulations forbids young families from being able to afford a home. Councilman Gallegos requested that staff review Mr. DIRECTION Speight's letter and give written answers to the letter and forward a copy of the response to the Council in the status report. He felt that Mr. Speight deserves an answer and the issue needs to be cleared up. Council concurred. It was moved and seconded that Ordinance No. 1071, AN ORDINANCE ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 1071 PARK AMENDING CHAPTERS 17.04, 17.10, 17.32, 17.50, INTRODUCED 17.52, AND 17.56 OF THE BALDWIN PARK MUNICIPAL CODE FIRST CASE NO AZC-132)," be introduced for first reading, be READING) read in title only, and all further reading be waived. M/S/C: MARTINEZ/MCNEILL. There were no objections. DRG-93-2)." N/S/C: MCNEILL/GALLEGOS. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Assistant to the City Manager Volmert explained the PACE ENT. Waste Transformation Proposal from Pace Enterprises, SOLID Inc. and the exclusive right to negotiate for the WASTE transformation and transportation of municipal solid NEGOTIA- waste from the City to an off-shore transformation TIONS facility. This agreement commits the City to owning and controlling a transfer station. Waste would still be collected by Waste Management, transferred to a transfer facility and transported to the Port of Los Angeles. She outlined concerns regarding the proposals, the added cost to the City and liability. Staff recommended rejection of the exclusive right to negotiate. It was moved and seconded to reject the Exclusive Right REJECT to Negotiate Agreement with Pace Enterprises and NEGOTIA- communicate to them the concerns contained in the Staff TIONS report of July 21, 1993. N/S/C: MCNEILL/MARTINEZ. APPROVED There were no objections. 00- COUNCIL/STAFF REQUEST AND COMMUNICATIONS Councilman Martinez requested: 1) Consideration of a REQUESTS pay phone at the Metrolink Station; 2) Public Works to consider hiring, in the scope of the existing budget, a part-time maintenance person to oversee court assigned workers for cleanup report requested); 3) A report regarding the GTA sticker program used by Glendora; 4) A report regarding a voluntary work furlough program for employees with no vacation time left to be allowed, in slow time, to take time off without pay. Mayor Vargas requested that the City take the lead in organizing community events and volunteer participation by using staff as an outreach to the community. Councilwoman McNeill requested that the microphones be inspected prior to council meetings to make certain they are working. City Clerk Gair requested that tonight's meeting be adjourned in memory of Frieda Richardson, Covina Councilwoman and former City Clerk of Covina for 26 years, who died on July 20th. 00- The regular meeting of the City Council was recessed at RECESSED 8:12 p.m. 8:12 P.M.
