The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS£ IZELL, ROLL CALL MARTINEZ, MCNEILL AND MAYOR VARGAS ALSO PRESENT: City Manager Penman, City Attorney Bower, Dir. of Administrative Services Yeats, Chief of Police Lanza, Dir. of Public Works Mousavi, Dir. of Human Services Nunez, City Treasurer Montenegro, Deputy City Clerk Branek, and City Clerk Gair 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communications open and ORAL COMMU invited those wishing to speak on any subject to come NICATION 77 forward. Waive Further Reading and Adopt RESOLUTION NO. 93-86 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK SOUTHERN CALIFORNIA EDISON) It was moved and seconded to approve Consent Calendar B CONSENT as presented. Councilman CALENDAR B Martinez abstained due to a possible conflict of APPROVED interest. 00- PUBLIC HEARING Mayor Vargas introduced the Public Hearing on, Approval PUBLIC of an amendment to the Zoning Code which adds Chapter HEARING 17.37, establishing standards applicable to businesses INTRODUCED engaged in the sale of alcoholic beverages." City Planner Onaga stated that the addition of Chapter AZC-131 17.37 to the Zoning Code, would regulate the issuance of ALCOHOLIC conditional use permits for the sale of alcoholic BEVERAGES beverages. Alcoholic sales outlets were divided into two categories for the purpose of establishing development standards. Included in the Chapter are additional findings-of-fact to all alcohol sales outlets that entail a property maintenance plan, sufficient buffering to the residential areas, and a review of all conditional use permit proposals by the Police Department. It was recommended that the ordinance pertaining to AZC-131 be approved. Mayor Vargas declared the Public Hearing open and PUBLIC invited those wishing to speak to come forward. There HEARING were none. OPEN Mayor Vargas declared the Public Hearing closed. CLOSED In response to Council, City Planner Onaga stated that DISCUSSION all alcoholic beverage sales outlets would need to comply with a conditional use permit by year 2000. The establishments that are operating without a conditional use permit are considered a nonconforming use. There are currently 77 establishments operating in the City and that each conditional use proposal will be handled independently. Councilman Martinez requested staff to prepare a report DIRECTION with suggested incentives to be offered to the owners of establishments that need to comply with a conditional use permit. Council concurred. It was moved and seconded that Ordinance No. 1072, AN ORDINANCE ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 1072 PARK ADDING CHAPTER 17.37 TO THE CITY CODE, IMPOSING INTRODUCED REQUIREMENTS FOR CONDITIONAL USE PERMITS FOR FIRST ESTABLISHMENTS ENGAGED IN THE SALE OF ALCOHOLIC READING) BEVERAGES," be introduced for first reading, that the ordinance be read in title only, and that all further reading be waived. Staff DR. EDWARD developed the documents and negotiated the terms and HERNANDEZ conditions necessary to terminate the lease with the INCUBATOR Southern California College of Optometry. A summary of BUILDING terms and conditions as presented in the staff report was explained pertaining to the new lease. Several issues need to be resolved prior to the Lessee purchasing one half of the building. Staff recommended approval of the Termination Agreement with the Southern California College of Optometry, and the new Lease Agreement with Dr. Hernandez retroactive to August 1, 1993. City Attorney Bower stated that the current lease calls DISCUSSION for the sale to Dr. Hernandez of the entire building and if Council desires to split the building, the agreement would need to be redrafted. It was moved and seconded to direct staff to make all LEASE the changes and authorize the City Manager to sign the APPROVED agreement. M/S/C: VARGAS/IZELL. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilwoman McNeill told of the concerns of Little MCNEILL Leagues from other cities pertaining to the conditions of the playing fields within the City. Councilwoman McNeill requested that staff look into ways of helping the little leagues. Council concurred. In response to Mayor Vargas, Chief of Police Lanza LANZA stated that the crime report would be out soon. Mayor Vargas spoke regarding Funding Your Dream" VARGAS project and requested staff to look into the LDC and other monies to put together a program to help young people develop entrepreneural skills. Council concurred. Mayor pro tem Gallegos requested that Agency signs be GALLEGOS posted at the construction sites of redevelopment projects. Council concurred. Councilman Martinez requested a status report pertaining MARTINEZ to the employees that have not taken any time off during the year and possibly recognizing them in some way. 00- The regular meeting of the City Council was recessed RECESSED 7:34 p.m. 7:34 P.M.
