ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and ORAL COMMU
invited those wishing to speak on any subject to come NICATIONS

Maryanne Huetinck, 13059 Amar Rd., invited Council and HUETINCK
Staff to the Community Center for a spaghetti dinner on
Saturday, from 5 p.m. to 8:00 p.m. The event is
sponsored by the Baldwin Park Woman's Club.
Anna Posiado, 3847 1/2 Stewart, ASB Sierra Vista High POSIADO
School, reported the school's activities during the
month of October.
Arturo Cordova, 5122 Winner, stated that he had spoken CORDOVA
with Sgt. Lopez regarding filing a complaint against
Officer Jaspar. He told of an incident on October 29th
involving his son, his son's friend and Officer Jaspar.
He requested the opportunity to discuss the problem with
the police department.
Roy Test, 15115 Kenoak, stated that he had driven on TEST
Ramona and the street does need renovating. He asked if
bordering cities would pay a portion of the renovation.
William Van Cleave, 13232 Emery, inquired about the lack VAN CLEAVE
of police bicycle patrol in the downtown area. He
asked, with the holidays approaching, that the bicycle
patrol be used more. He told of a recent theft that
could have been deterred by the presence of the bicycle
patrol.

It was moved and seconded to approve Consent Calendar B CONSENT
as presented. N/S/C: GALLEGOS/MCNEILL. Councilman CALENDAR B
Martinez abstained due to a possible conflict of APPROVED
interest.

PUBLIC HEARING
Mayor Vargas introduced the Public Hearing pertaining to PUBLIC
An appeal to the City Council relating to the Planning HEARING
Commissions decision pertaining to a condition in the INTRODUCED
conditional use permit CP-518): f) That Monday
through Sunday the establishment's hours of operation
shall be between the hours of 10:00 a.m. and 9:00
p.m.," Appelant: Andy Shahinian and Frank Foroogi,
14510-B Baldwin Park Town Center, Case No. CP-518."
city Planner Onaga described the location of the game CP-518
arcade and the number of games that would be located in
the arcade. The Police Department requested that the
establishment close no later than 9:00 p.m. daily, and
that the Planning Commission review the conditional use
permit in one year. Staff recommended that Council
uphold the Planning Commission's decision to deny the
appeal by adopting the findings of fact and approve CP-
516 subject to conditions listed in the staff report.
Mayor Vargas declared the Public Hearing open and PUBLIC
invited those wishing to speak on this subject to come HEARING
forward. OPEN
George Grasso, 1920 Main, Irvine, representative of GRASSO
Baldwin Park Town Center, stated that the building that
the arcade would occupy had never been rented. Mr.
Shahinian and Forooghi own two arcades in Glendale and
one in Downey and according to the Glendale Police and
the Downey Police, there have not been any problems at
the arcades. The owners would be very conscious of the
curfew hours and would not allow anyone under 16 years
old on the premises after 10:00 p.m.
William Van Cleave, 13232 Emery, spoke about the curfew, VAN CLEAVE
and the need for new businesses. He preferred that young
people be at home by 10:00 p.m.
Council discussed the police department's concern with DISCUSSION
the arcade being open the extended hours, and that they
did not want to discourage business. They felt that the
business would encourage young people to play games
rather than study.
Councilwoman McNeill moved to allow the arcade to MOTION
operate from 10:00 a.m. to 9:00 p.m. for people up to DIES
18 years old and 10:00 a.m. to 11:00 p.m. for adults,
with the following conditions: 1) hire additional
security officers; and 2) no teenagers allowed after
9:00 p.m. Motion died due to the lack of a second.
It was moved and seconded to adopt Resolution No. 93- RESOLUTION
117, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 93-117
BALDWIN PARK DENYING A REQUEST TO ALTER CONDITION F' OF ADOPTED
RESOLUTION NO. PC 93-16, ALLOWING A GAME ARCADE WITHIN
THE GENERAL COMMERCIAL ZONE CO-APPLICANT: ANDY SHAHINIAN
AND FRANK FOROOGHI; LOCATION: 14510-B BALDWIN PARK
TOWNE CENTER DRIVE; CASE NO: CP-518)." N/S/C:

to the Agency. The Agency is currently working to
develop the Baldwin Park/Francisquito Triangle. Two
property owners in the project have offered to sell
their property and the offers are acceptable. The loan
would be paid back in one year at the time of the
refinancing of the Sierra Vista Redevelopment Project
Area Bonds. Staff recommended that Council approve the
loan of $320,000 to the Agency and the Agency Board
approve acceptance of the loan from the City.
It was moved and seconded to adopt Resolution No. 93- RESOLUTION
118, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NO. 93-118
BALDWIN PARK, CALIFORNIA, APPROVING A FINANCING
AGREEMENT BETWEEN THE CITY OF BALDWIN PARK AND THE
BALDWIN PARK REDEVELOPMENT AGENCY" and approve the loan
of $320,000 to the Agency. N/S/C: GALLEGOS/MARTINEZ.
There were no objections.
Police Captain Kies requested Council approval of a PARKING
resolution adjusting penalties for parking citations, CITATIONS
and to adopt an ordinance to amend Section 1.20.010 of
the Baldwin Park Municipal Code. California Assembly
Bill 408 decriminalized parking citations and removed
their processing from the responsibility of the courts.
The governing body of the agency that processes parking
citations must implement a system of administrative
adjudication by January 1, 1994. Adjustments needed to
be made to the Municipal Code to standardize the parking
violation penalties and a new section 1.20.010 g)
needed to be added that would make previous infractions
now a civil penalty. Staff recommended to: 1) Approve
the ordinance which amends Section 1.20.010 f) of the
Municipal Code; and 2) Approve the resolution with the
proposed civil penalty schedule for parking violations.
It was moved and seconded that Ordinance No. 1075, AN ORDINANCE
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN NO. 1075
PARK AMENDING THE CITY'S REGULATIONS RELATING TO INTRODUCED
VIOLATIONS MISDEMEANORS, INFRACTIONS, AND CIVIL
PENALTIES," be introduced for first reading, be read in
title only and all further reading be waived. N/S/C:
MARTINEZ/GALLEGOS. There were no objections.
It was moved and seconded to adopt Resolution No. 93- RESOLUTION
119, A RESOLUTION OF THE CITY OF BALDWIN PARK ADOPTING NO. 93-119
CIVIL PENALTIES FOR PARKING VIOLATIONS. N/S/C: ADOPTED
MARTINEZ/MCNEILL. There were no objections.
Director of Public Works Mousavi requested that Council PUBLIC
hold a public meeting regarding Ohio Street/Kenmore MEETING
Avenue Sanitary Sewer Assessment District. Council had OHIO/
approved the Engineer's Report and set the time and KENMORE
place for a public meeting for November 3, 1993 and a SEWER
public hearing for November 17th. The intent of the ASSESS-
public meeting is to allow property owners to address MENT
their comments or concerns to Council regarding the DISTRICT
proposed improvements and Assessment District and to
incorporate public comments into the project file.
Mayor Vargas declared the public meeting open and PUBLIC
invited those wishing to speak to come forward. There MEETING
were none. OPEN

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Mayor pro tern Gallegos requested that Director of Human GALLEGOS
Services Nunez prepare the applications and paper work
for two high school seniors to attend the 2nd Annual
Seminar Youth Symposium at Dominguez Hills. Council
agreed by unanimous consent.
Councilman Martinez wished Mayor pro tern Gallegos a MARTINEZ
Happy Birthday."
Councilwoman McNeill requested that the Council meeting MCNEILL
be adjourned in memory of Pam Schnabel. Council agreed
by unanimous consent.
Mayor Vargas told about the workshop with Council and VARGAS
Department Heads. He stated that the Executive
Committee is doing a good job.
