HomeMy WebLinkAbout1994 04 06 CC MIN1994 04 06 CC MINòw @˜zCC MIN APR 6 1994[Þ›[H»8 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CITY HALL, 14403 EAST PACIFIC AVENUE, WEDNESDAY, APRIL 6, 1994 The City Council of the City of Baldwin Park in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, MARTINEZ MCNEILL, MUSE, MAYOR VARGAS ALSO PRESENT: Acting City Attorney Munoz, Chief of Police Lanza, Dir. of Administrative Services Yeats, Dir. of Community Development Carbajal, Dir. of Human Services Nunez, Dir. of Public Works Mousavi, City Treasurer Montenegro, Deputy City Clerk Branek, and City Clerk Gair 00- ORAL COMMUNICATIONS Mayor Vargas declared Oral Communications open and invited those wishing to speak on any subject to come forward. Raquel Morales, 3518 San Gabriel Valley Parkway, stated that Mayor Vargas had spoken with the students at Sierra Vista High School and that she disagreed with a statement that he had made and she would not be supporting him in the election. Larry Walton, 3802 Big Dalton, thanked City Clerk Gair for the Meet the Candidate Forum" for the mock election at Santa Fe School. He referred to an incident at the public forum for the candidates and stated the importance of the youth in the community. Robert Van Cleave, 4299 Maine, stated that all the businesses in the City are required to have a business license and inquired why the numerous street vendors are allowed to operate in the City without a license. Roy Test, 15115 Kenoak, stated that the senior lap time at the pool is interrupted by the exercise class and suggested that the times be changed. He also stated that the only ones that pay attention to the one-way street signs at the park are the senior citizens. There being no other speakers, Mayor Vargas declared Oral Communications closed. 00- PRE SENT ZONS Chief Lanza introduced Captain John Cisneros and told of his background and training. Mayor Vargas presented Captain Cisneros with a 30 Year Employee Pin. Council congratulated Captain Cisneros on his dedication and service. Mayor Vargas read a proclamation declaring April 4 10, 1994 as Public Health Week." Waive Further Reading and Adopt RESOLUTION NO.94-28 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK RELATING TO SOUTHERN CALIFORNIA EDISON) It was moved and seconded to approve Consent Calendar B as presented. MIS/C: GALLEGOS/MUSE. Councilman Martinez abstained due to a possible conflict of interest. Director of Public Works Mousavi stated that In-N-Out Burger is the only property with frontage along Virginia Avenue from Dalewood to the westerly bend of the street and that the name change will not impact any other businesses within the area. It was recommended that Council waive any application fees and adopt the resolution for changing the street name. Mayor Vargas declared the Public Hearing open and invited those wishing to speak to come forward. There were none. Mayor Vargas declared the Public Hearing Closed It was moved and seconded to waive the application fees and adopt Resolution No. 94-32, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CHANGING THE STREET NAME OF A PORTION OF VIRGINIA STREET TO HAMBURGER LANE." MIS/C: GALLEGOS/MCNEILL. There were no objections. Mayor Vargas Introduced the Public Hearing pertaining to the COMMUNITY DEVELOPMENT BLOCK GRANT CDBG) 20th YEAR ENTITLEMENT PROGRAM" and stated that the public hearing would be continued to the April 2Oth Council meeting. Mayor Vargas Introduced the Public Hearing that REQUESTED COUNCIL'S CONSIDERATION OF A CHANGE OF ZONE, A DEVELOPMENT PLAN, AND A TENTATIVE TRACT MAP NO.51572 FOR THE PROPERTY LOCATED AT 3567-3609 BIG DALTON AVENUE." City Planner Onaga stated that the applicant had requested a zone change from R- 1, Single Family Residential to R-1(PD), Single Family Residential Planned Development Overlay Zone, and a Development Plan to construct ten 10) single family residences. Two of the existing homes will be remodeled and relocated on the property. Re described the open space planned for each home, the access of the private street to Big Dalton, and the approximate square feet of each residence. Staff and the Planning Commission recommended that Council: 1) Adopt the Findings of Fact; and 2) Approve the Negative Declaration of Environmental Impact; and 3) Approve a zone change from R-1 to R-l(PD); and 4) Approval of the Development Plan and Tentative Tract Map with the conditions listed in the staff report. Mayor Vargas declared the public hearing open and invited those wishing to speak on Z-506 to come forward. Roger Dill, 3621 Big Dalton, stated that the properties have been zoned R- 1, that the property owners want the area to remain R- 1, the problem of traffic during rush hour from Big Dalton to Pacific, and that with the development, 22 more cars would be placed on the roadway. Ricardo Louken, 3615 Big Dalton, stated that he also owns 3619 Big Dalton. Re voiced his concerns for the investment in his properties, if there would be ample parking for the visitors to the development, and the crowding of ten 10) homes on property that originally contained only three 3) homes. Bradley Nutt, 4230 Bresee, stated his concern over the high density in the City and inquired about the benefits to the City from high density project. Jim Nottingham, developer and builder of the project, stated the length of time he has been in business, and that he was available for any questions pertaining to the project. There being no other speakers, Mayor Vargas declared the Public Hearing closed. It was moved and seconded that Ordinance No.1077, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-1, TO R-1(PD)) ON APPROXIMATELY 1.45 ACRES APPLICANT: NOTTINGHAM LTD.; CASE NO: Z-506; LOCATION: 3567-3609 BIG DALTON AVENUE)," be introduced for first reading, he read in title only and all further reading be waived. MIS/C: MCNEILL/GALLEGOS. There were no objections. It was moved and seconded to adopt Resolution No.94-33, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN AND A TENTATIVE TRACT MAP APPLICANT: NOTTINGHAM LTD.; CASE NO: Z-506 AND TM-51572; LOCATION: 3567-3609 BIG DALTON AVENUE)." MIS/C: GALLEGOS/MARTINEZ. There were no objections. 4)0- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS City Clerk Gair reminded Council that election day would be April 12th, that the counting center will be in the Council Chambers, that the Absentee Ballots will be counted at 8:30 p.m. that evening, and that the final count should be completed at approximately 10:00 p.m. Mayor and Council will be seated on April 19th at 7:00 p.m. The appointment of Mayor pro tern and the committee assignments will be on April 2Oth. 00- The regular meeting of the City Council recessed at 7:46 p.m. The regular meeting of the City Council reconvened at 7:47 p.m. Roll call remained the same. 00- CLOSED SESSION The regular meeting of the City Council adjourned at 7:47 p.m. to a Closed Session to consider 1) Conference with labor negotiator, pursuant to Government Code 54956.6, Agency negotiator, Yeats & Cole, Employee Organization: Police Lieutenants; and 2) Conference with Legal Counsel anticipated litigation, pursuant to Government Code 54956.9(b))(1), significant exposure to litigation: one case. The regular meeting of the City Council reconvened at 8:20 p.m. Roll call remained the same.
