Mayor Var gas explained that after the posting of' the agenda a need has arisen to consider
an item.
It was moved and seconded to place the Application to the County of Los Angeles for the
purpose of obtaining a Tree Planting Grant in the amount of $212, 588 on the agenda as
a Subsequent Need Item, under Reports of Officers, Commissions and Committees, No.
II.D.1 M/S/C: GALLEGOS/MARTINEZ. There were no objections.

ORAL COMMUNICATIONS
Mayor Vargas declared Oral Communications open and invited those wishing to speak on
any subject to come forward.
Alfonso Contreras, 3110 Baldwin Park Blvd., stated his opposition to the police helicopter
program because it is expensive. The program money could he used to purchase
computers for police cars. He felt the helicopter would be noisy.
Chiniga Chitaphan, 4118 Baldwin Park. Blvd., stated that she will he going to UC Berkeley
in the fall and thanked Mayor pro tern Gallegos, Councilwoman Muse and Mr. Nunez for
their help.

PUBLIC HEARINGS
Mayor Vargas Introduced the Public Hearing pertaining to Approval to Modify the
Current Swimming Pool Fee Structure to Include Adopting a Non-Resident Fee for All Pool
Activities and Decreasing the Engineering Fees pertaining to Utility Cuts and Increasing
Fees for Material Purchase and Monument Inspection."
Director of Human Services Nunez stated that currently the pool fees are 25 cents for
children, 50 cents for adults and no charge for senior citizens. The current pool fees have
increased the number of participants utilizing the pool including non-residents. The non-
residents pay no more than residents do. Staff proposed adjusting the resident fees by 50
cents with senior citizens remaining free and requesting non-residents to pay $1.00 for
children, $1.50 for adults and 50 cents for senior citizens. Staff recommended that Council
approve the modification of the swimming pool fees and adopt a non-resident fee for pool
activities.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on this
subject to come forward.
Roy Test, 15115 Kenoak, stated that he hoped Council would consider staff's
recommendation for the pool fees and he told of the increase in participants utilizing the
pool.

There being no other speakers Mayor Vargas declared the Public Hearing closed
In response to Councilman Martinez, Director of Human Services Nunez stated that the
pool fees are below other cities, that the non-resident has been paying the same as the
resident, and a non-residential card could be developed to distinguish between the resident
and non-resident.
Council discussed the cost of operating the pool, not placing the burden of the pool on the
residents of the City, not wanting to see low income children prevented from swimming
because of a rate increase, and not having a price increase brought back to Council next
year.
It was moved and seconded to approve the modification of the swimming pool fees for the
non-residents to $1.00 for children, $1.50 for adults and 50 cents for senior citizens and to
leave the fees for residents at the January 1993 schedule of 25 cents for children, 50 for
adults and free for the senior citizens. MIS/C: VARGAS/MARTINEZ. There were no
objections.
Director of Public Works Mousavi requested that the utility cuts he reduced by $2.00, that
the Plain Mylar be increased $1.50 each and that $425 he charged for monument inspection,
$425 each Parcel Map and $800 each Tract Map.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on this
subject to come forward. There were none.

Councilman Martinez requested that in the future, the fee increases be more specific on
the agenda.
It was moved and seconded to adopt Resolution No. 94-36, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO.
93-6 AND RESOLUTION NO. 93-7 SETTING FEES AND CHARGES FOR ISSUANCE,
PROCESSING AND FILING OF VARIOUS SERVICES AND PERMITS RELATED TO
HUMAN SERVICES, AND PUBLIC WORKS SERVICES adjusting only the non-resident
pool fees and the engineering fees. M/S/C: GALLEGOS/MUSE. Councilman Martinez
abstained due to a possible conflict of interest.
Mayor Vargas Introduced the Public Hearing pertaining to A request to Consider the
Amendment to Chapter 17.08 of the Municipal Code, General Regulations Residential
Zones, including changes establishing conditions and limitations on the repair of motor
vehicles in the residential zone, and regulation applicable to the storage of boats, trailers,
camper shells, and recreational vehicles in a residential zone.'
Building Official Cosgrove stated that the amendment of Chapter 17.08 of the Municipal
Code would eliminate motor vehicle repairs for profit in the residential zone, disabled
vehicles stored on jacks in driveways, and the storage of boats, trailers and recreational
vehicles from front yard area. It was recommended that Council approve the ordinance.

City Attorney Bowers stated that a revised ordinance was presented but that two
typographical errors need to be changed: 1) Page 2, Definition i) should read, Any repair
which is not defined as a minor repair"; 2) Delete Definitions A.1. Motor Vehicles,
renumber all the definitions and where the definition of Vehicle" include Vehicle or Motor
Vehicle."
In response to Councilwoman Lowes, Director of Community Development Carbajal and
Building Official Cosgrove stated that the code changes are necessary and needed to be
more defined for the prosecution of cases in court. Also, if the change of code places a
hardship on property owners, residential loan programs are available. The City has a
number of residents repairing vehicles in the residential zone that is blighting the areas and
that the changes in the code would respond to cleaning up the City, responding to
complaints, and that the enforcement would he low in priority.
Mayor Vargas stated that the citizens of Baldwin Park expect to live in clean homes free
of blight, that blight is not acceptable in other communities and should not he acceptable
in Baldwin Park, and that nothing prevents the recreational vehicle owner from placing
their equipment in the backyard.
It was moved and seconded to introduce Ordinance No.1078, AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING
CHAFER 17.08 OF THE MUNICIPAL CODE REGARDING GENERAL
REGULATIONS FOR RESIDENTIAL ZONES.' M'S: MARTINEZ/MUSE. Opposed by
Councilmember owes.
City Attorney Bower stated that since the vote was not unanimous, the first motion before
Council will he to approve the Ordinance to be read in title only.
It was moved and seconded that Ordinance No.1078 he read in title only M/S/C:
MARTINEZ/GALLEGOS. There were no objections.
The second action will he to introduce the Ordinance and waive all further reading.
It was moved and seconded to Introduce Ordinance No.1078, AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING
CHAPTER 17.08 OF THE MUNICIPAL CODE REGARDING GENERAL
REGULATIONS FOR RESIDENTIAL ZONES,' be introduced for first reading and all
further readings be waived. M/S/C: MARTINEZ/GALLEGOS. There were no objections.
Mayor Vargas Introduced the Public Hearing pertaining to A Request to Consider the
Amendment of Chapter 17.40 of the Municipal Code, Animal Regulations, Amending
Regulations Pertaining to the Maintenance of Fowl Within the R-1, Single Family
Residential Zone."
Building Official Cosgrove stated that the code amendment would be to Section 17.40.020,
Subsection D, I & 2. The Planning Commission has reviewed the amendment and
recommended it to Council for approvaL It was recommended that Council approve the
ordinance pertaining to maintenance of fowl.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on
AZC-134 to come forward.
Sandi Lucas, 4442 Bresee, asked what this meant. She also stated that she did not think
any roosters were allowed on R-1 property.

Councilwoman Lowes requested the existing code be placed in the agenda with the changes
clearly marked that staff recommends. She also stated that a change in the code was not needed
since everything in the code will handle the situation.
Director of Community Development Carbajal stated that Animal Control needed the code more
defined due to any future litigation.

17.40 OF THE MUNICIPAL CODE REGARDING ANIMAL REGULZONS FOR

Mayor Vargas introduced the Public Hearing pertaining to the 1994 Citywide Speed Zone
Survey and adoption of the ordinance establisbing speed zones on certain streets.
Director of Public Works Mousavi recommended approval of the prepared speed zones.
It was moved and seconded to adopt Ordinance No.1080, AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 10.56.010 OF
THE BALDWIN PARK MUNICIPAL CODE RELATING TO SPEED LIMITS ON
CERTAIN STREETS," be introduced for first reading, be read in title only and all further
reading be waived. MIS/C. GALZGOS/MAR'IINEZ. There were no objections.
Mayor Vargas introduced the Public Hearing pertaining to the Community Development
Block Grant CDBG) 20th Year Entitlement Program.
Director of Community Development Carbajal requested that Council conduct the public hearrng
to determine the needs of the low and moderate income persons and/or slum and blighted areas
of the City of Baldwin Park for the CDBG 20th Year Entitlement Prograrn. The CDBG
Advisory Committee has conducted two CommunityZNeighborhood meetings and as a result
submitted their recommendations in the staff report. Two additional proposals were received
after the Committee's recommendation which were: 1) $100,000 from the Queen of the Valley
for low cost medical care; and 2) $25,000 from the Hope in Youth organzzation.
Mayor Vargas declared the Public Hearing open and invited those wislling to speak on the
Community Development Block Grant CDBG), 2Oth Year Entitlement Program to come forward.
Kay Rich, 14855 Pacific Ave, Program Manager for Lutheran Social Services, thanked Council
for the flinds that have been given in the past. She told of the number of people helped with
shelter, food, and clothing. Telephone calls and letters are written for those that need assistance
with SSI or food starnps. Training is provided for families that want to find permanent shelter,
teaching them to manage their money, pay their bills and provide for their families.
Mr. Fitzgerald, 4655 Willowbrook, Los Angeles, Director of Hope in Youth, stated that the
organization is a prevention program for at fisk youth and their families, and it has a farnily
outreach program. Currently they are working with youth on La Rica, in ttuiler parks, and
taggers. The organization has received $200,000 in County fimding, they have been operating
in Baldwin Park since 1993, and have an office at 3848 Stewart Street.
Those speaking in favor of the Hope in Youth were: Robert Lucero, address not given;
Gina Lucero; and Graciela Ayalla, 14014 Jeremie.
Steve Stoltz, 4341 Bresee, spoke on behalf of the Board of Directors for the East San Gabriel
Valley Boys and Girls Club and thanked Council for their assistance in the past. He stated the
services provided by the latchkey program and that it subsidizes families that can not afford
daycare. Mental health counseling is also available for children and their families.
Terry Howell, Center for independent Living, 963 Badillo, Covina, stated that their organization
helps those that are disabled to live independently by training them to care for themselves, find
work and live not depending on family.

Eleanor Harder, Baldwin Park Food Center stated that the organization provides
emergency food, food to the low income, those on FDIC, senior citizens, the homeless and
the demands are growing daily to provide more assistance to the poor.
Debbie Dalton Director for WINGS, 14620 Hall, Whittier, stated that this organization
provides shelter for battered women and children, support groups for the women, and the
organization helps women file restraining orders.
Roy Test, 15115 Kenoak, inquired why money would go to the Queen of the Valley Hospital
instead of Terrace Plaza Hospital. Council explained the program is proposed by Queen
of the Valley Hospital and that Terrace Plaza does not have such a program.
There being no other speakers, Mayor Vargas declared the Public Hearing closed.
In response to Council, Director of Community Development Carbajal stated that the City
needs to upgrade the City block by block, that residential loans are available to assist the
homeowner in fixing up their property and that funds are available for the first time
homebuyer program.
Councilwoman Muse requested that Council receive copies of the applications submitted by
the groups, because it is easier to make a decision.

REPORTS OF OFFICERS. COMMISSIONS AND COMMITTEES
City Clerk Gair requested Council select a Mayor pro tern for 1994-95 and to designate
members of the Council as representatives and alternates on certain municipal committees
and organizations. A current listing of the assignments was included in the staff report.
It was recommended that Council select a member as Mayor pro tern for 1994-95 as the
first action and following that select the committee assignments each member desires to
serve on and adopt the resolution designating the City's Representatives and Alternates to
certain committees and organizations.
Mayor pro tern Gallegos thanked Council for allowing him to serve as Mayor pro tern for
two consecutive terms and stated that it was an excellent experience.
It was moved and seconded to. appoint Raul Martinez as Mayor pro tern. MIS/C:
GALLEGOS/MUSE. There were no objections.
Council discussed the various committees and accepted their assignments to the committees.
It was moved and seconded to adopt Resolution No. 94-37, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO.
93-47 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO
CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS.' MIS/C:
GALLEGOS/MARTINEZ. There were no objections.
Director of Community Development Carbajal requested Council adoption of a resolution
stating that it is in conformance with the Congestion Management Program requirements.
This resolution is needed to satisfy requirements of the 1993 Congestion Management
Program CMP) as mandated by the State. The purpose of the resolution is for
jurisdictions to self-certify that they are in conformance with the local CMP requirements
including the Countywide Deficiency Plan. The conformance will be based on meeting the
major program responsibilities as listed in the staff report Staff recommended approvaL

It was moved and seconded to adopt Resolution No. 94-38, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK, FINDING THE CITY TO BE IN
CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM CMP) AND
ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE
WITH CALIFORNIA GOVERNMENT CODE SECTION 65089." M/S/C:
GALLEGOS/MARTINEZ. There were no objections.
Chief of Police Lanza requested Council approval of a part-time helicopter police patrol
program. The helicopter is fuel efficient, will be able to assist in vehicular and foot
pursuits, roof top checks and respond to any point in the City in 30 seconds. Staff will
identify alternative funding sources such as grants and/or a shared-use/shared cost program
with neighboring cities. Staff recommended approval.
In response to Council, Chief Lanza stated that the public would be informed about the
helicopter in the NOW, Tribune and Times newspapers.
Councilwoman Lowes stated that she was opposed to the helicopter due to the expense, the
noise, the invasion of privacy, and that police cars, motorcycles and bicycles should be able
to respond in a city the size of Baldwin Park. She also stated that it was dangerous to
spend our contingency fund in case of a catastrophe.
In response to Council, Director of Administrative Services Yeats stated that the General
Fund Reserves are $2.3 million and $900,000 more is anticipated in PERS savings. Two
years ago the reserves were below $1 million. Prop 172 funds can be used for the helicopter
program but no sure of when they will be available to the City.
It was moved and seconded to approve the helicopter program, waive the formal bidding
process and appropriate funds in the amount of $10,000 from the Asset Forfeiture fund
and General Fund Reserves if determined that Prop 172 are not available for this program,
and amend to include in 1993-94 using $10,000 Asset Forfeiture funds and in 1994-95
using Prop 172 or other funding mechanism and all funds this year to be paid out of Asset
Forfeiture funds. MIS: VARGAS/MARTINEZ.

Motion Carried.
Director of Community Development Carbajal requested Council approval to submit an
application to the County of Los Angeles for the purpose of obtaining a Tree Planting
Grant in the amount of $212,588. The County passed Proposition A finding to public
agencies and nonprofit organizations for the purpose of planting trees which would result
in urban beautification. The County uses a competitive grant application for dispersing the
funds, the City's in-kind contribution would be $24,920 and this will provide approximately
900 trees to be placed where trees have been removed or lost due to age, vandalism, disease,
or simply do not exist. The trees will be planted by the City's Public Works Department,
with assistance by the California Conservation Corp. CCC). It was recommended that
Council approve the application and adopt the resolution.
It was moved and seconded to adopt Resolution No. 94-40, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE APPLICATION FOR
GRANT FUNDS FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE
DISTRlCT URBAN TREE PLANTING.

COUNCIL/STAFF REOUEST AND COMMUNICATIONS
City Clerk Gair shared with the Council the results of the Mock Election at Santa Fe
School. The City Clerk Staff and one person from the Finance Department conducted the
election. The Executive Team passed out plaques and donated $150 to the winning class
that had the largest percentage voter turnout. The Executive Team has decided to submit
the Mock Election for consideration by the League of California cities for the Helen Putnam
Award.
Mayor Vargas stated that in the future possibly expanding the mock election process to
more schools.
Councilwoman Muse stated that on Saturday, from 10 a.m. till 2 p.m. free immunization
shots will he given. On Sunday, from 1 p.m. to 6 p.m. a dance-a-thon will he held for AIDS
called the Love of Life, and a play on AIDS awareness called Secrets will be performed.
Mayor pro tem Martinez suggested that after the Invocation a brief update he given to the
public on the Study Session items.
In response to Councilwoman Lowes, Mayor Vargas stated that since the City did not have
a City Manager and if she has a problem she should direct her request to the department
head in charge of that particular situation. If she has a problem with a Director of a
department she can bring it up at a Council meeting.
Director of Administrative Services Yeats requested that a Team Building session he
conducted on May 14th from 8 a.m. till 12 noon in Room 307 with just the Council and
Executive Team, at that time all can review past team building goals, the budget and other
issues.
It was moved and seconded to adjourn the regular meeting of the City Council at 9:23 p.m.
to and adjourned regular meeting on April 21st at 7:00 a.m. in Room 307. M/S/C:
