HomeMy WebLinkAbout1994 06 01 CC MIN1994 06 01 CC MINòw @˜zCC MIN JUN 1 1994[Þ›[HÆ8 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CITY HALL, 14403 EAST PACIFIC AVENUE, WEDNESDAY, JUNE 1,1994 The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, LOWES, MUSE AND MAYOR PRO TEM MARTINEZ ALSO PRESENT: City Attorney Bower, Chief of Police Lanza, Dir. of Administrative Services Yeats, Dir. of Community Development Carbajal, Dir. of Human Services Nunez, Dir. of Public Works Mousavi, City Treasurer Montenegro, Deputy City Clerk Branek, and City Clerk Gair 00- The absence of Mayor Vargas was excused. 4)0- ORAL COMMUNICATION Mayor pro tern Martinez declared Oral Communications open and invited those wishing to speak on any subject to come forward. Rodney and Calley McPherson, 3562 Ahem Drive, inquired how school crossing guards are funded and could volunteer crossing guards be used at Jones. He stated that his son had been killed in the cross walk at Jones School. Councilmember Lowes requested that the school crossing guards be placed on the next agenda and the family informed of the procedure. Roy Test, 15115 Kenoak, asked what time of the morning a construction project could begin. He stated that he went to the Ramona Boulevard project at 6:30 a,m. and spoke with the foreman of the job, who became very hostile. Doug Donahey, 3751 Vineland, stated that his son crosses the street in front of Jones School, that the intersection does have a lot of traffic during the rush hours and that the intersection crosswalk is dangerous. There being no other speakers, Mayor pro tern Martinez declared Oral Communications closed. 4)0- CONSENT CALENDAR City Clerk Gair presented Consent Calendar A: 1. Waive Further Reading and Adopt RESOLUTION NO.94-55 APPROVING PROGRAM SUPPLEMENT TO LOCAL AGENCY STAFF AGREEMENT AND AUTHORIZING EXECUTION ATHOL STREET PEDESTRIAN IMPROVEMENT) 6. Waive Further Reading and Adopt RESOLUTION NO.94-56 AUTHORIZING A USED OIL RECYCLING BLOCK GRANT APPLICATION Mayor Lowes requested that Item No.3 of the Consent Calendar be removed for separate consideration. It was moved and seconded to approve Consent Calendar Items No.1-2 and 4-6. MIS/C: GALLEGOS/MUSE. There were no objections. In response to Councilmember Lowes, Director of Community Development Carbajal stated that the gift certificates listed under Planning are authorized as a part of the Regulation XV program, that it is an incentive for employees to find alternate ways to work, that the incentives are given out quarterly and the program is subsidized. Director of Administrative Services Yeats explained the $131 on page 20 was a food item for a Friday training session. It was moved and seconded to approve Item No.3 as presented. MIS/C: LOWES/GALLEGOS. There were no objections. City Clerk Gair presented Consent Calendar B: 1. Waive Further Reading and Adopt RESOLUTION NO.94-53 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK RELATING TO SOUTHERN CALIFORNIA EDISON) It was moved and seconded to approve Consent Calendar B as presented. MIS/C: GALLEGOS/MUSE. Mayor pro tern Martinez abstained due to a possible conflict of interest. 4)0- PUBLIC HEARING Mayor pro tern Martinez introduced the Public Hearing pertaining to the Preliminary Two- Year 1994-95 and 1995-96 Budget and to solicit public input regarding the contents of the budget document. Director of Administrative Services Yeats stated that the Preliminary Budget contained expenditures totaling $26.7 million for FY 94-95 and $27.1 million for FY 95-96. General Fund Revenues and Transfers total $11,556,265 for the first year and $11,719,725, resulting in an operating shortfall of $471,669 in FY 94-95 and $531,985 in FY 95-96. The budget will be balanced using various strategies, including cost containment measures to reduce operational cost. Staff recommended that Council direct staff to develop alternatives for balancing the budget, taking into consideration input from the Council as well as the community. Mayor pro tern Martinez declared the Public Hearing open and invited those wishing to speak regarding the Preliminary Two-Year 1994-95 and 1995-96 Budget. There were none. Mayor pro tern Martinez declared the Public Hearing closed. It was moved and seconded that Council direct staff to develop alternatives for balancing the budget and to consider any other input. MIS/C: GALLEGOS/MUSE. There were no objections. 00- REPORTS OF OFFICERS. COMMISSIONS AND COMMITTEES Chief of Police Lanza requested Council approval to amend the Municipal Code to regulate certain operations of hotels and motels. The proposed ordinance would hold hotel and motel owners, and/or management accountable for activities at their establishments that tend to promote criminal activities. The new procedures imposed by the ordinance would be: 1) Mandating the finishing of proper governmental identification by the renters; 2) Standardized registration cards and procedures; 3) Allowing of impromptu inspections by law enforcement officers or city officials; and 4) Maintaining of registration cards for a five 5) year period. Staff recommended Council approval of the Baldwin Park Municipal Code Section 9.06, as amended. City Attorney Bower stated that two changes needed to be made to the ordinance: 1) Section 9.50.020, Official Guest Registration Cards, the blank date to be filled in with July 15, 1994; and 2) Section 9.50.090 the last sentence the words other than the Posted Rate" needs to be deleted. Councilmember Lowes stated that the some hotels and motels charge mote than their prevailing rate because the motel operators overlook the criminal activity. She suggested that they not be allowed to charge more than the posted rate. City Attorney Bower stated that the last sentence in Section 9.50.090 should read, No Hotel/Motel Agent shall Let, Lease or Rent any Room at any rate in excess of the Posted Rate." It was moved and seconded to introduce Ordinance No.1083, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING TITLE 9 OF THE BALDWIN PARK MUNICIPAL CODE BY ADDING A NEW CHAPTER 9.50 REGULATING HOTELS AND MOTEL," for first reading, be read in title only and all further reading be waived. MIS/C: GALLEGOS/LOWES. There were no objections. Director of Public Works Mousavi recommended that Council hold a public meeting and adopt the resolutions approving the Engineer's Report for FY 1994-95 declaring its intention to provide for the annual levy and collection of assessments in connection with the Maintenance District and setting a time and place for a public hearing. The existing Citywide Lighting and Landscaping Assessment rates are proposed to remain unchanged for the Fiscal Year 1994-95. The average residential property will have an overall lighting and landscaping assessment of $97.40 for next year. The cost of maintaining the on-site landscaping for the Villas Del Paseo complex is proposed to be increased from $20.46 per year to $244.54 annually based on a proposal submitted by all four Homeowners Associations. It was recommended that Council: 1) Adopt the resolution approving the Engineer's Report for certain landscaping and lighting maintenance in a Maintenance District within the City; and 2) Adopt the resolution declaring the Council's intention to provide for annual levy and collection of assessments for certain landscaping and lighting in an existing Maintenance District and setting a public hearing for July 6, 1994. Elizabeth De Roes, President of Villas de Paseo III, 13632 13730 Ramona Parkway, stated the assessment for on-site lighting and landscaping would be raised 125% over the 1993-94 budget and unbeknownst to the homeowners, or the Associations, the deficit costs have been accruing for a total of $15,00 for two years. The assessment for FY 94-95 is $244.54 per unit. Phase 4 of the tract now has overgrown trees which requires an excess of clean-up time and that puts a burden on the other three units. The association presidents agreed to split off the basic maintenance contract and to remain under City supervision, and to switch the term extras" to the homeowners associations. She also requested that the associations be allowed input before the next landscaping contractor is selected. Director of Public Works Mousavi stated that he was surprised as he had met with the association and they seemed satisfied with the proposed agreement. The assessment of $244.54 was reasonable and agreed on with the president of the association. He stated that he would go back and meet with the associations again. Council discussed attempting to meet with the association, if the association does not want to be part of the contract, then move forward and bring back a report to Council with a recommendation on the contract. City Attorney Bower stated that Council could approve the Engineer's Report and set the public hearing prior to Council making a decision regarding the Associations. It was moved and seconded to adopt Resolution No.94-57, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR CERTAIN LANDSCAPING AND LIGHTING MAINTENANCE IN A LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT IN THE CITY OF BALDWIN PARK." MIS/C: GALLEGOS/LOWES. There were no objections. It was moved and seconded to adopt Resolution No.94-58, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE ANNUAL ASSESSMENT LEVY AND COLLECT ASSESSMENT S FOR CERTAIN IMPROVEMENTS AND MAINTENANCE PURSUANT TO THE PROVISIONS OF DIVISION 15, PART 2, OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA AND SETTING A TIME AND PLACE FOR A PUBLIC HEARING," and set the public hearing for July 6, 1994. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilmember Muse directed staff to look at ways to eliminate abandoned shopping carts from the streets, and to discuss with the School District possible volunteer crossing guards. Councilmember Lowes requested that the ground water cleanup be placed on the next agenda. She requested staff to see what other cities do to enforce stopping the street vending regarding and picking up of the carts. City Clerk Gair stated for the benefit of the McPherson family that was present, that the May 14, 1994, Council Meeting was adjourned in memory of their son.
