Mayor Vargas read the proclamation declaring the holidays of 1994 and 1995 as
*Buckle Up for Life Challenge," and presented it to Chief Lanza.
Mayor Vargas presented Awards of Merit to the owner of Mountain Produce, George
Bronson and for Dennis Bronson and Zulema Vidal for honesty in business and told of
the return of lost money to Keith Weeks. Mr. Weeks was presented with a City Pin for
his newspaper article thanking these individuals.

City Attorney Bower explained that after the posting of the agenda it became necessary
to consider the request for a loan to the Chamber of Commerce. This action is needed
prior to the next scheduled Council Meeting.
It was moved and seconded to place a Subsequent Need Item on the agenda to
consider the request for a loan to the Chamber of Commerce. MIS/C:

Jeanne Martens, 14847 Sierra Way, announced that a meeting, by invitation only, will
be held on November 15th at 11:00 a.m. for the Habitat for Humanity. She also thought
that the inspections prior to the sale of property was a good idea.
William Van Cleave, 13232 Emery, stated that the Chamber of Commerce needed the
$15,000 loan and cannot operate without it.
Robert Ochoa-Schutz, 336 Park Shadows, stated that the Chamber was in need of the
loan. He also requested that a meeting be set with the Chamber, School District and the
City pertaining to the NOW."
Terry Sandoval, 14525 Baldwin Park Town Center, owner of Max Travel, told of her
experience with signing a lease with the Town Center Management, and how they
changed the actual lease to a higher figure. She was told by the management that the
center was 75% leased. The lease was in the amount of $1900 a month and she cannot
stay in business with the high rent. She requested that the City intervene with the Town
Center Management on behalf of the tenants.
Alovero Tovar, 1648 Doubleg rove, West Covina, representing Richard Romero, 14515
Baldwin Park Town Center, read a letter prepared by Mr. Romero pertaining to the Town
Center Management misrepresenting the number of vacancies in the center, the high
rent, and abusive actions taken by Mr. George Grosso.
Sam Mercieca, owner of Subway Sandwich, 14525 Baldwin Park Town Center, stated
that he owns two other Subway's that he has to take from to make ends meet at the
Baldwin Park store and that he has been in Baldwin Park since February, 1987. The
center is only 50% rented and two more stores closed their doors two weeks ago. The
tenants have met and discussed the high rent, the center has never being completely
leased, and the leasing company does nothing for the tenants.
Ed Huetinck, 13508 Amar Road, stated that he was pleased with the Athol Pedestrian
crossing, that it was safer for the children going to De Anza School. He also stated that
the home sale inspections would protect the buyer as well as the seller and that it has
been needed for a long time.
Sandi Lucas, 4442 Bresee, stated that the Planning Commission had approved a liquor
license for the Taco Cabana restaurant, and that the restaurant would be open until 1:00
a.m. on the weekends selling mixed drinks. She named the other establishments that sell
liquor in the area. She inquired if the item would be a public hearing before Council.
There being no other speakers, Mayor Vargas declared Oral Communications
closed.

Councilmember Muse requested that Consent Calendar Item No.7 be removed for
separate consideration.
Councilmember Gallegos requested Consent Calendar Item No.8 be removed for
separate consideration.
It was moved and seconded to approve Consent Calendar A, Items 1-6 and 9-12 as
presented. MIS/C: MARTINEZ/LOWES. There were no objections.
Councilmember Muse stated that there could be some conflict of interest pertaining to
Item 7 due to the proximity of her employer's business to the site.
It was moved and seconded to approve Item No. 7 as presented. MIS/C:
MARTINEZ/GALLEGOS. Councilmember Muse abstained due to a possible conflict of
interest.
In response to Councilmember Gallegos, Director of Community Development Carbajal
stated that Michael Huls, R.E.A.'s proposal was to do a portion of the work with staff
completing the project, the equipment that would be bought and would stay in the City.
The City staff-time is approximately $70,000. Oricom Group's proposal administers the
entire program, and any equipment or programs purchased would belong to Oricom.
Oricom was not willing to do a portion of the work, they wanted to do the full program and
would not do less than the $340,000 proposal.
It was moved and seconded to approve Item No. 8 as presented. MIS/C:

LOWES/GALLEGOS. Mayor pro tern Martinez abstained due to a possible conflict of
interest.
PUBLIC HEARING
Mayor Vargas Introduced the Public Hearing pertaining to Adjustments In certain fees
and charges for issuance, processing and filing of various City services and permits
Court Referral Program; Shopping Cart Removal," and continued the public hearing
to November 16th.
REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Director of Administrative Services Yeats requested Council opposition of the Federal
Implementation Plan FIP). The U.S. Environmental Protection Agency EPA) has
proposed new air quality rules known as the Federal Implementation Plan FIP). The
proposal would only affect California and have severe impact on many mobile sources.
The FIP would impact the trucking and airline industries by cutting back service and
increasing costs. The cutbacks on the airline services would devastate the California
tourism economy and result in massive unemployment. The California School Boards
Association and the School Transportation Coalition report that the FIP will cost
California schools more than $600 million and render most school buses obsolete.
Cities would be forced to switch its fleets to alternative fuel vehicles requiring
installation of fueling facilities that costs approximately $750,000 per site. It was
recommended that Council oppose the Federal Implementation Plan by signing the
FIP opposition form and adopting the resolution.
It was moved and seconded to approve Resolution No.94-119, A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK IN OPPOSITION TO
THE FEDERAL IMPLEMENTATION PLAN FIP)," and sign the FIP Opposition
Form. MIS/C: LOWES/MUSE. There were no objections.
Director of Administrative Services Yeats stated that the City had received a request
from the Chamber of Commerce for a loan in the amount of $15,000. The loan
would be repaid from salary savings, based upon the difference in the Executive
Director's compensation level. The Chamber will be charged interest on the loan at
the current LAIF rate. The Chamber presented detailed budget reports and bank
statements detailing their crisis. Staff has discussed the possibility of the City and
School District assuming the responsibility for the production of the NOW newspaper.
The loan would be taken from the Business Improvement Reserves and repaid by

June 30, 1995.
Mayor Vargas requested that the School District, the Chamber and City meet and deal
with any concerns and issues pertaining to the NOW and bring a report back to the
Council.
It was moved and seconded to approve a loan of $15,000 to the Chamber of
Commerce that will be repaid by June 30, 1995 with interest. M/S/C: LOWES/MUSE.
There were no objections.

COUNCIL/STAFF COMMUNICATIONS
In response to Councilmember Lowes, Mayor Vargas stated that it was against State and
Federal law to require applicants for employment to live in the City, but it could be a
deciding factor if you have two qualified applicants.
City Clerk Gair requested all agenda items be called in to her for the Council meeting
scheduled for Tracy School on December 15th. She also stated that there have been no
responses from the commissioners, so a meeting will be scheduled with the
commissioners and Council for January.
Mayor Vargas announced that he will be absent from the November 16th Council meeting
since he will be visiting Israel and the Middle East.

The regular meeting of the City Council reconvened at 8:10 p.m. Roll call remained
the same.

CLOSED SESSION
The regular meeting of the City Council adjourned to a Closed Session to consider
Litigation: Greater Los Angeles Hotel/Motel et. al...vs the City of Baldwin Park, pursuant
to the Government Code Section 54596.9(a).
No action was taken.
