The City Council of the City of Baldwin Park
met in regular session in the Council Chambers
at 7:00 p.m.
ROLL CALL: Councilmembers LOWES, LOZANO, MARTINEZ,

The absences of City Clerk Gair and City Treasurer Montenegro were excused.
Mayor Vargas announced that City Attorney Bower was delayed but would be attending
the Council meeting.

Vincent Haydel, Area Manager for Southern California Edison, presented Council with
several rebate checks totaling $13,496 pertaining to the energy conservation earned on
the installation of a new lighting system in the City Buildings.
Mayor Vargas stated that a plaque was to be presented to Bob Archuleta for his support
for all the Veterans Programs and for serving as Master of Ceremonies at the Veterans
Day events, but he was not present.
Director of Administrative Services Yeats introduced the Full Time Employee of the
Year, Ellen Parks and the Part Time Employee of the Year, Cris Hernandez and told
of their accomplishments.
Acting Chief of Police Cisneros introduced Police Officers John Montgomery and Greg
Acuna and Police Dispatcher Oralia Agurcia and told of their life saving efforts that saved
Ahnika Robledo. Mayor Vargas presented Officer Montgomery, Officer Acuna and Police
Dispatcher Agurcia with Awards of Merit.

Assemblyman Gallegos thanked Officer Montgomery, Officer Acuna, and Dispatcher
Agurcia for their quick action in saving the baby's life and presented each one a certificate
from the State Assembly Legislative Office.
Mrs. Robledo thanked Police Officers Montgomery and Acuna and Dispatcher Agurcia for
saving her baby's life.

ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to speak
to come forward.
Fred C. Cortez, 14637 Pacific, referred to Municipal Code Section 17.08.080(b) and c),
pertaining to the Dismantling or storage of vehicles prohibited" and stated that he felt that
the law was out-dated and a violation of one's rights. He requested the City Attorney
review the law before it is challenged in court.
There being no other speakers, Mayor Vargas declared Oral Communications closed.

PUBLIC HEARING
Mayor Vargas Introduced the Public Hearing pertaining to the approval of the FY 94
Annual Performance Report for the Comprehensive Housing Affordable Strategy
CHAS).
Director of Community Development Carbajal stated that as a condition of receiving
certain Federal Funds, the City was required to develop and implement the
Comprehensive Housing Affordable Strategy which replaced the Housing Assistance Plan.
The purpose of the strategy is to determine the housing needs of the low and moderate
income persons/families and develop and implement a plan to meet those housing needs.

The summary and the goals of the Plan were outlined in the staff report. The City has
been approved for the Federal Home Grant Program and State Representatives will be
contacted regarding approval of the State Home Grant Program. Staff recommended
Council approve the FY 94 Annual Performance Report without changes.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak
pertaining to the Annual Performance Report for the Comprehensive Housing Affordable
Strategy CHAS) to come forward.
Jeanne Martens, 14847 Sierra Way, stated that she is in favor of any program that
assists first time homebuyers. A listing of cities was issued to the real estate brokers of
cities with a majority of Spanish sir names, the City of Baldwin Park was combined with
the City of Irwindale and neither city was on the list. The first time homebuyers in the
Hispanic community are buying somewhere else and the City needs to do something to
entice them to buy here.
There being no other speaker, Mayor Vargas declared Oral Communications closed.
It was moved and seconded to approve the FY 94 Annual Performance Report without

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Director of Administrative Services Yeats requested a budget appropriation for the
Attendance Incentive Program. He stated that as a part of labor negotiations, the
subject of sick leave accrual balances and maximum accumulation levels are discussed
each year. The long term employees that have accrued a large number of hours have
expressed concern upon leaving the City, through retirement or advancement, will receive
no compensation for their accruals. The employees that practice responsible use of their
sick leave are not recognized for their dedication. Two options were presented to
employees: 1) an amendment to the City's current contract with the Public Employees
Retirement System PERS) to include a service credit for unused sick leave. Accrued
hours at retirement would be credited as service days for retirement service credit, which
is a long term cost to the City; and 2) create a maximum accumulation level and allow
employees to annually cash in unused hours accumulated over the selected level. Staff
was directed to meet with the appropriate employee groups and offer a maximum
accumulation level and allow the employees to annually cash in the unused hours
accumulated over the selected level at a 50% buy back rate. A budget amendment in
the amount of $57,000 is required to appropriate funds for the Attendance Incentive
Program. Staff recommended approval of the budget amendment.

In response to Council, Director of Administrative Services Yeats stated that the
employees were able to select plateaus of either 300, 600 or 900 hours ot sick leave and
that the employees with excessive hours over the selected plateaus would receive the
50% buy back rate.
It was moved and seconded to approve the budget amendment in the amount of
$57,000 for the Attendance Incentive Program and authorize staff to implement the
program in conjunction with the December 22, 1994 payroll. MIS/C:
MARTINEZ(LOWES. There were no objections.
City Attorney Bower requested that the ordinance regarding the regulations of hotels and
motels be introduced for first reading. The ordinance repeals Chapter 9.50 of the
Municipal Code, which was challenged by the Los Angeles Greater Hotel/Motel
Association and the court issued a restraint preventing the City from enforcement, stating
that the ordinance was a violation of privacy. The nuisance of prostitution or drugs can
still be enforced on a case by case basis. According to the Red Light Abatement Act" a
nuisance hearing can be held and an order issued against any offending hotel/motel to
close down for one year. He stated that he was sure that Rutan and Tucker could
appeal the decision, but felt that to conserve the City's funds that a repeal of the
ordinance was in order. It was recommended that Council approve the repeal of the
ordinance.
Mayor Vargas requested that all complaints pertaining to the prostitution and drug
problems at the motels on Garvey be cc: to Judge Diane Wayne. Council agreed by
unanimous consent.
It was moved and seconded to Introduce Ordinance No.1091, AN ORDINANCE OF
THE CITY OF THE CITY BALDWIN PARK REPEALING CHAPTER 9.50 OF THE
BALDWIN PARK MUNICIPAL CODE REGARDING THE REGULATION OF HOTELS
AND MOTEL," for first reading, be read in title only and that all further reading be
waived. MIS/C: LOWES/MUSE. There were no objections.

Redevelopment Agency at 7:50 p.m.

Annual Report" be moved up on the Redevelopment Agenda to deal concurrently with
the same item on the Council Agenda. Council agreed by unanimous consent.
Director of Community Development Carbajal stated the purpose of the report was for the
Redevelopment Agency to approve and present to the City Council and for the City
Council to accept the Annual Report for Fiscal Year 1993-94 for the Redevelopment
Agency. The requirements for the report, as specified in the Health and Safety Code
Section 33080.1 were listed in the staff report. Staff recommended that the
Redevelopment Agency approve and present the Annual Report to the City Council, and
the City Council accept and file the Annual Report of the Baldwin Park Redevelopment
Agency.
It was moved and seconded that the Redevelopment Agency approve the Fiscal Year
1993-94 Annual Report and present the Annual Report to the City Council MIS/C:
LOWES/VARGAS. There were no objections.
It was moved and seconded that Council receive and file the Fiscal Year 1993-94
Annual Report of the Redevelopment Agency. MIS/C: MARTINEZ/MUSE. There were
no objections.
The regular meeting of the Redevelopment Agency recessed at 7:56 p.m.
The City Council meeting continued at 7:56 p.m. Roll call remained the same.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilmember Muse stated that she attended the Senior Citizen Christmas party at the
annex building and asked if Council would support allowing the Seniors to use the Annex
building since the WICK Program has left the City. Councilmember Lowes stated that she
certainly supported the Senior Citizens using the annex building.
Councilmember Muse stated that she had not seen any reports pertaining to Hope in
Youth and asked if the funding could be designated for some other organization. She
also commended the Human Services Department for the Breakfast with Santa and the
food baskets.
In response to Councilmember Muse, Director of Human Services Nunez stated that 425
food baskets were given out in the City.
In response to Councilmember Muse, Director of Community Services Carbajal stated that
Hope In Youth was five months behind with the required information, that a draw down

could not be issued without the required information, and that Council could direct staff
to award the $10,000 to any group Council selected.
Mayor pro tern Martinez stated that Hope In Youth was struggling to get off the ground
and that staff needs to offer help in securing the required information.
Mayor Vargas requested a letter be drafted to Catholic Charities inquiring about the
funding needs for this year and it the funds are not required for Hope in Youth to let the
City know.
Mayor pro tern Martinez stated that the CDBG Funding would be coming up again soon
and he requested that each of the agencies receiving funding provide reports showing
how many people in the City they actually help.
Councilmember Muse requested that the Human Services Commission work with the
Advisory Committee and identify the needs and the services received by the citizens of
Baldwin Park from the various agencies.
In response to Councilmember Lowes, Director of Public Works Mousavi stated that
the problems in the alley in back of the businesses located on Ramona and Barnes are
that some of the businesses do not want to rent trash containers so the trash is dumped
in the alley. The Public Works Staff and the Waste Management Representatives are
meeting with the various businesses in that area to try and find a solution.
In response to Councilmember Lozano, Director of Community Development Carbajal
stated that after the first of the year the City would begin another first time home buyer
program.
Mayor Vargas requested 1) that Human Services meet with representatives from the
Senior Citizen Center and that the Director of Human Services develop a report showing
how the seniors invision utilizing the center; and 2) an article in the newspaper pertaining
to the crime rate in the San Gabriel Valley stated that major crimes in Baldwin Park had
decreased again. He requested a comparison chart of the major crimes in the City for
last year and this year be developed and returned to Council before the end of the year.
Mayor pro tern Martinez stated that a city in northern California started a D.A.R.E. Teddy
Bear Program and requested that the City Police Department look into purchasing
D.A.R.E. Teddy Bears, carrying them in the trunk of the squad car, and giving them out
on domestic violence calls.
Director of Community Services Carbajal stated that a breakfast would be held on the
third floor, with a $5 donation. The donation would help three families receive Christmas
baskets from the employees of the City.
