Aileen Pinehero, 13009 Amar Rd., congratulated the Council on a good job. She suggested 1) that the walls of the civic auditorium remain intact, that inside of the walls people could park, and that fresco paintings could be on the walls; and 2) research to see if the Pacific Electric Station could be declared a landmark. William Van Cleave, 13232 Emery, stated that he appreciated the Police Department's involvement at the dairy on Frazier, the gangs do not hang out there anymore. Roth Dryden, 3745 Holly, stated that he had been to the Council meetings four times requesting that his street be swept. He had also contacted the school district regarding the street sweeping. He requested that when a complaint is made at a Council meeting, the complaintant be informed within four weeks of the results. She stated that the real estate office has developed an incentive program for the agents to get involved in the community. She introduced Alice Guerrero and Gus Sumararo of Amigos Realty. The Chamber of Commerce will start a division of real estate business here in the City. There being no other speakers, Mayor Vargas declared Oral Communications closed. 00- CONSENT CALENDAR Mayor Vargas stated that Item No.7 of the Consent Calendar was removed from the agenda as it was only a Redevelopment Agency item. Approve Agreement Los Angeles County Workfare Program 5. Approve Award of Contract Reconstruction of Bess, Puente and Frazier Gentry Bros. 6. Approval of Contract Replacement of Carpet, Flooring and Suspended Ceiling Howard's Rug 7. Waive Further Reading and Adopt RESOLUTION NO.95-2 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK RELATING TO SOUTHERN CALIFORNIA EDISON) It was moved and seconded to approve Consent Calendar B as presented. MIS/C: MUSE/LOWES. Mayor pro tern Martinez abstained due to a possible conflict of interest. 0- REPORTS OF OFFICERS, COMMISSIONS. AND COMMITTEES City Clerk Gair requested Council designate members of the Council as representatives and alternates on certain municipal committees and organizations for 1995. The appointments are necessary at this time due to Councilmember Gallegos' election to the State Assembly. A resolution will be brought before Council again in April for consideration of appointments to the various committees and organizations. It was moved and seconded to appoint Councilmember Muse as representative to the Upper San Gabriel Valley Water Association, and alternate to the Southern California Association of Governments General Assembly COG), and to nominate Councilmember Lozano as representative to the East San Gabriel Valley Planning Committee and alternate to the Local Agency Formation Commission City Selection Committee and to nominate Mayor Vargas as the representative for the Chamber of Commerce Liaison. MIS/C: VARGAS/MUSE. There were no objections. It was moved and seconded to nominate Councilmember Lowes as representative to the San Gabriel Valley Association of Cities. MIS/C: MARTINEZILOZANO. There were no objections. It was moved and seconded to adopt Resolution No.95-3, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO.94-37 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS." State law preempts the possession of alcoholic beverages on public property but the provision prohibiting consumption was upheld. Staff recommended approval. In response to Council, City Attorney Bower stated that in order to change the law to prevent possession of alcohol in the public parks, someone would need to lobby the alcohol beverage control people or contact an elected official to present a bill. He also stated that existing signs do need to be changed in the park that adequately state the law. In response to Council, Captain Cisneros stated that a police officer would need to see alcohol being consumed in the park before a citation could be written and that anyone with an open container may also be cited. Mayor Vargas requested that a copy of the ordinance be sent to Assemblyman Gallegos requesting a bill be introduced prohibiting the possession of alcohol in public parks. It was moved and seconded to Introduce Ordinance No.1092, AN ORDINANCE OF THE CITY OF BALDWIN PARK AMENDING SECTION 12.24.220 OF THE BALDWIN PARK MUNICIPAL CODE MAKING IT UNLAWFUL TO CONSUME ALCOHOLIC BEVERAGES IN PUBLIC PARKS," for first reading, that the ordinance be read in title only and that all further reading be waived. There were no objections. 00- COUNCILISTAFF REQUESTS AND COMMUNICATIONS Councilmember Lowes requested an item be placed on the Team Building Agenda pertaining to operating the City without a City Manager. She stated that there are two members presently on the Council that were not a part of making the decision to operate without the City Manager. Mayor Vargas requested the item pertaining to operating without a City Manager be placed on the Team Building Agenda and that the City Attorney bring a report on the legality of the Executive-Team concept. Council agreed by unanimous consent. Mayor Vargas reported graffiti on the roof of the market located on Los Angeles Street and Merced. He requested 1) a copy of the article in the Times pertaining to curfew and graffiti and holding the parents accountable be given to the E-Team for review; and 2) the Team Building meeting focus on a) how the City functions; b) review of goals and objectives previously set; and c) public safety. Crime has been lowered and the area cleaned up. He asked that the Chief of Police research a way of encouraging the police officers to move into areas in the City by possibly offering an incentive program and bring a report back to Council. In response to Councilmember Lozano, Director of Public Works Mousavi stated that staff is working with the City of Irwindale pertaining to the storm drain problem at Olive and Maine. Mayor Vargas requested a letter sent to the Mayor of Irwindale thanking him for taking the time to talk regarding the flooding issue and for offering his support on this. 00- It was moved and seconded to adjourn the regular meeting of the City Council at 7:50 p.m. to an adjourned regular meeting on January 14, 1995 at 8:00 a.m. in Room 307.
