Chief of Police Lanza introduced Community Service Officers Wendy Morales, Eva
Oriold, and Francisco Reynoso and told of their background and education. City Clerk
Gair administered the Oath of Office to Community Service Officers Morales, Oriold,
and Reynoso.
Director of Human Services Nunez introduced new employee Rosanne Adanto and
told of her background and education.

ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to speak
on any subject to come forward.
Al Reale, Senior Citizen Representative, stated that the senior citizens need a bigger
place to meet. The current meeting place needs to be remodeled, new restrooms
installed, floor coverings and new furniture.
L.J. Lucas, 4442 Bresee, stated that he represents the Board of Directors for the Boys
and Girls Club that he is available to help with any problems at the Boys and Girls Club
and that no one responds to his letter or telephone calls.

Charlie Clayton, 5121 Lante, requested no parking on the east side of Lante. He
explained that the street is very narrow, large trucks travel the street daily, and there are
times he cannot pull out of his driveway. He presented petitions and photographs of
Sierra Pallet Company and requested the height of the wooden pallets be lowered and
fire sprinklers be installed.
Arnold Castro, 3258 Frailer, stated that he had attended a Council meeting a month
ago and requested the City to help with the gang problems in his area, that the gangs
are still active, and that his children are frightened.
Stuart Felty, 1440 Vineland, stated his concerns about a liquor store at the corner of
Vineland and Francisquito, the neighborhood deteriorating, the presence of prostitutes,
and the speeding traffic on Vineland. He stated that he would be willing to get
signatures for ABC to stop the opening of the liquor store.
Robert Ochoa-Schutz, 336 Park Shadow Court, stated that he is on the Board of
Directors of the Chamber of Commerce, that the Chamber is going through a transition
and he thanked the City for their cooperation. He listed the following Chamber events.
1) January, 1995 a Business Improvement Assessment luncheon was conducted; 2)
February 14th the Chamber sponsored the State of the City Address; 3) March 23rd
a mixer will be at Mr. Bill's; 4) the April mixer will celebrate Monty's Electric's 30th year
in business; 5) the Chamber is working with the Community Development and the
Public Works Department to develop a beautification plan for downtown Baldwin Park;
6) an export international trade and practices seminar will be held in April; 7) a job
placement center through the Chamber office; 8) a small business task force has been
created; 9) the coupon book Baldwin Park Bucks" will be issued again; 10) the 16th
Annual Golf Tournament will be held on May 19th; 11) the Executive Director of the
Chamber of Commerce Roxanne Cortez conducts small business luncheons; 12) the
Miss Baldwin Park contest will be held on June 29th at the Marriott; and 13) the
Department of Community Development will conduct a business expo at the Metrolink
Station.
Marty Vargas, 13853-C 13853 Los Angeles St., representative of the Homeowners
Casa Los Angeles Condominium Complex, requested information and help with loan
programs to help restore their property. She also requested help from the police
department with the drug problems and the gang members loitering in the area.
Jeanne Martens, 14847 Sierra Way, requested a copy of the State of the City address
by the Mayor and for the Mayor to deliver the State of the City address to all the
concerned citizens free of charge.
Al Contreras, 3110 Baldwin Park Blvd., requested the figures on the salary resolution
be revealed to the audience.

PUBLIC HEARING
Mayor Vargas introduced the Public Hearing regarding An appeal relating to the
Director of Public Works decision pertaining to Tentative Parcel Map 1282,
Conditions 14 A, D, & E Applicant: E. Barton Doyle for John Gerard; Location:
3285 North Frailer Street).
Director of Public Works Mousavi stated that the Advisory Agency had conditionally
approved Tentative Parcel Map 1282 with conditions as listed in the staff report. The
Tentative Parcel Map included the subdivision of 3 parcels. The developer proposed to
construct two new single-family residences and remodel the existing house. One new
house has frontage along Frailer Street while the other new house has frontage along
Waco Street. The existing house has frontage on both streets. Pursuant to the City's
Municipal Code Section 15.04.140 and the requirements of the State Map Act, the
developer is required to construct all off-site improvements for the construction and
reconstruction of any buildings or structures when a subdivision map is proposed or the
estimated cost is in excess of $20,000. The existing pavement section along Waco
Street is deteriorated and the City has asked the developer to install a layer of 3" asphalt
on existing native material and to comply with Condition 14E as listed in the staff report.
It was recommended that Council deny the appeal.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak
pertaining to the Appeal for Tentative Parcel Map 1282 to come forward.
Larry Speight, 9101 Slauson, Pico Rivera, representing John Gerard, stated in response
to Condition 14(a) that the existing driveway is in good condition and with modification
would meet with the ADA standard and he requested modification to this condition. In
response to the requirements of Condition 14(e) there's an ordinance on the books that
requires the tenant to keep up the landscaping in the parkway as well as the lawn and
he requested that this condition be deferred to the current laws of the City. He

explained that Government Code 66411.1 refers to 4 or less parcels and that off-site
improvements should be related to and necessary for the proposed development and
that Condition 14(d) is unnecessary, unjustified and unreasonable. The improvement for
a full street in front of the single family home is not necessary and violates the normal
operating precedents in the community. The City has a program that includes the
resurfacing of Waco Street within four years, and he felt that an additional 4 years would
not harm the street with the building of one new home. He stated that he had invited the
engineering staff to meet at the site to review the conditions of the street and to possibly
overlay the street, but the offer was declined. He reserved the right to rebut anything
brought before the Council.
John Gerard, 719 N. Sunset, West Covina, stated that Waco Street is 27' wide from
the south curb to the north curb and approximately 150' deep from Frailer to the end of
the property line. An estimate of $9,000 to $9,500 has been proposed for the removal
of existing asphalt and the installation of 3,' asphalt on Waco. He further stated that he
had remodeled an existing home, demolished a fire damaged garage, barbecue and
patio area, and removed bad trees and trimmed all the existing trees on the property.
He presented photographs of the existing street and stated that the street in front of his
property did not have any pot holes, just the normal cracks from wear. Any cuts made
in the street for sewer or water lines would be patched in a professional manner. Funds
are committed for 1999 to resurface Waco, and the expense of building a home, plus the
resurfacing of the street presents a financial hardship.
Mayor Vargas declared the Public Hearing closed.
In response to Council, Director of Public Works Mousavi stated that staff had looked at
the driveway and it was inadequate. He further stated that he had spoken with Mr.
Speight at the counter pertaining to the street resurfacing of the street in 1999, that is
the time most economical for the City to resurface, it does not mean that the street is not
bad today.
City Attorney Bower stated for the record that the project involves the construction of two
new houses not just one, one is located on Frailer and the other one is on Waco. There
was going to be a requirement for slurry seal on Frailer, but the applicant reached an
agreement with the City on condition 14(d). The City is not requiring the removal of
the base just the asphalt cap and staff has estimated that to be approximately $2,000
to $2,500.

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Personnel/Risk Manager Cole requested Council approve and adopt the resolution
amending Resolution No.94-122, a Basic Salary Plan for employees of the City of
Baldwin Park, to reflect changes to Section 6 of Exhibit A of the resolution relating to
Executive Employees. The resolution must be amended to reflect changes to the
category of Executive Employees. Council after review of compensation survey
materials, levels of performance and ability to pay have determined it is appropriate to
increase the salaries of the Executive Employees, to establish the salary for Executive
Employees as a monthly fixed rate rather than a salary range and, place the position of
City Clerk Certified) to the monthly fixed rate Executive Employees and leaving the City
Clerk non-certified) as a fixed rate position receiving an annual stipend of $2,400. The
salaries were quoted for the Executive Team as listed in the staff report. It was
recommended that Council approve and adopt the Resolution.
Councilmember Lowes stated that she opposed the amount of the raises to the
Executive Team, that she preferred a City Manager, and a City Manager would be able
to evaluate the Team. Every event a City Manager needs to attend, six people attend
and the City picks up the bill. She also stated her resentment to paying the utility tax
in light of these raises.
Councilmember Lowes moved to reject the raises.
Motion died due to the lack of a second.
Mayor Vargas explained that the Executive Team deserve the raises, that the team is
responsible to Council, and that the raises only bring them to the average of others in
like positions, in the San Gabriel Valley. The City has saved $205,000 with the
exclusion of the City Manager's budget. He stated that he frequently receives calls
from other cities inquiring about the Executive Team and the savings to the City. The
Team has been creative in new programs, frugal and cost conscious. The Team's
efficiency and professionalism allows Council the freedom to work part time for the City.
The citizens are supportive of the policies and direction of the City Council and the
reason is they see results.
Mayor pro tem Martinez stated that the six people on the Executive Team are dedicated
to the community, spend endless hours attending meetings, and they have worked hard
for their raises. Mayor pro tem Martinez also stated that he was elected to do what is
best for the City and not just say something politically correct.
Councilmember Lozano stated that he supported giving the raises, that the Executive

Team needs to be brought up to the average, and that the Team was the talk at the
League of California Cities meeting in Northern California.
It was moved and seconded to adopt Resolution No.95-17, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO.94-
122 A BASIC SALARY PLAN FOR THE EMPLOYEES OF THE CITY OF BALDWIN
PARK." MIS/C: VARGASIMARTINEZ. Councilmember Lowes objected.
In response Risk/Personnel! Manager Cole's explanation of payroll periods, Mayor Vargas
requested that the following payroll be the effective date of the anniversary for any salary
increases, to make February the month for evaluation.
Director of Administrative Services Yeats stated that the staff report contained two sets
of reports that relate the City's Revenues and Expenditures for the first six months of
Fiscal Year 1994-95 and to the City's Financial Condition at Fiscal Year ended June 30,
1994. The first set of reports details the City's Revenue and Expenditure summaries for
the period ending December 21,1994. The first report compares budgeted to projected
year-end General Fund Revenues and Transfers to General Fund Revenues, Special
Revenue Funds, General Fund Expenditures and finally, All Expenditures. The second
group of reports is a method for assessing the financial condition of the city using the
Government Finance Officer's Association GFOA) Financial Indicators Database. A city
is limited in its ability to interpret its financial condition other than through comparisons
with similar sized cities, and this is an analysis of 10 key ratios for determining the City's
financial condition. The overall rating for FY 93-94 in now +5 and has continued to
improve over the last three years, the FY 91-92 was 3. Staff recommended Council
receive and file the FY 1994-95 Mid-Year Budget Review and the Financial Condition
Analysis for the year ended June 30,1994.
In response to Council, Director of Administrative Services Yeats stated that the
projected total budget savings is $794,000 and the reduction of operational cost are
approximately $479,000.

Police Chief Lanza requested Council approval to add Chapter 5.60 to the Municipal
Code, which would regulate solicitation of alms panhandling). City staff has
received complaints about people panhandling at various locations throughout the City.
Some of the panhandlers have acted aggressively toward the citizens, and this activity
deters people from shopping in the community. The intent is to provide an enforcement
tool to protect businesses and their customers. The panhandlers would need to be 50'
from the entrance to the parking area in the shopping mall. This does not apply to non-

profit solicitation. Staff recommended approval of the proposed ordinance, adding
Chapter 5.60 to the Baldwin Park Municipal Code
Mayor pro tern Martinez requested that copies of the ordinance be sent to gas stations,
markets and shopping malls with a letter signed by the Chief of Police.
Councilmember Muse requested that an article be place in the NOW pertaining to the
panhandling ordinance.
It was moved and seconded to introduce Ordinance No.1099, AN ORDINANCE OF
THE CITY OF COUNCIL OF THE CITY OF BALDWIN PARK ADDING CHAPTER 5.60
TO THE BALDWIN PARK MUNICIPAL CODE REGULATING SOLICITATION OF
ALMS," for first reading, that the ordinance be read in title only and that all further
reading be waived. MISIC: VARGASIMUSE. There were no objections.

COUNCILISTAFF REQUESTS AND COMMUNICATIONS
Mayor pro tern Martinez requested 1) a brief report on the Renewal Agreement with
Covina Jail. West Covina's booking fees are $5 cheaper than Covina; and 2) a
report from staff and the City Attorney on the legality to assist the Lucky Baldwin
Little League design and submit plans for a snack bar.
In response to Councilmember Lozano, Chief Lanza stated that the C.O.P.s Grant
pays $25,000 per officer per year and that the City will need to pay more than
expected.
In response to Councilmember Muse, Chief Lanza stated that the police department
can check the past history of an establishment that sells alcohol, along with public
opinion that voices their displeasure to the ABC.
In response to Councilmember Lowes, Chief Lanza referred to an article pertaining to
COP's Ahead and stated that the other cities are in a different program called COP's
First. The City received approval from the Federal Government for the COP's Ahead
program in December, 1994.
Mayor Vargas requested: 1) staff to contact Edison and put in motion a long range
plan to underground utilities; 2) staff to work with the City Attorney on implementing
a fund to help with little league or other non-profit organizations; Council agreed by
unanimous consent.) 3) staff plan a family day picnic in the park; 4) plan an event
for Council, staff and employees with their families; 5) plan a Take Back the Night"
march next year, concluding at the park with a State of the City Address; 6) a
