Mayor Vargas read the proclamation and declared the week of March 12-18, 1995 as
National Adult and Continuing Education Week" and presented it to Adrianne
Figueroa and Ve Ann Vesel.
Mayor Vargas requested the proclamation for National Fair Housing Month" be
mailed.
Jean Carpenter, Chairperson for the Human Services Commission presented Council
with an Award of Excellence for Facility Design and Park Planning, Morgan Park
Expansion and Renovation from the California Parks and Recreation Society that was
awarded at the California and Pacific Southwest Recreation and Park Conference held
on March 2-5, 1995.

of Troup #699. He thanked the Director of Human Services for supporting the Boy Scout
recruitment program, and that 24 boys were recruited at the Community Center recently.
Emma Mooneyham, 3116 Mangum, commented on the sand deposits left on the street
by the streetsweeper.
Charles Wan, stated that his tenant received a notification of a public hearing pertaining
to his property located in the area of the Triangle Project. He asked the reason he did
not receive the public hearing notification.
There being no other speakers, Mayor Vargas declared Oral Communications closed.

It was moved and seconded to approve Consent Calendar B as presented. MISIC:

PUBLIC HEARING
Mayor Vargas introduced the Public Hearing pertaining to Determining whether
public necessity, health, safety, or welfare requires the formation of an
Underground Utility District along the southside of Francisquito Avenue and
eastside of Baldwin Park Boulevard District 95-1).
Director of Public Works Mousavi stated that a public hearing is required to establish
an undergound utility district. The underground utilities will eliminate overhead
distribution facilities along the southside of Francisquito Avenue and the eastside of
Baldwin Park Boulevard in front of a proposed commercial development, and the
project will enhance the commercial development. The City will utilize $100,000 of
Rule 20A funds to construct the undergrounding project. The service lateral lines are
proposed to be included in the project and they will also be funded by Rule 20A. The
property owners will be responsible for costs associated with the connection for
service within their own properties, and this will not happen until the City is ready for
the development. Public Hearing Notices were sent to all the property owners of
record. It was recommended that Council 1) adopt the resolution for establishing the
undergrounding utility district; and 2) direct staff to work with Southern California
Edison Company as well as the affected property owners to provide assistance in
completing the required meter conversions.
Mayor Vargas declared the Public Hearing open and invited anyone wishing to
speak pertaining to the formation of an Undergrounding Utility District 95-1 to
come forward.
Pete Nijjar, stated that he is a property owner on Garvey Avenue, and that he did
not receive notification of the public hearing. He asked if his property would be
included in the formation of an undergrounding utility district.

and that his renter forwarded the notification to his home. He asked about the time line
for the City relating to the commercial development, and that he did not understand why
the property owner is required to pay for the undergrounding.
Marty Martinez, 3038 Maine, stated that he rents his home from Mr. Wan. He received
the letter notifying the property owners about the public hearing. He asked when the
commercial development would take effect. He stated that he rents and would need time
to find a place to live. The vacant apartments in the area that the City has purchased,
have vagrants and drug addicts living in them. He asked if the City would help with
relocation fees.
Steve Drag us, 3083 Maine, stated the percentage of poles that would be eliminated by
the undergrounding, and that the undergrounding should include the other side of the
proposed development. The City needs to deal with the existing property owners, and
that this meeting is the first notification he has received. He questioned the reason for
the underground utility since the development would be at least a year away, and also
questioned the costs to the property owners for service as most of them will not own the
affected property.
There being no other speakers, Mayor Vargas declared the Public Hearing closed.
In response to Council, Director of Public Works Mousavi stated that the resolution
needed to be approved and Edison notified, so that Edison can place the project in their
budget. The listing of the property owners of record was obtained through a parcel
management system. The development will not begin for a least a year, and at that
time all the property in question should be owned by the developer or the City. If the
development does not come to pass, the resolution can be rescinded by another
resolution.
Councilmember Lowes requested 1) that Council receive a copy of all notices that the
property owners receive; and 2) that if the development is not underway by December,
1995, the resolution be rescinded. She informed the audience that the Project Area
Committee will meet on Thursday, March 16.
City Clerk Gair stated that property owners rent their property out, they do not change
their mailing address with the County and that is why notifications are sent to the tenant.
It was moved and seconded to approve Resolution No.95-22, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION
TO ESTABLISH UNDERGROUND UTILITY DISTRICT 95-1." MIS/C: MUSEILOZANO.
Mayor pro tem Martinez abstained due to a possible conflict of interest.

of the Final EIR and adoption of Findings Project: The Centre at Sierra Vista;
Location: Baldwin Park Boulevard/Francisquito) and stated that the Public Hearing
would be continued to the April 5, Council meeting.
Mayor Vargas introduced the Public Hearing pertaining to the Establishment of an
increase in certain fees and charges for issuance, processing and filing of various
City services and permits.
City Clerk Gair requested Council approval of a resolution changing certain fees and
charges for various city services and permits. It was necessary to amend Resolution
No.94-62 in order to add certain fees and to amend other fees where costs to the City
have increased. The departments making the additions and/or amendments to the fee
changes were listed in staff report. It was recommended that Council, following the
Public Hearing, adopt the Resolution amending Resolution No.94-62, setting fees and
charges for issuance, processing and filing of various city services and permits in the
City.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on
the fees and charges to come forward. There were none.
Mayor Vargas declared the Public Hearing closed.
Director of Public Works Mousavi explained that the recordation fees are for the
property owners that request corrections on subdivision maps.
Councilmember Lowes stated her objection to the fees for the Court Referral Program.
In response to Council, City Attorney Bower stated that Councilmember Lowes could pull
out the Court Referral Program and object to that portion, or that another resolution
could be adopted that contained only the Court Referral Program.
It was moved and seconded to approve Resolution No.95-23, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION
NO.94-62 SETTING FEES AND CHARGES FOR ISSUANCES, PROCESSING, AND
FILING OF VARIOUS CITY SERVICES AND PERMITS IN THE CITY," omitting the
Court Referral Fees. MIS/C: MARTINEZILOZANO. There were no objections.
It was moved and seconded to approve Resolution No.95-24, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Director of Administrative Services Yeats requested Council approval of the selection
of Valuation Resource Management, Inc. to perform fixed asset appraisal services
for the City of Baldwin Park. A fixed asset appraisal is necessary to provide the City
with an accurate inventory count and valuation. Valuation Resource Management will
inventory and bar code tag all applicable assets over our capitalization policy of $300.
Items valued at under $300 will be grouped by like asset with quantities and values.
A list will be provided with current insurable values for replacement and proof of loss.
The total cost is $6,900 plus the cost of the bar code tag and includes a master file
tape. Staff recommended that Council approve the selection of Valuation Resource
Management, Inc.
It was moved and seconded to approve Valuation Resource Management, Inc. to
perform a fixed asset appraisal of the City's fixed assets. MIS/C:
MARTINEZIMUSE. There were no objections.
City Clerk Gair requested Council approval of the introduction of the ordinance to
adopt the new Baldwin Park Municipal Code and to set a public hearing to
adopt the ordinance. In 1994 the City Clerk's office contracted with American Legal
Publishing to revise, amend, restate, codify and compile certain existing general
ordinances of the City. This allowed our current code to be completely recodified,
updated to comply with current state laws, and to be computerized. Along with the
introduction of the proposed ordinance a Public Hearing needs to be set for the April
5, 1995, Council meeting. Upon adoption of the ordinance at the April Council
meeting, the new code will become law on May 1, 1995. Prior to the ordinance
becoming law, a Folio" system will be installed that will allow City Hall employees
access to the municipal code and eventually the Council, the City Attorney, and
interested persons to access from their own computers. It was recommended that
Council approve the ordinance and set the public hearing for April 5.
It was moved and seconded to introduce Ordinance No.1100, AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA,
ENACTING AS AN ORDINANCE FOR THE CITY OF BALDWIN PARK, REVISING,
AMENDING, RESTATING, CODIFYING, AND COMPILING CERTAIN EXISTING
GENERAL ORDINANCES OF THE CITY DEALING WITH SUBJECTS EMBRACED
IN SAID CODE," for first reading, that the ordinance be read in title only, and all
further reading be waived and that a Public Hearing be set for April 5,1995, for
consideration of enactment. MIS/C: LOWESILOZANO. There were no objections.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilmember Lozano thanked Public Works for the tour of the City facilities and for
trying to show the different types of jobs. He also stated that the hamburger stand on
Maine and Estella needs to be torn down.
In response to Mayor pro tern Martinez and Councilmember Lowes, Mayor Vargas stated
that he liked the suggestion of placing a brief statement in Spanish on the agenda to let
non-English speaking know they can speak during Oral Communication.
Councilmember Muse requested 1) that lifter be removed from the I-10 Freeway off-
ramp at Baldwin Park Boulevard; 2) grass be replaced in the dirt areas at Morgan Park;
3) that Section 8 notify the property owners about the problems at the Frazier
Apartments: and 4) Walnut Creek Nature Park be marketed for the Scouts to visit.
Councilmember Lowes stated that the 605 Freeway bridge over Rivergrade Road has
steel supports holding it up and requested staff to investigate who was responsible for
the bridge.
Mayor pro tern Martinez requested 1) staff schedule a day for the family picnic; 2) an
update on the progress of the rear parking for the police; 3) establishing a grant of
funds to help little leagues buy equipment; and 4) the house at 4430 Maine, has
graffiti and derelicts, and needs to be taken down.
Mayor Vargas requested 1) a tentative schedule of the all the events planned for this
fiscal year for the community; 2) staff prepare a report on establishing a grant of funds
to work with little league; 3) staff to look for a site that possibly a mini-Dodger Stadium
could be built; 4) staff to contact Congressman Martinez' office and our representative
in Sacramento for senior citizen grants to help with a new facility; 5) staff to get rid of
the house at 4430 Maine; 6) another bank be contacted to come into the City, that three
banks for 75,000 people is not enough; 7) a Study Session item be on the agenda
for legal fees of the City; and 8) staff to meet with the water district concerning the
construction of a clean water site in the City.
Director of Public Works Mousavi stated that a Public Hearing pertaining to the
preliminary clean water facility is scheduled and that he would attend.
City Attorney Bower requested a Study Session be set in the near future to discuss the
clean water facility.
Director of Administrative Services Yeats stated that Council would review, readjust, or
expand the budget in late April or May.
