in regular session in the Council Chambers at
7:00 p.m.

Mayor Vargas read the Proclamation declaring June 24, 1995 as the California
Highway Patrol Baldwin Park Area 25th Anniversary and requested that the
proclamation be mailed.
Director of Public Works Mousavi introduced the New Employee for Public Works
Department, Martha Alvarez and told of her background and education.
Chief of Police Lanza introduced the following Explorer Graduates:

RESOLUTION NO.95-37 APPROVING AND AUTHORIZING THE
EXECUTION OF A MASTER

It was moved and seconded to approve the Consent Calendar as presented. MIS/C:
LOWES/LOZANO. Mayor pro tern Martinez abstained on Item No.3 due to a possible
conflict of interest.

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Mayor Vargas requested the item pertaining to the Rate Increase Waste Management
of San Gabriel/Pomona Valley be continued to July 5th.
Director of Administrative Services Yeats requested an Ordinance be introduced to add
Section 10.19 relating to claims for money or damages against the City) and Section
10.20 relating to the statute of limitations for the review of City decisions) to the Baldwin
Park Municipal Code. Under state law, public entities are excepted from the claims filing
requirements when they use another public entity. However, state law allows a local
entity to reestablish a claims filing procedure that other entities must comply with in order
to correctly process a claim, and to establish a 90 day statute of limitations for certain
actions filed against the City. Staff recommended adoption of the ordinance.
It was moved and seconded to introduce Ordinance No.1103, AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADDING SECTION 10.19
RELATING TO CLAIMS FOR MONEY OR DAMAGES AGAINST THE CITY) AND
SECTION 10.20 RELATING TO THE STATUTE OF LIMITATIONS FOR THE REVIEW
OF CITY DECISIONS) TO THE BALDWIN PARK MUNICIPAL CODE," for first reading,
that it be read in title only and all further readings be waived.
The regular meeting of the City Council adjourned at 7:35 p.m. to a joint meeting with
the Redevelopment Agency.
Director of Administrative Services Yeats submitted the amended Fiscal Year 1995-96
Operating Budget for City Council reaffirmation. The FY 1995-96 Budget contained

expenditures totaling $31,366,853 which included all programs under the jurisdiction of
the City. General Fund Revenues and Transfers total $12,182,800 and Expenditures
total $11,840,371, resulting in an excess of $342,429. The FY 1995-96 Budget has been
balanced using various strategies, including cost containment measures. The City's
operating policies and procedures have been reviewed and reinvented to insure that the
City is doing things right, and doing the right things. The General Fund expenditures
were reduced by over $334,000, while staff has implemented a $4,000,000 Capital
Improvement program. Staff will continue to implement the Long Range Information
System Master Plan. He also told of the goals and expansion of programs of each
department in the City. Staff recommended Council adopt the resolution.
It was moved and seconded to approve Resolution No.95-38, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK REAFFIRMING THE BUDGET
FOR THE CITY OF BALDWIN PARK FOR THE FISCAL YEAR COMMENCING JULY
1, 1995 AND ENDING JUNE 30, 1996," and approve the Financing Agreement between
the City and the Redevelopment Agency. M/S/C: MARTINEZ/MUSE. There were no
objections.
Director of Administrative Services Yeats requested Council and Agency Board approval
of the Agency Budget for Fiscal Year 1995-96 and the provision of administrative staff
support and professional service to the Agency from the City'. The budget reflected a
basic reporting and administrative structure for the Agency. It indicated that some of the
Agency's project areas are built out and that most of the Agency's financial resources
are committed to meet existing indebtedness. Several properties have been purchased
in the Sierra vista Project Area and preliminary relocations have occurred. The
Disposition and Development Agreement is nearing completion and the Triangle project
should move into full implementation. Long standing agreements with developers have
been renegotiated in the Central Business District and Delta Project areas. The highest
priority' of the Agency for FY 1995-96 will continue to be the development along the San
Bernardino Freeway corridor. It was recommended that Council and Agency Board
adopt the resolution approving the agency budget and loan agreement in the amount of
$243,900.
It was moved and seconded to approve Resolution No.307, A RESOLUTION OF THE
BALDWIN PARK REDEVELOPMENT AGENCY APPROVING THE AGENCY BUDGET
FOR THE FISCAL YEAR 1995-96 COMMENCING JULY 1, 1995 AND ENDING JUNE
30, 1995" AND ACCEPTING THE FINANCING LOAN FROM THE CITY OF BALDWIN
PARK AND AUTHORIZING THE EXPENDITURES THEREOF. MIS/C:
MARTINEZ/MUSE. There were no objections.
The regular meeting of the City Council reconvened at 7:45 p.m. Roll call remained the
same.

Director of Administrative Services Yeats recommended that Council adopt a resolution
establishing the City's appropriation limit for Fiscal Year 1995-96 as required by State
law. Pursuant to Article X111 B of the California State Constitution appropriations made
by State and local governments may increase annually by a factor comprised of the
change in population combined with either the change in California per capita personal
income or the change in the local assessment roll due to local non-residential
construction. Data supplied by the State Department of Finance indicated that the
change in per capita personal income is 4.72% over last year and the population change
over last year is 1.01%. These factors combine to increase the City's annual
appropriations limit to $30,732,720 for FY 1995-96. It was recommended that Council
adopt the resolution setting the City appropriation limit for Fiscal Year 1995-96 at
$30,732,720.
It was moved and seconded to approve Resolution No.95-39, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, SETTING THE
ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 1995-96. MIS/C:
LOWES/LOZANO. There were no objections.

COUNCIUSTAFF REQUESTS AND COMMUNICATIONS
Mayor Vargas thanked staff for all the hard work on the budget. He requested that
staff contact the Tribune with a press release pertaining to the budget and the
Explorer Graduates.
Director of Administrative Services Yeats stated that the Tribune reporters are
currently working on an article pertaining to City Budgets and the reporters have
inquired about the City's stable financial condition.
Councilmember Muse recognized Director of Public Works Mousavi for receiving the
Lucky Baldwin Award. She stated: 1) that Director Mousavi will be going to Iran to
share a ten year pavement management plan at the University; and 2) the Bike
Rodeo was very successful. She requested that pictures of the first time homebuyer
be taken in front of their newly purchased home and that the picture be placed in the
NOW to help the program.
In response to Councilmember Lozano, Chief Lanza stated that with the hiring of
Officers Kuberry and Meister the Bike Patrol will be scheduled for four days a week;
and Director of Community Development Carbajal stated that at the next Planning
Commission meeting the Commissioners will be discussing parking requirements,
signage, and Conditional Use Permit process for businesses.

Mayor pro tern Martinez stated that Jennifer York showed, on T.V., the Teddy Bear that
was given to her at the Open House, and he thanked staff for a good job. He also
stated that the tree by the Amphi-theater at Morgan Park is dead.
In response to Mayor Vargas, Director of Public Works Mousavi stated that some of the
trees on Ramona had to be heavily trimmed due to possible liability, while others could
be moderately trimmed.
City Attorney Bower stated that his office had received an appeal on a Public Works
dispute with COPP Contracting, Inc. for CIP 292.

No action was taken by Council. Direction was given to staff.
