Mayor Vargas read the Proclamation celebrating September 23, 1995 as the 75th Anniversary of the League of Women Voters and presented it to Marcia Arkin. Mayor Vargas, Councilmembers Lozano, Martinez, and Muse, and Planning Commissioners Ochoa-Schutz and Oclaray presented 1995 Beautification Finalist Awards to the Conti Family, 4351 Harlan, and to the Henry Family, 14145 Clark Street. Mayor Vargas presented the 1995 Beautification Winner in Recognition of Outstanding Property Maintenance to Ray and Francisca Zabel, 15131 Howellhurst. The Notice of Public Hearing was published and is the last step prior to submitting the GPR to HUD. The highlights of the GPR were 1) Assisted Down Payment Assistance) 15 families in buying their first home in Baldwin Park; 2) A total of 3,077 lineal feet of sidewalk constructed; 3) A total of 15,708 lineal feet of street reconstructed; and 4) 22 rehab loans and 3 grants made under the Low Interest Residential Loan Program. It was recommended that Council approve the GPR and instruct staff to incorporate any and all public comments into the final adopted GPR. Mayor Vargas declared the Public Hearing open pertaining to the Grantee Performance Report GPR) for the 20th Year CDBG Program of the City Fiscal 1994-95) and invited those wishing to speak to come forward. There were none. Mayor Vargas declared the Public Hearing closed. It was moved and seconded to approve the GPR and instruct staff to Incorporate any and all public comments into the final adopted GPR. MIS/C: MARTINEZ/MUSE. There were no objections. 00- REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES Acting Director of Administrative Services Cole proposed amendments to the City's current contract with the Public Employees' Retirement System PERS) and recommended that the Council approve and adopt the Resolution of Intention. PERS allows contracting agencies the opportunity to amend their contracts to provide options that are beneficial to both the agency and their employees. The first amendment provides two years additional service credit to those employees who could be subject to mandatory transfers, layoffs, and/or demotions, if they elect to retire within a designated period of time. The second amendment provides employees the option to purchase up to four years of any continuous active military or merchant marine service prior to employment to increase the number of their service years. Staff recommended that Council approve and adopt the Resolution of Intention, including the Exhibit"" contract amendment. It was moved and seconded to approve RESOLUTION NO. 95-63, A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF BALDWIN PARK," including the Exhibit" contract amendment. Administrative Assistant Roessler recommended Council support the resolution on sales tax redistribution to increase the amount received by cities to 2%. The resolution directs the League of California Cities to initiate legislative actions, either through a ballot initiative, to change the percentage split to 4% for the State and 2% to cities. It was recommended to support the League of California Cities proposal on sales tax redistribution. It was moved and seconded to approve RESOLUTION NO. 95-64, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK SUPPORTING THE LEAGUE OF CALIFORNIA CITIES RESOLUTION PN SALES TAX REDISTRIBUTION TO INCREASE THE AMOUNT RECEIVED BY CITIES TO 2%." MIS/C: LOZANO/MUSE. There were no objections. Director of Human Services Nunez purposed an agreement with a carnival amusement company to provide services for the Celebrate Baldwin Park festivities in 1995. Seven carnival amusement companies were contacted and sent a request for proposal for carnival amusement services for the festivities. Staff requested proposals to include the highest compensation paid to the City, payment for security, fencing, restrooms, and the provision of complimentary tickets. Staff also requested that the Baldwin Park Police Department be hired to provide security for the event. A detailed comparison of the services offered from Christiansen Amusement and Maurer Concessions and Rides was listed in the staff report. Based on the information received by the two carnival amusement providers, staff recommended entering into an agreement with Christiansen Amusements for carnival services for the 1995 Celebrate Baldwin Park festivities. In response to Council, Director of Human Services Nunez stated that the 1,000 free tickets would be distributed through the schools Home Liason Aides, and that the 1,000 tickets were the same as last year. Mayor pro tem Martinez requested 1,000 tickets that would allow 1,000 children to get on rides. He also requested that the carnival be monitored for the $1 fee to be waived for admission for all children under the age of 12 when accompanied by an adult. Mayor Vargas and Councilmember Muse requested 1,000 free family day tickets and requested that staff negotiate for the family day passes. In response to Mayor pro tern Martinez, Director of Human Services Nunez stated that the City receives 30% up to $40,000 and 35% over $40,000. The carnival pays for the police department's time, assembles and provides the booths for the non-profit organizations, provides the type of games to be played, and sells the prizes to the non- profit group for $75. The carnival obtains all permits and licenses, not only from the City, but the County. In response to Mayor pro tern Martinez, Director of Human Services Nunez stated that a representative from the carnival will be present at the October 4th Council meeting. Mayor Vargas requested that next year, since this is a service agreement, that this be entered into as a negotiated agreement, and Council will direct staff to negotiate with a single vendor. It was moved and seconded to direct staff to begin the negotiations to enter into an agreement with Christiansen Amusement for carnival services for the 1995 Celebrate Baldwin Park festivities in addition clarify the type tickets and how the food and game booths are operated. MIS/C: VARGAS/MUSE. There were no objections. Chief of Police Lanza requested authorization from Council to hire a ninth dispatcher and to allow the Police Department staff to commence with recruitment efforts. The Police Department previously budgeted for a ninth dispatcher but due to general fund revenue uncertainties, the position was cut. It was brought to Council's attention that the ninth dispatcher would assist in providing double dispatcher coverage, 24 hours a day, 7 days a week. Proposition 172 fund revenue, along with expected savings from salary and overtime accounts, will be sufficient to fund the position. Staff recommended approval. Council discussed the need for another dispatcher that is bilingual, specifically in Spanish, the compensation required for the ability to translate, and that the demographics of the City is mostly Spanish speaking people. In response to Council, Acting Director of Administrative Services Cole stated that compensation is paid to employees that are bilingual. If the City will now require bilingual employees the City will have a process to go through with the compensation for the other City employees. In the recruitment of employees, being bilingual in Spanish is highly desirable, but it is not mandatory. It was moved and seconded to approve the ninth dispatcher position for the Police Department and require that position be bilingual in Spanish. MIS/C: MARTINEZ/LOZANO. There were no objections. Director of Public Works Mousavi requested Council award a contract to Excel Paving Company for the construction of the City parking lot on Ramona Boulevard. The project includes the repair of failed sections of asphalt pavement, the installation of one and one-half inch asphalt overlay, wrought iron fencing, a handicap ramp and a security system. The lowest responsible bid was $84,450 from Excel Paving Company. The Engineer's Estimate for the project was $75,000, however, the estimate did not include any security gates or electrical work. Within FY 1995/96, only $56,000 has been allocated from General Funds, therefore, an additional appropriation of $43,507 is required in order to complete the project. Staff recommended approval. In response to Council, Director of Public Works Mousavi explained the process for the Engineer's Estimate. He further explained that the driveway from Bogart to the compound area will be open with a gate to the parking lot, and an entrance from Ramona. The driveway on Ramona will be separate from the Chinese restaurant driveway, and the Fire Department does require two accesses be available to an enclosed area. The security will include a card reader, and an option would be that the Ramona driveway be used for exit only. It was moved and seconded to approve 1) an additional appropriation in the amount of $43,507 from the General Fund; and 2) award a construction contract in the amount of $84,450 to Excel Paving Company and authorize staff to enter into an agreement with Honeywell, Inc. to install the security system. In addition, authorize the Director of Public Works to execute any necessary change orders in an amount not to exceed five percent 5%) of the original contract amount. MIS/C: MARTINEZ/LOZANO. There were no objections. Director of Public Works Mousavi requested Council to terminate the contract with Fierro Janitorial Services. The services of Fierro Janitorial have consistently failed to perform satisfactorily to the specifications of the contract. A janitorial service checklist was developed in order to assist Fierro Janitorial. The checklist were done every Friday by staff and the checklist revealed that several items were repeatedly left unattended. Staff met with Mr. Fierro on several occasions to discuss the unsatisfactory performance. Staff is proposing to award the contract to the second lowest responsible bidder, Bell Building and Maintenance Company. The total annual contract with Bell will be $79,380 which represents an increase of 12% over the current contract. It was recommended that Council terminate the contract with Fierro Janitorial Services. It was further recommended that Council award the contract for janitorial services to Bell Building and Maintenance Company in the amount of $79,380. Councilmember Muse expressed her regret to terminate a contract with a local business, but supported the action due to the deficiencies. It was moved and seconded to terminate the contract, effective October 21,1995, with Fierro Janitorial Services, and to approve the award of contract for janitorial services to Bell Building and Maintenance Company in the amount of $79,380.
