The City Council of the City of Baldwin Park
met in a Study Session in Room 307 at
6:00 p.m.
ROLL CALL: PRESENT: COUNCILMEMBERS LOWES, LOZANO,
MARTINEZ, MUSE, AND MAYOR VARGAS
ALSO PRESENT: City Attorney Bower,
Chief of Police Lanza,
Dir. of Administrative Services Yeats,
Acting Dir. of Human Services Adanto,
Dir. of Public Works Mousavi, and
City Clerk Gair

ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to speak
on any subject to come forward.
Maria Martinez, 2121 Pacific, stated that TIC programming should include community
and church services. People that are shut-ins like to have church services videod and
more community events. She felt the time spent on community events was too limited.
She asked how does she go about getting something done and cause things to happen.
She further stated that others have concerns about this and the classes.
There being no other speakers, Mayor Vargas declared Oral Communications closed.

REPORT
Juan Herrera, TCI, General Manager introduced himself and Keith Cooper. He stated
that he transferred from Oklahoma and is originally from California. He communicated
his desire for TCI to get closer to the community, that he has a real sense of community
and is committed. He introduced Janet Turpen, Franchise Administrator and Deborah
Luppold, Director of Government and Community Relations.
Mayor Vargas stated that he was glad that TCI was here. The City wants to establish a
better relationship and have basic issues concerning 1) customer service; 2) community

events covered; and 3) lack of communication when events are not covered. We want
to feel like Baldwin Park matters.
Mayor pro tern Martinez stated his biggest concern is accessibility for the certified training.
Public Access should not involve politicians, but should involve the residents and real life
stories, and it should be promoting activities. Public access has been very difficult for
those who desire to participate in the course, there are too many obstacles. East Los
Angeles has a great public access channel, and he would like to see this happen to
promote the youth. He spoke about those who have called and received no call back.
He also stated that the Bulletin Boards are: 1) old information; 2) not reliable; 3)
concerts at the park were broken into segments; and 4) sporting events cut out in the
middle of the game. He further stated that he wanted to take this opportunity to
communicate to TCI and would like to see us move forward.
General Manager Herrera stated that he thinks the problems can be fixed quickly, he will
look into the matter. He further stated that TCI may be able to come up with access but
maybe there's another way to accomplish this.
Keith Cooper stated that Channel 32 carries educational programs on day time shows,
but night time is different. Channel 33 is show productions in Hacienda Heights, and it
is a bulletin board and access that is broadcast in Baldwin Park.
Director of Community Relations Luppold defined community access as: 1) Local
Organization; 2) Government Access; 3) Educational Access; and 4) Public Access.
Public access is a forum to speak on a message. Any message is appropriate and after
training, anyone may do this. She felt that TCI needs to look at how this obligation is
being filled, and to look at all facets of programming.
In response to Mayor Vargas, Director Luppold stated that Government Access could be
used as Council Meeting coverage. It deals with non-commercial in nature, not political.
City government can speak to citizens. She also responded that to produce a program
in Spanish, training would be required.
Mayor Vargas stated there is a need for the Spanish programming when you look at the
numbers that this might effect.
Councilmember Lowes said she does not have cable because she's heard too many
complaints, such as charges are passed on to customers regarding the franchise fee.
In response to Mayor pro tern Martinez, Mr. Cooper stated that he could buy his cable
remote.

Ms. Luppold stated that the charges for franchise fees is allowed by law and is passed
on at 5% of gross revenue.
Mr. Herrera stated that he can be personally called regarding complaints. He will speak
to constituents, that there are no mirrors in how costing is done.
Councilmember Lowes inquired how this is related to the customer on the billing. In
response, TCI stated that the franchise fee is charged to the customer and returned to
the City as a fee.
Director of Administrative Services Yeats state the fee is equal to approximately $70,000
per year.
Ms. Luppold stated FCC has agreed that the franchise fees can be passed to the
customer. The only item considered is whether the fee should be on gross revenue.
Mr. Herrera stated he would return to a study session and explain, in detail, the billing
process.
Councilmember Lozano shared some of the concerns he has heard. He served on the
Community Access Channel in East Los Angeles. He stated the need for positive
programming in our City. He's looking forward to working with TCI.
In response to Councilmember Muse, Mr. Cooper explained how Hacienda Heights
programmers are trained and how they do their programs.
Mr. Herrera stated that the Baldwin Park office varies in activities, but is mostly a
payment station.
Council expressed concerns about the equipment in the training classes. Council wanted
more local organization of programs.
Mr. Herrera stated that he wanted to go back and work on some solutions for TCI and
the City, and come back with a presentation. He spoke regarding the changes that come
about constantly. He stated the difficulty in keeping a balance in programming, and how
he wants to have strong communication.
Mayor Vargas invited TCI to return. Bob Roessler will be following up with TCI to
determine the best way to meet these desires. He also stated he would like to schedule
the events for the year. TCI agreed.
