The City Council of the City of Baldwin Park
met in regular session in the Council Chambers
at 7:00 p.m.

Mayor Vargas read the Proclamation declaring October 29 November 4,1995 as Adult
Education Awareness Week" and presented it to Jean Nelson.
Chief of Police Lanza introduced Police Officers David Herrera and Raymond Findley and
told of their background and education. City Clerk Gair administered the Oath of Office
to Police Officers Herrera and Findley.
City Clerk Gair explained that Deputy City Clerk Branek had completed the education
requirements and point system to become a Certified Municipal Clerk. City Clerk Gair
presented Deputy City Clerk Branek with a Certified Municipal Clerk's Pin.
Mayor Vargas stated that Director of Public Works Mousavi won First Prize for his salsa,
and Director of Administrative Services Yeats won Second Prize for his guacamole at a
recent Men's Prostate Cancer Awareness Seminar. Mayor Vargas presented Director
of Public Works Mousavi with a First Place Medal.

Larry Walton, 3802 Big Dalton, thanked Council and the Kiwanis Club for the Halloween
program sponsored at the Community Center. He felt that the program was very positive
and that Baldwin Park is a great place to live.
Jaspal Soni, property owner of 14353 Garvey, stated the problems he was having
repairing his property for occupancy.
Gerardo Pinedo, Field Representative for Matthew Martinez, stated that he had been
welcomed by staff, and that it was a pleasure attending the Council meeting. He would
be available for any questions, or to offer services from Congressman Martinez' office.
Steve Dugan, contractor for Jaspal Soni, stated that Mr. Soni has been waiting for a
return call from staff pertaining to the 14353 Garvey property. He also stated that they
want to resolve any conditions required by the City so that the property can be occupied.
There being no other speakers, Mayor Vargas declared Oral Communications closed.

Council member Lowes requested that Item No.8 be removed for separate consideration.
It was moved and seconded to approve Consent Calendar Items 1-7 & 9. MIS/C:
MARTINEZ/LOZANO. There were no objections.
In response to Councilmember Lowes, Chief Lanza stated that the $155 per hour is for
flight time. The cost for the program is $120,000 that includes the officer's time.
Councilmember Lowes expressed her concerns for the cost of the helicopter program,
and that payment for the use of the helicopter services by other cities was under
compensated. She felt that each of the five participating cities should pay equal for equal
participation. Since the cities are willing to pay up to $1200 per month, she felt that the
cities used the helicopter service on a regular basis.
In response to Councilmember Lowes, Chief Lanza stated that there is some confusion
over the sharing of cost for the helicopter program, that the helicopter only routinely
patrols the City of Baldwin Park, and it only leaves the City to go to the other five cities
on request. Those are requests for specific type incidents. The helicopter is in the City
of Baldwin Park 95% of the time.
It was moved and seconded to approve Item No. 8 as presented. MIS/C:

PUBLIC HEARING
The regular meeting of the City Council was called Into a Joint Public Hearing
with the Redevelopment Agency at 7:50 p.m.
Mayor Vargas introduced the Public Hearing pertaining to *"To take public
testimony regarding the disposition of 18.1 acres of property located immediately
north of the San Bernardino Interstate 10) Freeway. The approximately 18.1 acre

triangular shaped property is bounded by the I-10 Freeway, Baldwin Park Boulevard,
Francisquito Avenue, and the Santa Fe Public Transportation SPT) rail line. The
Jack-in-the-Box restaurant at the corner of Baldwin Park Boulevard and Francisquito
Avenue is not a part of the project.) The proposed project is for the development
of a retail commercial center. The Disposition and Development Agreement for the
Centre at Sierra Vista Triangle Center Project)."
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on
the Disposition and Development Agreement for the Centre at Sierra Vista Triangle
Center Project) to come forward.
Michael Messlna, 1101 S. 2nd Street, Alhambra, SDC Partner, stated that he was at the
meeting to answer any questions from Council, staff or the public. He stated that he was
disappointed and frustrated that the DDA could not be completed tonight. He believes
that everything could be brought together in a couple of days and asked if Council would
consider an adjourned meeting.
Mayor Vargas stated that the DDA was continued from the October 18th Council meeting
and that the item would be continued again to November 15th.
Sandi Lucas, 4442 Bresee, stated the DDA in the present form is a good document.
She expressed her concern for Mr. Rojo's business located in the project area. The City
has an obligation to make sure a business and/or residents have equal, if not better. The
City should work with this man and make things equatable for Mr. Rojo. She stated that
she was disappointed in the attitude of staff, and feels that they should be working with
this man and making sure things are easy for him to go into business. Mr. Rojo has been
in business for 18 years in the City. Council needs to take a personnel interest to make
sure things happen for the best for the businesses and residents.
There being no other speakers, Mayor Vargas stated that the Public Hearing pertaining
to the Disposition and Development Agreement DDA) would be continued to
November 15th.
In response to Mayor pro tem Martinez, Director of the Redevelopment Agency Yeats
stated that based on the legal requirements and the high priced contracts with consultants
that are doing the actual negotiation for the acquisition and the relocation, there are legal
requirements that we are following so that we comply with the law. He reminded the
crowd that there are legal requirements with which the City can legally spend for the
property that are in accordance with AB 1290. The City is trying to follow those
requirements and stay within the budget of the project. He stated that he is trying not
to meet with the residents, except for Mr. Rojo. He met with Mr. Rojo on Tuesday. The
consultants will do the actual calculation of the numbers for what will be replacement
housing and actual relocation costs. Then, if we can not come to an agreement, Director

Yeats stated he would be in a third position to make the offer from the Agency standpoint
that would be beneficial to the City and the property owner. If the City can not come to
a reasonable agreement at that point in time, then we would go through the normal legal
process which would be a Resolution of Necessity and Eminent Domain. He further
stated that he has a report that he received from Cutler and Associates on Tuesday, and
a copy will be placed in Council's status report.
In response to Mayor Vargas, Director Yeats stated that the last thing the City wants is
to go into eminent domain on any property and he conveyed that to the PAC members
at their last meeting. He stated that he is attempting to meet with all of them, he has
met with the consultants this week and gave them parameters for a price range which
they could go to, perhaps make a more equatable offer based upon the appraisals that
the City has had. He further stated that he felt that they are making significant progress
with most of the property owners in the project.
It was moved and seconded to continue the Public Hearing pertaining to the
Disposition and Development Agreement DDA) to November 15th. MIS/C:

The Joint Public Hearing of the City Council and Redevelopment Agency was
recessed at 8:02 p.m.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilmember Muse requested a report pertaining to a left hand turn lane on
Ramona to the Presidents Plaza; and 2) staff look into the accidents that have
happened on Vineland and some way to control the speeding traffic.
Councilmember Lowes requested 1) her travel expense report; 2) a copy of Council's
pay schedule; 3) the water treatment plant has offered a bus tour to a near by facility
for residents that are concerned with various issues, and that notification be sent to
the residents in the area; and 4) that staff prepare a report pertaining to signs being
posted stating no truck route" so that the big trucks parked on Tracy and elsewhere
can be cited.
Councilmember Lozano requested Public Works contact Congressman Martinez' office
or Assemblyman Gallegos office concerning the bushes that need to be chopped

down in front of the Guadalajara Grill by Cal Trans, and find out why the City of Baldwin
Park doesn't get the same treatment as West Covina.
Mayor Vargas requested that a copy of a program called the Neighborhood Preservation
Strategy"' be placed in the Status Report and given to the E-Team, and to look at a way
to implement this program in the City.
City Clerk Gair stated that Weatherman Maclovio Perez has promised good weather for
the parade and there are 435 entries in the parade including dignitaries, bands drill
teams, tall flags, civic groups and some very pretty cars. Some people that are from
Azusa have volunteered with their classic vehicles for the parade.
