met in regular session in the Council Chambers
at 7:00 p.m.

Chief of Police Lanza introduced Police Officer John Patino and told of his background
and education. City Clerk Gair administered the Oath of Office to Police Officer Patino.
Director of Administrative Services Yeats introduced the new employee in the
Administrative Services Department, GIS Coordinator Jim Keller and told of his
background and education.
Director of Administrative Services Yeats told the background, education, and experience
of the nominees for Employee of the Year, both part-time and full-time employees. He
introduced the part-time nominees for Employee of the Year, Ricardo Zarsa, Nancy
Romero and George Zarsa. He also Introduced full-time Employee of the Year
nominees, Art Castellano, Mark Dozmati, David Villela, Delores Madsen, and Bob
Roessler. The winners will be announced at the City's Recognition Dinner on December
8th.

Mayor Vargas declared Oral Communications open and invited those wishing to
speak on any subject to come forward.
Jean Carpenter, 3441 Vineland, President of the Chamber of Commerce, stated that
a new Executive Director of the Chamber of Commerce had been hired, and invited
everyone to the Chamber Open House.

Jeanne Martens, 14848 Sierra Way, inquired about the property located on Garvey and
Vineland that has soil contamination, and stated that Cal-Trans needs to clean up the
area along the freeway.
Larry Walton, 3802 Big Dalton, stated that the citizens of Baldwin Park are paying for
two police departments, the City and the School Police. He asked if the School District
did not have confidence in the City Police Department? He suggested a police
department commission. He asked the City to consider purchasing a table for Council
at a fashion show on February 2 at St. John's.
Bill Van Cleave, 13232 Emery, stated that Baldwin Park Beautiful would be out on
Saturday, 16th, and that their new trailer would be on display at the Community Center.
There being no other speakers, Mayor Vargas declared Oral Communications closed.
Mayor Vargas explained that the City can not purchase a table for events with public
funds. Individuals may purchase, but not a public entity.

City Attorney Bower stated that after the agenda was posted a Subsequent Need Item
arose to take action on under Reports of Officers as Item No. *`ll.C.1". The
documents that were received required action before the next Council meeting.
It was moved and seconded to add the Subsequent Need Item to the agenda
pertaining to a Co-Grantee in a State ABC Grant in conjunction with West Covina and
Covina. MIS/C: MARTINEZ/LOWES. There were no objections.

PUBLIC HEARING
The regular meeting of the City Council was called Into a Joint Public Hearing
with the Redevelopment Agency at 7:40 p.m.
Mayor Vargas Introduced the Public Hearing pertaining to taking public testimony
regarding the disposition of 18.1 acres of property located Immediately north of
the San Bernardino Interstate 10) Freeway. The approximately 18.1 acre
triangular shaped property Is bounded by the I-la Freeway, Baldwin Park
Boulevard, Francisquito Avenue, and the Santa Fe Public Transportation SPT)
rail line. The Jack-In-The-Box Is not a part of the project.) The proposed project
is for the development of a retail commercial center. The Disposition and
Development Agreement for the Centre at Sierra Vista Triangle Center Project)."
Mayor Vargas declared the Public Hearing open and invited those wishing to speak
on the Disposition and Development Agreement for the Centre at Sierra Vista
Triangle Center Project) to come forward. There were none.
Mayor Vargas declared the Public Hearing closed.
Director of Administrative Services Yeats stated that the Public Hearing had been
continued from the past two Council meetings as Staff continued to meet with SDC
and with Dayton Hudson Target) to work out final language to the DDA. The last of
the changes have been completed and the most significant change is that the Agency
will now be contributing $65,000 back to Target for facade improvements in their
project. Staff had asked for, and SDC is paying, the other portion of the $65,000 for a
total of $130,000 for the improvements to the facade. The facade improvements
includes a tile roof, and tiled and arched entry ways to the Target building. Staff
recommended that Council and the Agency Board adopt Agency Resolution No.310
and Council Resolution No.95-71.

It was moved and seconded to approve Agency Resolution No.310, A RESOLUTION
OF THE REDEVELOPMENT AGENCY OF THE CITY OF BALDWIN PARK APPROVING
A DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE
REDEVELOPMENT AGENCY OF THE CITY OF BALDWIN PARK AND SCD
PARTNERS, LTD., AND DAYTON HUDSON TARGET) PERTAINING TO THE
DISPOSITION AND DEVELOPMENT OF AGENCY-OWNED REAL PROPERTY
LOCATED IN THE CITY OF BALDWIN PARK, AND MAKING FINDINGS THEREFOR AS
REQUIRED BY HEALTH AND SAFETY CODE SECTION 33433. M,S/C:
VARGAS/MARTINEZ. There were no objections.
Mayor Vargas commented that he was relieved that several years of hard work had been
completed, negotiating and working with residents. He also stated that he wanted the
residents dealt with in a fair and equitable way. There is still some work to do with SDC
to get tenants in the project. The community will be excited that they can go to a major
retailer in the City. The project will be finished March, 1997.
Councilmember Lowes stated that she was proud of the City Staff, the City Council, and
the developer with this project. The project will be brought to the City without the burden
and pain of some of the other projects.
Mayor pro tem Martinez stated that it is imperative to get the buildings boarded up, and
to keep the area cleaned up for the residents that are still living around the project.
Director of Administrative Services Yeats stated that he would be sending weekly/bi-
weekly updates on the progress of the status of acquisitions. The City is at a 70% figure
for final negotiations and signed documents, or submitted documents to the resident, or
property owner, and waiting for those documents to come back. Staff will continue to
work with the acquisition and relocation consultants. He also thanked Council and the
E-Team for their support and understanding. In response to Councilmember Lowes, he
stated that the City will get all the benefits of the property tax increments, and the sales
tax revenue.
Councilmember Lozano stated that this is a new era for the City. Residents can now
spend their money in our City. We have to have a bright future for the children of
Baldwin Park. He also stated that the City will work with the residents and hope that the
relocated residents will continue to live in the City.
Mayor Vargas introduced the development team, Mike Messina and Bill Ross.
The Joint Public Hearing of the City Council and the Redevelopment Agency was
recessed at 7:50 p.m.

The regular meeting of the City Council was reconvened. Roll call remained the same.
REPORTS OF OFFICERS. COMMISSIONS AND COMMITTEES
Director of Human Services Nunez requested Council allocate funds to lease
paratransit vehicles for a period of four months until the transit study is complete.
The City currently contracts with DAVE Transportation to provide paratransit service.
Three of the existing vehicles used to provide these services are no longer suitable
because they have excessive mileage and mechanical problems. The Human
Services Department is currently developing a transportation study for the City. The
interim suggestion to lease three vehicles for a temporary period until the study is
complete has been offered by DAVE Transportation.. This solution would have the
least impact on riders and would not disrupt service. It was recommended that the
City lease three vehicles from DAVE Transportation temporarily at a rate of $800 per
vehicle, per month for a period of four months until the transportation study is
complete.
In response to Mayor pro tem Martinez, Human Services Director Nunez stated that
the vehicles are being used, but because there is no agreement the City is not being
billed. DAVE will decide, after the Council meeting, whether to pull the vehicles out of
service or continue to operate with the old vehicles.
In response to Mayor Vargas, Director Nunez stated that the paratransit vehicles are
the big buses. The City of La Puente and West Covina lease their vehicles from
DAVE Transportation for the same $800 fee.
Mayor Vargas requested an accounting of DAVE Transportation that shows their
leases and their costs.
It was moved and seconded to approve the lease of three vehicles from DAVE
Transportation at a rate of $800 per vehicle per month for a period of four
months until the transportation study Is complete. MIS/C: MUSE/LOZANO.
There were no objections.
Director of Human Services Nunez requested Council authorize the purchase of a
new telephone system with Phoneby. The Department of Human Services currently
functions with a minimum of five lines and over a dozen work stations. The present
system has become obsolete and cannot handle the volume of calls received at the
Center. The equipment for the new proposed system was outlined in the staff report

with a total cost for the telephone system is $24,996.85. It was recommended that
Council approve the purchase of the telephone system proposed by Phoneby for the
Baldwin Park Community Center, to waive the formal bidding process, and authorize
staff to proceed with the installation of the phone system.
In response to Councilmem ber Muse, Director Nunez stated that the system is separate
from City Hall, and that the phone system will be able to send a recording of the up
coming events to the person that is on hold.
In response to Mayor Vargas, Director Nunez stated an allowance was made on the old
phone system equipment, and the price of the system is the net cost.
It was moved and seconded to approve the purchase of the telephone system from
Phoneby, to waive the formal bidding procedure, and authorize staff to proceed with
the installation of the phone system. MIS/C: MUSE/LOWES. There were no
object ions.
Director of Public Works Mousavi stated that in response to inquiries by Council regarding
the needs to improve traffic and pedestrian circulation within the vicinity of Charles
D. Jones Junior High School and the Intersection of Merced Avenue and Ahern
Drive. Staff took traffic counts, pedestrian counts, speed surveys, reviewed accident
records, and analyzed the geometric's of the street. Subsequent to the completion of
data gathering, staff conducted the following traffic warrant analysis in accordance with
the California Department of Transportation established procedures, and those are the
procedures used in the City of Baldwin Park to install any traffic control devices: 1) with
respect to traffic signals, a traffic signal is not required at this intersection; 2) a flashing
beacon is not required; 3) all signs and pavement markings are appropriate and properly
in place; and 4) crossing guards are required for elementary school pedestrians only.
Based upon all the information, the vicinity of Charles D. Jones Junior High School along
Merced Avenue and Ahern Drive do not require any further action to be taken at this time.
It was recommended that Council accept and file the report and not take any further
action on the subject intersection at this time.
Councilmember Lowes stated that she knows that the City requires crossing guards for
only elementary pedestrians. Holland Junior High School has a crossing guard that
accommodates the elementary children crossing Olive or Baldwin Park Blvd. to Margaret
Heath and to Santa Fe School. Some elementary school students do cross Merced to
get to their elementary school, which is Vineland, and because of that, and concern for
the elementary school children's safety that do have to cross Merced, she recommended
that a crossing guard be hired.

Mayor Vargas stated that he sees a lot of young children using the cross walk to get to
school. So with all due respect to staff, the City needs to respond to the needs of the
community over and above the requirements that are put upon us to make us do certain
things. In this case, he stated, that he supports the idea of having a crossing guard
in order to provide safety to the children that are going to the elementary school. It
doesn't prevent accidents, but it doesn't mean we should not do anything to help protect
the children. In spite of staff recommendation, Council should go ahead and provide a
crossing guard at the Merced Avenue and Ahern Drive intersection.
In response to Councilmember Muse, Chief Lanza stated that he did not have the exact
annual figures for a crossing guard but he estimated that it cost in the area of $2,000 per
year. Councilmember Muse stated that was a small price to pay for the safety of the
children that have to cross at that intersection.
It was moved and seconded that the City hire a crossing guard for the Merced Avenue
and Ahern Drive intersection to serve the elementary school children. MIS/C:

Director of Public Works Mousavi requested Council approval of an ordinance amending
the Baldwin Park Municipal Code adopting, by reference, the current editions of the
new uniform codes. The building industry is regulated by a number of codified laws
so that consistent energy efficient and structurally sound buildings are the end result of
construction efforts. The City utilizes these codes by adopting them by reference into the
Municipal Code. Prior to adoption by reference, Notice of Public Hearing must be posted.
The new uniform codes proposed to be adopted are Uniform Building Code, 1994 Edition,
Uniform Fire Code, 1994 Edition, the National Electrical Code, 1993 Edition, the Uniform
Housing Code, 1994 Edition, the Uniform Mechanical code, 1994 Edition, the Uniform
Plumbing Code, 1994 Edition, and the Uniform Swimming Pool Code, 1994 Edition. Staff
recommended approval.
It was moved and seconded to introduce Ordinance No.1108, AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN
SECTIONS OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO THE
ADOPTION OF NEW UNIFORM CODES," for first reading and that the Ordinance be
read in title only and all further reading be waived, and to establish a public hearing for
December 6, 1995. MIS/C: MUSE/LOWES. There were no objections.
Police Captain Kies requested Council approval that would allow the Baldwin Park Police
Department to participate as a co-grantee in a State Department of Alcoholic Beverage
Control grant with the cities of West Covina and Covina. Last year, the West Covina
Police Department requested Baldwin Park Police Department's participation in a joint

task force to combat alcohol related problems that are common to both communities.
The project was named Partners Against Alcohol Related Crimes PMRC). The new
PAARC program was proposed to include the participation of three cities, West Covina,
Covina and Baldwin Park. The requested amount for the grant was $96,674. The tri-city
proposal was approved by ABC with training scheduled to begin after January 1,1996.
Enforcement activities will include, but not be limited to, bar checks, off-sale establishment
undercover operations to enforce sales to minors, and DUI checkpoints. The teams will
operate on an overtime basis, grant funds covering the costs. The overtime status of the
task force will not impact normal staffing levels of the department. Staff recommended
Council approval of the resolution, authorizing participation in the ABC grant named
Partners Against Alcohol Related Crimes.
City Attorney Bower stated just for the record, that the Attorney's Office will go along
with recommending approval of the resolution. This resolution was provided by the State
as the resolution we need to adopt, it's less than a model resolution. There are several
inconsistencies in it, it authorizes the submission of a proposal to ABC for the grant,
obviously that has already been done. It talks about approving a contract which the State
is not even gotten to us yet. Its ambiguous as to who the authorizing agency is, and
frankly includes items that should really be in the contract and not the resolution. Since
this is the one that the State says to use, and we do not want to jeopardies getting these
funds, we would recommend going ahead and approving it."
It was moved and seconded to approve Resolution No. 95-79, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AUTHORIZING THE
PARTICIPATION OF THE BALDWIN PARK POLICE DEPARTMENT AS A CO-
GRANTEE IN A STATE ALCOHOLIC BEVERAGE CONTROL GRANT WITH THE CITIES
OF WEST COVINA AND COVINA A." MIS/C: LOWES/MUSE. There were no objections.

Councilmember Lowes requested that her microphone be repaired.
In response to Councilmember Lozano, Chief Lanza stated that there has been a
challenge to the San Jose Curfew Law by the ACLU and a California Supreme Court
agreed to hear it. Council will be updated on any decisions that are rendered.
City Attorney Bower stated that there are two cases the Supreme Court's looking at
1) curfew law, that is actually Bakersfield, and 2) the TRO against the gangs is the
San Jose Law. They both have wide impact on the City and the City Attorney's Office
is monitoring them and we will get decisions that uphold the City's power in both of
those areas.

Councilmember Lozano commended the Human Services Department, the Police
Department and City Clerk Gair for the parade.
Mayor pro tem Martinez requested a Study Session or report be addressed pertaining to
people riding in the parade that were candidates for office. He stated that he does not
want to turn the parade into a political event.
City Clerk Gair stated that she had been warned by American Legal that we have a very
weak parade ordinance. When we recodified the code, they pointed out that we need to
amend the ordinance because of a lot of the requests by different groups to enter a
parade, we are skating on thin ice with the ordinance we have. The people have first
amendment rights and we had people riding in the parade who were incumbent board
members who were active candidates. To deny somebody else the right to participate
might put the City in jeopardy.
In response to Councilmember Muse, City Clerk Gair stated the request for bingo on
Garvey started out being denied. They opened up administrative offices for this
Children's Positive I D bingo non-profit organization, and that was all approved. Then they
applied for bingo as a non-profit group, and they sounded like they wanted to use the
whole building to play bingo. They could not do that, because it takes 35 parking place
per sq. foot of the building. The group went back with an attorney and shrunk the size
of their bingo playing area to conform with the parking lot spaces. There was nothing in
their application that would allow us to deny it. We still can request by State Law 1%
of their profits after a certain amount, the only predicament this puts the City in is that,
we have never done this to St. John's and others. Our attorney has advised me that we
cannot discriminate. We will now have to ask that all bingo groups and make that same
contribution. The l.D. organization can only have 45 people play at a time. This is in
the redevelopment area and hopefully someone will come by and want to buy all that
battery tainted land and take the whole thing.
In response to Councilmember Muse, City Clerk Gair stated that Code Enforcement has
tried to monitor the auto repair on Susquehanna. When the Code Enforcement Officer
approached the owner of the property recognized our officer, and he did not open for
business that day. They seem to be working on Friday's and Saturday's and as soon as
we bring on board our other Code Enforcement Officers those days will be covered. A
Business License can not be issued for auto repair in a residential area.
Councilmember Muse stated that Director Mousavi has a couple of locations similar to
the water treatment site that is being proposed in the City, and asked if any one from
Council would like to visit these sites. Councilmember Lowes and Martinez stated they

City Attorney Bower stated that only two Councilmembers could go on the water
treatment plant tour.
Councilm ember Muse stated her concern about the numerous pool hall applications in the
City. She asked if a moratorium or a way the City limit the number of pool halls in the
City.
Mayor Vargas requested that the pool hall moratorium be brought to a Study Session.
Mayor Vargas requested 1) a thank you letter be sent to Tony Hernadez and another
man for arranging the reception for the Chinese Delegation; 2) the following be placed
on a future agenda regarding the renaming of the Senior Center in honor of Julia McNeill,
the Community Center in honor of Esther Snider, and Morgan Park in honor of Caesar
Chavez.

It was moved and seconded to adjourn the regular meeting of the City Council at 8:35
p.m. to a Team Building Session at the Community Center at 8:00 a.m. on November
