The City Council of the City of Baldwin Park
met in a Study Session in Room 307 at
5:00 p.m.

ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to speak
on any subject to come forward. There were none.

Development Services Manager Hutar presented to Council a copy of the proposed
billiard regulations, that included location criteria for siting billiard halls. Manager
Hutar presented several diagrams showing various alternative standards. She
explained that the shaded areas of the diagrams showed geographical areas in which a
prospective billiard hall would be precluded. She presented several development
standards and explained the impact on each alternative.
In response to Mayor Vargas, City Attorney Bower stated that one restriction could
include that a billiard hall can not locate within 1,000 ft of a park.

Council discussed the alternatives for the billiard halls and the impact on the areas.
Mayor Vargas stated that he preferred Alternative No.7, that stated a billiard hall could
not locate within 150 ft. of a residential zone, not within 1,000 ft. of another billiard hall,
and not within 1,000 sq. ft. of a school.
In response to Councilmember Lowes, City Attorney Bower stated that billiards are not
considered an adult business, the City does allow billiard halls in the City, and there are
places billiard halls could locate. Restrictions can be imposed on billiard halls, the City
is not prohibiting them from locating in the City.
Commission Ochoa-Schutz stated that he had a problem with the Definitions portion of
the Billiards Regulations. He asked if a bar, restaurant or teen club had more than one
table, would be considered a pool hall? He stated that if a church had coin operated pool
tables, they would be classified as a pool hall.
In response to Commissioner Ochoa-Schutz, Development Services Manager Hutar
stated that billiards had to be the primary use of the business. She further stated that
Global would be a close call if Alternative No.7 had been adopted when they made their
application.
In response to Commissioner Ochoa-Schutz, Mayor Vargas stated that the ordinance
needs to be made more clear, that the City, the Community Center and non-profit
organizations are exempt from being classified as a billiard hall when they have pool
tables.
Mayor Vargas suggested adding to Alternative No.7, that no billiard hall could locate
within 1,500 ft of a park.
In response to Mayor pro tern Martinez, Development Services Manager Hutar stated that
existing billiard halls would be grandfathered in.
Mayor pro tem Martinez asked if the pool tables were the problem or the alcohol that is
usually associated with billiards the problem?
Councilmember Lozano stated that he was concerned about the image of the City and
that is the reason he wanted the billiard halls discussed and guidelines set. He further
stated that most businesses can survive without liquor.
In response to Mayor pro tem Martinez, Planning Technician Harbin stated that a bar can
open in any Commercial or Industrial Zone with the issuance of a Conditional Use Permit.

appearance of the building; and 2) relating to police calls in the area.
Mayor Vargas stated that Alternative No.7 is acceptable with the amendment to include
1,500 ft from the park, to clarity the Definition,Z and not to group the non-profit groups
or organizations as billiard halls. He also stated two or more pool tables would be
considered a pool hall. He directed staff to look at the ordinance regarding liquor stores
and bars, that there are several bars around schools.
City Attorney Bower explained that there are major retailers that sell liquor such as
Lucky's and Ralph's.
Mayor pro tem Martinez requested the liquor store owners be notified prior to CUP
renewal.
In response to Mayor pro tern Martinez, Planning Technician Harbin stated that half of the
liquor outlets in the City do not have a CUP, their status will expire in the year 2,001,
and at that time the City can require a CUP or close them down.
Director of Public Works Mousavi described the way a public hearing is conducted at a
Planning Commission Meeting. A staff report is given, the Commissioners make
comments and then the appellant is allowed to speak. He further stated that the public
hearing needs to be opened prior to discussion by the Commissioners.
Commissioner Ochoa-Schutz stated that the Commission did use a format.
Commissioner Huetinck stated that the format could be obtained from the League of
California Cities.
Director Mousavi stated that the commissioners could ask technical questions, if there
is something that you don't understand, or call staff to get clarification.
Mayor pro tem Martinez and Councilmember Lowes both agreed that the commissioners
should give the public the opportunity to address the commission first.
Mayor Vargas directed staff to use the format used by City Council to conduct a public
hearing at the planning commission meetings.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Mayor Vargas stated that Council wanted to meet with the Planning Commission to
review the goals and visions for the City pertaining to the following: 1) safety; the
update of the General Plan; the Long Range Planning for Community Development
and Economic Development; balanced business growth; working to assist our large

retail centers; customer service to the residents; build up of reserves; having well
trained, highly paid employees; more community involvement in Town Hall Meetings;
infrastructure; to provide leadership in social issues with the School District; more
recognition for the City; upgrade housing with a renovation program; and focus on the
development of the freeway corridor. He asked if there were any issues that the
Commissioners did not understand?
Councilmember Muse stated that Baldwin Park 2000 held its first Steering Committee
meeting and that subcommittees had been formed. She invited any one interested in
serving on any of the following subcommittees to contact the organizer and that a person
only serve on one committee: Community Participation, the organizer is Mayor Vargas;
Employment, organized by Father Jim; Health, organized by Councilmember Muse;
Education, organized by Dr. Kemper; Safety and Security, organized by Chief Lanza;
Economic Development, Infrastructure, Housing and Technology, organized by Director
Mousavi and School Board Member Viramontes; and Recreation/Community Services,
organized by Director Nunez.
Commissioner Huetinck asked if something could be done about the colors painted on
homes? He also inquired about fences being even on streets, rather than some being
installed out to the curb.
Council discussed the freedom that people have to paint their homes any color and the
uniqueness in the community. Councilmembers and the Commissioners discussed the
problems with setbacks and the requirements for commercial setbacks.
Mayor Vargas directed staff to look into the problems of property setbacks.

Director of Public Works Mousavi presented an award that he received for Clean
Cities.
Director of Recreation/Community Services Nunez stated that the City had received 5-
6 Certificates for Good Neighbor."
Chief of Police Lanza presented a video that was recently presented on CNN
pertaining to the privitazation of the City jail.
