Chief Lanza presented King" with a retirement badge from the Police Department. Chief of Police Lanza Introduced new employee Police Dispatcher Liliana Pedroza and told of her education and background. City Attorney Bower stated that Consent Calendar Item No.5, Bobby Bales and lgnacio Franco will be deleted from the agenda. The claim for Bobby Bales was filed late and the claim for Ignacio Franco was incomplete. Bill Van Cleave, 13232 Emery, stated that the last three times he and his wife called the Baldwin Park Police Dispatch they have been disappointed. He told of the difficulty in getting the police dispatcher to send officers to investigate a possible stolen vehicle, and getting cooperation from the dispatcher to call the Highway Patrol about an accident on the freeway and a freeway on ramp. Frank Estrada, 3119 Stewart, stated that he rides the Metrolink to Los Angeles every day. He spoke of his concerns regarding the significant amounts of graffiti, the junk cars in backyards, and trash along the Baldwin Park route. He stated that people drive 50 mph minimum on Stewart Street, from Ramona Blvd. to Los Angeles St. He also inquired about receiving inforrnation on the water treatment plant. There being no other speakers, Mayor Vargas declared Oral Communications closed. CONSENT CALENDAR The Consent Calendar consisted of the following: 1. Mayor pro tern Martinez abstained on Item No.3 due to a possible conflict of interest. PUBLIC HEARING Chief of Police Lanza requested Council approval of a fee schedule revision relative to jail booking fees. It was determined that the Baldwin Park Police Department should charge an approximate fee of $65 per day booking fee for prisoners other than those arrested by Baldwin Park Police Department. Staff surveyed a number of nearby police departments charging such booking fees and determined that $75 would be a more appropriate fee. Staff recommended that Council adopt a jail booking fee of $75 per day per prisoner. In response to Mayor pro tem Martinez, Chief Lanza stated that separate agreements would need to be adopted by each city that wants to use the jail facility. The City of Covina charges $95 and the City of West Covina charges $85 for booking fees. It was moved and seconded to approve RESOLUTION NO.96-18, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO. 96-13 SETTING FEES AND CHARGES FOR ISSUANCE, PROCESSING AND FILING OF VARIOUS SERVICES AND PERMITS IN THE CITY" approving a jail booking fees at $75.00 per day per prisoner. Some of the problems include a proliferation of parking variance requests and also parking calculation for commercial uses, particularly shopping centers. At their January meeting, the Commission voted to recommend to the Council the proposed changes as outlined in the staff report. In addition to a minor clarification and cleanup there are six major changes to the ordinance 1) a reduction in the parking stall size; 2) a reduction in the minimum parking rates for commercial and restaurant uses; 3) the creation of a commercial center' shopping center) parking rate which simplifies the calculations for multiple use commercial properties; 4) an increase in the parking lot landscape requirements; 5) the allowance of subterranean and semi-subterranean parking for multi-family residential projects; and 6) the allowance for carports and garages for multi-family residential projects. Item 6 was included as a result of the 1994 Housing Element update. The State Department of Housing and Community Development HCD) required the City to commit to revising its multifamily parking standards as a condition to certifying the City's Housing Element. Staff and the Planning Commission recommended approval. In response to Councilmember Lozano, Manager Hutar stated that the Target Stores have their own standards that they have to meet, and it turns out that it is more than the existing code. Mayor Vargas declared the Public Hearing open and invited those wishing to speak pertaining to the parking ordinance to come forward. Bill Van Cleave, 13232 Emery, stated his concern for parking mid-size to large vehicles in spaces that have been narrowed. He requested that some leniency be given for the larger pick-up trucks and 4 wheel drive vehicles. There being no other speakers, Mayor Vargas declared the Public Hearing closed. In response to Councilmember Muse, Manager Hutar stated that the universal stall size is 8' 6", and that Target Stores only has one size parking stall and it is larger. The new ordinance for commercial usage would require 1 space per 100 ft. of gross floor area. She also clarified the landscaping requirements. In response to Councilmember Muse, Director of Public Works Mousavi stated that the architects have to work with specific design requirements in order to comply with the ADA requirements. They do not have to have access to all the units that are Multi-family, several units can be designated as handicapped. Council ember Muse stated her concerns with carports. She further stated that it would be a mistake for the City to allow the carports, just to get some grants. There is no protection to keep the cars from being stolen, and that carports are unsightly. Mayor pro tern Martinez stated that he agreed with Councilmember Muse, that he does not like carports, that they look tacky. He requested that design review be made for each of the subterranean parking areas so that flooding is not an issue. Councilmember Lowes stated that she would not only like to have the design review for the subterranean parking for flooding, but also for the aesthetics. She also agreed with Mayor pro tern Martinez and Councilmember Muse that the carports are unacceptable, that people need a garage. Councilm ember Lozano stated that he objected to carports, that some of the older homes have carports and they are dilapidated. ft was moved and seconded to amend the Ordinance to delete Item No 6 regardIng carports. M'S: MUSEILOWES. In response to Mayor Vargas, Director of Public Works Mousavi stated that if carports in, Item No.6 is amended it could affect the Home Grant Program, because the State was strong in placing that wording in the ordinance. He also stated that developers will have the option of either a carport or a garage. Staff will look hard at the carports, in design review, to make the design so restrictive and difficult that even the cost would be comparable to a garage. The carports could require landscaping, security lighting, and a security system and garages are more marketable than carports. The approval of the Home Grant last year was conditional on the City revising its ordinance to allow carports. In response to Mayor Vargas, Director of Administrative Services Yeats stated that the committed amount for the Home Grant Program is $500,000, and it can be utilized for various purposes, including multi-family and single family. It is currently being used for single family projects and rehabilitation projects. The intent is to eventually have some senior housing that is a multi unit construction, and in those types of units the City would want to ensure that there are garages, or some type of structure for storage of a vehicle. Telacu has carports with storage units. Mayor Vargas clarified that the carports are not for single family units, but for multi-family units. He agreed with Councilmember Muse that this change in the ordinance is something that is placed on the City to get the funding, but the selling price of a unit may prohibit people from buying a home, and that he has no problem with a carport. In response to Mayor pro tern Martinez, Director Yeats stated that multi-family is more than two units, two units constitute a duplex. The City will still have control through design review as to what a carport will look like and where the carports will be located. If Covina or any other City has the Home Grant Funds they will be required to have carports. Councilmember Lowes stated that after summarizing all that had been said, she would withdraw her second to the motion. Councilmember Lozano stated his opposition that the State has imposed the carport requirement. Mayor pro tern Martinez stated that he would second the motion to amend item No.6 of the ordinance. AZC-135) for first reading, to be read in title only, and all further reading be waived. MIS/C: LOWES/LOZANO. There were no objections. Director of Public Works Mousavi requested Council authorize the street name change from Robin Avenue to Cesar Chavez Drive and adopt a resolution changing the street name. On March 6th Council adopted a Resolution of Intention setting the time and place for a public hearing to the street name Change from Robin Avenue to Cesar Chavez Drive. Robin Avenue runs North from Ramona Boulevard and then turns East and runs to Laurens Avenue. It was recommended that Council 1) conduct the public hearing; and 2) adopt the resolution for changing the street name of Robin Avenue to Cesar Chavez Drive. Mayor Vargas declared the Public Hearing open and invited those wishing to speak regarding the street name change of Robin Avenue to Cesar Chavez Drive to come forward. There were none. M/S/C: VARGAS/MUSE. There were no objections. 00- REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES Director of Administrative Services Yeats stated that the staff report had two reports that relate to the City's Revenue and Expenditures for the first eight periods of Fiscal Year 1995-96 and the City's Financial Condition at Fiscal Year ended June 30, 1995. The first report contained details of the City's Revenue and Expenditure summaries for the period ending February 29, 1996. These comparisons are the FY 95-96 budgeted amounts compared to actual July 1, 1995 through February 29, 1996, and a projected year-end balance for General Fund Revenues Estimated Actual), Special Revenue Funds, and all expenditures. The final report in the first set compares budgeted to projected year-end General Fund Revenues and Transfers to General Fund Expenditures. This group of reports provides information for management intervention if expenditures are exceeding budgeted amounts, or to allow for an adjustment if a variance in anticipated revenues seems likely. The second group of reports is a method for assessing the financial condition of the City using the Government Finance officer's Association(GFOA) Financial Indicators Database. This comparison is of Baldwin Park's key ratios compared with those of 162 cities of a similar size across the nation. He explained 1) that the analysis of the City's General Fund Revenues indicates short falls in several categories. The largest short fall is in taxes property taxes). There has been an increase in sales tax, license and permits, and use of money and property. Motor vehicle and license fees have shown an increase. The total projected variance in General Fund Revenues is $284,582, which is an approximately a 2% variance; 2) the projected variance for Special Revenue Funds is $39,887 which is less than 1%; 3) the projected total expenditures for all departments indicate that each should spend less than appropriated, and the total budget savings should be approximately $152,264; 4) the analysis of General Fund Revenues and Expenditures shows that the original gap of $47,134 has increased by $132,318 to $179,452; 5) according to the 10 ratios, the City's financial position continues to show improvement, rating a +5 as listed in the staff report. General Fund Reserves have increased by $908,804 in FY 94-95, to $4,251,886. The City's total General Fund Budget is $12,000,000. Staff recommended Council receive and file the report. Director Yeats stated that every year the budget is adopted, a series of resolutions are adopted. He recommended that every year Council adopts the budget, we are insuring that we have a certain percent of General Fund Reserves that are held each year. In response to Mayor Vargas, Director Yeats stated that 5% is the standard, the Fiscal Analysis will address a good mix for General Fund Reserves. If a major disaster occurred, 10% would fund operations for a minimum period of time. He further stated that 20% would be excessive, 10% would be a good figure. Mayor Vargas stated that he supported placing a percentage of General Fund Reserves aside. He directed staff to see what other cities are doing as far as adopting resolutions. In response to Mayor pro tem Martinez, Director Yeats stated that Council could repeal the resolution with adequate votes. In response to Councilmember Lowes, Director Yeats stated he would like to take revenues and expenditures for the last ten years and project ten years in the future. The bar code for revenue is holding steady and the expenditures are holding steady, and the revenue line is above the expenditure line every year. The City is on solid footing. The City has been able to pay off over $4,000,000 in outstanding debt on the Sierra Vista Project Area. Council congratulated staff on the hard work and discussed the increase of services to the community while paying off debts and increasing reserves. It was moved and seconded to receive and file the FY 1995-96 Mid-Year Budget Review and the June 30, 1995 Financial Condition Analysis Report. M/S/C: LOWES/MUSE. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Mayor pro tem Martinez requested the City fund a portion of the amount the officer for Operation 2000, and that the staff discuss a joint venture with the School District. Councilmember Lowes stated that the program is good, and since the grant is running out, she stated her objection to having a police officer teach in the classroom. The officers do not want to give up their time in the field. She further stated that the City does have the DARE Program. In response to Chief Lanza's suggestion, Mayor pro tern Martinez stated that he is opposed to using a retired police officer, but to see if there is an interest by any of the officers, and that he did not want to make it a mandatory program. Councilmember Muse suggested officers from the School District may have an interest in serving in the classroom. Mayor pro tern Martinez asked for a report pertaining to what other cities pay their reserve officers. He also invited everyone to attend the Sunday, 5:00 p.m. Teen Mass at St. John the Baptist Church also, after every Mass a fund raiser will be held for the Life Team. Some of the City's Police officers will participate in the 5:00 p.m. Mass. Councilmember Lowes stated that she and Councilmember Lozano attended meetings on disaster preparedness. She stated that she is impressed with the progress that the City has made. She further stated that she is not prepared at home for a disaster, and that the citizens need to be educated on what to buy and just to practice a disaster drill. Councilmember Lozano stated that if an in-service training for the workers is held, that the Lieutenant from the CHP should be hired to conduct the training. He also stated that the Maine Street Reconstruction Committee has finished their meetings and will be presenting their ideas to the Council. Mayor Vargas requested the report pertaining to the Maine Street Reconstruction be in the Status Report prior to the Study Session. Councilmember Lozano stated that he likes the old City business cards. He stated that the new cards are hard to read. He requested that the next cards that are ordered be printed in larger print. Councilmember Muse stated that some of the reports have the new logo, while others are using the old logo. She requested the next printing of City letterhead have Councilmembers names included down the side of the page. Mayor Vargas stated that he had made changes to the back of his business card, and suggested that all the Councilmembers look at his card before reordering their cards. Director of Administrative Services Yeats stated that the Director of Recreation/Community Services has volunteered to change the City flag to the new logo. He stated that staff wants to target the senior citizens, as a group, with the program that is more like a grant that can be placed on the title and will only be paid off only when the property is sold. Councilmember Muse requested that a program be set up for senior citizens to be able to rehab their homes with payoff at the time the property is sold. Council agreed by unanimous consent. Acting Economic Development Services Manager Roessler explained the City's existing rehab program and the provisions made for senior citizens, handicapped or disabled people that includes a choice of a deferred loan or a 1% loan. Councilm ember Lowes requested the Council Meeting be adjourned in memory of William Gamble. In response to Mayor Vargas, Director of Administrative Services Yeats stated that staff would include in the budget funding for the college graduates that graduated from Baldwin Park Schools who return to Baldwin Park to purchase their homes. Mayor Vargas directed staff to call the City of Santa Ana pertaining to their college graduate program. Mayor Vargas requested: 1) that the Sierra Vista Soccer Team be given Certificates and Plaques at the April 3rd Council meeting; and 2) an event at the end of the school year, to be held in the Amphitheater, that would recognize the student athletes and other students that participate in extra curricular activities. Council agreed by unanimous consent. Councilmember Muse suggested that the students who have been accepted into college be recognized at the same event in the Amphitheater, and she suggested it be called Celebrate Our Youth.
