in regular session in the Council Chambers at
7:00 p.m.

Mayor Vargas read the Proclamation declaring the Month of April, 1996 as Earthquake
Preparedness Month15 and presented it to Disaster Coordinator lrv Dawson.

ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to
speak on any subject to come forward.
Susan Van Cleave, 13232 Emery, commented on a couple of phone calls she made
from her cell phone, on the 605 Freeway, to the Baldwin Park Police Dispatcher. She
stated that if the dispatcher had taken the information and contacted Highway Patrol it
would have been helpful and a service to the citizens. She stated that she would get
the dates and times that she called the Police Department when she receives her
phone bill.
Bill Van Cleave, 13232 Emery, stated that Rick's Security has the incident that
happened in front of his store logged in his book, but the Police Department does not
have any record of his call.

Mayor Vargas introduced the Public Hearing to Determine City's Needs under the
Annual Action Plan/Consolidated Plan for FY 1996-97.

Director of Administrative Services Yeats stated the purpose of the Consolidated Plan is
to determine all the needs in thbZ community, especially for the low and moderate income,
prioritize those needs, and setup an action plan to meet the needs with available
resources. The areas of importance and the estimated funds to be allocated under the
Consolidated Plan were outlined in the staff report. The HOME Program was developed
to expand the supply of decent, safe, sanitary and affordable housing for very low-income
and low-income. It was recommended that Council conduct the public hearing to
determine the housing and community development needs of the City pursuant to federal
Consolidated Plan regulations.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak on
the Annual Action Plan to come forward.
Those requesting funding were:

There being no other speakers, Mayor Vargas declared the Public Hearing closed.
In response to Councilmember Muse, Director Yeats stated that the Action Plan was
developed based on the 1990 Census and placed the population of Baldwin Park into
various categories, ethnic background, income levels, housing standards and levels,
density, occupancy levels, maps were developed, and input from the community and
service agencies. The information received from HUD is a computer program that has
limited mapping capabilities, but lots of graphical and numerical analysis of the City.
Information is received from internal departments in the City that provide blighted areas,
infrastructure, and social services. The Executive Team will also be making a
recommendation. The funding level is $600,000 less than last year.
Council ember Muse asked that the 1990 Census be included with the recommendations
and proposals both to the Advisory Committee and to Council.

have decreased that request child care vouchers, and advertisements have been placed
in r1ie NOW. He further stated that they are asking to increase the number of people that
could potentially be able to receive the grants. In the past the funding was limited to the
low income families, but now includes low as well as moderate income families. The
income for a moderate income family is approximately $32,000 for a family of 3.
In response to Mayor Vargas, Director Nunez stated that staff has contacted each of the
child care centers to make sure that all of the residents of the community have been
advised, and an advertisement and article was has been run twice in the NOW. A flyer
was sent to the School District, not specifically about the voucher program.
In response to Councilmember Muse, Director Nunez stated a lot of programs offer Utility
Assistance Program, but the Center has people that come in on a daily basis requesting
assistance with their utilities. Many of the agencies no longer have the funds available
to assist people with their utilities and their programs are done on a limited basis.
Mayor pro tern Martinez explained that residents go to agencies that serve a region and
they may not have the funding, because the funds go quickly on a first come, first serve
basis.
In response to Councilmember Muse, Director Nunez stated that the Food Bank has
found a building that needs to be rehab'd. Staff contacted the owner of the building, the
rent is negotiable, and the Food Bank was contacted with this information. Other
locations have been suggested to the Food Bank, but so far no decisions have been
made by the Food Bank. The Chaplain from the Veteran Family Service is being evicted
from his building and he was supplying food to many of the residents. He also expressed
a concern that he could not find a location within the City limits.
Mayor pro tem Martinez requested the amounts that were budgeted for 1995-96, for the
public services, and how much money was actually expended by those organizations.
Director Yeats stated that next year the first meeting will be a joint meeting with the
Council and Advisory Committee. Next year with an enhancement computerization the
City staff will be able to provide its own stats and not have to rely on HUD for regional
information. He further stated that he would prepare a report with the government
requirements for CDBG Funding.
Councilm ember Lowes explained that she attended three of the CDBG meetings and they
did have a quorum at the last meeting. The Chairman was absent, but the other
Commission Members were prepared, committed, and diligent.
Council discussed duplicate services, the need to train the City's Commissioners, a
special committee to serve only during the CDBG funding period, a joint meeting with the

Advisory Committee, the similarity of the Recreation/Community Services Commission
and the Housing Commission, and a Study Session to discuss the CDBG funding
process.

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Director of Administrative Services Yeats requested adoption of a resolution
supporting the Introduction and adoption of a validating act In response to the
Santa Clara County Local Transportation Authority vs. Guardino SB 1950). The
California Supreme Court's decision required voter approval for the imposition or
increase of any special or general tax as set forth in Proposition 62. Legislation has
been introduced that would designate December 14, 1995 as the effective date of the
Santa Clara decision. The legislation is supported by the League of California Cities
and numerous other local agencies. The bill was outlined in the staff report. It was
recommended that Council adopt the proposed resolution.
in response to Councilmember Lozano, Director Yeats stated that the City's Utility Tax
ordinance was originally adopted in 1987, and readopted in 1991. The City's
ordinance would be valid because it was adopted prior to December 14, 1995. It does
not address the issue of retroactivity it only occurs if the bill does not pass. Our
annual utility tax is $1.3 to $1.4 million dollars, and is 30% of the General Fund
Budget.
It was moved and seconded to approve Resolution No. 96-21, 1.3 RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA,
SUPPORTING INTRODUCTION AND ADOPTION OF A VALIDATING ACT IN
RESPONSE TO SANTA CLARA COUNTY LOCAL TRANSPORTATION AUTHORITY
V. GUARDINO." MIS/C: MARTINEZ/MUSE. There were no objections.
Director of Administrative Services Yeats stated that the purpose of the report was to
advise that the Computer Aided Dispatch CAD) and Records Management System
RMS) selection team has made a final decision and will begin the process of
contract negotiations. All required tasks were completed by each vendor and based
upon the evaluation matrix, Spiliman Data Systems was selected as the vendor who
provides the solution that best matches our requirements. Their system was rated an
average of 91.67. The total proposed cost of the system is proposed at $482,408.00.
Staff recommended approval.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Gouncilmember Muse stated that the varnishing in the Council Chambers looked
wonderful.
Mayor Vargas recommended including that bilingual skills are highly desirable in all
personnel job postings and job openings. If there are other positions that Council or
Staff considers bilingual skills are required, the item needs to be discussed.
In response to Councilmember Lowes, Director Yeats stated that bilingual skills are
highly desirable, but not required. Council required that the dispatcher position be a
bilingual position.
Mayor pro tern Martinez requested Council receive a copy of the Rules and Personnel
Procedures.
Mayor Vargas invited everyone to the Easter Egg Hunt and the dedication of the
Cesar Chavez Amphitheater on Saturday, April 6th.
