HomeMy WebLinkAbout1996 07 03 CC MIN SS1996 07 03 CC MIN SS@˜}"MIN SS JUL 3 1996[Þ›[H6A8 JOINT REGULAR STUDY SESSION MEETING OF THE CITY COUNCIL AND THE PLANNING COMMISSION OF THE CITY OF BALDWIN PARK, 14403 EAST PACIFIC AVENUE, WEDNESDAY, JULY 3, 1996 The City Council and the Planning Commission met in joint regular session in Room 307 at 6:00 p.m. ROLL CALL PRESENT: COUNCILMEMBERS LOWES, LOZANO, MUSE AND MAYOR VARGAS ALSO PRESENT: Planning Commissioners Huetinck, Holguin, Oclaray, and Martinez City Attorney Bower, City Attorney Goldfarb, Dir. of Administrative Services Yeats, Chief of Police Lanza, Dir. of Public Works Mousavi, Dir. of ReciCommunity Services Nunez, and Acting City Clerk Branek 00- The absence of City Clerk Gair was excused. 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communications open and invited those wishing to speak on any subject to come forward. There were none. There being no speakers, Mayor Vargas declared Oral Communications closed. 00- TOPICS OF DISCUSSION Assistant Planner Harbin told of the current ordinance requirements and the Supreme Court determinations to operate adult businesses in the City. She stated that the City Cannot prohibit adult businesses but cities may regulate their location and other certain elements. Councilmember Martinez arrived at 6:15 p.m. The p oposed ordinance establishes location criteria with 1000 feet between residential zones, legal nonconforming residential uses, schools, parks and churches, unless separated by a major freeway, or a public utility right of way at 100 feet in width and be located within either the Industrial or Industrial Commercial Zone. Licensing requirements would include background checks for not only the business operator s), but the performers. The facility and employees standards include the following: 1. No material outside the premises 2. Specific lighting requirements footcandles) 3. Sound absorbing insulation 4 Signage 5. Security Guards 6. Minimum required performer dressing facilities 7. No physical contact with patrons 8. Facilities subject to inspection at any time The massage parlors are currently in adult business regulations and are not protected under the 1st amendment. The massage parlors will keep the current requirements of a required Conditional Use Permit, C2 zoning and the location criteria of: 1 500' other massage parlors 2. 500' church and schools 3. 250' fl-Zoning 4. Business Licensing required pursuant to Chapter 118 In response to Councilmember Lozano, Assistant Planner Harbin stated that the Courts would allow an adult business to locate in the City. In response to Planning Commissioner Martinez, City Attorney Goldfarb referred to a ruling by the 9th Cirucit Court regarding the Topanga Press that dealt with the amount of available property for adult businesses to locate.
