It was moved and seconded to add to the agenda a Subsequent Need Item to the Closed Session to discuss Public Employee Appointment for Interim Police Chief and the evaluation of an Interim City Manager. M/S/C: LOWES/MUSE. There were no objections. 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communication open and invited those wishing to speak on any subject to come forward. Wilbert Hunt, Baldwin Park Library Manager, stated that he had assumed the position of Library Manager January 1st. He told the hours that the library will be open, about the various programs, and the numerous volunteers. The Library has applied for a grant that will enable them to continue the programs this year. The City has provided the museum with $10,000, but all the money that is taken in by the museum will only pay the utilities. She requested help with the tax bill to keep the doors of the museum open. PRISCILLA POPICK, stated that the Tribune does not print negative letters about the Mayor and referred to a recent published letter. Larry Walton, 3802 Big Dalton, thanked City Clerk Gair, her staff, Director Yeats and his staff for all the work that is accomplished in the community. He referred to a publication that he felt was political propaganda. He stated his approval for the appointment of Captain Kies as Acting Chief of Police. He further stated that he does not see the Mayor at various City events. Marina Montenegro, 313 Park Shadows Court, applauded Lt. Lopez for stepping down as Acting Chief of Police. She inquired about the qualifications, experience and the expertise of the newly appointed Planning Commissioner Danny Galindo. There being no other speakers, Mayor Vargas declared Oral Communications closed. CONSENT CALENDAR The Consent Calendar consisted of the following: 1. It was moved and seconded to approve Consent Calendar Items 1.4 & 6-8. M/S/C: MARTINEZ(LOZANO. Councilmember Martinez abstained from Item No.3 due to a possible conflict of interest. Mayor pro tem Muse abstained due to a possible conflict of interest. 00 PUBLIC HEARING Mayor Vargas Introduced the Public Hearing pertaining to the Consideration of an Increase In service rates for refuse collection pursuant to an agreement between the City and Waste Management of the San Gabriel Valley/Pomona Valleys, and the extension of the Waste Management Agreement." Development Services Manager Roessler stated that Council approved, in concept, an automated waste collection system and an extension of the current contract to the year 2006 on August 7th. The new services would include weekly automated waste and recycling collection for all single family residents at a rate of $12.07 per month. The rates shall be adjusted on July 1st of each year to account for extraordinary changes in uncontrollable costs incurred since the last rate adjustment as explained in the staff report. A reserve in excess of $135,000 has accumulated over the past two years as a result of savings realized on renegotiated rates at the BKK Landfill. Waste Management proposes to utilize this reserve to offset the proposed rate of $12.76 for residential service by $.57, allowing the rate to remain at $12.19. Staff recommended approval. Mayor Vargas declared the Public Hearing open and invited those wishing to speak pertaining to an increase in service rates for refuse collection to come forward. Everyone is against a single bin. The home rates seem reasonable. The commercial rates are too high, and the rule that everyone must have a trash container is a hardship on some businesses and churches. Waste Management offered a free bin for cardboard and then a few months later tried to bill Mr. Bill's for recycling. He further stated that now, they take the cardboard to Allan Paper Company and make money for his business. Lee Lucas, 4442 Bresee, stated that he was also on the original committee for recycling. He further stated that he felt that Waste Management has given him excellent service for many years. He complimented Development Services Manager Roessler on the report and for dealing with Waste Management. Sandi Lucas, 4442 Bresee, stated that it would have been nice to have a sample trash can on display for the public. She further stated that there is a need to look at greenwaste, and that the residents could be forced to recycle. There being no other speakers, Mayor Vargas declared the Public Hearing closed. In response to Council, Development Services Manager Roessler explained that at the August 7th meeting, before being informed by City Attorney Bower that the agreement could not be approved, it was agreed in concept to use Option B 1, which incorporated a basic extension of 6 years to the agreement, which would include weekly waste pickup and recycling. That would take the current rate of $12.19 down to $12.07. This $12.07 does not include any increase for the closure of BKK and the extra transportation costs for transportation to other sites. Waste Management presented a rate increase and a schedule of fees that represented the 5% rate increase. The current rate was increased by 5% to $12.76 With the reserves of the $135,000 spread over 20 months, and expanded over the households, the rate was lowered to $12.19. As long as the 96 gallon container is filled up first you can put out as many other trash cans for unlimited pick up, in addition to bulky items. There probably will not be an opportunity to build reserves for the City again. The rate increases after the 20 months could be significant and the CPI could also affect the rates. The businessman has the opportunity to recycle to lower the bin rate. The new automated system will be in effect late January or early February, the rates will take place in late October. Councilmember Lowes stated, for the record, that in the Waste Management contract the residents will get two bins, one for recycling and one for regular trash. Once those bins are full, then the resident can fill any bins that they may have and it is unlimited trash pick up. In response to Councilmember Lowes, Manager Roessler stated that articles will be in the NOW about the change of waste pick up, and inserts will be placed in the billing in English and Spanish. The educational articles will be on a continuing basis. The bins, if damaged, will be replaced at no charge to the customer, if the damage is not done deliberately. City Attorney Bower clarified that the $12.19 rate would only be through June, 1997, because Waste Management would be entitled to a rate increase based upon CPI on July 1, 1997. The subsidy from the $135,000 would apply to the new rate. In response to City Attorney Bower, Manager Roessler stated that the $135,000 would be incorporated in the Waste Management contract amendment. It was moved and seconded to Introduce ORDINANCE NO.1118, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CHAPTER 50.19 OF TITLE V OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO FEES FOR REFUSE COLLECTION AND CURBSIDE RECYCLING SERVICES," for first reading, that it be read in title only and all further readings be waived; and approval of Amendment No.3 to the Agreement between the City of Baldwin Park and Waste Management of San Gabriel/Pomona Valley. M/S/C: LOWES/MARTINEZ. There were no objections. Mayor Vargas Introduced the Public Hearing pertaining to the Public Hearing and approval of Grantee Performance Report GPR) 21st Year Community Development Block Grant CDBG) Program. Director of Administrative Services Yeats stated that the City receives an annual grant from the U.S. Department of Housing and Urban Development HUD) to carry out activities benefiting the low and moderate income persons and eliminate blighted conditions in the City. The public hearing is the last step required prior to submitting the GPR to HUD. The Notice of Public Hearing/Availability of the GPR for public review was published in English and Spanish and posted in numerous City facilities. Staff has not received any public comments regarding the GPR. The GPR was reviewed and approved by the CDBG Advisory Committee with two recommendations: 1) Take necessary steps to reinstate the CDBG Commercial Loan Program; and 2) Take necessary steps to insure the completion of four carry-over projects. It was recommended that following the Public Hearing, that Council approve the GPR and instruct staff to incorporate any and all public comments into the final adopted GPR. Mayor Vargas declared the Public Hearing open and invited those wishing to speak pertaining to the GPR to come forward. Larry Walton, 3802 Big Dalton, asked who made the decisions on the priority of the distribution of the funds and if there was a list available. He asked that the standard or list of priorities of how the funds are allocated and to whom the funds are allocated be available to the public prior to the meetings. There being no other speakers, Mayor Vargas declared the Public Hearing closed. It was moved and seconded to approve the GPR and incorporate any and all of the public comments into the final adopted GPR. M/S/C: LOWES/MARTINEZ. There were no objections. Mayor Vargas introduced the Public Hearing pertaining to an increase in towing and storage fees. Captain Kies stated that the state-wide fees charged by the Official Police Garage Companies increased with the approval of the California Highway Patrol CHP). The CHP is the regulatory agency over tow and storage fees and local police agencies and tow companies base the related rates on CHP's recommendations. The requested rate increase was listed in the staff report. Staff recommended approval. Mayor Vargas declared the Public Hearing open and invited those wishing to speak pertaining to the increase in towing and storage fees to come forward. There were none. Mayor Vargas declared the Public Hearing closed. In response to Councilmember Lowes, Captain Kies stated when the Police Department calls the fees are the same and that he did not know what fees would be charged to a civilian. The City has agreements with 5 different services and the companies are used on rotation. Mrs. Mayorga, Royal Coaches, stated that if a tow company has a CHP contract the rate is the same for the public as it is for the City. Councilmember Lowes asked for a report on how the tow companies have provided service and how often each company is used. There were no objections. 00- REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES Management Assistant Martinson requested approval to appropriate general fund monies for membership In WeTip. WeTip provided the City with 24 hour service, 365 days a year for 24 years. The service previously has been provided at no cost to the City. WeTip gives the citizen a centralized depot to report illegal activities anonymously. If a conviction is obtained, the witnesses providing information to WeTip are eligible for cash rewards. Due to economics, WeTip can no longer afford to continue providing service to cities that do not support them financially. The Police Department feels this is a valuable service. Shared support costs for the service are determined based on population. Staff recommended approval of an additional budget appropriation of $3,529 of General Fund monies for membership in WeTip. In response to Councilmember Lowes, Captain Kies stated that Asset Forfeiture Funds would qualify for the appropriation of funding for WeTip. Manager Martinson stated that the fund contained approximately $13,000. The past year the City received 60 tips from WeTip. Councilmember Lowes suggested using the Asset Forfeiture Funds for the appropriation of funding to WeTip. In response to Councilmember Martinez, Director Yeats stated that Council could state to use the Asset Forfeiture Funds as large a sum as available for funding WeTip and the rest be used from General Funds. It was moved and seconded to approve a budget appropriation of $3,529 using Asset Forfeiture Funds as large a sum as available for funding We Tip and the rest to be used from General Funds. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilmember Martinez requested that an item be placed on the next Council agenda for the appointment of his position on the Mid-&San Gabriel Valley Consortium. He announced that he would not seek re-election in March, 1997 due to wanting to spend time with his family and the reassignment of his job.
