PRESENTATION
Mayor Vargas read the Proclamation declaring the month of November as Family
Literacy Month" and presented it to Stephanie Clark Ochoa.
ORAL COMMUNICATION
Mayor Vargas declared Oral Communications open and invited those wishing to speak
on any subject to come forward.
Sally Wieck, 4130 Cutler, invited Council to participate in the annual Community
Thanksgiving Dinner on Wednesday, November 27th. Larry Walton is co-chair and
volunteers are needed to help cook, serve and donate food for the dinner. The
volunteers will begin set up at 10:00 a.m. and dinner will be served at 5:00 p.m. Dinner
will be served to each volunteers family if they are present. She further stated that the
committee has requested no campaigning.
Carol Anderson, Waste Management, stated that Waste Management participated in
the 4Oth Anniversary celebration. They were able to answer many questions pertaining
to the new trash pickup. She stated that she has met with staff working on the
transitional period and January 31st will be the first automated service.

Larry Walton, 3502 Big Dalton, thanked those that will volunteer for the Community
Thanksgiving Dinner. He requested clarification on the election measures pertaining to
the positions of City Treasurer and the City Clerk. He asked who proposed that the two
positions be changed to appointed and if a person is elected in March would the
appointive positions begin in the year 2001.
Candy Carmichael, 4341 Cutler, stated that she previously requested the red zone be
reassessed at the rear of the Community Center and staff informed them that their
request had been denied, because during the morning hours before the pool or the
Community Center is open there is sufficient parking. The parking fills up during the day
and during the evening rush hour. The Public Works Department requested the Police
Department to enforce the law pertaining to the red zone and to cite those in violation.
She appealed to the Council for some compromise which would allow parents to pick up
their children at the Community Center.
Miguel Garcia, 1872 Calino, stated that he has a problem with a neighbor who calls
the police on his children that play in the street, and about the music he plays. The
neighbor lives at 1886 Calino, but the complainant does not own the house and he does
drugs. He further stated that he is trying to support his family, and that two years ago
he had a heart attack. Mr. Garcia also stated that he buys cars, fixes them at his home
to sell and that he was recently stopped from auto repair at his home by Code
Enforcement.
Tom Pack, owner of Sequel Contractors, 12240 Woodruff, Downey, stated that Sequel
was the lowest responsive bidder for the Baldwin Park Boulevard Street Reconstruction
Project, because the low bidder did not bid the right unit. By rebidding the job, the
other bidders will see their unit prices, and Sequel feels that they are already the lowest
responsive bidder on the job and that the job should be awarded to Sequel.
Able Majonellas, co-owner of Sequel Contractors, asked that Council look at the facts
on how the bids were presented, and that if Sequel is not awarded this lob they would
be penalized for someone else's mistake.
Martha Flores, 4748 Phelan, stated that they represent the Geddes School parents. She
stated there has been a lot of traffic with cars speeding on Phelan, there is a lack of
signs and a need for a crosswalk. If possible, have signs posted, a crosswalk installed,
and a police officer pass by during the hours that children are being picked up.
Hector Gallesia, 4118 Mayland, stated that the street needs to be repaired, that he
has lived there for 12 years, and nothing has ever been done to the street.
There being no other speakers, Mayor Vargas declared Oral Communications closed.

In response to Candy Carmichael, Mayor Vargas stated that Council wanted
the parking expanded and the problems resolved at the Community Center. He further
apologized to the parents for any inconvenience in picking up their children at the
Community Center. He directed staff to address the problems and parking situation at
the Community Center.
In response to Larry Walton, City Clerk Gair stated that changing the elected position of
City Clerk and City Treasurer has been discussed in staff meetings, in Study Sessions,
and Team Building sessions for over two years. At one time the measures were almost
consolidated with the County election. The point of it is, to appoint people with
professional skills for a very technical jobs, it would be difficult today for someone
without experience to supervise all the duties performed by City Clerk and staff. If
candidates run for the Office of City Clerk or City Treasurer, in March, and the voters
approve both positions or one position to become appointive that candidate that sought
one of the offices, will not be seated. The incumbents, if the voting public changes the
position to appointive, will simply finish Out their terms to March 11, 1997, and then would
no longer serve in an elective position. The appointed position of Treasurer would be
done by the City Manager or the Director of Administrative Services who does that work
now. She further stated that the appointed certified position of City Clerk, City Clerk
Gair has been appointed to that position since 1984. The elected position of City
Treasurer and City Clerk would not continue to 2001.
Mayor Vargas stated that more policing by the School Police needs to be done at
Geddes. He directed staff to meet with the parents from Geddes and to look into the
traffic problems at the school.

Director of Public Works Mousavi requested Council reject all bid proposals submitted for
the construction of Baldwin Park Blvd. and Francisquito Avenue and Merced Avenue, CIP
604. He explained the bidding process and that five bids were received. Excel Paving
Company was the apparent lowest responsible bidder. However, when staff checked the
unit prices, it was noticed that bid item no.5 at an estimated quantity of 1,172 tons
rather than the correct amount of 1,472 tons. If the quantity is corrected the bid price
would be $415,110.60, as a result the second bidder Sequel Contractors, Inc. at

$412,696.40 becomes the low bidder. Staff recommended rejecting all bids received at
11:00 a.m. on October 23, 1996 for the Baldwin Park Reconstruction Project, CI P 604
and authorize staff to re-advertise the project for new bids.
In response to Councilmember Lozano, Director Mousavi stated that the bids would be
re-bid and Sequel would have the opportunity to rebid again.
Mayor Vargas stated that it was unfair to be penalized for others mistakes and since
Sequel is the lowest bidder and that all the legal options need to be reviewed. That
legal input needs to be received and if there is no legal reason for not awarding the bid,
it is his recommendation to award the bid to the lowest bidder Sequel).
It was moved and seconded to award the bid to the lowest bidder without re-bidding
and continue Item No.12 to next meeting. M/S(C: VARGAS/LOWES. There were
no objections.

PUBLIC HEARING
Mayor Vargas Introduced the Public Hearing pertaining to the Consideration to the
Police Department pursuing grant funding through State Assembly 3229; Citizens
Option For Public Safety COPS). A prerequisite to soliciting these funds was
that the Police Department submit to Council a plan for expenditure of funds.
Captain Bennett stated that staff discussed the priority issues of the Police
Department's current and long range plans, goals and needs. Technology was
identified to be a high priority. Staff was notified that the City would be awarded
$171,036.73 in Assembly Bill 3229 monies on October 18,1996. The proposed plan
for the expenditures of the grant monies were: 1) Purchase of 65 Computer
Notebooks for use by Police Patrol and Detective personnel at a cost of approximately
$78,000; 2) Purchase of 28 Vehicle Computer Links for Vehicles at a cost of
approximately $3,500; and $89,500 as partial cost for the reconfiguration of the
Communications Center to accommodate new equipment. Staff recommended: 1)
Conducting a Public Hearing relative to the plan for expenditures of the Citizens
Option For Public Safety COPS) Grant funds; and 2) Following the Public Hearing,
approve expenditures from these monies as outlined.
Mayor Vargas declared the Public Hearing open and invited those wishing to speak
pertaining to the grant funding for Citizens Option For Public Safety COPS) to come
forward.

police department.
Larry Walton, 3802 Big Dalton, stated that technology is very important and asked
Council to approve the computers for the Police Department.
Lee Lucas, 4442 Bresee, stated that the lap top is the best investment this year for the
police department.
In response to Mayor pro tern Muse, Captain Bennett stated that the note books would
allow the officers to enter all data, contacts in the field, and calls during the day, that
would be down loaded and captured in the files and available for retrieval. The lap tops
are not a permanent mount and they can be removed from the cars and taken into a
remote site. The department has not received the bids for the reconfigurations,
estimates are $100,000. The communications staff, the dispatchers, have been
increased by one and two dispatchers are needed during each shift. The CAD will require
two dispatchers to enter the data. The reconfiguration is necessary to accept all the
new Systems that have been budgeted for the CAD installation. He stated that another
grant application will be mailed to COPS MORE Grant asking for an additional $50,000
to supplement the costs for the communications center reconfiguration.
In response to Mayor Vargas, Captain Bennett stated the officers will be able to access
JADIC through the lap tops in the cars, and that is where the interface links comes in.
In response to Councilmember Lozano and Mayor pro tern Muse, Captain Bennett
stated that the implementation will be running by December 12th. February more of the
system will be installed and the system will be up and running by late 1997. Special
courses will be offered in December and that is not a part of the$171,000. Officer Chris
Williams has excellent computer skills and has been removed from patrol to assist in the
computer program.
Captain Kies stated that Edmund Urquiza, Records Management, is very dedicated to
the implementation of the CAD and soon a clerk will be used full time to input information.
Mayor Vargas commented on the technology the City has implemented, that citizens can
contact the City through E-Mail at Baldwin Park.Com. and check out the Web Page.

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
City Manager Yeats requested approval of a professional services agreement for
executive searches for two vacant department head positions, with David M. Griffith &
Associates, LTD. The two vacancies in the City's Executive Management Team, the
Director of Community Development and Chief of Police. Six executive search firms were
surveyed and the results were analyzed. The David M. Griffith & Associates, LTD. has
extensive experience in executive searches and was highly recommended by their
previous client cities, and directed staff to return with a professional services agreement.
Staff recommended approval.
It was moved and seconded to approve a professional services agreement for
executive search services with David M. Griffith & Associates, LTD. M/S/C:
MUSE/LOZANO. There were no objections.
City Clerk Gair requested Council to designate representatives and alternates to fill the
positions vacated by the resignation of Councilmember Martinez. The vacant positions
are: 1) Upper San Gabriel Valley Water District; 2) Civil Defense Area D" General
Membership); 3) Local Agency Formation Commission City Selection Committee; and
4) Mid-San Gabriel Valley Consortium. It was recommended that Council select
members to fill the positions now vacated and adopt the Resolution to formalize the
selection of new representatives.
Councilmember Lozano volunteered to serve on all the committees that were vacated by
the resignation of Councilmember Martinez.
City Manager Yeats stated that changes needed to be made to the alternates, on the Civil
Defense Area D" Directors Meeting, Mid-San Gabriel Valley Consortium, change to the
City Manager until a new Director of Community Development.
It was moved and seconded to approve Resolution No. 96-94 94, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO.
96-22 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO
CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS. M/S/C: VARGAS/MUSE.

In response to Mayor Pro Tem Muse, City Manager Yeats stated that December 4th
at 5:00 p.m. an overview of the CDBG funding process, the Consolidated Plan and a
review of the budgetary commitments that have been made, and a discussion of

Council's priorities, will be presented at a Study Session with the Recreation/Community
Services, Housing Commission and the City Council. He further stated that notification
is placed in the Tribune, La Opinion, the NOW, and several other publications. She
suggested a mailing be made to the agencies to notify the non-profits from the
Recreation/Community Services Department list of non-profits.
Mayor Vargas directed that staff Contact the home liaisons for lists of organizations that
serve the residents, and have Tad work with Recreation/Community Services.
Mayor pro tem Muse stated that Baldwin Park 2000 sub-committees have identified
needs in various areas, obtained information, and that could be part of the discussion
on December 4th.
City Manager Yeats stated that Healthy Cities Survey will provide needed information.
Director of Recreation/Community Services Nunez stated that the Action Plan from the
Healthy Cities will be completed by the end of December.
In response to Councilmember Lozano, Director of Public Works Mousavi stated that he
marquee at Morgan Park has been given to a consultant to design, but so far no one has
bid on the marquee. Councilmember Lozano requested a show case or picture of areas
that have been improved, or future projects be on display at the Community Center.
City Manager Yeats stated that with the GIS portion completed, staff will be able to
print out a colored street map of the City that will show what streets are paved, what
year the streets will be paved, and even the funding sources.
Councilmember Lozano complimented Director Nunez, his staff and City Clerk Gair for
the parade and 40th Anniversary celebration on November 2nd.
In response to Mayor pro tem Muse, Director of Public Works Mousavi stated articles will
be in the NOW on storm drains, and notification will be sent out to those it will impact.
All the Individuals that complained have been contacted by staff.
Mayor Vargas stated that Baldwin Park 2000 is still looking for volunteers. Prop A Park
Bond was passed and the City will get $242,000 for specific at risk youth and it will be
earmarked for the little league fields, the other amount that the City will receive is
$200,000, plus $20,000 a year for 20 years for maintenance. Mayor Vargas requested
discussions with little leagues and the school districts before the little league season
starts. The Park Bond will give the City a total of $500,000 to upgrade the Little
League Fields.

and so that there is ongoing maintenance. Mayor Vargas stated that the volunteers
are the ones that have been doing the maintenance and the maintenance should be
maintained for the parents and players.
Councilmember Lozano requested a report on the impact of Prop 218 and the effect on
the City by its passage. He requested that the report be placed in the NOW in English
and Spanish so the public will know what will be happening in the City.
City Manager Yeats stated that a report will be placed in Tuesday's status report
regarding the effect of Prop 218. It could cost cities over $100 million to comply with
the law, and this message did not get out to the public. The impact on the City will
be on landscaping and lighting districts.
City Clerk Gair announced that the candidate's nomination period will open next
Tuesday, November 12th through December 5th, and the nomination period for Council
will be extended to December 11th, because an incumbent won't be filing. She
thanked City Manager Yeats and Data Processing for the computer installation in the
Council Chambers.
City Manager Yeats stated that invitations have been sent for groundbreaking ceremony
on November 16th; and 2) that he will go on his first ride along with Acting Chief of
Police Kies on Saturday afternoon for the day patrol and they will also do the night
patrol.
