ROLL CALL PRESENT: COUNCILMEMBERS LOWES, LOZANO, MARTINEZ, MUSE, AND MAYOR VARGAS ALSO PRESENT: City Attorney Bower, Dir. of Administrative Services Yeats, Chief of Police Lanza, Dir. of Public Works Mousavi Dir. of Rec/Community Services Nunez, City Treasurer Montenegro, Deputy City Clerk Branek, and City Clerk Gair Director of Public Works Introduced new employees, Development Services Manager, Nancy Hutar and Associate Engineer, Ann Garvey, and told of their education and experience. City Clerk Gair Introduced new employee, Code Enforcement officer, Domenic Castanon, and told of his background and experience. 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communications open and invited those wishing to speak on any subject to come forward. Jesus Gonzales, 4229 Park Place, stated that the City did a good job on repaving Park Place. He stated that he wants to be a good neighbor, but the street has trash, graffiti, and auto repair that goes on 24 hours a day. He requested a gate be place across the entrance of the street. William Van Cleave, 13232 Emery, stated that the Baldwin Park School Police does a good job and they are important. The School Police have had their problems, but the City needs both the City Police Department and the School Police. Raul Reyes, 3162 Athol, asked was it Council or the public that requested the name of Morgan Park be changed to Ceasar Chavez Park? He stated that he did not want the name of Morgan Park changed. Ceasar Chavez is honored with a holiday. Ceasar Chavez accomplished a lot in his lifetime, but he never visited Baldwin Park. Gerardo Pinedo, Field Representative for Matthew Martinez, stated that he would be available for any questions, or to offer services from Congressman Martinez' office. Robert Preclado, Veteran Family Service Corp, 5021 N. Calmview #C, told of the number of families that received food and toys during Christmas. He explained that his organization had five buildings, but now only three. He asked the City to help his organization with a larger facility. He requested a working relationship with the police, fire and paramedics in case the need arises for emergency services. There being no other speakers, Mayor Vargas declared Oral Communications closed. Zoo- Director of Public Works Mousavi presented a slide presentation of the Work Fare Program that showed the accomplishments of the people involved in Work Fare. He introduced Public Works Supervisor Art Castellano and Senior Maintenance Worker Tim Cardiel. CONSENT CALENDAR The Consent Calendar consisted of the following items: 1. Waive Further Reading and Adopt RESOLUTION NO. 96-2 SUPPORTING FUNDING OF LEGAL SERVICES CORPORATION TO PROVIDE LEGAL SERVICES TO THE POOR It was moved and seconded to approve the Consent Calendar. M/S/C: MUSE/LOZANO. Mayor pro tern Martinez abstained to Item No.3 due to a possible conflict of interest. Do REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES Director of Administrative Services Yeats requested Council approval of the ordinance to amend Ordinance No.1074 which designates certain city employees to fulfill the duties and functions of the CIty Manager. Urgency Ordinance No. 1074 was adopted in October, 1993, that designated certain city employees, department heads, to fulfill the duties and functions of the City Manager. The position of Director of Economic Development was eliminated through reorganization and there is a need to officially designate the department heads that assumed the duties of the Director of Economic Development by amending the original ordinance. It was moved and seconded to Introduce Ordinance No.1110," AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING ORDINANCE NO. 1074 DESIGNATING CERTAIN CITY EMPLOYEES TO FULFILL THE DUTIES AND FUNCTIONS OF THE CITY MANAGER'S OFFICE," for first reading, that it be read in title only, and all further reading be waived. M/S/C: VARGAS/MARTINEZ. There were no objections. Mayor Vargas stated the next item was requesting the support of an alternate board member for the MTA The Council can, if it wishes to, endorse a candidate. Two candidates are seeking support, one is Bradbury Councilwoman Beatrice La Pistro-Kirtley and Monrovia Mayor Bob Barkely. He asked Council if there were any other candidates they wished to support or a motion to support a candidate, he would entertain that. M/S/C: MARTINEZ/VARGAS. There were no objections. 00 COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilmember Muse requested 1) that prior to the Advisory CDBG Meeting of January 11th, that more effort be exerted to inform the non-profit organizations, more community input, and more public participation on deciding the distribution of the funding. She requested that Director Nunez distribute the information to the organizations; and 2) the Director of Recreation/Community Services to prepare a recommendation on fees, limitations, cleaning feel or security deposit for the rental of City facilities. Council agreed by unanimous consent. Councilmember Lowes asked that the report include the cost of staff time. Councilmember Muse requested a joint meeting between the School Board and Council. Mayor Vargas stated that there is new leadership on the School Board and they are anxious to work out problems that address the district and the City. Mayor Vargas stated that he has mixed emotions about armed school police, and knowing that the level of training is not the level of training of Baldwin Park Police Officers. He expressed his concern over someone getting hurt by the school police for not following proper procedure for tactical maneuvers. An example of that was displayed over the weekend in a pursuit accident on the freeway. Council is responsible for this community's safety. He further stated that he is not clear on the function of the school police, except to protect the school children and the school property. He requested that the Police Department prepare a report of recent incidents that involve the school police, where there is uncertainty as to their responsibility, and it would include this last incident. How often does the City dispatch school police to the schools, and when they are not being dispatched, what is it that they are doing? Council agreed by unanimous consent. Mayor pro tern Martinez stated his concern is when the City is doing the dispatching and the City is brought into a situation that is caused by an action school police take, what exposure will the City have? He stated that a contract needs to be drawn up between the City and the school police that defines the school police role. Councilmember Muse stated that tonight's meeting needs to be adjourned to January 8th at 10:00 a.m. to tour a water treatment plant in Burbank. The Burbank facility is similar to the one that will be built in Irwindale on the border of Baldwin Park. Director of Public Works Mousavi stated that he needs to know the number of people that will be going on the tour by January 7th. In response to Councilmember Lozano, City Clerk Gair stated that the City has a court order to demo the theater on Pacific Avenue. A contract will be on the next meeting agenda to approve the funds to demo that building. Director of Administrative Services Yeats stated that the same developer that talked about building a theater in Baldwin Park is currently involved in a major project with the City, and the City would like to see that project finished first. Mayor pro tem Martinez stated that he would like to find funding to get the sidewalks completed Olive from Maine to Azusa Canyon Rd. Council agreed by unanimous consent. Councilmember Lowes suggested that the City not be so rigid with straight sidewalks. Mayor Vargas agreed some of the trees or walls should be saved. In response to Mayor pro tem Martinez, Chief Lanza stated that he is aware that the COP's Ahead did have some money for equipment and some cities are getting some funding. The Police Department is looking into trying to get some of the funding. Mayor Vargas explained his reasons for wanting to rename Morgan Park. He said that many of the old time residents never felt that Baldwin Park had any discrimination, but it did. Renaming the park after Ceasar Chavez, the Community Center after Esther Snyder and the Senior Center after Julia McNeill will give the City some real sense of history. He further stated that he has spoken to as many people in favor of changing the name of the park as people against. In response to Mayor pro tem Martinez, Director of Public Works Mousavi stated that a sign would be erected soon at the Triangle Project. Councilmember Muse ask that a name be given to the new center, rather than just calling it the Triangle Project. Director of Administrative Service Yeats stated that Target is hesitant to have the formal announcement until they have gone through the full acquisition process, and they are ready to do their groundbreaking. The project is currently called the Centre at Sierra Vista.
