Mayor Lowes read the Proclamation and declared September 7-13,1997, as California
History Week" and presented it to Flora Mckay.

ORAL COMMUNICATION
Mayor Lowes declared Oral Communications open and invited those wishing to speak
on any subject to come forward.
Dick Tatum, Baldwin Park, stated that he still has problems with speeders on his street
and that the speed causes a back draft that shakes his heavy duty pickup truck. He
spoke earlier in the evening with the Chief of Police regarding the speeding problems.
Betty Brockway, Long Beach, asked for a zone change, or variance, or for the City
to purchase her property on Dalewood. The property was left to her and her sister after
her mother's death in July, 1995. They tried to sell the property for $150,000, but the
zoning ruled out all the potential buyers. They considered a billboard to oft-set some of
their costs, but that was prohibited. The Los Angeles County Assessor's Office has billed
their property taxes based on a value of $279,000. The Director of Community
Development offered them $140,000 for the parcel of land. The property is surrounded
by homes, there is no truck access, and the property is zoned for an office. She
presented the Council with a map and pictures of the parcel. She will contact Gloria
Molina's Office next.

REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Acting Chief of Police Kies requested approval of an amendment to Section 122.99(B)
of the Baldwin Park Municipal Code, making a violation of Section 122.02, Street
Vending either a misdemeanor or an infraction. The Citrus Municipal Court judges
asked law enforcement representatives to modify the ordinance dealing with illegal street
vending to be either a misdemeanor or infraction. This would allow the judge more
flexibility in rendering dispositions in such matters. If a defendant has been before the
judge on several occasions for violation of the vending ordinance, the judge would then
handle the case as a misdemeanor. If the defendant is found guilty, the judge will
sentence the defendant to actual jail time. Staff recommended approval.
In response to Councilmember Van Cleave, Chief Kies stated that Code Enforcement
is enforcing the code also and issues citations to violators. Code Enforcement has been
properly trained.

In response to Councilmember Lozano, Chief Kies stated that the individual that is cited,
have to be able to retrieve their cart, prove ownership and authorization to redeem the
equipment. The suppliers charge the vendor $200 to pay for the recovery of the cart.
It was moved and seconded to introduce Ordinance No.1127 AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION
122.99(B) OF THE BALDWIN PARK CODE OF ORDINANCES, SO ANY VIOLATION
OF SECTION 122.02 OF THE CODE SHALL CONSTITUTE EITHER A MISDEMEANOR
OR AN lNFRACTlON,Z for first reading, that it be read in title only and all further
readings be waived. M/S/C: VAN CLEAVE/MUSE. There were no objections.
Acting Chief of Police Kies requested approval of an Operational Agreement between
the City and the Baldwin Park Unified School District for the STAND 2000" program,
and an additional appropriation of funds in the amount of $25,110.00 which is necessary
for funding the City's portion of the program STAND 2000 provides a Consistent anti-
drug and alcohol message to elementary school students, and prepares them for the
DARE lessons taught later by a City police officer. The proposed Operational Agreement
will be for an entire school year, thus increasing the City's cost to $25,110.00. Staff
recommend approval.
In response to Mayor pro tem Muse and Mayor Lowes, Chief Kies stated that he would
check with the school district to see if the Stand 2000 program could be held for St.
John's also. The funding is provided through Proposition 172 and can be used for
Public Safety and the cost most likely, would be increased.
Mayor Lowes stated that she wanted the program to continue and to definitely plan for
next year
It was moved and seconded to approve the Operational Agreement for the STAND
2000 program. M/S/C: VAN CLEAVE/LOZANO. There were no objections.
It was moved and seconded to approve an additional appropriation of funds in the
amount of $25,110.00 to fund the City's share of the STAND 2000. M/S/C:
LOZANO/MUSE. There were no objections.
Acting Chief of Police Kies requested approval of an agreement for tow services with
the various providers that currently provide the service to our City. The police
department currently uses the following tow companies for its police tow needs: Albert's,
Basura's, Budget, FreddiZMac's and Royal Coaches. The new agreements are similar
to the ones that were entered into in 1994 with two exceptions. First, Section 10 was
added to articulate the rotation policy of the department and instead of a three year

agreement, changing to a one year agreement. Staff recommended approval.
It was moved and seconded to approve the agreements between the City and the
participating tow companies: Albert's, Basura's, Budget, Freddie-Mac's and Royal
Coaches. M/S/C: MUSE/LOZANO. There were no objections.
Director of Recreation and Community Services Nunez requested approval of the design
for Central Park West. Staff contacted a representative from California Street Hockey
Association and four local batting cage operators to participate in a joint public private
venture to construct a roller rink or batting cages. Not much interest was shown by
either party. David Evans and Associates were hired to design the southern 2/3 portion
of Central Park West. The 2/3 portion would give the park basketball facilities that are
well lit, playground areas, and bathroom facilities. The second year the second phase
would begin with the design of batting cages. Should the City choose to complete the
design of Central Park West the original fees are $29,445 plus $11,555 for the
bathroom/maintenance building. Design work for the norther 1/3 portion of Central Park
West of $25,300 would increase to $66,300. Staff recommended approval.
In response to Council, Director Nunez stated that the entire cost to design the park is
$66,300, to design just the Southern 2/3 of the park is $41,000. Staff felt that it was
better to proceed with the development of the Southern 2/3, and to use the $25,000
difference for the development of the Southern part of the park, and complete the
second phase in two years. The batting cages would be added during the second
phase. The funding source is CDBG Funds. The goal at this time is to get the park
functioning.
Director Cervantes stated that one issue is the City has set aside $350,000 this year and
can accomplish 2/3 of the work with that money. The additional $25,000 that would add
to the design could be spent now, but we would not know if the City has the money to
build that next part next year. Staff would rather wait until we know what is available. It
looks like it will cost $500,000 to complete that 1/3. In response to Mayor pro tem
Muse, Director Nunez stated that the $350,000 comes from Community Development
Block Grant Funds.
Kim Rhodes, Architect David Evans and Associates, stated that the final construction
drawings, the review period, and the bid time would take about 4 months before
construction could begin.
In response to Councilmember Van Cleave, Director Nunez stated that the cost does not
include the block wall.
It was moved and seconded to approve the design for the southern 2/3 portion of
Central Park West and that the northern 1/3 of the park be graded and seeded to

remain as green open space for future construction of a batting cage facility, for a
total of $41,000 which includes the $11,500 for the bathrooms. M/S/C: VAN
CLEAVE/MUSE. There were no objections.
Management Assistant Fukushima, requested that a contract be awarded to West
Coast Arborists, Inc. WCA) for tree-related services by piggybacking" on the
contract with the City of Tustin. The Public Works Department maintains 11,000 trees
throughout the City. In-house staff performs all tree-related services including trimming,
planting, removing and spraying. The City lacks a complete inventory of trees; their
locations, species, etc. To better manage tree maintenance operations and in
conjunction with the City's Information Systems Master Plan, staff needs to develop a
complete inventory of the existing trees, develop a comprehensive, as well as, proactive
tree maintenance program and link it to the City's GIS. WCA proposes to complete the
inventory within 90 days at fee not to exceed $21,375. Funds are available in the
Informations Systems budget. It was recommended to be approved.
In response to Councilmember Van Cleave, Management Assistant Fukushima stated that
a list of the trees that are trimmed is generated by a work order when people call in or
through staff. It would be more cost effective to send crews out if there were records of
the trees. All trees that are newly planted would be Computerized. WCA will provide
all the information and the computer will be updated.
Director Mousavi stated that a digitized map will recognize where the trees are, their size
and species, the maintenance required, and that different trees require different
maintenance. With this system, when a resident calls, staff will be able to recall the tree
at that address, when it needs to be trimmed, and the response will be much quicker to
the resident.
In response to Council, Management Assistant Fukushima stated that West Covina has
contracted with WCA, but they do not have the GIS. West Covina Staff has to
personally update each file. She explained how beneficial the GIS System is to the
different departments. The system is in place and it will be down loaded into the City's
GIS. West Coast Arborist will provide the initial information and then as the City plants,
or removes, or trims, the City will upgrade its records.
It was moved and seconded to waive formal bidding procedures and award a
contract to West Coast Arborists, Inc. for tree-related services by piggybacking" on
the agreement with the City of Tustin. M/S/C: MUSE/LOZANO. There were no
objections.
City Clerk Gair requested approval of a contract for the demolition of Dreamland
Trailer Park, 14353 Garvey Avenue. The owner of Dreamland Trailer Park, Jaspal Soni
with his contractor, Design Concept of Chino, obtained all of the necessary permits to

completely rehabilitate the structures on the property. The permits expired and no
inspections were requested. Mr. Soni then hired a new contractor, Pakaj B. Shah of Los
Angeles, renewed the expired permits, but the new contractor never commenced the
work or contacted the City for any inspections. In January, 1997, supplemental permits
were obtained. A duly noticed Public Hearing was held on July 17,1997 to determine
if the structures, the overgrown weeds, trash, litter and debris constituted a public
nuisance. Mr. Soni was notified by regular and certified mail and a receipt was returned
to the Code Enforcement Division signed by Mr. Soni. Mr. Soni did not appear at the
Public Hearing. It was determined at the Public Hearing that the property was a public
nuisance and all structures were ordered to be demolished and all weeds, trash, litter
and debris removed from the property by August 17,1997. The owner was notified and
again failed to respond or comply. On August 18, an abatement warrant was signed by
the judge at Citrus Municipal Court giving the City the authority to enter the property to
abate the existing nuisances. Three proposals were received for the demolition and
cleanup. Interstate Field Services, San Dimas, proposal was the lowest at $11,500
which did not include the asbestos survey and removal of asbestos contained in the old
roofing, flooring, etc. Staff estimates that the survey and removal will not exceed $3,000.
The City will lien the property with Los Angeles County to recover all costs associated
with this project. Staff recommended approval.
It was moved and seconded to approve a contract with Interstate Field Services, Inc.,
of San Dimas mas for $11,500, plus an asbestos survey/removal not to exceed $3,000,
for the demolition and cleanup of Dreamland Trailer Park at 14353 Garvey Avenue.
M/S/C: VAN CLEAVE/MUSE. There were no objections.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Councilmember Lozano complimented the Police Department for the good job they
did during the UPS strike. He announced that there will be a Study Session on
September 3rd with the Executive Director of Metrolink to discuss the noise issues.
He requested that more time lapse for the green arrow traffic signal on Baldwin Park
Boulevard and Tracy. In response to Councilmember Lozano, Director Mousavi
stated that the tree by the marquee sign will be trimmed.
Councilmember Van Cleave thanked Director Nunez for the use of a van to transport
55 young people to help Baldwin Park Beautiful clean up property on Garvey and
Frazier. He stated that the abandoned property needs to be fenced to prevent
anyone from getting injured. He thanked Director Mousavi and his staff for installing
the roof vents in the storage building at Morgan Park. He announced that the Rotary
and Key Club will give away vouchers for free smoke alarms to be given away at the
park on Saturday at the Kids Care Fair.

Mayor pro tern Muse stated that the shuffles stop at the shopping centers, but requested
that the shuffles stop inside the shopping centers. The shuffle is running on time, but
some stops possibly could be made quicker, and that time allow for stopping inside the
shopping centers.
Mayor Lowes stated that the shuffle was just getting started and it completes its run
every 30 minutes, and people like the promptness. She preferred to continue with the
current schedule and to look at the stops. The shuffle was not designed as a dial-a-ride
program, but a shuffle bus that gives the public access to the shopping centers. She
did not agree with Mayor pro tern Muse to deliver people to the door of Target.
In response to Mayor pro tern Muse, Director Mousavi stated that a three month
evaluation of the ridership would be taken to see what needs to be added or deleted,
and a comprehensive report will be available by the end of next month. A survey has
not been done by the ridership, but the question will be asked on the survey about
going into the shopping centers. If the shuffle stopped in each center that would add
5 to 10 minutes and the whole schedule would have to be changed or additional buses
added to maintain the 30 minute schedule that is in place. Mayor Lowes requested that
in the survey, it be made clear, that if the shuffle goes into the centers it would mean
a longer time for the people to wait for the shuffle and to give them that choice.
Mayor Lowes announced that the crime rate dropped by 25% and requested that the
report be put in the NOW; and that Thursday night is Baldwin Park's night at the
Quakes game. She requested 1) that the Traffic Committee review a request for a
handicapped parking space in front of McNeil Manor by the gate; 2) the radar trailer
be placed on Baldwin Park Boulevard between Los Angeles and Olive for a week; and
3) Council get a tour of the new communications center.
Director Nunez announced that Saturday will be Kids Care Fair beginning at 9:00 a.m.
till 2:00 p.m. with 42 presenters and 24 children that will perform.
