PRESENTATION
City Manager Yeats introduced Police Explorer Iris Secaida and told of her education,
experience and service. Police Officer Nelson, Officer Matson and the Explorers that
were present, presented a plaque from Explorers Post 654 to Explorer Secaida. Mayor
Lowes presented an Award of Merit to Police Explorer Secaida.
Bobbie Nixon told of the accident on Ramona and Baldwin Park Boulevard involving the
Paramedics. The injured Paramedics administered the medical help that was necessary
to the man that caused the accident. She felt that the Paramedics do not get enough
recognition.
Mayor Lowes introduced the Paramedic of the Year, Dave Niedzialek and told of his
experience. Mayor Lowes and the Council presented Paramedic Niedzialek with a City
Plaque.
Mayor Lowes introduced Paramedics Lenko Spaleta and Guy Melker and told of the
accident, and the assistance given by the injured Paramedics. Mayor Lowes and the
City Council presented City Plaques to Paramedic Guy Melker. Paramedic Lenko
Spaleta was unable to be present.

ORAL COMMUNICATION
Mayor Lowes declared Oral Communications open and invited those wishing to speak
on any subject to come forward.
Mike Tuohy, stated that Embassy Limousines is his client. Embassy has rented a piece
of property at 13327 Garvey Avenue and has spent $20,000 on rent and improvements
to the facility. Embassy has not been able to move in because of a technicality in the
Business License. The Business License does not distinguish the difference between
a taxi cab and a limousine. He felt that a limousine service is covered by the Public
Utilities Commission and it does not require a business license, insurance coverage, or
permits of the driver. The limousine services is a contractual agreement, they do not
charge by the mile. He requested that Council distinguish the limousine service from
the taxi cab companies. Embassy has 5 limousines that will be stationed in the City,
ones in other cities, and Embassy is the largest limousine company in the Valley. He
introduced Albert Pena the owner of Embassy Limousines.
Raul Martinez, Baldwin Park, stated that he has a problem in his neighborhood with
drug dealing. He reported the matter to the Police Watch Commander about 4 months
ago. Neighbors have called and were told to talk to detectives, to take pictures, and to
catch drug deals on film. One of his neighbors offered their home so the police could
do surveillance. He told of the infestation of gang members from Clark to Olive. The
police are not pro active. He requested that the Special Enforcement Detail be
reactivated. He voiced his concern about the park, the dried grass, lights that are out,
and puddles around the snack area.
Acting Chief of Police Kies stated that he had spoken with Mr. Martinez on the telephone,
and the neighbor did not readily offer their home. Working undercover narcotics
activities does take time, and the SED issue is another issue that is not appropriate to
discuss at this time. He added that he would be glad to work with Mr. Martinez.
Scout Leader Max Meyer, represents Boy Scout Troop 696. She introduced Jason
Koo, Patrol Leaders and Scout Kiel Gamble. He mentioned that his Scout Master was
awarded the first female Scout Master in the San Gabriel Valley. He requested a dozen
of the baseball caps with the City logo. Scout Expo will be held at the Santa Anita Race
Track and requested the City place an ad in the program. If the City does not wish to
buy an ad, a donation will be acceptable.
Dick Tatum, Edra Street, stated that with fall and spring people do a lot of trimming.
He asked if a chipper was available to make a mulch instead of hauling the trimmings
to the landfills. He asked that the name of his street be changed and bleachers be
installed so the people could watch the speeders.

Richard Granados, 13525 Tracy, complimented the Police Department. He went on a
ride along and gang members were arrested. Shopping carts and trash is a problem
on Tracy. People have been sitting on shopping carts waiting for the shuffle. Z
requested more pressure be placed on the businesses to keep the Carts off the
residential properties.
Dan Trunco, Baldwin Park stated that the park is one of the finest around, it is safe and
clean. He stated at the All-American Cities Award that the park is clean and that he takes
his grandchildren there often. He complimented the Council and the Police Department.
Mayor Lowes stated that the park will soon be reseeded. The park is worn due to the
concerts and different activities this summer.
City Manager Yeats stated that in January a new shopping cart law went into effect that
has made it difficult for the City's proactive shopping cart removal program. The City is
restricted by the new law. The City is working with the new owners of the Sierra Center,
Food 4 Less, and Target to create the first agreement between the City and a business,
where the City would be responsible for picking up the carts and taking them back to
the center. The stores would then pay the City a fee.
City Clerk Gair stated that she spoke with Mr. Tuohy and he will come into the office
regarding the business license for the limousine service. The story Mr. Tuohy has
received is quite different than the actual happenings in the Business License
Department.
There being no other speakers, Mayor Lowes declared Oral Communications closed.

Director of Community Development Cervantes stated that copy of the GPR/APR was
included for review in the staff report and the highlights were as follows:
1. A total of 5,792 lineal feet of sidewalk Constructed.
2. A total of 4,480 lineal feet of street reconstructed.
3. A total of 3,211 lineal feet of new storm drain.
4. 13 rehab loans and 5 grants made under the Low Interest Residential Loan
Program.
5. Assisted 5,768 persons/households in the area of public services.
6. Assisted 23 families to buy their first home.
The CDBG Advisory Committee made three recommendations:
1. A follow-up report is requested after federal action, report back to the
committee of federal comments, if any.
2. Take steps to plan better so that projects are completed on schedule.
3. Limit assistance to low income people for CDBG funded Public Services.
Mayor Lowes declared the Public Hearing open and invited those wishing to speak
regarding the Grantee Performance Report 22nd Year Community Development Block
Grant Program to come forward. There were none.
Mayor Lowes declared the Public Hearing closed.
In response to Mayor pro tem Muse, Director Cervantes stated that if the people are
served by the same provider they should be counted once. lithe people are serviced
by additional providers then they would be counted by each agency that serviced them.
The requirement could be made that only unduplicated services be reported. The
recommendation from the CDBG Advisory Committee is to limit the services to the low
income people. Mayor pro tem Muse stated that she feels that the City should continue
to try to bring these agencies into the community, to those willing to provide services to
the community, especially those wishing to come into the Family Service Center.
In response to Mayor pro tem Muse, Director Nunez stated the amount of Day Care
Subsidies that are provided have been reduced. There are currently 120 children in the
Latch Key Program. The number of children now being served is 114.

It was recommended that Council approve the GPR and instruct staff to incorporate
any and all public comments into the final adopted GPR/APR. M/S/C: MUSENAN
CLEAVE There were no objections.
Mayor Lowes introduced the Public Hearing pertaining to ZApproval for designation
of Homeownership Zone and to submit federal application to the Department of
Housing and Urban Development HUD) for a Homeownership Grant.
Director of Community Development Cervantes requested 1) Council to designate a
Homeownership Zone to apply for grant funds, which has $10 million available for the
United States, and it's awarded on a competitive basis. They require that a City designate
a Homeownership Zone. That within that Homeownership Zone it is comprised primarily
of residential properties. The second criteria is that the City has enough housing
opportunities to develop new construction, and rehabilitation opportunities to make a
difterence in a neighborhood. In selecting a Horneownership Zone staff looked at
opportunities for development. Then patterns of rental vs. homeowner occupancy, the
more owner occupied property, the more stable the environment. The properties have
to be contiguous. One of the largest sites available is located on Pacific Avenue. There
are also sites available on Puente Avenue and Badillo.
Staff recommended Ramona/Badillo be the north border, Francisquito on the western
end to Foster, south to Vineland to Merced, south to Puente, and north to Badillo. In
conjunction to requesting a grant for $1.5 million it was felt that $6.5 million could be set
aside in CDBG Funds plus HOME Funds. It was recommended that most of the funding
be spent on these infill areas, about $7 million required for land, provide a program
which is an ongoing program, for acquisition for single family housing, rehab, and
conversion to homeownership. Third, look at Opportunities for rental apartments that
need rehabilitation, to see if there is any incentive for the owners to rehab the apartments
and turn them into owner occupancy. There is no commitment at this point. If the City
is awarded the grant, then there is a specific contract that is negotiated and awarded.

relating to the Homeownership Zone to come forward. There were none.

In response to Councilmember Van Cleave, Director Cervantes stated that of the 16 sites
that have been targeted and recommended, fourteen are primarily for residential. A site
located on Ramona and Monterey has been submitted for a senior housing project. On
Francisquito and Ramona a vacant site could be used as industrial or for higher density
housing. The program is design for homeownership, the homeownership could be in
the form of a condo, or a single family unit. Councilmember Van Cleave expressed his

concern for HUD projects, which are some of the worst projects in the City. He stated
that he would like to keep as many single family units as possible.
Director Cervantes stated that the Cook Development in the area of Vineland and Merced
which was recently approved would be that type of concept. Eight of the units are for
low/moderate income home buyers, the others are market so they would be mixed.
There are deed restrictions and there would be qualifications for purchasing the property.
There is some equity investment also. The City wants to assist, but not create more
obstacles for the neighborhood or the community. A GRC study recently stated that in
order to get business investments, the City has to work on the housing stock also.
Mayor pro tem Muse stated that some of the vacant properties have been eye sores for
years. Some of the repossessed homes have been rehabilitated.
It was moved and seconded to approve Resolution No.97-64, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AUTHORIZING SUBMISSION
OF AN APPLICATION FOR HOMEOWNERSHIP ZONE GRANT TO THE UNITED
STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT." M/S/C:
MUSENAN CLEAVE. There were no objections.
REPORTS OF OFFICERS. COMMISSIONS. AND COMMITTEES
Mayor Lowes stated that the Proposition 218 Report has been removed from the
agenda.
COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
Mayor pro tem Muse stated that she spoke to Congressman Martinez regarding the
Mexican Government not extraditing Spooky Alvarez unless California agrees that
the death penalty will not be used. She asked that the City push not to allow Mexico
just to release Spooky Alvarez, and to step up communication with Gil Garcetti to do
what he has to do to get him back here to stand trial. Janet Reno stated that a treaty
has been signed that the death penalty would not be upheld for extraditing criminals.
Mayor Lowes directed staff to concentrate on contacting Mexico and request/demand
release of this citizen of the United States to stand trial for murder, with no strings
attached.

Councilmember Lozano stated that he concurs and it would Probably be best to direct
staff to send a letter to the Ambassador in Mexico and ask for results as soon as
possible.
Councilmember Van Cleave stated that if the United States allows the death penalty to
be dropped, it will set a precedence that people will commit a crime and go to Mexico
knowing they can avoid the death penalty. We do not need another country telling the
United States how to operate our laws. It is a United States citizen that broke the law
in the United States and he needs to be brought to justice in the United States.
City Manager Yeats stated that the precedence has already been set. Staff is actively
pursuing this issue, the State Department of the United States and the Mexican
Consulate and all are waiting for their call back.
Mayor pro tern Muse stated that the League of California Cities is proposing an
amendment to the shopping cart ordinance, they are proposing to make it easier to
retrieve shopping carts. She asked that AB 1427 be supported. She requested that the
Housing Commission, CDBG Advisory Committee and the Recreation/Community
Services Commission conduct a joint meeting, that they work together on the social
services portion of the CDBG funding. She asked that the agencies coordinate better.
In response to Mayor pro tern Muse, Mayor Lowes stated that she does not agree with
the recommendation, that each commission has their own job. The Housing
Commission is being taught about the qualifications required to receive CDBG Funding
right now. She suggested that a Recreation/Community Services Commissioner also
attend the meeting with recommendations. She stated that Council usually do not go
against the Commissioner's recommendations, its usually the staff's recommendations,
it's not invalidating the Commissions.
City Manager Yeats stated that the second meeting in October be set as a joint meeting
to find Out Council's priorities. He stated that a second Study Session meeting will be
set later on in the process with the Housing Commission, CDBG Advisory Committee,
Recreation/Community Services Commission and the Council. Council agreed by
unanimous consent.
Councilmember Lozano stated that he would be in support of the Recreation/Community
Services Commission to work on the social services funding. Mayor Lowes suggested
that Councilmember Lozano attend one of the CDBG Funding meetings to see their
process in progress.
Mayor pro tern Muse announced that this Saturday, September 20th at 12:00 will be the
official planting ceremony for the Baldwin Park Community Garden. She invited
everyone to attend the dedication.

Councilmember Van Cleave invited everyone to attend Baldwin Park Beautiful on
Saturday. Some of the people running for office have called to state they will help the
with the community cleanup, and he asked that if someone is running for office that they
help the Committee after the election.
Councilmember Lozano invited everyone to attend the scholarship program on Friday,
September 19th, 9:00a.m. till 5:00p.m. at the Snyder Community Center. He requested
staff research for grants for people who have a higher income and due to debt or the
fact that they are just over the limit can't qualify. They also will get the opportunity to
participate in the rehab and home buyer programs.
Director Cervantes stated that a letter had been sent to business owners and large
property owners within the Camelback Project Area, telling them about a hearing for the
Extension of an Exclusive Agreement with Autonation. The City Attorney has advised
that the Redevelopment Agency does not have to go the Council, that it was an
automatic extension, and they have an additional 60 days or until November 15th.

were no objections.
