HomeMy WebLinkAbout1997 11 05 CC MIN1997 11 05 CC MINòw @˜}ŒCC MIN NOV 5 1997Yæ´YH08 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CITY HALL, 14403 EAST PACIFIC AVENUE, WEDNESDAY, NOVEMBER 5,1997 The City Council met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL PRESENT: COUNCILMEMBERS LOZANO, MUSE, VAN CLEAVE, AND MAYOR LOWES ALSO PRESENT: City Attorney Olivas, City Manager Yeats, Acting Chief of Police Kies, Dir. of Community Development Cervantes, Dir. of Public Works Mousavi, Dir. of Rec/Community Services Nunez, City Treasurer Montenegro, and City Clerk Gair 00- PRESENTATIONS Mayor Lowes read the Proclamation and declared November 15, 1997 as *`America Recycles Day" and presented it to Director of Public Works Mousavi. Acting Chief Kies introduced the Representative from the Automobile Club, Officer Mike Ford, and the Representative from the California Highway Patrol and presented them with the 10851 Auto Theft Recovery Award" He thanked Officer Chris Hufford for his work in bringing the award to the officers that deserve it. Officer Frydendal was unable to be at the meeting. 00- Communication Mayor Lowes declared Oral Communications open and invited those wishing to speak on any subject to come forward. Roy Test, stated that he understands the Mayor will deliver a State of the City address with a $4 to $5 charge for breakfast. He requested that the Mayor visit the Senior Citizens Center and tell the seniors about the State of the City free of charge and at a better time. He felt the local politicians are untouchable and the only time they appear anywhere is for a fee and the Senior Citizen Center would appreciate some of them visiting with the seniors. The Congressman will be in the Celebrate Baldwin Park parade on Saturday. Marlen Garcia, Baldwin Park, stated that it is a happy day for the residents of Baldwin Park, the right man was elected to Council, Ricardo Pacheco. She came to the Council six months ago and requested that Ricardo Pacheco be appointed to the vacant council seat, because he is an educated man, a family man, the right man for the job, and he received the next highest votes in the previous election. She criticized Mayor Lowes and Councilmember Van Cleave for wasting money on the November election, and for the Council stalemate. Conrado Magdaleno, Baldwin Park, criticized Councilmember Van Cleave for statements be made and for an article in the Tribune regarding the appointment of Ricardo Pacheco to the vacant Council seat. The money that was spent on the election could have been spent more wisely. Dick Tatum, Edra Street, spoke about speeding vehicles on Edra, passing on the curve, double parking, and tailgating. It is dangerous driving your car in and out of your driveway on Edra. Dan Trunco, stated that the election is over and there should be no personal feelings. Ricardo Pacheco has won and everyone on the Council should have the City's best interest at heart. There being no other speakers, Mayor Lowes declared Oral Communications closed. 00- CONSENT CALENDAR City Clerk Gair presented the Consent Calendar: 1. Approve Agreement All American City Award Arellano Associates Councilmember Van Cleave requested Item No.6 & 9 be removed for separate consideration. Mayor pro tem Muse requested Item No.8 be removed for separate consideration. It was moved and seconded to approve the Consent Calendar Items No.1-5, 7, 9 11. MIS/C: MUSE/VAN CLEAVE. There were no objections. Councilmember Van Cleave stated that maps were included in the staff report regarding the sidewalk project. He requested a map of the sidewalks that have been installed. City Manager Yeats stated that two sidewalk projects are going on at the same time, one project is the Safe Routes to Schools and secondly there is a Master Plan to put sidewalks throughout the community. The study recommended some improvements on Vineland at the intersections of Pacific Avenue and Merced Avenue. Speed and accident records show that the accident records are more than the expected accident records for this type of street. The study is the first phase of the project and the construction will begin after all the design and improvements have been made. Council will approve the study and the improvement recommendations, City Attorney Olivas stated that Mayor pro tern Muse would abstain on Item No.9, because she lives on Vineland Avenue. It was moved and seconded to approve Consent Calendar Item No.6. MIS/C: LOZANO/VAN CLEAVE. There were no objections. It was moved and seconded to approve Consent Calendar Item No.9. MIS/C: VAN CLEAVE/LOZANO. Mayor pro tern Muse abstained due to a possible conflict of interest. In response to Mayor pro tern Muse, Director Nunez and City Manager Yeats stated that there was a problem with the lighting. The cost of the lights was $85,000, Westco Lighting quoted $45,000, which did not included prevailing wages. If the City goes to bid for the lighting separately, the cost will be lower. The general contractor has included a profit by sub-contracting the lighting. The way the bid packet was designed, if fencing was done for all the ball fields it was a one line item, the same amount was bid for each ball park instead of the actual amount per park. When the actual amount is bid, it should reduce the costs and the scope should be expanded back to what Council wanted to do in the beginning. Because the general contractor wants to do the whole project, he is sub-contracting out the lighting, he is building in a profit margin for the lighting and that can be bid separately and save money, and that savings can be put back in the project. Mayor pro tern Muse stated that she wanted to be assured that the project would not be reduced, that the money would be found to complete the little league fields according to the original scope. She requested an update Containing the re-calculations. City Manager Yeats requested that all bids be rejected. And prior to sending out the new bid packets for the little league field lighting that the bid packets be brought back to Council to show the original requests are included. It was moved and seconded to approve Item No.8, to reject all bids for the Youth Little and prior to sending out the new bid packets it will be brought back to Council with all the items requested." COMMISSIONS AND COMMITTEES Mayor Lowes stated that the Agreement for Financial Consulting Services for AutoNation with Rod Gunn & Associates would need to be continued to the next meeting. Councilmember Lozano stated he requested information with reference to the background of Rod Gunn & Associates. The Status Report had information pertaining to Rod Gunn, but he was busy and could not review the material. He requested information be given to Council 72 hours in advance of a meeting. It was moved and seconded to continue the agreement for Financial Consulting Services with Rod Gunn. MIS/C: LOZANO/VAN CLEAVE. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilmember Lozano recognized newly elected persons: Valley County Water Board, Mariana Lake and Al Contreras; and to Council, Councilman Elect Ricardo Pacheco. In response to Councilmember tozano, Director Mousavi stated that as of November 6th there should not be any constmction problems at Walnut and Olive Streets. Director Nunez stated that a request to carry over monies to purchase lumber to finish the Pleasant View Ball Field regarding clean up. Councilmember Van Cleave stated that if the City has the opportunity to purchase any more diesel tractors to make sure the engines are clean air engines. City Attorney Olivas stated that he would consult with City Clerk Gair with regards to the ordinance change for once a month sidewalk sales for the merchants. He congratulated all the candidates and he stated he looks forward to working with Councilman Pacheco. Mayor pro tem Muse requested to know: 1) the amount of money the City receives in grant monies f6r recycling; 2) how much time is staff spending on these types of projects; and 3) if a consultant is authorized to do the recycling services, then what is staff doing in-house. In response to Mayor pro tem Muse, City Manager Yeats stated that no new job classifications have been created, nor has more staff been added. Normally if necessary, the classification plan is approved, new positions are brought to Council. She congratulated all the candidates in the audience and asked that the budget study session and the Vision Meeting be rescheduled to December 5th. She congratulated all the winning candidates and complimented Councilman Elect Pacheco for his professional campaign. She looks forward to working with him on the Council. City Clerk Gair stated that the Reader Board that was used during the election was very successful. Azusa called and said it was a great idea and even asked if the City would be putting up their results too. She thanked Director Nunez for all his help on election night. She announced that the reviewing officer for the Celebrate Baldwin Park Parade will be Roy Test. City Clerk Gair explained that the County Clerk is allowed 28 days to do their certification of an election. The canvassing of the ballots begin on November 6th. The Registrar Recorder will verify all the signatures of the provisional ballots, challenged ballots, and absentee ballots also. When the certification if finalized, there will be a difference in the vote, because these will be added in to the total from November 4rd. City Attorney Olivas stated that he attended the Baldwin Park Career Day and the closing ceremony for Red Ribbon Week at Santa Fe School. The future lawyers of Baldwin Park will begin in about a month and are now accepting applications. 00- Mayor Lowes adjourned the regular meeting of the City Council at 7:49 p.m. There were no objections.
