HomeMy WebLinkAbout1998 05 06 CC MIN SS1998 05 06 CC MIN SS@˜zMIN SS MAY 6 1998[Þ›[H6Ø8 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CITY HALL, 14403 EAST PACIFIC AVENUE, WEDNESDAY, MAY 6,1998 The City Council met in a study session in the Council Chambers at 6:00 p.m. ROLL CALL PRESENT: COUNCIL MEMBERS LOZANO, MUSE, PACHECO, VAN CLEAVE, AND MAYOR LOWES ALSO PRESENT: City Attorney Olivas, Acting Chief of Police Kies, Interim Finance Director Sanchez, Dir. of Community Development Cervantes, Dir. of Public Works Mousavi, Dir. of Rec/Community Services Nunez, and City Clerk Gair 00- CLOSED SESSION The City Council met in Closed Session at 6:00 p.m. to consider a Conference with Legal Counsel regarding Anticipated Litigation as Significant Exposure to Litigation pursuant to Government Code section 54956.9(b) relating to One Case. The City Council reconvened at 6:15 p.m. Roll Call remained the same. City Attorney Olivas stated that in Closed Session the City Council considered the item as stated. Direction was given to Staff and no further action was taken. 00- ORAL COMMUNICATIONS Mayor Lowes declared Oral Communications open and invited those wishing to speak to come forward. There were none. This money will have to be repaid to the County and he explained that process and the need to meet with the County. Marilyn Garcia, Bone Counsel, stated that it is important to cure this problem because it needs clearing up for the general stability of other projects. She also explained some of the ways that the repayment will be approached and that one of the reasons for concern is that the County can stop sending tax increments. She further explained to the Council housing funds cannot be used to repay other debts. The Council discussed this issue and their concerns about: * How this affects other projects. * Why these over payments were not noticed earlier. * Using reserves to repay the funds to the County. * The General Fund balance being able to absorb this cost. * The seriousness of this being compounded by the misappropriation of the Gas Tax monies. * Ml the money that has been loaned to Redevelopment Projects and the affect on the General Fund. * Staff members being mislead and the neglect on the part of someone regarding this. * This happening over a seven year time period and not noticed. * The cap that was established of one million dollars. * Establishing a policy on this so that this does not happen again. * Considering to amend the cap. Director Cervantes offered some alternatives to the Council for possible future changes to help put the City in a better position. Also, at the request of the City Council, Dean Flores, a member of the Bond Counsel team, stated that he recollected that Mr. Rod Gunn, who formerly did bond issues for the City, stated back in 1994 that there was a need to pay back funds to the County. 00- Mayor Lowes adjourned the study session at 6:45 p.m. There were no objections.
