Acting Chief of Police Kies introduced Police Officer Vince Luciano and told of his background and education. City Clerk Gair administered the Oath of Office to Police Officer Vince Luciano. Council welcomed Officer Luciano to the City and into a changing city. They offered their assistance at all times, congratulated him for his position, and said they were here to support him. They thanked him for joining us and encouraged him that he had joined a fine police department. 00- ORAL COMMUNICATION Mayor Lowes declared Oral Communications open and invited those wishing to speak on any subject to come forward. April Dawn Walker, Baldwin Park, lives by the Metrolink tracks stated that she received her notice very late for the Metrolink meeting. Her neighbor's house has still not sold, because the houses have depreciated since the train goes by. She would like to have her house be part of some of the studies. Does not understand how Metrolink can get away with destroying her property. The vibration on her property is bad and something has to be done. She would love to move. Those persons were: Maritza Torres, Sean Curtis and Mrs. Ruiz. Conrado Magdalena, Baldwin Park, read an article about the former city manager suing the City. He commented on irregularities that had occurred which he felt was the former city manager's fault and he felt that the former city manager should only be thanked for what good he did. He requested that all the transaction done by Carl Yeats he investigated. He referred to coming to City Hall to get help opening up a business and he could not get help, but a recreations commissioner did get help. He was not asking for special treatment. Lady resident not audible) spoke about donating land on Marion Street. She had to move a trailer because of this and a relative agreed to do this without vehicle registration. She asked that his ticket be excused because of the circumstances. Dolores Holguin, resident, spoke regarding requests that she had made at the last meeting regarding a loan given to the Mayor's son and commented on ethics. She outlined the process that was done after the loan was not approved and the former city manager finding a way to see that the loan was granted. She requested that all loans he recalled and investigated. She commented regarding the low morale in the City Hall and stated that if the employees are unhappy let them leave. She questioned the position of Assistant to the City Manager when there is no city manager. Linda Gair, resident, spoke regarding the Metrolink and the futility of fighting the railroad. She thanked the Council for all they had done but it appears the railroad always wins. She also commented on the dollar loss to the acre of land that her family owns next to the Metrolink. Resident, Garvey Apartments in Baldwin Park, inquired about qualifying to buy a home. Their landlord is increasing the rent like the trailer park. She commented on the son of someone here buying a home very cheap and she would like to qualify also. Will she have the same type of rates because she also pays taxes and does not want to be discriminated against. She thanked Council Members Pacheco, Lozano and Muse for helping them to get their rent lowered. M Contreras, Baldwin Park, stated that the Council is here to make policy and not to take advantage of the policies that are made. Make everything that is available he accessible to everyone because a sister of a former mayor also got a house and a recreations commissioner got a loan. He hoped that this is over for now and is a done deal. There were no objections. 00- PUBLIC HEARING Mayor Lowes introduced the Public Hearing pertaining to Ordering the annual levy and collection of assessments associated with the Citywide Landscaping and Lighting Maintenance District for FY 1998-99 and authorize the County of Los Angeles to add this Assessment to the property tax bills." Director of Public Works Mousavi stated that on March 4, 1998 Council authorized the City Engineer to prepare the Engineer's Report and on May 6, 1998 the Council approved this Report for FY 1998-99. The proposed rates will be the same as they were for FY 1998-99. The Assessment District will generate $1,256,836 in revenues and these funds will be utilized for the maintenance of landscaping, street lighting and traffic signals. It was recommended for approval. Mayor Lowes declared the Public Hearing open on, the collection of assessments associated with Citywide Landscaping and Lighting" as previously described and invited those wishing to speak on this subject to come forward. Al Contreras, resident, asked that the City consider freezing some of the taxes. There being no other speakers, Mayor Lowes declared the Public Hearing Closed. Council Member Muse clarified that this tax had voter approval and is a formality. The proposed rates reflect an increase of 1.2% based upon the Consumer Price Index CPI) for the Los Angeles-Long Beach area. The Citywide Park Maintenance Assessment District will generate $999,503 in revenues to provide for annual park maintenance expenditure of $987.120. Baldwin Park's general fluid contribution for general benefit for FY 1998-99 will be $460,336. It was recommended for approval. COMMISSIONS. AND COMMITTEES Transit Coordinator Bouton stated the purpose of the report is to receive and file the noise, speed and vibration portion of the Metrolink Study report and to authorize staff to complete the dust study in June and bring the final report of the Metrolink Study of noise, dust, speed and vibration for further consideration. Behrens and Associates conducted the study of noise, speed, and vibration portion of the study. Many residents felt that the Metrolink trains had slowed down and were quieter during the time of the study. Staff commissioned Behrens and Associates to repeat noise, speed and vibration monitoring without Metrolink's knowledge. This study was conducted during the last week of April. The dust portion of the study has not been performed due to the heavy rainfall over the last months. The study will be performed in late June or early July when the dust levels should be back to normal. Don Behrens, Behrens and Associates measured speed, noise and vibration levels at three sites adjacent to the railroad tracks in the City. There was an increase of noise that can be considered to be intrusive by residents and the vibration levels indicates that Metrolink is well within the acceptable standards. The test performed without Metrolink's prior knowledge were similar to the first study except that trains were traveling about 4 mph faster. The City does still have the option to apply for the Quiet Zone status from the Federal Rail Administration. This designation may require some improvements at grade crossings but will allow trains to travel through the City without using their horns. It was recommended to receive and file the report. Mayor Lowes opened the meeting for Public Input relating to the MetroLink and invited those wishing to speak on this subject to come forward. Residents living near the tracks commented on 1) the inconvenience of not being able to use your back yard, or your telephone; 2) the structural damage to their houses; 3) animals going crazy; 4) guests that are frightened; 5) sick children because of the dust; 6) the arrogance of the Metrolink personnel; 7) needing to stand up and tell Metrolink what we want; 8) save the City money and stop the dust study; and 9) the frustration with the end result of this report because it was a waste of time. Those residents speaking were; April Dawn Walker, Gus Martinez, Henry Lopez, Mr. Valarde and David Avila who live on Paddy Lane. Roy Test, resident felt, through personal experience, construction of the building may be helpful to stop noise, but patios can not be made more liveable. Kathryn Tizcareno, Vineland Avenue, felt for the people that have to suffer through this, but the benefits out weigh the inconveniences. She also spoke against the former city manager. They are always biased. * Focus on the complaints of the people and help the residents to register those complaints. It was suggested that the Quiet Zone be pursued to reduce or eliminate the need to blow the horn and the street crossings will be enhanced to stop illegal crossings. Those costs may not be that big. It was moved and seconded to receive and file the report and authorize staff to complete the dust study in June and bring the final report of the Metrolink Study of noise, dust, speed and vibration for further consideration and that the Quiet Zone application be pursued by the City. Director of Public Works Mousavi requested Council to contract for the services of an Interim Finance Director and approve the rate of compensation until the Finance Director position is filled permanently. Jose R. Sanchez, who was hired as the Interim Finance Manager was asked to fill the position of Interim Finance Director until a permanent Finance Director is hired. As Interim Finance Director, Mr. Sanchez will be assuming the responsibility of administering the Finance Department which includes the City's accounting system, budgeting, payroll, purchasing, accounts payable, investments, information systems, central stores and serve on the Executive Team. Mr. Sanchez is proposing that he fill the Interim Finance Director position as a contract employee at a rate of $60 per hour with a work week of approximately 32 hours. Mr. Sanchez is not asking for any transportation consideration that the permanent Finance Director position would be eligible for. The proposal recommended that the Interim Finance Manager position, which Mr. Sanchez was hired for, not be filled. It was recommended for approval. Finance Manager Sanchez explained the hourly range that he bases his calculations on which is the permanent salary for the position by a full time employee. His responsibilities have increased over that of Linda Holmes. The City is in the recruitment process and he based his request on what that position will bring as a salary range. Council discussed the proposal before them and it was moved and seconded to approve the rate of compensation at $50.00 an hour until the Finance Director position is filled permanently to Mr. Jose R. The City has looked at alternatives to allowing individuals to be hired contingent on the results of a fingerprint check, as well as looking at the various levels of employee hiring. In utilizing an outside agency that can provide a basic employee profile check in matter of a few days to supplement the fingerprint check can provide us with an additional level of security to our processing. Information has been provided by one company and that is an employee profile check that can be accomplished in 2 to 3 days at the approximate cost of $52 to $57 per person. This service can be used when hiring interim/contractual individuals, full time employee and part time employees on a contingency basis while pending the fingerprint clearance. The estimated cost for these services can be between $20,000 $30,000 annually. Full time and part time individuals being considered for hire that would involve coming in contact with children, will not be hired on a contingency basis and must wait for the fingerprint check has to be completed. The School District will provide the city with the documentation to confirm the clearance of all employees they have used. Staff recommended approval. It was moved and seconded to approve the revised pre-employment hiring process and authorize staff to request proposals from companies that provide employee profile checks. M/S/C: MUSE/VAN CLEAVE. There were no objections. 00- COUNCIL AND STAFF REQUESTS & COMMUNICATIONS Council Member Muse requested that 1) a letter of support be sent to Sacramento to preserve the wash and the river behind Walnut Creek Nature Park; 2) we come up with some kind of a plan to clean up the Cal Trans areas, because we need to lobby our people to listen to us; and 3) residents interested in the first time home buyers programs be notified by flyers in the trailer parks and the apartments so that they are aware of these programs. Councilman Van Cleave commented on the trailer parks and that their cars are being towed away. He also thanked Ralph, Sid and Betty for coming to the Baldwin Park Beautiful Celebration. He told how many trophies they gave out and about the cooperation of the kids. Mayor Lowes commented on the B P Beautiful Celebration, how great the celebration was this year, about presenting a plaque to the Van Cleave Family because they give so much to that program.
