The Closed Session will go on the City Council Agenda at the end of the meeting and the other Status Updates for the Local Development Corporation will go on the Agenda at the time of the Staff Report PRESENTATIONS Police Chief LE GARRA introduced, gave a brief background and welcomed the newest member of our staf{ Finance Director James Hathaway Finance Director HATHAWAY gave an acceptance speech, thanking all for the confidence shown in him. ORAL COMMUNICATIONS Larry Ortega, Executive Director of the Community Union we coordinate the after school computer Training Program at the Esther Snyder Community Center. This Saturday we are having a half-day seminar free of charge from 12:00 to 4:00 p.m. at the Esther Snyder Community Center for all residents of Baldwin Park. I want to invite the entire City of Baldwin Park and everyone else that might be there. There will also be bi-lingual translators available at the site. I would like to thank the City council for continuing to support us and making this a really successful program for the children of Baldwin Park. I followed up on a hunch. This individual was paying particular attention to three little girls as they walked past him. Because of this man's actions with the little girls I was to become somewhat familiar with Megan's Law which prior to this I only vaguely remembered hearing something about. This law, as most of you know, regards the accessibility of information to the public by way of a CD Rom in a computer. This City had one such computer available at a detective's desk. And was available only when the detective was available. I was able to obtain some information that I was looking for at the Sheriff's Station as they have a computer located at their front desk in the lobby area. Last week I had a conversation with Ten Muse and the Police Chief outside the Council Chambers regarding this, as the meeting was canceled because the air conditioning wasn't working. Thanks to Ted and Chief Richard LeGarra, I understand now that a computer is going to be available soon in the lobby area at the Police Station so the residents of Baldwin Park may check on people they suspect of being a registered Sex Offender or Child Predator living close to them. Having access to this information I believe will give parents a tool to better protect their children in their own neighborhoods. I personally believe that the residents will benefit by having this information available literally at their finger tips at the Police Station here. Now, this brings me to the man that runs the Sex Crimes Unit for our Police Department, Detective John Hullar. This man pretty much takes care of the Sex Crimes in Baldwin Park by himself I was impressed with this man's knowledge of all of the aspects of the law and his quick response to questions and concerns that I and others had. With cutbacks in budgets that have hit Baldwin Park and with the resources more limited now, I wanted to give Officer Hullar credit for doing what I believe to be an outstanding job in working with the issues of Sex Offenders in Baldwin Park. I do believe that he deserves some recognition for his efforts to keep the children of Baldwin Park safer from predators that are lurking closer to us than we had ever imagined. So with that I thank you for my opportunity to speak to you. Councilmember LOZANO stated, If we could send a letter to Detective John Hullar for that tremendous job because I know Mr. Curtis was very impressed as to the assistance that he gave him. I also want to recognize that he's an Officer who's about to complete his Master's in Public Administration. It is also important for us to recognize Officers for this great job that he did. It was very impressive. Thank you for recognizing him, Mr. Curtis. Captain Mower said, there's one point that I thought was strange on the agenda. There's a deal where Mr. Bill is going to abstain because of a conflict of interest. I will just say watch it. Mr. Trunco, Baldwin Park said, last year I went to the All American City awards and I was proud to speak on how things have changed in Baldwin Park and how a real good job was done. But I'm really depressed on all the bad publicity we've been getting lately in the papers. Not only in the Tribune, but in the Times and everywhere. I just think that you guys up there should straighten out and stop this kid stuff and let's get down to business with the City. Stop voting on things for your own selves and vote for what the people need in the City. This bad publicity is not doing us any good. Everywhere I go like West Covina people say what's the matter with Baldwin Park, what's going on. I'm proud to be a resident of Baldwin Park. I've been here 30 years and I want to stay here until I die. But I want people up there Council) to look out for out here audience) and not grandstand. Our Police Department is doing good. Our Community Center is doing great. We never had that 30 years ago. I just want you guys to look out for us. Thank you. Roy Test, Baldwin Park said, I can only echo what this man has just said. It is my feeling that we have too many politicians up there and not enough real Council people who are interested in the City. Margarita Vargas, Baldwin Park stated, I have two items to talk about. I read in the paper that Linda Gair resigned as City Clerk. I was surprised because the last meeting that I was here she said that her love for the City was so strong that she was going to keep working as the elected City Clerk. I was surprised. But all of you have to keep working and make sure that the City runs good. So we have to prove that the City can be run with anybody that's in charge of the City Clerk position. For the Chief of Police, the principal I had at Kenmore asked me to ask you about the Telacu building. It's frill of dry grass so he's afraid it could be a fire hazard. So maybe someone could go and clean it up. The red on the sidewalk is faded. So somebody needs to go repaint it. I don't know if that's the City's responsibility. There were no other speakers. It has been approximately 60 days since the City Council hired our company to put together an implementation plan related to revitalizing the economic base of the City of Baldwin Park. Over the past couple of months the City Council has gone through some very painful decisions with respect to cutting the budget, laying off people, going through the process of setting priorities. In the package that I gave you, the scope of work that we put together, as part of our contract, was very clear. It was to structure and put in place a multi-year economic program designed to strengthen the City's economic base resulting in increased and stabilized General Fund revenue sources and enhance levels of public services. We proposed taking on a two-phased approach. One was going through a process that lead to the development of these strategies. Secondly, moving into implementation. To accomplish that, we put together a project team made up of Urban Futures, Inc. And H.R. Culvert Enterprises that brought to the City of Baldwin Park expertise in the following areas: One is in economic development and redevelopment. The other one is retail, commercial investment development, tenants positioning and repositioning, business attractions, marketing promotions, business retention, business district property and asset management. With that expertise, what we chose to do was to review all the studies and reports that have been done in the past. Those reports included the following: The Sierra Vista Puente-Merced Freeway Quota Economic Development Strategy by GRC Associates, The Stanley R. Hoffman Associates, Baldwin Park 2000 Plan Economic Development, Technical Report of Baldwin Park 2020 General Plan Economic Development, Physical and Economic Analysis. We looked at the General Plan Project Notebook. We looked at redevelopment project area development plans. We looked at the demographics of this community that were produced by CACI Marketing Services. Also we looked at the Community Development Project Status listing. We met with Mr. Steve Cervantes and asked him to put together a listing of projects that are currently on the books that are either in the development phase, planning phase or projected future projects. Also we had three meetings with the City Council, Economic Development Committee and also the City Staff What we found is that those studies and reports were outstanding, in terms of identifying the issues, doing an analysis of the issues and making solid recommendations as to what should be done. Also in many respects, gave a good sense of what the priorities are But like a number of reports, do not go the next phase in terms of what is the delegation of responsibilities as who should be doing these things, what are the time frames and what are the resources that should be allocated to make these things happen. As we met with the Council and the Economic Development Committee, it became very clear that Economic Development is a critical component of 1) making sure that you don't have to go through that process of laying off people again and cutting back services. But improving the quality of life in this community. When you look at how staff time and how budget resources are allocated, there is no relationship to that priority and your Organizational Structure. We also found during our initial presentation is that there is no strategy in place to work with the existing business base. For a number of reasons it's understandable that emphasis and priority should be placed on the Freeway Corridor. That's where you're going to have the type of retail and business type of activity that generates the General Fund revenue that will help you maintain the level of services that you enjoy right now. However, as we became very familiar with your economic base, we noticed that there were a number of businesses scattered throughout your City. What we also assessed was the failure to recognize the importance that your downtown Civic Center can play in economic development. To a large degree the downtown Civic Center, instead of being looked upon and managed as another strip commercial district, when you look at the unique demographics within your market place, one walks away with the impression, looking at the demographics of Baldwin Park, of being looked upon as a negative. What I mean by that is 1) in the City of Baldwin Park we have a concentration of Hispanics 79.8% compared to 43% for the county and 62% for the primary market area. 2) The median housing values are lower in Baldwin Park at $151,000 compared to the county $226,000 and the primary market area of $186,000. Forty percent of the population here is blue collar, 50% of the population 25 years and older have not completed high school. Per capita retail sales $2,185 which is about 38% of L A. County and 25% of primary which is about $8,000 and manufacturing and wholesale trade is a strong part of Baldwin Park's economic base, while the county and the primary trade area have declined in importance. The reason why r bring that up, from an economical development standpoint you look at the types of businesses that are located along the Freeway Corridor. The types that should be going there are ones that don't restrict their customer base, the corporate boundaries. By putting in the right type of retail mix, and the right type of developments, realistically you can attract from a 10-15 mile market place. In your downtown core area, we see that as a golden opportunity for you to address the needs of your unique demographics. Not only within Baldwin Park, but the greater market place. There is no place in this market place that we've designed that look at these demographics as a positive. The fact that you have a large Hispanic base here, they have certain types of shopping and activity needs that aren't being addressed. We don't feel very comfortable addressing those issues, but you need to hear about that and you need to hear about our analysis of what should be done to deal with them. Based upon these observations, the second reason we wanted to meet with you tonight, to share with you our recommendation to the change of scope of our work efforts. We would be doing you a disservice if we continued along the same lines, producing the document that we were contracted for. But we feel if we did that, then you would have another study on the shelf We want to recommend to you some specific things and hopefully, as we engage in discussion of these, we end up with support to proceed forward. With that conceptual support then we can put together the implementation strategies and the written documents for you. Our recommendations are to put in place the organizational structure and professional staff to manage Economic Development programs and activities that had been identified by your Economic Development Director. We met with Mr. Cervantes and what he pointed out to us, when you start looking at the amount of Economic Development activities that are on the books right now, in different phases of development. Do you know how much these projects add up to $83 million of private investment in this town. Those projects conservatively would generate a combination tax increment and sales tax to the City of $2.1 million tremendous. You know how many people you have to manage those assets none! There is an existing organizational chart in the packet). I would like to focus your attention going to the Chief Executive Officer position to the Community Development Department. Mr. Cervantes has the responsibility of managing Housing Division, Redevelopment, Economic Development, Planning Division and Building and Safety. Look under Redevelopment/Economic Development. Every person that you see there has programmed responsibilities in other departments. No one is assigned project management responsibility. We looked at your competitive base, Covina, West Covina. They have full time people. West Covina has 15 flill-time people allocated to Economic Development. It makes good business sense because there is a return on that investment. By allocating appropriate resources, trained, professional expertise in the appropriate areas to generate the type of General Fund revenue that will offset any of those costs. We are recommending a re-organization of your Economic Development functions. 1) you have a City Council that sits also as the CRA that oversees your Chief Executive Officer and Executive Director, that oversees the Department Head. We are recommending that the Department Head do what he's supposed to do manage. Also having a City Council Economic Development Committee. We were impressed with all the projects that Mr. Cervantes and his Department were working on, the clear impression that we had was the City Council was not really aware all this was going on. We are recommending that we have within this structure a City Council/Economic Development Committee that will work closely within the Economic Development Division. Also to hire three people. One is Redevelopment Project Manager, that would not only have program manager responsibilities but also would manage the work efforts of two project coordinators. In the packet there are very detailed descriptions of what we need related to these positions. Councilmember PACHECO said, you are recommending to have staff look over these projects while they are being completed. Mr. Cano continued, the second recommendation is related to hiring the appropriate staff and commence with the development implementation of a city-wide business development program to help strengthen the small independent types of businesses. They need to understand visual impact. Our studies have shown that people will not go into the stores if they can not see through the windows. Then comes merchandise. Knowing how to properly locate it in the store. Niche marketing, customer service and customer service approach which is different than your Home Depot small businesses must be friendlier. Another thing is collaborative advertising, special events. Also, the importance of image enhancement. Forth, initiate a process with the downtown property owners and merchants to revitalize the downtown Civic Center with the goal of creating the downtown as the focal point of the community and a destination for the visiting public. When we first made our presentation, City Council directed the Chamber of Commerce to present their business plan at a future date to the City Council. We believe the Chamber's role is critical. As a company, we strongly believe that the Chamber should have a business plan just like any other business in terms of how are they going to reach out to the membership, what is the value that they're going to add to the membership? Bottom line what I am asking the Council tonight, even though this is a slight change from our original scope of work, we think it is one that is critical to proceed forward especially as it relates to the Economic Development function and the hiring of trained professional staff that can monitor and manage the programs and hopefully, bring them to reality. Councilmember PACHECO said, you are asking for the small local businesses to recreate a sort of downtown area like Covina has so as to capture more of the market? It will be a part of your plan as to how we will achieve that? Mr. Cano said yes. Councilmember LOZANO stated, I am very impressed with the information that you have given. Also I think it is important to look at current, existing areas that are revenue-enhancing areas. Mr. Cervantes is inundated with large amounts of work. It would be wise for us to look at this and implement some of the recommendations that you have put together. I think we should set up a study session to look at this informative information and implement it. Councilmember MUSE asked about the organizational structure. The Development Services Manager position is frozen right now. It is not in the new proposed structure. That position is being redefined as Redevelopment Project Manager? Not three new position that you are proposing, but two? Mr. Cano said yes. Justification is correspondence prepared by Mr. Cervantes that gave us a listing of all the projects dated 7/22/98. We were quite impressed with the projects that were presently under negotiations and also the number of projects that were currently going through plan check review process. Based upon that demand and to be able to deliver the type of oversight projects, we felt that at a minimum, three people should be assigned to those projects. Councilmember MUSE asked, with this Economic Development Committee, sometimes information does not get back to the frill group. I am interested in the small businesses and nurturing them and offering them assistance, and maybe the Chamber of Commerce could help us with that. Councilmember VAN CLEAVE, said that business retention and business expansion is extremely important. Mr. Cano agreed and added, the best form of business expansion is business retention. Councilmember PACHECO said maybe we could have a workshop for the public. We could invite the businesses so they could see we are making a transition toward being more aggressive and we want to retain their business. Also, I would like the same thing for Developers. Mr. Cano agreed it was a good idea. Mayor LOWES asked Mr. Cano, are you asking us to conceptually approve your complete plan tonight or just for what you are presenting tonight? Mr. CANO replied, that he would like the change in scope to be conceptually approved. Specifically reorganizing, business retention, downtown revitalization. Mayor LOWES said, this is the first time we have received your report as a body and since your suggestions and recommendations do involve hiring two people, when we have just laid off people and we have just hired a new Finance Director yesterday. I would like to have time now for the Council and Staff to digest this for a couple of weeks or so and get a report back as our Finance Director can get a feel of our finances and your report and how our Staff feels about moving forward with this and what their recommendations would be based on the money that we have available, where it would come from, what the benefits would be to us and whether our Staff agrees. Some of the things I do think we need that was mentioned is a workshop where we can all get together and really talk about these things. Z the Chamber could set up business seminars where we can teach marketing is a good idea. Mr. CANO said, we are not asking you to make any decisions tonight with respect to a committee hiring people or reorganizing. What we want is to go back and put this in a draft report to you so you can look at it. Mayor LOWES closed the Redevelopment Agency Meeting at this time. CONSENT CALENDAR Mayor LOWES read a Letter of Resignation effective 9/8/98 from Linda Gair who asked that it be read at the Council Meeting. Mayor LOWES asked for a motion on Items #1 through #7 on the Consent Calendar. M/SIC: PACHECO/MUSE There were no objections. PUBLIC HEARING III. A. Consideration of the proposed construction and assessment along Belgate Street, East of Merced. Approve Rejection of Bids Belgate Avenue Sewer Assessment District Authorize to Re-advertise. Public Works Director MOUSAVI presented the report to the City Council. The lowest bid received on construction companies is 19% higher than the original estimate. Therefore, the property owners have requested to modify the scope of work and reschedule the project for advertising. We request the Council reject this bid. Seeing no interest Mayor LOWES closed the Public Hearing. Motion was made to reject all bids and modify scope of work. MetroLink Dust Study and Final Report Transit Coordinator Kara Bouton presented the Report to City Council. Earl Roberts, representative from RES Environmental Services reported that they designed and implemented a Dust Study at a residence that borders the MetroLink track. The study was done over two days; a busy train day with 25 trains and a Sunday with no trains. Based on the two dust samples the deferential was very minimal These 24-hour samples did not exceed either the state or federal standards for particulate. Transit Coordinator Kara Bouton stated in order to further address residents' concerns, a Quiet Zone application is in the process. Also a status meeting has been set up for next Thursday in the Park which will include MetroLink representatives and to answer Councilmember LOZANO concerns, Kara stated that the resident have been informed via mail. Councilmember MUSE stated this proves we are at the mercy of federal and state guidelines. We all feel there is a definite problem. Maybe cities can ban together to help each other. Resolution of Intention Approving Amendment to Contract Public Employment Retirement System and City of Baldwin Park Personnel/Risk Manager COLE presented the Report to City Council which provides retirement benefits for all miscellaneous employees at a level of 2% at 55. LDC Report Community Development Director CERVANTES presented the Report to the City Council stating that the LDC is not legally recognized by the state as a non-profit organization. The changes needed to comply include a loan committee of the Finance Director, Community Development Director, a Banker, a Real Estate Broker, a Chamber of Commerce representative and a Business Owner representative. These people should be recommended by the E-Team and then approved by the City Council. Also needed is a 2-year term limitation. The loan amount maximum currently is $75,000. Mr. Cervantes said we could possibly expand to other areas of the City also. He added the changes would not effect the status of the loans, just the structure of the committee. Councilmember PACHECO said he would like to see the status of current loans. Councilmember VAN CLEAVE asked, why not expand into the entire city instead of limiting it to just other areas' of the City? Councilmember MUSE said, will there be a requirement that you have to be a Baldwin Park business person? Mayor LOWE S stated that the recommendation is that the Council directs Staff to prepare an Administrative Plan eliminating the LDC and replacing it with a committee appointed by the City Council apprised of Staff; Chamber, a Banker Lender and a Business Owner. The committee would be re-appointed annually. The Mayor added, we would like to add that it be a local business and that the term limits for two years and two terms only. I would like to request that our Chief of Police supply a report for a public safety committee including information on surrounding cities, public safety committees and the ordinances that started the committees and impact they have had on the crime rate in the area. Z believe West Covina and Chino Hills have one. Mayor LOWES said, we need Council consensus. She added that our city is very small and she does not see a need for this commission since our Police Chief and his department do such an outstanding job. Councilmember MUSE said, I would like that report to see what other cities do and how it impacts their residents and city. Chief of Police LE GARRA said, a lot of cities have committees that work with the Police Department to make things happen and sometimes they have different names like Advisory Committee. After talking with members of the Baldwin Park Soccer League which has 70 teams encompassing children from age 5 to adult men and women, we feel we need sports fields and it would be nice if they were lit at night. I would like to direct the Community Development Director and Public Works Director to work with the Baldwin Park Soccer League to do a feasibility study including cost estimates and sites. Accordion Federation of North America which is a very large musical competition 3 or 4 Baldwin Park students who actually received the top awards. 6) Finally, the opening festivities for Kaiser Permanente Hospital will be held on October 3, and the community is invited. One of the special programs they have is the assembling of a time capsule. The deadline is September 16 for the public to add to it, to be opened in 25 years. Councilmember LOZANO said, I want to also mention for recognition, David Ferrer who was awarded for a Speech Contest. V.3. Development of Fiscal Policy Councilmember LOZANO said, before introducing Mr. Jim Hathaway, I want to officially introduce a fiscal policy. I believe we should have standards so when the budget comes around we won't make the same mistakes. I was real impressed with the Concerts in the Park and all the other functions your department runs so well. V.4. Removal of Planning Commissioner Dolores Holquin Mayor LOWE S said, our Council has had an opportunity to look at the articles and reports that have been in the paper. City Attorney OLIVAS asked if Ms. Holquin had been notified of this in writing. He also warned that accusations should be verified and taken very seriously. Mayor LOWES replied, I did not inform her but she was at the Council meeting when I put this on the agenda. I am requesting that a Planning Commissioner be removed. At Planning Commission Meetings and Conferences, Dolores Holquin made reservations for 5 Conferences that she did not attend and it cost the City several hundred dollars. Ms. Holquin was asked to leave the Mid-Valley Democratic Club for a variety of reasons. Ms. Holguin said she turned in a $70.00 request for printing of business cards, but they were not business cards. It appears to have been a false claim. Ms. Holquin has been very controlling and disruptive at the Planning Commission meetings, rude to some Councilmembers and staff. I request that she be removed. We may not have all the finds. The community might want to help defray the finds. Director of Recreation/Community Services Nunez informed, there is a community wide ceremony on Saturday, October 24. City Attorney OLIVAS stated, I have had the pleasure of working with Assembly Member Gallegos' office in assisting in drafting AB2055 which is a bill that acknowledges a City's right with respect to planning Adult businesses to cooperate with adjacent cities in zoning of the Adult businesses. Councilmember VAN CLEAVE had two concerns: 1) street lights still need to be serviced by either Edison or the City, especially now that we're about to turn our c]ocks back and, 2) Jay-Walkers, 100 200 people cross the street in the area of the Park at Ramona and Baldwin Park Boulevard. More are going to have accidents. Something has to be done. Chief of Police LE GARRA stated, we will be giving some additional traffic education. We have two programs with the schools at the end of month with schools Buckle Up for Safety, and the Safe Route Program in conjunction with the auto club. Councilmember VAN CLEAVE stated he wanted to see our City look beautiful. Freeways, off- ramps and walk over bridges. Somebody needs to do something. whatever it takes, we need to have something done. Public Works Director MOUSAVI stated we have on the budget this year to rep ave Baldwin Park Boulevard, the sidewalks and walkway areas. The bridge widening has been postponed till year 2003. Councilmember LOZANO stated he would want to work with Bill on the Encroachment Permit to clear up the Freeway. Work with staff also. Councilmember MUSE had several topics of discussion/comments: 1)1 want to make sure we are looking at the Y2K millennium bug. I would like to know how other cities work with this problem. 2) The Independent Cities Lease Authority of which I'm on the board, approved the Fresh Rate program which is a loan program for homeowners that is different from first time homeowners because you don't have to be a first timer. It is not as stringent as FHA requirements. It allows people in different situations take advantage. We should work at marketing this program more. 3) Web page, who updates it and when. I am still listed as Mayor pro-tem. Nothing is current. We should be keeping on top of these things. 4) A resident who lives behind Jones had some things to discuss with the Soccer League. She was willing to gather up her neighbors to have a discussion with the Soccer League people, a broken window and something about a port-a-potty. 5)1 would like to the City give out awards of merit for the following individuals: Junior Statesman Program where you study the government and interact with congress people.
