PRESENTATION
Mayor LOWES presented a Proclamation proclaiming October to be Domestic Violence Awareness
Month. Mayor LOWES presented the Proclamation to Sylvia Telasco who represented the Wings
Organization.
AWARD OF MERIT
Mayor LOWES presented an Award of Merit to Officer John Hullar for dedicated service above
and beyond the call of duty for the City of Baldwin Park.
PRESENTATION TO THE CITY
Mayor LOWES and the Council Members accepted a Presentation of $5,000 from the Amateur
Athletic Foundation showing appreciation for Baldwin Park's Community Center.
Councilmember LOZANO thanked the Amateur Athletic Foundation and recognized Officer Hullar
for his outstanding service to this community.
ORAL COMMUNICATIONS
A woman complimented Baldwin Park for prioritizing the safety of their families by having us
provide services for healthy families.

Quintilla Avila said, domestic violence' is an inappropriate choice of words. There is nothing
domestic about violence. The new phrase is relationship violence' and October is Relationship
Violence Month. We need more awareness. Many are suffering, especially our children.
Emily Loeb, Baldwin Park, spoke about Matthew Shephard. She stated what is most frightening is
that this crime could have been committed anywhere. Yesterday the Board of Supervisors, of the
County of Los Angeles passed a resolution calling on the Federal Legislature to enact stricter hate
crimes legislation. I would like this City Council which leads a cultural and socially diverse
community to take similar action and help steer this country towards becoming a more harmonious
and just society. I would also like to ask our Mayor to lead us in a moment of silence for Matthew
Shephard and all hate crimes victims and to adjourn the meeting in honor of the life of Matthew
Shephard.
Councilmember LOZANO said, I support the moment of silence and to adjourn the meeting in the
name of Matthew Shephard. I am preparing a resolution for the next meeting that we will be
consistent with the motion passed by the County Board of Supervisors along with proposed actions
to be taken with hate crimes and tolerance of diversity.
Mayor LOWES called for a moment of silence in memory of Matthew Shephard.
Seeing no further interest Mayor LOWES closed Oral communications.

Mayor LOWES asked for approval of the nine Items on the Consent Calendar.

IV. A. 1. Approve Election Vendor for City Election Services

IV. A. 2. Appointment of Commissioners Housing Commission
City Clerk TIZCARENO presented the report to City Council. Recommendation that City Council
proceed with the appointments of seven Offices of the Housing Commission.
Mayor LOWES said, first we have the two Offices that have to be filled by a tenant and someone
over 62. I think we only have two applicants that qualify: Patricia Graham and Lilly Bailey. They
will be appointed to Office 6 and Office 7. There were no objections.

Mayor LOWE S stated, we have seven new Housing Commissioners and they will be notified if they
are not here tonight. They will be sworn in at the next meeting or at the Housing Commission
Meeting whichever occurs first.
IV. A. 3. Approve a Report on the Conflict of Interest Code Designated Positions
Finance Department
City Clerk TIZCARENO presented the report to the City Council. Recommendation that the City
Council receive and file the 1998 Conflict of Interest Code Biennial Notice.
M/S/C: PACHECO/VAN CLEAVE There were no objections.
IV. B. 1. Approve Baldwin Park City as a Designated Passport Agency
Finance Director HATHAWAY presented the report to the City Council. Recommendation to
authorize the Finance Director to enter into an Agreement with the Passport Services Division of the
State Department to have the City Hall of Baldwin Park designated as a Passport Processing Site.
M/S/C: MUSE/PACHECO There were no objections.
Mayor LOWES commended Mr. Hathaway for a great idea and not only for revenue to the City and
free training for our employees but also service to a lot of people.

V.1. Update on Megan's Law
Officer John Hullar stated, we have 641 files on sex offenders. Twenty-five are now living out of
state, 21 are in prison, 33 are now deceased, 12 are no longer required to register, 145 are living

elsewhere in the State and 35, although not living in Baldwin Park, the Justice Department is not able
to verif' the exact location.
I organized a sweep in 1971 which targeted 25 locations. Only two offenders were actually found.
With this information, I developed a computerized filing and tracking system for the Baldwin Park
Police Department It identifies information and monitors when they should register. The
Department of Justice provides us with a CD Rom that contains information of sex offenders.
Presently, the CD Rom shows 132 sex offenders live in Baldwin Park. This number is not correct,
it incorporates out of state and deceased offenders. They will be updating. The sex offenders listed
on the CD Rom are classified in three categories: High Risk, Serious and Other. High Risk means
convicted of at least one violent offense and one or more violent non-sex crimes. Serious means
convicted of various sex crimes. Other convicted of sex crimes such as pornography. Although these
offenders are listed on the CD Rom, they can only be accessed by Law Enforcement Personnel.
Information regarding Other sex offenders may not be released to the public. High Risk and Serious
can be released to the public under certain conditions. After going through all these files and
checking dozens of locations, the actual number of sex offenders registered in Baldwin Park was 70.
None of these are High Risk. They are all listed as Serious. The investigation of sex offenders is on-
going to protect the citizens of Baldwin Park. Councilmember LOZANO asked, what constitutes
not having to register as a sex offender?
Officer Hullar answered, that is determined by the Justice Department and one of their criteria is if
a sex offense occurred 20 years ago and they have a clean record now. Jf anyone wants to use the
CD Rom, you must be 18 years old or older, provide a California driver's license or identification
card, sign a statement that you are not a sex offender, that you understand the purpose of the release
of information is to protect the public and that you have a distinct purpose for viewing the CD Rom.
V.2. College Work Study Program
Councilmember LOZANO
1)Recognized the Mayor of La Puente who was in the audience.
2)Stated that youth at Baldwin Park High School and Sierra Vista have asked me on previous
occasions if it is possible for us to work out an internship with them. Some of them are interested
in architecture. I don't think there's a cost factor, probably more like paperwork.
3)5 aid that yesterday was significant in reference to an investigation that went on for year and a half
I was extremely happy that nothing was found toward my immediate committee. I want to clarity that
even though the investigation showed absolutely nothing, there are still those perpetrators that caused
this problem of placing these applications in the City Clerk's office. Mayor LOWES, you mentioned
that you would not apologize and so did our former City Clerk, Linda Gair. Although I respect your

opinion on that, I think that there should be an apology for something that should have been an
inquiry type of issue. My brother and I apologize to you for what you went through and yet nothing
was proven, as we know, at the District Attorney's office. We work to help this City move forward.
Our ultimate goal is to move this City forward together. The citizens deserve nothing but the best.
I want to say that I'm extremely happy with the outcome.
City Clerk TIZCARENO stated, I would like to establish in the future before any files are sent out
to the D.A. for investigation, that we set up a Blue Ribbon Committee to review these matters along
with the City Attorney, County representatives and maybe other City Clerks from adjoining cities.
This will eliminate any politics to enter into the decision to move forward. I would like to provide
you with a written policy at a future date.
V.3. City Volunteer Program
Councilmember PACHECO stated, some people ask about volunteering here in the City. I would
like to form a Volunteer Bureau here in Baldwin Park so that anyone wishing can come in to one
location and look for the different volunteer opportunities. Could that be worked out by the
Personnel Commission so that they could get involved and take a look at other volunteer programs
in other cities? Also, to make it a program for the youth of our City to be able to have an opportunity
to use that volunteer experience for a job. Also internships for college level youth. Maybe the staff
could work with the Personnel Commission to establish this Volunteer Bureau.
Mayor LOWES stated, our staff has been cut back and they have been over burdened with the day
to day work that they have. I think these are good programs, but personally, right now with the
elections coming up and the general plan finalization, I feel that this is too much of a burden on our
staff
Councilmember PACHECO responded, that is why we need this program now. The Personnel
Commission has a five member body that can do a lot of the ground work that we need to put this
program together and the staff can get help from these volunteers at a time they need it,when they
are over burdened.
Councilmember VAN CLEAVE stated, I have a volunteer group that has been averaging about 100
people on Saturdays. You have to have supervisors out there. We have a real hard time working
with all these kids. We love them, they're great, they're totally honorable students. But there's only
three or four adults; my wife, my daughter, myself Lately for the last six months we've had the
Reyes', Raul and his wife. We don't have enough adult supervision. You really need to think about
the adult supervision.

Councilmember MUSE stated, I feel that when you are short staffed is when you can really use
volunteers. Maybe we need volunteer supervisors.
Mayor LOWES stated, Chief LeGarra has started a program with the Pastors in the City and they
are meeting once every other month. They are getting together a list of what they offer so people can
volunteer for a variety of things. They are making a booklet of this information and it should be
coming forth in the near future. So there is work being done in this area.
Chief of Police LE GARRA stated, Captain Kies is putting together volunteers for the Police
Department. We can extend this to the entire City. We've already done a lot of ground work. We
already have nine or eleven volunteers from the Police Department and we can give this information
to the Personnel Commission.
Councilmember PACHECO stated, that he already spoke to Nadja Cole who is willing to meet with
the Personnel Commission.
Councilmember LOZANO stated, I think that is a great idea. That allows the Personnel
Commission to be more active. Maybe we can look at it as a Pilot Program to see if it does burden
the staff
Chief of Police LE GARRA stated, the E-Team is prepared to discuss this tomorrow when we have
our meeting.
Councilmember MUSE stated, in the Police Department's Activity Report I was impressed with the
Walk and Talk activity. She read from the report how Officers help people all the time; a woman
complaining on the street that she couldn't breathe and the Officer called for para medics
immediately. Also, while talking to people on the street it was mentioned that a truck had been in
a certain driveway with two plates on it which they reported and found out it was stolen a year ago
as part of the loot from a ring of car thieves. I commend the Officers and the Chief and the Walk and
Talk program.
Chief of Police LE GARRA stated, through this Walk and Talk program one Officer was able to
help a family of four find a temporary residence. Another helped find one person a job. Another
helped by giving out bus vouchers. Another Officer is working with a medical institution to have
some tattoos removed from a man's face at no cost. I am very pleased with the Officers, taking the
initiative on their own.
Mayor LOWES stated, the Clergy work hand-in-hand with the Police with this Walk and Talk
Program.

Councilmember MUSE stated, the Community Center gave us a copy of their bylaws to try to get
more grants in the City. Grants are an under utilized asset that we can take advantage of I'm hoping
we can update the bylaws or find a way we can breathe some life into doing more find raising. I am
asking if Council will allow me to work on this with our City Attorney, David Olivas, and our
Director of Recreation/Community Services, Ralph Nunez.
Mayor LOWES stated, I would also like to work on that.
CONSENSUS
Director of Recreation/Community Services NUNEZ
1)We were notified today by the Pentagon that the Honorable Reese Calbera, Secretary of the Army,
will be at our Veteran's Day Ceremony on Wednesday, November 11. We will also have a Para-
Troop group that will do the jump again.
2)On November 2, we have scheduled the installanon of the ceramic tile at Central Park West. 132
tiles will be completed by children from the Central Elementary School. I would like to extend an
invitation to members of the City Council.
3)The Display Case in front of the Council Chambers. We have had an organization, Relationship
Violence", come in that requested to put their items in the Case. However, there is no policy in place.
We will prepare a policy for the City Council's and City Attorney's review. That will also include
the marquee.
Mayor LOWES
1)1 agree with Mr. Lozano whereas the Deputy District Attorney stated that it was very clear in
regard to the Absentee Ballot Applications that crimes were committed. There is no sufficient
evidence to charge anyone. As Mayor Pro Tem Lozano said, that leaves the perpetrators still out
there which is a grave concern to us. It leaves Baldwin Park in limbo and I am sorry about that. But
they do need evidence that will hold up. I hope this will never happen again in our City.
2)A citizen on Farnell Street reports that due to a traffic accident two months ago, the curb is out.
He would like it replaced for safety reasons and his yard washes out into the street. Mso, one block
away an accident on the 605 Freeway took about I 5 feet of chain link fence which now allows access
to the freeway by animals and children.
3)Crosswalks with no striping or is very faded; one at Francisquito and Puente, one at Francisquito
and Dalewood.
4)1 would like to request a brochure on Pima Corporation so that I can refresh myself on their
location, their qualifications, etc.

5)On the Claims and Demands I noticed that Mr. Mousavi has his 30 hours per week from 9/Z/98 to
9/30/98 and at $71 an hour that came to $8,733. I would like City Council and the E-Team to
consider requesting that Mr. Mousavi spend his 30 hours working at City Hall rather than spending
all this time at a City Council Meeting. See if he can assign a staff member to be at the City Council
Meetings except on rare occasions when he would be needed here.
Objections: PACHECO/MUSE/LOZANO
Mayor LOWES requested City Council and the P-Team to make every effort to set a Friday
morning aside for at least a half-day workshop so that we can discuss a number of things.
Chief of Police LE GARRA stated, I have asked Nadja Cole to make phone calls and try to set that
meeting up in the very near future.
City Attorney OLIVAS stated, I meant to endorse very strongly what the City Clerk has said about
setting up a Blue Ribbon Committee. I wasn't even informed when the matter was referred to the
D.A. I believe that a Committee composed of someone from the County and an adjoining City Clerk
and perhaps a variety of people would be able to keep the politics out of referring things to the D.A.
Mayor LOWES adjourned the Regular Session of the City Council. There were no objections.
