A. Drug Free Zone
Director of Recreation/Community Services NUNEZ presented the report to the City Council
stating that the approval of City Council is necessary to declare an area a Drug Free Zone.
Councilmember PACHECO asked Mr. Nunez if he would bring an Ordinance to that effect for the
next meeting.
B. Information Services Update
Finance Director HATHAWAY presented the report to the City Council.

denominations to grow closer to Christ. On October 30, the Teen Program held a retreat at Malibu
Canyon with over 200 Baldwin Park teenagers attending. Thanks to the donations received by
Councilmembers Lozano and Pacheco, this retreat was made possible for many.
Jenna Nalle, Baldwin Park said, I would like to thank the City Attorney, Mr. Olivas, for also
supporting the Teen Program. His donation assisted in the purchase of the 250 T-shirts that every
participant received.
Carlos Durango, Baldwin Park said, our Teen Program starts off with the 5:00 Mass at St. John the
Baptist and we go from there to the Hall]. I welcome all of you to come and see.
Bob Kuhn, Glendora, said, as a former Council Member and Mayor of Glendora, I can certainly
appreciate and understand the decisions that you make on behalf of the people. One very important
decisions are going to be made this evening: Item IV.B. 1. the election of a Water Quality Authority
Member. We are going through major changes in the Authority, and you are going to be nominating
someone to serve on that board for the next 3½ years. Please support Maggie Clark.
Margaret Clark, Rosemead, said, I represent Baldwin Park as one of 13 cities in the San Gabriel
Basin which do not pump their own water. I would appreciate your support.
Margarita Vargas, Baldwin Park, said, yesterday I worked in the Walnut Creek Park Polling Area
as an inspector. My son Javier and another lady were helping me. Thank you, Mr. Ralph Nunez.
A man, Baldwin Park, stated, I noticed water coming out of the pavement in the middle of the street.
I called the City, the County and the Water Department. I have been told by the City to pay $5,000
to fix the sewer line. It is not even on my property. I do not think it is fair. I would appreciate
anything you can do for me.
Mayor LOWES asked Mr. Mousavi for a report on the situation.
Mr. Walton, I would appreciate your support for Margaret Clark.
Nancy Telavenega. Baldwin Park, I live in the AutoNation area along with other tenants here
tonight. Our landlord has already raised our rents so his property value would go up. And he may
be raising them again shortly. This has caused us stress, concern, confusion. We feel cheated.
Tenants are caught in the middle. We respectfully request your assistance in remediating this rent
increase via reimbursement by the City to all tenants or negotiating with our landlord for a grace
period of at least six months while the tenants decide if they want to stay or not. Also, assurance that
Z because we came and spoke tonight, none of us will be retaliated against in any way, shape or form.

James Noman, Baldwin Park, said I feel I'm being exploited because we do not have any rent
control in Baldwin Park. I have lived here three months and I was affected already. Also, I am not
covered under the relocation expenses, so it is not fair. I ask you to put a stop to this.
Councilmember LOZANO, said maybe our City Attorney can look into some kind of Resolution
to protect our residents.
Mary Ferrer, Baldwin Park, said regarding the Contract Designs for Proposition C to be awarded
to AAE Consultants, I believe it is a total conflict of interest.
Angel Vanegas, Baldwin Park, said I would like to thank Mr. Lozano and Ms. Muse for their
support.
Seeing no further interest, Mayor LOWES closed Oral communications.
CONSENT CALENDAR
Mayor LOWES pulled Items No.3 and 4 for discussion.
Mayor LOWES asked for approval of the Consent Calendar Item Numbers 1, 2, 5, 6 and 7 on the
Consent Calendar.
MIS/C: LOZANO/MUSE There were no objections.
11.3. Approve Agreement with the Los Angeles County for the Olive Street Storm Drain.
Councilmember PACHECO asked Mr. Mousavi to explain the savings that occurred from the
County. Public Works Director MOUSAVI stated, Olive Street had experienced flooding for many
years. The cost was estimated at approximately $4.5 million for repairs. I have been working with
the County for three years now to have them participate in this project. The project is now complete.
The City's cost was $1.8 million from the final cost of $5 million. We are asking for approval to
receive the balance of $564,000 from the County.

Mayor LOWES stated, it was recommended that we award this Contract to AAE Consultants for
$42,375. Mr. Mousavi already makes $1 10,000 for his part time position with the City. Since he is
a partner with AAE Consultants, I feel he should either not be working as our Public Works Director
or AAE should not be allowed to bid or participate on jobs that we have. She asked for the City
Attorney's opinion.
City Attorney OLIVAS, said, I addressed this in a written memorandum to all the Council Members
already. It was decided in order to create a firewall between Mr. Mousavi and the actual wording
of the Contract, a separate pane! would review this matter and Mr. Mousavi would not be involved
in the decision. Councilmember PACHECO stated we would be saving approximately $16,000 by
using AAE Consultants. Councilmember ember VAN CLEAVE said, no other bidder has an office or staff
inside the City beside Sid Mousavi. I believe it is a conflict of interest.
Mayor LOWES made a motion to reject this bid and put out a call for three more bids and I believe
we desperately need a City Manager or CEO.

Mayor LOWES opened the Public Hearing.
Seeing no interest Mayor LOWES closed the Public Hearing.
Mayor LOWES stated, it is recommended that the City Council read Ordinance No.1135, in title
only, relating to adoption of the new Uniform Codes. The City Council on second reading, in title
only, adopt Ordinance No. 1135 and amend Sections 150.001,150.006, 150.040,150.050, 150.055,
150.060, 150.070, 151.01 and 151.02 ofthe Baldwin Park Municipal Code.
City Attorney OLIVAS read the Title: Title Ordinance No. 1135 An Ordinance of the City Council
of the City of Baldwin Park amending certain sections of the Baldwin Park Municipal Code relating
to the Adoption of new Uniform Codes.
City Attorney OLIVAS stated that the appropriate motion is to adopt by Title and waive further
reading.
MIS/C: LOZANO/MUSE There were no objections.
Ill. B. Adoption of Title 20 of the Los Angeles County Code Sanitary Sewers and
Industrial Waste
Public Works Director MOUSAVI presented& the report to City Council. It is Staff's
recommendation that the City Council introduce Ordinance No.1136 an Ordinance adopting Title
20 of the Los Angeles County Code Sanitary Sewers arid Industrial Waste for first reading and that
the Ordinance be read in Title only and that all further readings be waived.
Mayor LOWES opened the Public Hearing.
Mr. Walton, Baldwin Park asked, is there an onsite monitoring process? Who is doing the lab
testing? Is the City behind that? What is going on with the dumping going into the City sewers?
When was the last update of the sewers maintenance in the City of Baldwin Park? Are records kept
daily, quarterly, yearly?
Ms. Popick, Baldwin Park said, Valley View Water is the worst service. Customer Service leaves
a lot to be desired,
Seeing no further interest, Mayor LOWES declared the Public Hearing closed.
Councilmember VAN CLEAVE asked, do we monitor? Public Works Director MOUSAVI
answered, yes we do at random two or three times a year at least once) it is monitored. Everything

is categorized. It is a new program with fines for offenders. The majority of the cities in Los Angeles
have adopted this Ordinance.
Councilmember MUSE said, then the $25,000 comes from the General Fund. Mayor LOWES
clarified that the fees are charged once a year.
Mayor LOWES said, the recommendation is that the City Council introduce Ordinance No.1136
an Ordinance adopting Title 20 of the Los Angeles County Code Sanitary Sewers and Industrial
Waste for first reading, that the Ordinance be read in Title only and that all further readings be
waived.
City Attorney OLIVAS read the Title: An Ordinance of the City Council of the City of Baldwin
Park, California, amending Baldwin Park Municipal Code Section 51.12(13) and adopting b) reference
Part 2 of Chapter 20.36 of Division 2 of Title 20 of the Los Angeles County Code.

III. C. Consideration of the establishment of an increase in certain fees and charges for
issuance, processing and tiling of various City services and permits. RESOLUTION

IV. A. 1. Approve Election Vendor or City Election Services
City Clerk TIZCARENO presented the report to the City Council. She recommended that the City
contract with SES for the election vendor services and the City Attorney be instructed to draft a
Contract for services not to exceed $28,860.15 and the Mayor be authorized to sign such Contract.
MIS/C: MUSE/PACHECO There were no objections.
Mayor LOWE S inquired about the Translation Fee of $4,400. She asked if the Candidates pay for
this themselves? City Clerk TIZCARENO answered, yes and added that this company is quoting
the cost for translation at less than half of what we paid last year.
IV. B. 1. Election of Water Quality Authority Member RESOLUTION NO.98-90
Chief of Police LE GARRA presented the report to City Council. He recommended that the City
Council adopt Resolution No.98-90 casting its seven 7) votes for one of the candidates of the Water
Quality Authority Board. The two candidates are: Margaret Clark and Richard Melendez.

Councilmember LOZANO said I believe Maggie can do a good job. But we also have to open up
opportunities for other individuals. I support Richard Melendez.

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
V.1. Resolution declaring the City of Baldwin Park's continuing efforts to eradicate Hate
Crimes and expressing its solidarity with the Los Angeles County Board of Supervisors
in condemning recent Hate Crimes RESOLUTION NO.98-89
Councilmember LOZANO stated, the Baldwin Park City Council condemns the violent attack on
Matthew Shepherd and all acts of hate and bigotry. Be it moved that the Baldwin Park City Council
support the motion of the Los Angeles Board of Supervisors in calling for Federal Hate Crime
Legislation. Be it moved that the Baldwin Park City Council send a letter of condolence to the family
of Matthew Shephard. Be it moved that the Baldwin Park City Council work with community groups
to inform residents on cultural diversity and tolerance. Also, I would like to circulate this Resolution
as we adopt it to neighboring cities so we can present it altogether.
MIS/C: LOZANO/VAN CLEAVE There were no objections.
Councilmember LOZANO informed the City Council of a resolution to be put on the next Agenda.
He read a resolution on election procedures.
Whereas, Baldwin Park's Municipal elections have been the subject of an investigation
by the Los Angeles County District Attorney's office in which fraudulent activities
have been determined. Whereas, such allegations impact unfavorably on the Baldwin
Park City Council, its members, as well as the City as a whole. Whereas, it is essential
to have accountable City Council free from election fraud, or the appearance of
election fraud. Whereas, the citizens of Baldwin Park require a truly representative
leadership and accountability on the part of that leadership. Whereas, the citizens
require a democratic electoral process not impacted by the political goals or agendas
of groups within the City of Baldwin Park. Be it resolved that the Baldwin Park City
Council thank the District Attorney's office for carrying out a complete investigation
of election fraud. Be it resolved that, the Baldwin Park City Council refer to
conducting all future City elections in the Los Angeles County Registrar/Recorder's

office. Be it resolved, that in the event that the Los Angeles County
Registrar/Recorder's office can not conduct future elections, a private, independent
organization with no other connections with Baldwin Park and its officials be
contracted to conduct and oversee all future Municipal elections.
Mayor LOWE S stated if you put this on the agenda I would like a fill' report on what the cost would
be for a private, independent company. Councilmember VAN CLEAVE stated, I would like some
legal information as to the right to go directly to the District Attorney if I feel there is some foul play
in the Council or in the General Election. We need further interpretation.
Councilmember LOZANO stated, I think we should give our business card trade to Baldwin Park.
Also, in reference to Flag Lots, I feel we should place a moratorium on Flag Lots. City Attorney
OLIVAS advised, you can do a moratorium but it has to come back in the form of an Ordinance.
On the other hand, it could be remedied by the General Plan process that is going on. Mayor
LOWES stated, if you all agree to this, the General Plan is finalizing right now and I am sure it will
be taken care of This might not be necessary.
Councilmember LOZANO asked the City Attorney if there is any type of clause or courtesy
resolution we can introduce so that we can protect renters with some form of rent control in the
redevelopment areas. City Attorney OLIVAS will consult with Steve Cervantes on Redevelopment
laws.
Councilmember PACHECO requested to put on the next Agenda a drug-free zone'. It is making
parks, schools and libraries a drug-free zone whereby if anyone is caught selling drugs it will add
another year to their sentence.
Councilmember MUSE
1)Commented on the Red Ribbon Ceremony which was good for the community
2)Thought the Recreation Brochures were a great idea.
3)On the Redevelopment situation with the renters, I hope we can do something to prevent the rent
increases.
4)Received a complaint from a resident on Durness Street stating that when a huge dumpster was
emptied, a big chunk of asphalt was taken out of the street. Waste Management did not patch it
properly.

road. It is a very dirty, dusty street. Chief of Police LE GARRA said be was aware of the situation
and was taking action.
2)Recommended to put our business cards out to bid.
3)1 think we should not charge our residents for repairs in streets and sewers when these big, heavy
trucks are allowed to use these streets.
4)We have a problem on Baldwin Park Boulevard and Ramona across from the Community Center,
where the kids run out and cross the street. I feel we need a fence there. Chief of Police LE
GARRA is aware of the problem and is working on it.
Councilmember MUSE said, with holidays approaching, I would like to know if we are going to
have sobriety checkpoints. Captain Higginbotham said every year we have our traffic lanes and our
DUI lanes set up. We will also be working with the Automobile Club of Southern California.
City Clerk TIZCARENO asked Chief of Police LeGarra about the manning of the Satellite Police
Stations. Chief of Police LE GARRA said he put a memo out to increase the manpower at the
Satellite Stations.
Director of Recreation/Community Services NUNEZ informed everyone of the Basketball Game
on Friday, November 20 at 7:00 p.m. to raise money for the children of Baldwin Park. He also
reminded everyone about the Veteran's Day Celebration on November 11.
Councilmember LOZANO welcomed back our City Treasurer who was out for surgery recently.
Mayor LOWES adjourned the Regular Session of the City Council. There were no objections.
