The Baldwin Park CITY COUNCIL met in REGULAR SESSION at the above time and place.
ROLL CALL Present: Council,members: Ricardo Pacheco, Linda L. Oak,
William Bill" Van Cleave, and Mayor Lozano.
Also present: David Olivas, City Attorney; James B.
Hathaway, Finance Director; Richard A. LeGarra, Chief of
Police; Ralph Nunez, Director of Recreation/Community
Services; Steve Cervantes, Director of Community
Development; Arm Montenegro, City Treasurer; Kathryn V.
Tizcareno, City Clerk, and Rosemary M. Ramirez, Deputy
City Clerk
REORGANIZATION Mayor Lonno opened nominations for the position of Mayor
Pro-Tem. Councilwoman Oak nominated Bill Van Cleave,
seconded by Councilmember Pacheco. There were no objections
and Councilman Van Cleave was appointed Mayor Pro-Tern.
RESOLUTION APPOINTING Upon question from Councilwoman Oak, Deputy City Clerk
DELEGATES AND Clerk Ramirez informed the Council that this matter will be
ALTERNATES before the Council at their next regularly scheduled meeting.
PROCLAMATION/ PRESENTATION
AMERICAN RED Mayor Lozano read the Proclamation and declared the month
CROSS MONTH of March 1999 as the American Red Cross Month and
presented the proclamation to Emergency Coordinator Irv
Dawson.
NEW POLICE EXPLORERS Chief LeGarra spoke of the required training and knowledge
that is possessed by graduates of the Explorer Post Officer
Rick Villines introduced: Lizzette Banuelos, Vanessa
Graciano, Joe Jinesta, Leonardo Lagunas, and Eli Torres as
the five new Explorers.
PUBLIC COMMUNICATIONS
APPRECIATION OF On behalf of the City Council, Director Nunez and Mayor
TARGET STORES Lozano presented a plaque to Target Stores and Stan Phelps
for their continued support of Youth Programs.

SUPPORTERS OF The following persons expressed their feelings with regards
TERI MUSE TO FILL to the vacancy on the City Council. In recognition of her
COUNCIL VACANCY accomplishments and dedication to the community, many
petitioned the council to appoint Teri Muse rather than
spending thousands of dollars of taxpayers' money on a
special election. Those who spoke in favor of appointing Teri
Muse to the City Council are as follows:

OPPOSITION OVER PLANS The following persons spoke in opposition to the Housing
FOR NEW APARTMENTS{ Development plan for new apartments that are being planned
to be built on Comic Street Those who are opposed to the
plans for the new apartments are:

IN FAVOR OF PLANS The following persons spoke in favor of the Housing
FOR NEW APARTMENTS Development plan for new apartments that are being planned
to be built on Corak Street Those who are in favor of the
plans for the new apartments are:

ARTICLES REFERENCED Priscilla Popick, Baldwin Park, said that the only reason
N IRIBUNE Councilman Pacheco and Mayor Lozano won the election
was because of the lies printed in the Tribune.
INVITATION TO SCHOOL Kathleen Gair, School Board President, invited Council
DISTRICT FACILITY Members to Olive Middle School on Tuesday, March 23,
DISCUSSION 1999, at 4:30p.m. for a series of presentations and discussions
regarding the facilities that are being changed in the School
District.

CONCERN OVER BALLOT Frances Serpa, Baldwin Park, inquired about her husbands
ballot being thrown out asked what happened to it.
CONCERN ABOUT Dick Tatum, Baldwin Park, said the Night Circuit Court
OVERTURNED VOTES of San Francisco has overturned the votes of San Francisco
93% of the time. He does not want to see the same thing
happen to Baldwin Park.
CONCERN OVER RACISM Marlen Garcia, 14404 B. Merced Ave., Baldwin Park, wants
to end racism items that keep coming up. Ms. Garcia stated
for the record that at this point Councilman VanCleave
stepped away from the meeting.
ANNOUNCEMENTS FROM Jesse Carlos, Alhambra, Rep. From Congressman Martinez'
THE OFFICE OF CONGRESS- office, announced that Congressman Martinez is scheduled
MAN MARTINEZ' OFFICE to speak at a legislative luncheon on March 30, at the Ralnada
Suites at 1089 Santa Anita, South El Monte. New location
for the Congressman's office is 2550 W. Maine St, Suite 301,
Alhambra, CA. 91801(626)4584524. He wanted to convey
his open-:door policy: Immigration, Social Security,
Department of Motor Vehicles assistance.

City Clerk Tizcareno presented the Consent Calendar as
follows:
Councilwoman Gair pulled the following items from the
Consent Calendar for discussion:

Councilman VanCleave requested that the following item be
pulled from the agenda for discussion.
I) Contract for the re-roofing of Senior Citizens Center
CERTIFICATE OF POSTING The Certificate of Posting for March 17, 1999, was approved.
TREASURER'S REPORT Treasurer's Report was received and filed.
REJECTION OF CLAIM City Council re-\elected the claim of Donald Rodriguez, Claim
DONALD RODRIGUEZ No.9703 IA and directed staff to send the appropriate notice
of rejection to claimant.

PLANS & SPECIFICATIONS Plans and specification and authorization of staff to

Morgan Park was approved.

CLAIMS AND DEMANDS Councilwoman Oak commented that she had already received
RESOLUTION NO.99-21 a response to her inquiry from Director Hathaway and Chief
LeGarra with regards to the hind appropriation for the
temporary employee and noted that this service was being
charged to the City Clerk's Budget election Account).
Councilwoman Gair also inquired about the payment for the
uniforms. However, she has since been informed by Director
Nunez that a grant was applied to the cost of the uniforms.
Upon question, Director Hathaway informed Councilwoman
Oak that the contract and payments to AAE would be ending
soon.
There being no further comments, a motion was made and
unanimously approved to adopt Resolution No.99-21 entitled,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK ALLOWING CLAIMS AND
DEMANDS AGAINST THE CITY OF BALDWIN PARK".
MOTION: Councilman VanCleave
SECOND: Councilman Pacheco
Motion Carried.
RE-ROOFING CONTRACT- Since it could not be immediately established as to which
SENIOR CITIZEN CENTER portion or what areas of the Senior Center would be re-roofed,
Councilman VanCleave made a motion and unanimously
approved to table this matter to the next regular meeting.

SECOND: Councilwoman Gair

REPORTS OF OFFICERS AND COMMITTEES
CITY COUNCIL City Attorney David Olivas mentioned that Government
VACANCY Code 36512 states that within 30 days of the Canvass, which
occurred March 9th', the City Council must decide whether to
appoint an individual to the vacancy or to call for a special
Election. A decision is required by the April 7th' meeting
either adopt the resolution to appoint or conduct a special
election.
A motion was made to appoint Teri Muse to fill the Council
vacancy and approve Resolution 99-22, A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK, CALIFORNIA, FILLING A VACANCY ON TIE
CITY COUNCIL BY APPOINTMENT'.

Motion Failed.
Councilwoman Gair made a motion bring back to the next
meeting, the resolution calling a special election along with
the second resolution requesting a consolidation with the
County of Los Angeles.
MOTION: Councilwoman Gair
SECOND: Mayor Pro Tern Van Cleave
NOES: Mayor Lozano and Councilman Pacheco
Motion Failed
A substitute motion was made to approve to continue both
items with the option of an appointment and the option of
calling the special election including the two resolutions to the
April 7, 1999 meeting.

COUNCIL/STAFF REQUESTS AND COMMUNICATION
CALIFORNIA HEALTHY Director Nunez informed the Council that Staff has
dims I ENDOWMENT 30 graduating families from the California Healthy
FOUNDATION Cities and California Endowment Foundation on April 1st,
California League of Cities will be submitting a grant
application to allow participants of the program as well as
staff to attend the California Z of Cities Conference
which will include registration, all expenses for the
representatives as well as funds for installation of the
Community Center On-Line which will cost about $1,100 for
installation. Also, Student Government Aide should
coordinate with the school District on May 4 to allow High
School Students to observe first-hand how their city works.
CHIEF'S FORUM Chief LeGarra announced the Chiefs Forum will be
on March 24, 1999 at 6:30 p.m. at the Community
Center.
SENATE BILL 56 Chief of Police LeGarra mentioned that the City has
received a letter from Senator Solis asking for support for
Senate Bill 56 which prohibits employers from discriminating
or not allowing employees to take time off to appear in court
as witnesses or to obtain a civil restraining order. The letter
will be put on the next City Council Agenda.

SENATE BILL 98 Chief of Police indicated that he received a request from the
Air Quality Management regarding Senate Bill 98, which will
also be put on the Agenda.
CLOSED SESSION Mayor Lozano announced that a closed session would be
conducted at this time. At 10:10 the City Council adjourned
to Closed Session to discuss the following:
