The CITY COUNCIL of the City of Baldwin Park met in a REGULAR MEETING at the
above time and place.
ROLL CALL

ANNOUNCEMENTS
EXPRESSION OF APPRECIATION
Mayor Pro Tern Gair expressed her sincere appreciation to all who telephoned, sent cards, and
kept Kathleen Gair in their prayers during her recent surgery.
FORMATION OF KIWANIS BUILDERS CLUB"
Councilmember Van Cleave announced the formation of a Builders Club at Sierra Vista Jr. High
School, noting that to date, there are approximately 370 youths involved in this organization from
the City of Baldwin Park.
STAFF ACKNOWLEDGED
Councilmember Pacheco acknowledged staff and the job well job on the landscape maintenance
along the freeway. He also thanked Director Carrillo and staff for their efforts and success of the
recent Easter program.
CHAMBER MIXER
Councilmember Garcia announced the Baldwin Park Chamber of Commerce Mixer to be held on
April 19, 2001, at 5:00 p.m., at Kaiser Permanente. Everyone is invited to attend.
HARLEY DAVIDSON'S GROUND BREAKING CEREMONY
Mayor Lozano wished to thank the Chamber of Commerce and City Staff for their participation
and efforts in organizing the Harley Davidson ground breaking ceremony.

PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS
Mayor Lozano was joined by the City Council in presenting the following:
Awards of Merit were presented to the Bassett Little League Board Members.
An Award of Recognition was presented to Dr. Carlos Rubio in appreciation for his commitment
and contributions to the citizens of the City of Baldwin Park.
A proclamation proclaiming the month of April, 2001 as Domestic Violence Month was presented
to Mariam Padilla of the Choices Program.
PUBLIC COMMUNICATIONS
COMMENT REGARDING ACTIVITY INCIDENT
Ms. Priscilla Poppick, inquired about the status of her daughter's complaint regarding the
suspension of her granddaughter from a certain recreation activity.
MISCELLANEOUS COMMENTS
Jaime Martinez, 18004 Rexwood, Azusa, spoke regarding evidence about the police
department. He spoke about his arrest on February 16, 2001.
REQUEST BIKE RACK AT SENIOR CENTER
Mr. Roy Test requested that a bike rack be installed at the entrance to the Senior Center.
AMERICAN'S WITH DISABILITY ACT INQUIRY
Oscar Christiano inquired about the city's compliance with the American's with Disability Act.

PUBLIC HEARING
PUBLIC HEARING TO CONSIDER NEEDS AND PROPOSED USE OF CDBG FUNDS FOR
PUBLIC SERVICE AGENCIES FOR FY 2001-02 Continued from April 4, 2001)
Director Forintos presented the report by stating that the purpose of this public hearing is for the
City Council to consider the public service applications and award funding, within the 15% cap
amount available, to public service agencies that have submitted applications.
Mayor Lozano declared the public OPEN for public participation.
The following individuals spoke on behalf of their organizations, respectively: Robert Lewis,
Baldwin Park Community Food Center; Helen Hernandez, Family Service Center; Cindi Hamlow,
YWCA of San Gabriel Valley WINGS Women in Need Growing Strong); Chris Garcia, Service
Center for Independent Living, Inc.; Kay Rich, East San Gabriel Valley Coalition for the
Homeless; Mariam Padilla, Choices Health Families; Larry B. Ortega, Community Union; Jack
Kennedy, Santa Anita Family Service; Michael Steadman, City of Baldwin Park Police
Department; Yolanda Quarrie, Citrus Valley Health Foundation; Dr. Elmer E. Jackson, CEH
Recovery Services; and Dale H. Lewis, Family Counseling Services.
Ms. Ana Montenegro spoke favorably on behalf of the funding request of CEH Recovery
Services. Mr. Isaac Bias, spoke on behalf of CEH Recovery, stating that this program offers a
unique, yet extremely successful style of recovery services. He spoke of his accomplishments
and success of the program and requested the City Council's support of the funding request.
Mr. Ernie Valdez, member of the CEH Recovery Program, spoke of the remarkable life changes
that have taken place in his life, especially that of being drug-free for the past 26 years. Mr. Joe
Sykes Jr., a Baldwin Park resident since 1936, commended the City Council on the progress
that has been made. He wished the City and Council continued successes.
There being no one else wishing to speak, Mayor Lozano declared the public hearing CLOSED.
A motion was made to defer the decision portion of the allocations to a special Study Session
Meeting to be held on Wednesday, May 2, 2001 at 5:30 p.m.

A motion was made to waive further reading, read by title only and adopt Resolution No. 2001-
038 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK
APPROVING A DEVELOPMENT AGREEMENT FOR THE CONSTRUCTION OF ONE THREE
SIDED BILLBOARD STRUCTURE; APPLICANT: BULLETIN DISPLAY, LLC, LOCATION 12670

PUBLIC HEARING TO CONSIDER AN APPEAL TO THE CITY COUNCIL OF THE
CONDITIONS OF APPROVAL IMPOSED BY THE PLANNING COMMISSION RELATING TO
A MODIFICATION TO CONDITIONAL USE PERMIT CASE NO. CP-425; APPELLANT: SAM
SHARMOJ, REPRESENTING PLAZA MARKET; LOCATION: 13902 FRANCISQUITO
AVENUE, UNITNOS. A, B & C Continued from March 21, 2001)
Principal Planner presented the report stating that this is a request for City Council consideration
of an appeal by Sam Sharmoj representing Plaza Market. More specifically, the applicant is
appealing two conditions of approval imposed by the Planning Commission specifically, that the
conditional use permit shall be subject to a one-year time limit, and that the individual sales of
bottles and cans of be prohibited.
Mayor Lozano declared the public hearing OPEN for public participation.
The following person in favor of the applicant:
John All, 101/^ year owner of the Meat Market at Plaza Market, spoke on behalf of Plaza Market
applicant Sharmoj. He asked the City Council for their favorable support of applicant's request.
Victor Hernandez, resident, spoke of Mr. Sharmoj's contributions to the community, stating that
Mr. Sharmoj is always willing to help his neighbors.
Stewart Felty, 1440 Vineland, stated that as a 34-year resident of the neighborhood, he has
seen that the presence of the Plaza Market and their current owners, has made a positive
difference in the neighborhood.
Ron Morris, U.S. Postal employee, stated that in his 16 years of mail delivery service in this
area, he has never seen this area of town so clean and free of loitering and other bad elements.
Gregory Chacon, 40-year resident of Baldwin Park, stated that this area has cleaned up
significantly and hopes that the Council votes in favor of the applicant.

Al Contreras, resident, requested that if the council denies applicant Sharmoj's request, that a
review of the additional forty plus stores within the City of Baldwin Park be made for the purpose
of applying the same conditions as set forth on this application.
Jose Ochoa, Co-Owner of the Meat Market at Plaza Market, stated that he has never witnessed
any problems as a result of Plaza's Market business conduct. He asked the City Council for
their support of the applicant.
Ross Vega, resident, stated his support of the applicant.
Martha Quirones, 30 years resident of Baldwin Park, stated that she has not experienced any
problems with the applicant. She hopes that the Council votes in favor of the applicant.
Mario Morales, 8 year resident, stated that the owners of Plaza Market have been responsive to
the community and are always willing to assist the residents in any way possible.
Luz Gomez, has lived in the neighborhood for 11 years. She stated that they are customers of
Plaza Market and that they run an excellent business.
Francisco Gomez, 11 year resident, said that the owners have helped many of the residents on
several occasions and have been a pleasure to have in the neighborhood.
LeRoy Still, resident of the neighborhood since 1963, stated that the owner's of Plaza Market run
a very clean business. They are well liked by the neighbors and an asset to the community.
Clifford Davis, an Electrical Sign Contractor for Plaza Market, stated that his work requires to
travel into many communities. In his years as a contractor, he has never seen a cleaner, better
run business than that of Plaza Market.
There being no one else wishing to speak, Mayor Lozano declared the public hearing CLOSED
for public participation.
Mayor Pro Tern Gair expressed an apology to Mr. Sharmoj, stating that the conditions placed by
the Planning Condition are out of line and unfair. She expressed her opposition to the Planning
Commission's recommendations. Mayor Pro Tern Gair acknowledged the amount of support
that was given to Mr. Sharmoj by his neighbors.
Councilmember Pacheco commended Mr. Sharmoj on his business and acknowledged the level
of support he received from his neighbors.
Councilmember Van Cleave acknowledged owners John and Sam, stating that members in the
community respect them. He expressed his support of the applicant's appeal.
Councilwoman Garcia felt that the treatment given to Plaza Market has been unfair. The
owner's are involved in their community and it is evident by the support received, that they are
well like and making a positive difference in the City.

A motion to overturn the Planning Commission's decision and allow use and eliminate the
requirement to renew the Conditional Use Permit until such time that the market is sold. It was
noted that said resolution would be brought back for adoption at the next City Council meeting.
There were no objections.

ORDINANCE AMENDING CHAPTER 100 OF THE BALDWIN PARK MUNICIPAL CODE
RELATING TO OFFICIAL POLICE TOW SERVICES
A motion was made to waive further reading, read by title only and introduce for first reading
Ordinance No. 1177 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AMENDING
SECTION 100.020 AND 100.090 OF TITLE X, CHAPTER 100 OF THE BALDWIN PARK
MUNICIPAL CODE RELATING TO THE ESTABLISHMENT AND REGULATION OF OFFICIAL
POLICE TOW SERVICES".

COUNCIL/STAFF REQUESTS AND COMMUNICATIONS
REQUEST BY COUNCILMEMBER MARLEN GARCIA FOR TOPIC DISCUSSIONS
Mayor Lozano requested that the request of Councilmember Garcia relating to: 1) Fees for
Metrolink parking at Badillo; 2) Mini and/or strip mall Review Committee; and 3) Public Safety
Community Advisory Committee, be deferred to the next city council meeting for discussion.
There were no objections.
BILLBOARD ADVERTISING
Councilmember Pacheco requested a copy of the billboard outdoor advertising schedule and
requested that the Street Market and Concerts in the Park be advertised on the City's allocated
advertising billboard.
STOP SIGN REQUEST
Councilmember Garcia received a request from resident Maria Franco for installation of a traffic
light or a 4-way stop sign. Staff was asked to look into this matter.
